In nine treaties signed by Tribal Nations and the United States between 1867 and 1868, the United States promised redress to Native Americans for wrongs committed against them by “bad men among the whites.” Today, Native Americans are more likely to be killed by police than any other group, with much of this violence concentrated near the borders of Tribal Nations. Although claims brought under the “bad men” treaty clauses offer an avenue for combatting this epidemic of violence, courts have begun interpreting the clauses to apply only when “wrongs” occur within Tribal boundaries. Parents’ right to control the upbringing of their own children is long-established in the United States. However, in the case of child abuse, neglect, or abandonment, a state can terminate parental rights, permanently severing the legal relationship between a parent and a child. In New Mexico, to terminate parental rights for abuse or neglect the State must prove three elements by clear and convincing evidence: (1) the child is abused or neglected; (2) the conditions that brought the child into care are unlikely to change in the foreseeable future and (3) this is the case despite reasonable efforts by the …

Predicting The Future Past: Human Cognitive Limits And Proximate Cause Determinations In Civil Actions, Dr. Molly Wilson, Helen Webster

Juror decision-making is inherently influenced by psychological biases, which pose a significant challenge to the fairness and accuracy of proximate cause determinations in tort cases. This Article explores the cognitive and social biases—such as hindsight bias, primacy, anchoring, belief in a just world, and moral outrage—that affect jurors as they engage in the complex reasoning required to assess foreseeability and causation. Given that jurors must disregard their knowledge of actual harm and set aside emotional responses to tragic injuries, the risk of bias is substantial. Food loss and waste (FLW) present pressing environmental and economic challenges. Upcycling technologies provide a sustainable pathway by transforming food by-products into value-added products; however, consumer acceptance remains a critical barrier. Guided by Self-Determination Theory (SDT), this study investigates how environmental motivations influence consumers’ attitudes and purchase intentions toward milk enriched with upcycled peanut skins. Data were collected from a nationally representative sample of 1488 U.S. adults. Structural equation modeling (SEM) was employed to test hypothesized relationships among motivational constructs, and cluster analysis was used to identify consumer segments based on motivational profiles. I'm delighted to present the updated version of Geology Lab Activities, initially developed during the COVID-19 pandemic for online learning. As we have returned to the classroom, this revised edition remains a versatile educational tool for community college students, adaptable for both online and in-person classes.

Pathogenic free-living amoebae such as Acanthamoeba castellanii are present in soil and water worldwide. A. castellanii causes systemic infections with very high mortality rates, yet drugs specifically targeting this pathogen are not available. Methods to reliably generate and assay cysts, which drive infection recurrence and drug resistance, are unavailable in a high-throughput format suitable for drug screening and testing. In this study, we developed a robust and reproducible protocol for encysting A. castellanii as well as a high-throughput, quantitative cyst viability assay using fluorescent live/dead staining coupled with microscopy and automated image analysis. International Journal of Religious Tourism and Pilgrimage
Looking at the life of St. Francis of Assisi (1181/2–1226) through the lens of liminality can help to understand this complex figure. Anthropologist Victor Turner, for example, has explored Francis’s embrace of poverty as a means of experiencing liminality and the communitas that accompanies it. Three episodes in the life of Francis in particular constitute liminal experiences in that Francis left behind old ways of being, crossed thresholds, and experienced transformation: his encounter with lepers, his renunciation of possessions and coinciding embrace of poverty, and his encounter with Sultan Malik al-Kamil. Large language models (LLMs) are increasingly used as sources of health advice, raising urgent concerns about reliability, safety, and personalization. While prior work has studied health advice conflicts, these efforts typically ignore patient context and treat contradictions as universal. In this paper, we propose the task of contextualized divergence detection, which frames divergence not only as strict contradictions but also as context-dependent mismatches. To support this task, we introduce a novel dataset of 10,545 samples that combines user profiles, consumer medication guideline documents, and advice statements, with divergences synthetically generated across four categories: direct, conditional, temporal, and sub-typical. This work develops a framework to create meshes with user-specified homology from potentially dirty geometry by coupling background grids, persistent homology, and a generalization of volume fractions. For a mesh with fixed grid size, the topology of the output mesh changes predictably and monotonically as its volume-fraction threshold decreases. Topological anti-aliasing methods are introduced to resolve pinch points and disconnected regions that are artifacts of user choice of grid size and orientation, making the output meshes suitable for downstream processes including analysis. Alaska is an aviation-dependent state with about 23% of the population living off the road system. For so many, aviation infrastructure performance is critical to maintain flows of food, medicine, air ambulance services, patient travel, and basic transportation between communities. One key set of assets from this suite of infrastructure are Automated Weather Observation Stations (AWOS) or Automated Surface Observation Stations (ASOS) that generate real-time aviation weather data that is crucial for operational decision making and the certified weather reports that are functionally essential for landing under instrument flight rules. The Appellate Division affirmed the Supreme Court's dismissal of a cooperative landlord's action seeking to retroactively collect 30 years of maintenance fees for additional shares allocated to a tenant. The court found that the proprietary lease's plain language only allowed maintenance collection from the date of issuance, not retroactively. The landlord's claim was also time-barred. Additionally, the court affirmed the grant of attorneys' fees to the tenant under the proprietary lease's reciprocal provision, Real Property Law § 234, because the tenant successfully defended the action to enforce purported obligations.

