The Hidden Power Of Citizenship: Political Identity In The Twilight Zone Of Equal Protection, Charles J. Anderson Apr 2026

The Hidden Power Of Citizenship: Political Identity In The Twilight Zone Of Equal Protection, Charles J. Anderson

Indiana Law Journal

More than half a century ago, in the landmark case of Graham v. Richardson, the Supreme Court held that the Equal Protection Clause of the Fourteenth Amendment prohibits state-level blanket exclusions of noncitizens. That case ushered in a new rule: State classifications based on alienage are “inherently suspect” and subject to strict scrutiny. But Graham’s rule has a major exception. Just a few years after Graham was decided, the Court upheld several state laws excluding noncitizens from working as police officers, public school teachers, and probation officers. So was created what would later be termed “political function” doctrine. …

Information Law Pluralism, Hannah Bloch-Wehba Apr 2026

Information Law Pluralism, Hannah Bloch-Wehba

Indiana Law Journal

Information-intensive activities are reshaping political, social, and economic institutions. As they respond to these shifts, legislators and regulators are embracing information as a regulatory device for tech. Far from limiting themselves to public disclosure, consumer notice, and other traditional mechanisms of fostering transparency and information flows, however, legislators are using other, more nuanced tools to incentivize regulated entities to obtain, generate, and share information.

This Article maps the landscape of the emerging information-based regimes for regulating tech and assesses their conceptual and practical implications. It canvasses an extensive set of recently enacted laws regulating the information economy and shows that, …

Rethinking Objectivity: The Problem Of Pretext In The Fourth Amendment, Monu S. Bedi Apr 2026

Rethinking Objectivity: The Problem Of Pretext In The Fourth Amendment, Monu S. Bedi

Indiana Law Journal

Pretextual encounters continue to erode the legitimacy of the Supreme Court’s Fourth Amendment jurisprudence. Simply put, a police officer can act on personal bias or animus as long as the search or seizure is deemed “objectively reasonable.” Numerous scholars (e.g., Bennett Capers, Gabriel Chin, and David Harris) have critiqued this objective standard, contending it perpetuates discriminatory practices, particularly against communities of color. The late Justice Ruth Bader Ginsburg herself suggested that the Court might need to reconsider the legal precedent she helped establish. More recently, Orin Kerr has also argued that the Court’s reliance on objective determinations is inconsistent with …

The Addison C. Harris Lecture: Intellectual Diversity Mandates And The Freedom To Teach, Keith E. Whittington Apr 2026

The Addison C. Harris Lecture: Intellectual Diversity Mandates And The Freedom To Teach, Keith E. Whittington

Indiana Law Journal

This Essay provides the first examination of the Indiana Senate Bill 202, which was adopted into law in the spring of 2024. The new law imposes an “intellectual diversity” mandate on public university classroom teaching in the state. The law is novel in its approach but is part of a larger movement to intercede in what is taught in university classrooms. The intellectual diversity mandate raises difficult and unexamined conceptual, normative, and practical problems that will now demand attention from university officials in Indiana and that might soon confront university administrators in other states across the country if the Indiana …

Encampments And Property Law, Terry Skolnik Apr 2026

Encampments And Property Law, Terry Skolnik

Indiana Law Journal

Although encampments have become increasingly common, they remain under-theorized, especially in the field of property law. Homeless encampments are ubiquitous in many cities. Social movements—such as Occupy Wall Street, the Freedom Convoy Movement, and college campus protests related to the war in Gaza—involve encampments that aim to catalyze social change. Yet surprisingly, legal scholars have devoted relatively little attention to encampments. This is a major oversight. Encampments matter for a range of moral, philosophical, and legal reasons that are hiding in plain sight and generate important theoretical and practical consequences that require deeper scrutiny.

This Article aims to fill this …

Systemically Valuable Transaction Costs, Mitchell C. Johnston Apr 2026

Systemically Valuable Transaction Costs, Mitchell C. Johnston

Indiana Law Journal

Ronald Coase’s famous theorem tells us that in a world without transaction costs, legal entitlements would be distributed efficiently. It is often treated as a corollary of the Coase Theorem that reductions in transaction costs generate increases in welfare as barriers to efficiency-increasing transactions fall. To be sure, not all voluntary transactions are efficiency increasing (for example, some transactions create negative externalities). In such cases, scholars have noted that transaction costs may inhibit socially inefficient transactions. But the situation is more complex. Drawing on ideas from systems theory, this Article advances a more complete theory of when transaction costs support …

Use Of Anterior Segment Optical Coherence Tomography To Manage Acute Corneal Hydrops In Keratoconus, Michelle K. Man Od Apr 2026

Use Of Anterior Segment Optical Coherence Tomography To Manage Acute Corneal Hydrops In Keratoconus, Michelle K. Man Od

Optometric Clinical Practice

Background: Acute corneal hydrops, a rare complication of keratoconus and other corneal ectatic disorders, is characterized by a break in Descemet’s membrane (DM). The subsequent corneal edema caused by leakage of aqueous into the stroma and epithelium may result in corneal scarring that often reduces visual acuity and may mandate corneal transplantation as resolution. The initial diagnosis is sometimes challenging but can be confirmed with anterior segment optical coherence tomography (AS-OCT). AS-OCT is also useful in deciding treatment regimen.

