Wrongful Improvers As A Guiding Principle For Application Of The Ftc’S Ip Deletion Requirement, Emma Elder Dec 2022

Wrongful Improvers As A Guiding Principle For Application Of The Ftc’S Ip Deletion Requirement, Emma Elder

Washington Law Review

The 2021 Federal Trade Commission (FTC) investigation into cloud storage app developer Everalbum resulted in a consent decree that required Everalbum to delete not only unlawfully collected data, but also algorithms created using that data. The FTC had imposed this kind of penalty only once before. Questions remain about how the FTC will apply this so-called intellectual property (IP) deletion requirement in the future. This Comment argues that situations where companies develop intellectual property from misappropriated consumer data are analogous to cases where courts seek to apply the property law rule of the wrongful improver, i.e., where one party knowingly …

Mobile Health Technology Development: Adaptations For Children And Adolescents With Autism, Caroline Emerson Dec 2022

Mobile Health Technology Development: Adaptations For Children And Adolescents With Autism, Caroline Emerson

Honors College Theses

Mobile health technology is a growing health resource that is usually designed for the general population. The existing literature on children and adolescents with autism suggests that their experience with mobile health technology may differ from the general population due to the coexisting conditions and social determinants of health related to autism. These differences can impact the anticipated effectiveness of mobile health technology. The goal of this qualitative study was to learn more about the experience of children and adolescents with autism with mobile health technology by interviewing health care providers, individuals who have autism, and parents of children with …

Behavioral Phenotypes Revealed During Reversal Learning Are Linked With Novel Genetic Loci In Diversity Outbred Mice., Jared R Bagley, Lauren S Bailey, Leona H. Gagnon, Hao He, Vivek M. Philip, Laura G Reinholdt, Lisa M Tarantino, Elissa J Chesler, James D Jentsch

Faculty Research 2023

Impulsive behavior and impulsivity are heritable phenotypes that are strongly associated with risk for substance use disorders. Identifying the neurogenetic mechanisms that influence impulsivity may also reveal novel biological insights into addiction vulnerability. Our past studies using the BXD and Collaborative Cross (CC) recombinant inbred mouse panels have revealed that behavioral indicators of impulsivity measured in a reversal-learning task are heritable and are genetically correlated with aspects of intravenous cocaine self-administration. Genome-wide linkage studies in the BXD panel revealed a quantitative trait locus (QTL) on chromosome 10, but we expect to identify additional QTL by testing in a population with …

Mongo Beti Et La Fabrique De L’Écrivain Africain, Romuald Fonkoua Dec 2022

Mongo Beti Et La Fabrique De L’Écrivain Africain, Romuald Fonkoua

Présence Francophone: Revue internationale de langue et de littérature

This article analyses the correspondence between Mongo Beti, and his editor, Les Éditions Africaines or Présence Africaine, from the early 50s to 90s. At the beginning of his writer life, Mongo Beti was confronted conditions of publication in French postcolonial era. Because of the political ideology of decolonization that presided over his creation, Présence Africaine (both Revue and publishing Company) seems to have not taking in account the real meaning of writing in French colonial country, the ambitions of young black African writer in the new era and the representation of African literature for him. Through his constant criticism on …

Independence Testing-Based Approach To Causal Discovery Under Measurement Error And Linear Non-Gaussian Models, Haoyue Dai, Peter Spirtes, Kun Zhang Dec 2022

Independence Testing-Based Approach To Causal Discovery Under Measurement Error And Linear Non-Gaussian Models, Haoyue Dai, Peter Spirtes, Kun Zhang

Machine Learning Faculty Publications

Causal discovery aims to recover causal structures generating the observational data. Despite its success in certain problems, in many real-world scenarios the observed variables are not the target variables of interest, but the imperfect measures of the target variables. Causal discovery under measurement error aims to recover the causal graph among unobserved target variables from observations made with measurement error. We consider a specific formulation of the problem, where the unobserved target variables follow a linear non-Gaussian acyclic model, and the measurement process follows the random measurement error model. Existing methods on this formulation rely on non-scalable over-complete independent component …

A Candle In The Labyrinth: A Guide For Immigration Attorneys To Assert Habeas Corpus After Dhs V. Thuraissigiam, Joshua J. Schroeder Dec 2022