Background: Emergence coughing after general anesthesia with an endotracheal tube (ETT) is a frequent occurrence related to airway irritation, and it can result in the spread of infectious respiratory droplets and hemodynamic instability. This is of particular concern when caring for patients with suspected or confirmed airborne infections. The irritation of the tracheal mucosa by the endotracheal tube (ETT) stimulates the cough reflex as anesthesia lightens. For this reason, preventing coughing at emergence is important to protect both patients and providers.

Legal decision-making is expected to meet high standards of consistency and rationality, yet human judgments in this domain are known to be influenced by procedural factors such as evidence order and intermediate evaluations. Recent work has shown that even legal professionals, including judges, are susceptible to such biases when assessing criminal cases. This raises a critical question: do large language models, which are increasingly proposed as decision-support tools in legal contexts, exhibit similar procedural biases—and if so, can these biases be mitigated? Ruspolia differens Serville (Orthoptera: Tettigoniidae) is among the most widely consumed edible insect in Eastern and Central Africa, where it contributes to both household nutrition and income generation. As a nutrient-dense food source, it offers a promising alternative to curb food insecurity and malnutrition. Background: Fungal meningitis outbreaks are rare and entail high mortality rates. Beginning May 2023, we investigated fungal meningitis caused by Fusarium solani species complex occurring in US patients who received epidural anesthesia in Matamoros, Mexico.
Methods: Early epidemiological information suggested US patients with suspected fungal meningitis had undergone mostly cosmetic procedures under epidural anesthesia performed in 2 Matamoros clinics. US patients known to have received surgery at these clinics during 1 January-13 May 2023 (clinic closures date) were identified and notified by public health officials. Battery state-of-health (SoH) estimation is central to transportation electrification because it conditions safety limits, warranty accounting, power capability management, and long-horizon fleet optimization. Although deep temporal architectures can achieve high laboratory accuracy, field deployment is frequently limited by laboratory (Lab)-to-field (L2F) domain shift that alters input statistics, feature definitions, and noise regimes. Under such a shift, predictors may remain strongly monotonic, preserving degradation ordering and become operationally unreliable due to systematic output distortion (e.g., compression/warping of the SoH scale). This paper presents optimisation studies for the combination of high efficiency reversible solid oxide cells (rSOC) with offshore wind farms in the Celtic Sea. Reversible systems can be used both in electrolyser and fuel cell mode, allowing potential benefits from switching between modes depending on the instantaneous condition of the electricity and hydrogen markets. The purpose of these studies is to determine the most cost-efficient method to combine rSOC with offshore wind whilst matching electricity supply with demand. For the past decade, I have been studying pilgrimage in all its dimensions in what my colleagues and I have been calling a kaleidoscopic inquiry (McIntosh et al., 2024). In my current investigations, I have been exploring the journey of the soul upon the death of its host. My focus in this working paper is the myths and traditions of the Yolngu Indigenous peoples of northeast Arnhemland in remote northern Australia with whom I lived and worked in the 1980s and 90s. Purpose:
Several states' early intervention (EI) eligibility criteria require children to show developmental delay based on age-equivalent (AE) scores. Unfortunately, the use of AE scores to determine eligibility is not empirically supported because they do not account for the normal variability of scores found within the general population. The purpose of this project was to explore the likelihood of eligibility misidentifications based on AE scores rather than using standard scores that incorporate normal population variability.Method:

The integration of viral sequence into the human genome plays critical role in the onset of various diseases, especially cancers. To facilitate systematic analysis of these events, we present VISDB 2.0, an expanded and updated database of human viral integration sites (VISs). The current release contains more than 270,000 manually curated VISs derived from 209 peer-reviewed publications, covering 11 viruses, including four retroviruses and seven DNA viruses. This represents a 3.5-fold increase in VIS entries compared with the previous version. Microplastics are pervasive in urban aquatic systems, which serve as both conduits of particle flow and incubators of microplastics. These aquatic systems transport microplastic particles while simultaneously altering their physical, chemical, and biological properties. Despite their growing environmental relevance, constructed wetlands and riverine systems remain underrepresented in studies of microplastic fate and transport. This dissertation aims to assess the patterns influencing microplastic transport and aging across urban aquatic environments through a combination of field experiments and mechanistic modeling.

This article refines the concept of black swans, typically described as highly unlikely and catastrophic events, to be internally consistent. It explores features of the financial system that prevent the eradication of black swans. The main implication is the need to enhance the financial system’s resilience to withstand unforeseen events rather than focus on past crises. The article introduces a “resilience principle” for designing official-sector policies that can achieve such goals. The principle calls for policies that are adaptable, universal, and systemic.