Case Report: This case report discusses the use of AS-OCT to aid in the diagnosis of acute corneal hydrops in a …

Focal Choroidal Excavation Associated With Resolved Central Serous Chorioretinopathy, Loren W. Bennett Od, Katherine M. Mehalik Od Apr 2026

Focal Choroidal Excavation Associated With Resolved Central Serous Chorioretinopathy, Loren W. Bennett Od, Katherine M. Mehalik Od

Optometric Clinical Practice

Background: Focal choroidal excavation is a localized concavity of the choroid within the macula defined by its appearance on optical coherence tomography. The condition is typically nonprogressive and often an incidental finding. It may not impact vision, although it can be associated with other visually significant macular pathologies.

Case Report: A 48-year-old male patient presented with a recent history of blurred vision in the left eye. A dilated fundus examination revealed a discrete area of pigment mottling in the macula; both the history and clinical appearance were consistent with resolved central serous chorioretinopathy. Optical coherence tomography did not show residual …

The Offshore Origins Of Regulatory Arbitrage, Ian J. Murray Apr 2026

The Offshore Origins Of Regulatory Arbitrage, Ian J. Murray

William & Mary Business Law Review

Especially since the 2007–08 financial crisis, commentators have seized on the term “regulatory arbitrage” to describe a sprawling range of strategic compliance behavior spanning diverse sectors of the contemporary economy. Despite the term’s prevalence, there is scant agreement on the scope of activities it describes. To some, it has become a catch-all for legal avoidance from time immemorial. Such an expansive understanding obscures the context that led the term to acquire salience and fosters a fatalist view that all regulation is futile. Resisting this trend, this Article answers calls to situate regulatory arbitrage in a richer socio-historical context. Tracing the …

The Hidden Tax Game, Doron Narotzki Apr 2026

The Hidden Tax Game, Doron Narotzki

William & Mary Business Law Review

Taxation is not just a legal duty; it is a game, and the best players always win. While governments rely on laws and penalties to enforce compliance, corporations, high-net-worth individuals, and elite tax strategists exploit loopholes, turning complexity into opportunity. This Article argues that tax avoidance is not a flaw in the system, but an expected outcome. Modern tax law does not just permit avoidance; it actively encourages it. The more intricate the rules, the more valuable it becomes to manipulate them.

Using game theory as an analytical lens, this Article reframes taxation as a high-stakes competition, where strategic players …

Journal of the Arts and Special Education

Despite the many documented physical and social benefits, dance is frequently not accessible to individuals with and without disabilities. We share an inclusive dance community partnership called Let’s Dance! that was developed to foster movement, connections, and inclusion. To increase awareness and inclusive dance opportunities, this community partnership involved (a) a workshop on inclusive dance practices for preservice teachers and (b) a community-based inclusive Let’s Dance! dance event. Following a review of the literature outlining the benefits of dance and the barriers that need to be dismantled to make dance more inclusive for students of all abilities, we share inclusive …

Watch Me Watch: Reaction Videos As A Social Form Of Online Video Engagement, Rodney Okyere, Carlos Augusto Bautista Isaza, Jaehoon Pyon, Ihudiya Finda Ogbonnaya-Ogburu, Shuo Niu, Sang Wong Lee

Computer Science

Reaction videos (RVs) are surging in popularity, emerging as a distinctive facet of participatory culture on modern social video-sharing platforms such as YouTube, TikTok, and Twitch. This study aims to explore not only the motivations and engagement patterns of viewers towards RVs, but also the underlying nature of the virality and community-building phenomena that this sub-genre of video content fosters. We conducted 16 semi-structured interviews with individuals who identified as regular viewers of reaction videos to gain a deeper understanding of how they discover reaction videos (RQ1), the values that drive their motivations for viewing RVs (RQ2), and the ways …

Rearfoot Realignment As A Prophylactic Strategy For Recurrent Lateral Column Ulcers In Diabetic Foot: A Case-Based Hypothesis, Christopher I. Anjorin Ms Dpmc, Ali-Abdul Kareem Dpm Apr 2026

Rearfoot Realignment As A Prophylactic Strategy For Recurrent Lateral Column Ulcers In Diabetic Foot: A Case-Based Hypothesis, Christopher I. Anjorin Ms Dpmc, Ali-Abdul Kareem Dpm

