Historical Methods Of Constitutional Interpretation And Political Gradations, Nelson Tebbe
Historical Methods Of Constitutional Interpretation And Political Gradations, Nelson Tebbe
Texas A&M Law Review
In this symposium Essay, I explore the hypothesis that as constitutional politics have become more assertive, historical methods of interpretation have become more prominent. In other words, the claim I would like to test is that the intensification of constitutional politics and the prominence of historical argument are correlated. Moreover, the relationship between the two appears to be linear. As arguments become bolder, they are more likely to deploy history as a method of interpretation. That proposition may seem counterintuitive, and it is intriguing.
Roger Taney, Memory Entrepreneur, Anne Twitty
Roger Taney, Memory Entrepreneur, Anne Twitty
Texas A&M Law Review
Roger Taney’s infamous “opinion of the court” in Dred Scott v. Sandford (1857), which rejected the possibility that Black Americans could ever be citizens of the United States, was rooted in the authority of the past.
But Taney’s account of that past has been a source of criticism ever since the decision was rendered.
To be sure, there was plenty to complain about. Many, though certainly not all, have taken issue with Taney’s narrative of the making of the United States Constitution and its attendant meaning, critiquing both Taney’s understanding of the Union and his insistence that the Constitution was, …
Hermeneutics In History, John Fabian Witt
Hermeneutics In History, John Fabian Witt
Texas A&M Law Review
Lawyers sometimes ask about the place of history in legal or constitutional interpretation. Historians typically ask a different question. The historians’ inquiry is more often about the place of a phenomenon, like interpretation in history, not vice versa. Constitutional interpretation is itself a historical practice, with particular, changing, and contingent political structures. It is driven by relatively autonomous forces such as war, natural disaster, social mobilizations, migrations and exclusions, economic transformations, and more, all of which shape and condition lawyers’ interpretive projects. If we put interpretation in history, rather than the other way around, then interpretation and (by extension) constitutional …
Why Constitutional Argument Matters, Philip Bobbitt
Why Constitutional Argument Matters, Philip Bobbitt
Texas A&M Law Review
The program for this symposium promised that I would be discussing the “descriptive grammar of constitutional law.” To put my purpose less benignly, I should say that I mean to attack the practice of limiting what I will call “modal analysis” to its descriptive virtues. Part of that attack will be the claim that courts and their commentators should pay closer attention to the modal requirements of the fundamental forms of constitutional discourse, but not because straying from this is a kind of grammatical faux pas. After all, if the system I have urged for constitutional analysis—the system of …

The construction of syntactically correct sentences plays an important role in conveying messages clearly and accurately during communication. Therefore, this study discusses the ability of fourth-semester students of the Dutch Studies Program at Universitas Indonesia in the 2024/2025 academic year to arrange rest elements, such as direct objects, indirect objects, adverbs of time, frequency, quantity, instrument, and place. The study focuses on syntax, and using a quantitative descriptive method to analyze students' ability to arrange rest elements according to syntactic rules. The data used in this study were obtained from 30 students who completed 25 questions containing scrambled words. The …

This article examines the role of the Japanese newspaper Yomiuri Shinbun in covering the great East Japan disaster on March 11-13, 2011. This study uses a quantitative and qualitative approach, with content analysis methods and Gunther-Kress multimodal critical discourse analysis methods on 98 photos published by the newspaper. The results show that the newspaper published a special edition twice, with photos that did not show photos of the deceased victims, creating a distance between the reader and the subject. Most of the photos were taken from a distance, indicating a lack of interaction and showing that the victims did not …

French-Indonesian Speech Sound Interference In Quality Comparison Of Otter And Descript’S Automatic Transcription, Muhamad Raihan Maulana Putra Mulya, Myrna Laksman-Huntley
International Review of Humanities Studies
Since COVID-19, Zoom has become the primary distance communication platform integrated with automatic transcription tools such as Otter and Descript. However, meetings involving non-native French speakers can generate sound interference that reduces transcription accuracy. This study compares the automatic French transcription quality of both tools in corporate online meetings affected by interference from native Indonesian speakers. The data consists of online meeting recordings of Indonesian speakers in French based on the textbook, Affaires.com. The analysis applies Weinreich’s (2010) interference theory, Le Querler’s (1994) word class theory, Word Error Rate, and Tholly et al.’s (2025) severity levels of automatic French transcription …

