In this nonpayment proceeding, the tenant moved for dismissal, summary judgment, leave to amend the answer, and to reargue a prior decision. The court denied the motion to reargue as untimely under CPLR § 2221(d)(3). The motion to dismiss or for summary judgment was also denied, finding the landlord sufficiently pleaded the premises' deregulation status and its interest. While the court granted the tenant's request to amend the answer to include failure to state a cause of action and breach of warranty of habitability defenses, it struck the rent overcharge counterclaim and related defense, applying the law of the case …

Study Objectives Chronic sleep loss is widespread and can cause deficits in vigilant attention. There are few practical biomarkers that can be used to assess the impact of chronic sleep loss on alertness and performance. Those that are available, such as tests of vigilant attention, cannot discriminate chronic sleep loss from other impairments, like alcohol intoxication, limiting the use of such tools. We aimed to test whether a suite of behavioral oculometrics would be sensitive, and perhaps specific, to chronic sleep restriction (CSR). The aryl hydrocarbon receptor (AHR) is a ligand-dependent transcription factor activated by environmental toxicants like halogenated and polycyclic aromatic hydrocarbons, which then binds to DNA and regulates gene expression. AHR is implicated in numerous physiological processes, including liver and immune function, cell cycle control, oncogenesis, and metabolism. Traditionally, AHR binds a consensus DNA sequence (GCGTG), the xenobiotic response element (XRE), recruits coregulators, and modulates gene expression. Yet, recent evidence suggests AHR can also regulate gene expression via a non-consensus sequence (GGGA), termed the non-consensus XRE (NC-XRE). The prevalence and functional significance of NC-XRE motifs in the genome have remained unclear. …

Grammar-checking tools have gained popularity as a means of addressing writing difficulties and improving students’ writing quality, particularly grammatical accuracy. Therefore, it is important to examine the relationship between the frequency of Grammarly use and the accuracy of students’ thesis writing to understand the potential benefits and limitations of Grammarly as a writing tool in academic contexts. Defective Viral Genomes (DVGs), which are viral genomes that are defective in some way, are naturally occurring byproducts of viral replication in numerous RNA viruses, notably Orthomyxoviridae (Influenza virus), Filoviridae (Ebola and dengue), and Paramyxoviridae (Respiratory Syncytial). They have three well-defined functions: interference with regular virus replication, immunostimulation, and virus persistence. DVGs are defective viral genomes that can hijack the replication cycle of wild-type viruses, leading to partial or complete suppression of viral populations. The Cost Of Underperforming Investments
Journal of Economics and Finance Education
Underperforming investments change a firm's equity value, cost of equity, capital structure and cost of capital. We show how to correctly adjust the cost of capital and correctly value a firm with underperforming investments. The correct equity estimate equates the equity value derived from the Economic Profit Model with the equity used to estimate the WACC. We demonstrate how underperforming investments can reduce equity value even though earnings may increase. We confirm our results with the Residual Earnings Model and show that our approach for valuing a company with underperforming investments also works well with investments that increase equity value.

22q11.2 deletion syndrome (22q11.2DS) is the most common chromosomal microdeletion disorder, presenting with a broad spectrum of congenital abnormalities and neuropsychiatric symptoms. Movement disorder is one of the most common neurological manifestation of the syndrome. The literature reports that early Parkinson's disease and dystonia in particular are associated with the syndrome. We here describe the first known case of choreiform movement disorder in a girl suffering from 22q11.2DS, responsive to tetrabenazine after a relapsing-remitting course.

A middle-aged male presented with subacute onset, progressive illness with diarrhea, persistent hiccups, bilateral hand tremors, gait imbalance, multifocal myoclonus, and weight loss. Clinically, the patient also had cachexia, pallor, oral thrush, and hepatosplenomegaly.. Investigation indicated chronic HIV infection, anemia of chronic disease, transaminitis, hyponatremia, CSF pleocytosis (lymphocyte predominant), elevated CSF protein, diffuse pachymeningeal enhancement on the brain MRI, mediastinal and abdominal necrotic lymphadenopathy, circumferential bowel wall thickening, and hepatosplenomegaly on CECT abdomen. CECT chest exhibited centrilobular nodular opacities. His sputum gene Xpert ® MTB/RIF was positive for Mycobacterium tuberculosis. Although the brain is an important part of a person’s sexual life, little is known about the correlations between sexual response and brain activation. This study examines brain response through clinical testing to reveal a number of brain structures whose activation are relevant to sexual arousal besides psychological testing according to the common traditional values and standards of Iranian society. Based on initial self-report, 25 homosexual and 25 heterosexual males participated in this test to elucidate the identity and sexual trends via Minnesota Multiphasic Personality Inventory (MMPI-2). Time value of money problems are integral to finance. We focus attention on the issues raised when a noninteger solution results from solving for the variable N (number of periods) in a time value of money annuity problem. We show that such a numerical solution, while mathematically correct, can deviate from the narrative of the problem. This deviation from the narrative could cause misunderstandings between instructors and their students and practitioners and their clients. We demonstrate how instructors and practitioners can explain the deviation from the narrative in such cases, and how cash flows can be adjusted to avoid missing …

Extraordinary Or Excessive? Rethinking Nonretroactive Changes In Decisional Law As Grounds For Compassionate Release, Anna Zumbar

Federal courts are deeply divided on whether nonretroactive changes in decisional law affecting sentencing are an “extraordinary and compelling reason” for compassionate release under 18 U.S.C. § 3582(c)(1)(A), The First, Second, Fourth, and Tenth Circuits recognize district courts’ broad discretion to weigh such changes, emphasizing that broad judicial discretion supports consideration of any relevant factors. In contrast, the Sixth, Seventh, Eights, and D.C. Circuits exclude nonretroactive changes in decisional law from consideration, confining “extraordinary and compelling reasons” to narrower circumstances. This circuit split has produced inconsistent outcomes, with similarly situated defendants subject to disparate treatment based solely on geography. The …

This essay explores the phenomenon of judicial activism in the United States, focusing particularly on procedural aspects, from a comparative perspective influenced by the civil law tradition, especially the Italian legal system. While American legal discourse often criticizes judicial activism as an overreach by the judiciary—sometimes calling it “imperialist” in relation to recent Supreme Court decisions—this work reinterprets the concept through the more subtle mechanisms of procedural intervention. I argue that activism should not be viewed solely through the lens of constitutional interpretation or resistance to precedent. It should also consider judicial actions that reshape procedural norms, such as pleading …

Teaching Collective Action Problems Without Contextual Bias: The Red/Green Simulation

Collective action problems are at the heart of many economic issues. Often, students have trouble comprehending how society ends up with a less than optimal outcome, and may incorrectly assume that someone must want the outcome that occurs. Correcting this error is made difficult by the biases that students bring to these issues. The Red/Green simulation demonstrates the tension between self-interest and the social good in a context-free manner allowing students to see that these sub-optimal outcomes may not be desired by anyone, but instead can result from unhealthy systems of incentives.