A Candle In The Labyrinth: A Guide For Immigration Attorneys To Assert Habeas Corpus After Dhs V. Thuraissigiam, Joshua J. Schroeder

UC Law Constitutional Quarterly

In the summer of 2020, immigration law seemed to become the gravitational center of presidential power. After the Supreme Court decided several immigration cases in favor of the executive department, former President Trump cited “the DACA case” to support a new constitutional theory that “[t]he Supreme Court gave the president of the United States powers that nobody thought the president had.” Accordingly, Trump began to issue presidential legislation including “an immigration plan, a health care plan, and various other plans.”

Trump also began to occupy cities that were politically opposed to his presidency with ICE and CBP agents, including BORTAC …

Developing Novel Remote Camera Approaches To Assess And Monitor The Population Status Of Australian Sea Lions, Mathew Hourston, Daniela Waltrick, Stuart Blight, Ainslie Denham, Alex Hesp, Steve Taylor

Fisheries Research Reports

This project trialled the use of remote cameras to monitor the relative abundance of Australian sea lions (ASLs, Neophoca cinerea) at three Western Australian (WA) breeding colonies. The research was undertaken by the Department of Primary Industries and Regional Development (DPIRD) to assess whether the analysis of camera footage could be used to estimate ASL relative abundance, providing an alternative to the traditional “boots on the ground” approach (hereon in “BoG”) of visiting colonies to count animals. This report outlines the strengths and limitations of this novel approach rather than providing an update on the population status of ASLs. …

Visual components of trauma memories are often vividly re-experienced by survivors with deleterious consequences for normal function. Neuroimaging research on trauma has primarily focused on threat-processing circuitry as core to trauma-related dysfunction. Conversely, limited attention has been given to visual circuitry which may be particularly relevant to posttraumatic stress disorder (PTSD). Prior work suggests that the ventral visual stream is directly related to the cognitive and affective disturbances observed in PTSD and may be predictive of later symptom expression. The present study used multimodal magnetic resonance imaging data (n = 278) collected two weeks after trauma exposure from the AURORA …

Phase Transitions In Evolutionary Dynamics, Adam D. Scott, Dawn M. King, Stephen W. Ordway, Sonya Bahar Dec 2022

Phase Transitions In Evolutionary Dynamics, Adam D. Scott, Dawn M. King, Stephen W. Ordway, Sonya Bahar

Physics Faculty Works

Sharp changes in state, such as transitions from survival to extinction, are hallmarks of evolutionary dynamics in biological systems. These transitions can be explored using the techniques of statistical physics and the physics of nonlinear and complex systems. For example, a survival-to-extinction transition can be characterized as a non-equilibrium phase transition to an absorbing state. Here, we review the literature on phase transitions in evolutionary dynamics. We discuss directed percolation transitions in cellular automata and evolutionary models, and models that diverge from the directed percolation universality class. We explore in detail an example of an absorbing phase transition in an …

A Comparison Of Logistic, Ridge, And Lasso Regression With Heart Failure Risk Data: Effects Of Sample Size, Predictor Correlation, And Predictor Weight On Outcome Accuracy, Mahmoud M. Aljuhani Dec 2022

A Comparison Of Logistic, Ridge, And Lasso Regression With Heart Failure Risk Data: Effects Of Sample Size, Predictor Correlation, And Predictor Weight On Outcome Accuracy, Mahmoud M. Aljuhani

Electronic Theses and Dissertations

Logistic Regression (LR), LASSO regression, and RIDGE regression are standard classification techniques for predicting a dichotomous output. Since these methods are applied for similar purposes and have different features, it is crucial to evaluate the performance of these methods under different controlled conditions. With this information, researchers can apply the optimal method for specific conditions.