Discourse And Ideological Strategies In Presidential Campaign Speeches Of Mr Peter Obi, Richard Oliseyenum Oliseyenum Maledo, Rita Ejiro Enisire
International Review of Humanities Studies
Studies on political speeches in Nigeria have focused essentially on the speeches of political office inaugural speeches and speeches of political office holders, while not much appears to be done on the speeches of candidates who did not succeed in the election. Thus, this study undertakes a critical analysis of discourse and ideological strategies in the presidential campaign speeches of Mr Peter Obi, the presidential candidate of the Labour Party, in the 2023 presidential election in Nigeria. Mr Peter Obi's speech in Akwa Ibom State is purposively selected as our data for this study, and Van Dijk’s socio-cognitive approach to …

Wills Eye Hospital Papers
PURPOSE: Our study is motivated by evaluating the role of hematopoietic cell transplantation (HCT) after chimeric antigen receptor T-cell (CAR-T) therapy for ALL, a debated topic. Because patients may receive HCT at different times after CAR-T infusion or never, HCT post-CAR-T should be considered as a time-varying covariate (TVC).
METHODS: Standard Cox models and Kaplan-Meier (KM) curves (naïve method) assume that TVC status is known and fixed at baseline, which can yield biased estimates. Landmark analysis is a popular alternative but depends on a chosen landmark time. Time-dependent (TD) Cox model is better suited for TVC although visualizing survival curves …
A Modular Llm Approach To Argument Extraction In Philosophical Texts, Nate Miller
A Modular Llm Approach To Argument Extraction In Philosophical Texts, Nate Miller
Masters Theses
Engaging with philosophical works is a rewarding but demanding task that challenges both human readers and computational systems designed to extract arguments from dense philosophical reasoning, and although large language models (LLMs) have made substantial progress in argument extraction, the most advanced models are often costly to run. As a result, there is growing interest in determining if multi-agent pipelines that divide a task into smaller stages can reduce cost while maintaining or improving performance.
This study investigates a modular multi-agent approach for extracting arguments from philosophical texts using LLMs, and compares its performance, cost, and runtime to both single-agent …

Langkat Regency is one of the regencies in North Sumatra with a mangrove forest area of 26,774 hectares in 2024. Mangrove forests offer numerous benefits to coastal communities. Beyond serving as ecosystem resources, mangrove forests also provide economic benefits to coastal residents. Since the 1990s, coastal communities in Langkat Regency have begun cutting down forests for firewood without understanding the potential impacts. If this phenomenon continues, mangrove forest deforestation will worsen. The research aims to identify the characteristics of coastal communities in Langkat Regency, analyze the economic programs favored by these communities, and develop economic program models that sustainably utilize …

Background
Intracranial arteriosclerosis (large‐ and small‐vessel disease) is considered a risk factor for major neurological disorders, such as stroke, cognitive impairment, and dementia. While most studies investigating intracranial arteriosclerosis include individuals from industrialized populations, the prevalence and clinical meaning of intracranial vascular calcifications in populations with a subsistence lifestyle is unknown. Methods
In this population‐based study evaluating data collected between 2017 and 2019 from Tsimane and Moseten people, 2 indigenous populations of forager‐horticulturalists living in the Bolivian Amazon, we used computed tomography to determine the prevalence of vascular calcifications in the intracranial internal carotid arteries, vertebral arteries, and lenticulostriate arteries …Assessing The Influence Of Teachers’ Teaching Experience And Educational Qualification On The Use Of Oral Tradition In Teaching Igbo Language In Secondary Schools In South-East Nigeria, Princess Ngozi Ndibe
Assessing The Influence Of Teachers’ Teaching Experience And Educational Qualification On The Use Of Oral Tradition In Teaching Igbo Language In Secondary Schools In South-East Nigeria, Princess Ngozi Ndibe
Journal of Language, Literature, and Arts
The declining use of indigenous languages among younger generations, combined with the increasing reliance on conventional textbook-based instructional approaches, has raised concerns regarding the preservation of the Igbo language and its cultural heritage. These concerns prompted an empirical investigation into the influence of teacher-related factors on the effective integration of oral tradition in Igbo language instruction. This study employed a descriptive survey design involving public secondary school Igbo language teachers, from whom 500 respondents were selected through multistage sampling. Data were collected using a validated questionnaire, with reliability established through Cronbach’s alpha. Questionnaire administration was conducted with official authorization. Data …