Following previous research, which reported the effects of conditions such as sample size and multicollinearity on the performance of the classification methods, this research focused on the effects of when sample size, level of predictor collinearity, and predictor variable weight are controlled on the performance …

Neurology Articles

Reorganization of motor circuits in the cortex and corticospinal tract are thought to underlie functional recovery after cortical injury, but the mechanisms of neural plasticity that could be therapeutic targets remain unclear. Recent work from our group have shown that systemic treatment with mesenchymal stem cell derived (MSCd) extracellular vesicles (EVs) administered after cortical damage to the primary motor cortex (M1) of rhesus monkeys resulted in a robust recovery of fine motor function and reduced chronic inflammation. Here, we used immunohistochemistry for cfos, an activity-dependent intermediate early gene, to label task-related neurons in the surviving primary motor and premotor cortices, …

Revisiting The Fried Chicken Recipe, Zachary B. Pohlman Dec 2022

Revisiting The Fried Chicken Recipe, Zachary B. Pohlman

Notre Dame Law Review Reflection

Twenty-five years ago, Gary Lawson introduced us to legal theory’s tastiest analogy. He told us about a late-eighteenth-century recipe for making fried chicken and how we ought to interpret it. Lawson’s pithy essay has much to be praised. Yet, even twenty-five years later, there remains more to be said about legal theory’s most famous recipe. In particular, there remains much more to be said about the recipe’s author, a person (or, perhaps, group of people) whom Lawson does not discuss. Lawson’s analysis of the recipe leads him to an “obvious” conclusion: the recipe’s meaning is its original public meaning. If …

Identifying Susceptibility Genes For Essential Hypertension By Transcriptome-Wide Association Study., Lu-Jie Huang, Qiao-Xia Zhang, Robert K Valenzuela, Jia-Chen Xu, Fang Yan, Jie Ma

Faculty Research 2022

Hypertension is a leading risk factor of cardiovascular disease and mortality in the population worldwide. Recently, hundreds of genomic loci were reported for hypertension by GWAS, however, the most SNPs are located in intergenic regions of genome, where a functional cause is difficult to determine. In the current study, a TWAS of hypertension was conducted using 452,264 individuals including 84,640 patients. KEGG and GO enrichment analyses were performed for the hypertension-related genes identified via TWAS. PPI network analysis based on the STRING database was also performed to detect TWAS-identified genes in hypertension. We have identified 18,420 genes from the …

Pesticide Exposure And Cortical Brain Activation Among Farmworkers In Costa Rica, Carly Hyland Dec 2022

Pesticide Exposure And Cortical Brain Activation Among Farmworkers In Costa Rica, Carly Hyland

Public and Population Health Faculty Publications and Presentations

Background: Previous epidemiological studies have reported associations of pesticide exposure with poor cognitive function and behavioral problems. However, these findings have relied primarily on neuropsychological assessments. Questions remain about the neurobiological effects of pesticide exposure, specifically where in the brain pesticides exert their effects and whether compensatory mechanisms in the brain may have masked pesticide-related associations in studies that relied purely on neuropsychological measures.

Methods: We conducted a functional neuroimaging study in 48 farmworkers from Zarcero County, Costa Rica, in 2016. We measured concentrations of 13 insecticide, fungicide, or herbicide metabolites or parent compounds in urine samples collected during two …

Increased Child Initiated Activity In Child-Centered Learning Environments, Angela Robinson Dec 2022

Increased Child Initiated Activity In Child-Centered Learning Environments, Angela Robinson

Graduate Teacher Education

Child-initiated activity in child-centered learning environments benefits the development of the whole child. Current research lends evidence that the early relationships and experiences of a child directly impact learning success (Nitecki, 2017; Fyffe et al., 2022). The indoor and outdoor environment are positioned as places for learning providing freedom and space to support health and well-being (Maynard et al., 2013). Classrooms have largely removed free play to address academic standards and high-stakes testing (Pistrova & Slutsky, 2018). This has been demonstrated by the implementation of scripted curriculum, the removal of toys such as unit blocks that foster creativity and imagination, …

The genetic prehistory of human populations in Central America is largely unexplored leaving an important gap in our knowledge of the global expansion of humans. We report genome-wide ancient DNA data for a transect of twenty individuals from two Belize rock-shelters dating between 9,600-3,700 calibrated radiocarbon years before present (cal. BP). The oldest individuals (9,600-7,300 cal. BP) descend from an Early Holocene Native American lineage with only distant relatedness to present-day Mesoamericans, including Mayan-speaking populations. After ~5,600 cal. BP a previously unknown human dispersal from the south made a major demographic impact on the region, contributing more than 50% of …