School of Podiatric Medicine - Student Research

Lateral column ulcerations remain a persistent and complex challenge in diabetic foot management. Although procedures such as tailor’s bunionectomy may provide localized pressure relief, they often fail to address the underlying biomechanical contributors, most notably rearfoot deformities such as calcaneal varus or pes cavovarus frequently observed in diabetic patients. These structural abnormalities shift the weight‑bearing axis laterally, increasing ground reaction forces along the fifth metatarsal and predisposing individuals with diabetic peripheral neuropathy and impaired proprioception to recurrent ulceration. This case explores the hypothesis that prophylactic rearfoot realignment may offer superior long‑term outcomes by correcting the mechanical etiology of lateral column …

Exchange Rate Volatility And Colombian Export Performance: A Comparative Product-Level Time-Series Analysis, Sebastian Pedraza Apr 2026

Exchange Rate Volatility And Colombian Export Performance: A Comparative Product-Level Time-Series Analysis, Sebastian Pedraza

Theses & ETDs

This thesis examines the effects of nominal exchange rate volatility on Colombia’s export volumes to the United States, with emphasis on sectoral heterogeneity across agricultural and energy products. While exchange rate movements are widely recognized as an important determinant of trade performance, empirical evidence on the role of exchange rate volatility remains mixed, particularly for developing economies. This study contributes to the literature by distinguishing between exchange rate uncertainty and exchange rate level effects and by adopting a product-level time-series approach. Using monthly data from 2016 to 2024, the analysis focuses on four major Colombian exports: coffee, cut flowers, crude …

Efficacy Analysis In Clinical Trials: A Comprehensive Review Of Statistical And Machine Learning Approaches, Dhrubajyoti Ghosh, Samhita Pal Apr 2026

Efficacy Analysis In Clinical Trials: A Comprehensive Review Of Statistical And Machine Learning Approaches, Dhrubajyoti Ghosh, Samhita Pal

Faculty Articles

Efficacy testing is a cornerstone of clinical trials, ensuring that medical interventions achieve their intended therapeutic effects. Over the decades, a wide range of statistical methodologies have been developed to address the complexities of clinical trial data, including parametric, nonparametric, Bayesian, and machine learning approaches. Parametric methods, such as t-tests, ANOVA, and LMMs, have traditionally been the foundation of efficacy testing due to their efficiency under well-defined assumptions. Nonparametric techniques, including the Friedman test, Brunner-Munzel test, and modern extensions like nparLD, have emerged as robust alternatives, particularly for skewed, ordinal, or non-normal data. Bayesian methodologies have enabled the incorporation of …

Canadian Journal of Law and Technology

The advent of generative AI (GenAI) has generated shockwaves across industries. Many established professions are grappling with how GenAI’s functionality transforms their daily activities, staying power, and raison d’eˆtre. GenAI’s newfound facility with words and language has rapidly encroached upon the purview of lawyers, whose trade has long been expertise with words. While some worry about lawyers’ place in a GenAI-oriented future economy, others are optimistic about the transformative potential GenAI offers as a tool to the practicing lawyer. Legal service providers have been quick to adopt GenAI tools in the name of efficiency, harnessing its generative power for tasks …

Who Is A Champion Teacher? A Comparative Longitudinal Analysis Of Teacher Practices In Teacher Professional Development Programmes In East Africa, Jane Rarieya, Esther Kibga, Omari Abunga, Fredrick Mtenzi, Nyagwegwe Wango Apr 2026

Who Is A Champion Teacher? A Comparative Longitudinal Analysis Of Teacher Practices In Teacher Professional Development Programmes In East Africa, Jane Rarieya, Esther Kibga, Omari Abunga, Fredrick Mtenzi, Nyagwegwe Wango

Institute for Educational Development, East Africa

This comparative mixed-methods study defines and profiles the “champion teacher” by synthesising primary longitudinal and cross-sectional data from two complementary teacher professional development (TPD) initiatives implemented across East Africa (Tanzania, Kenya, and Uganda): the long-term, pre-service teacher-oriented Foundations for Learning (F4L) programme and the short-course, in‑service teacher Strengthening Education Systems East Africa (SESEA) programme. The champion teacher construct is operationalised through a Champion Teacher Index (CTI) comprising three integrated domains: head (cognitive pedagogical knowledge), hands (psychomotor instructional practice), and heart (affective, leadership, and gender-responsive dispositions). Quantitative analysis revealed statistically significant longitudinal differences between the programmes. F4L teachers demonstrated higher mean …

"Under The Fig-Tree": Anti-Federalist Conceptions Of American National Identity, Clara Kernodle Apr 2026

"Under The Fig-Tree": Anti-Federalist Conceptions Of American National Identity, Clara Kernodle

Tenor of Our Times

The constitutional convention of 1787 gave America some of her most energetic and exciting few months in American history. The Federalists proposed the Constitution as a replacement for existing government, opposed by Anti-Federalists on principled grounds. Thus ensued a mountain of political writing and propaganda that historians still study today. The Anti-Federalists lost the debate, and then were lost to history. Few Americans have even heard of the Anti-Federalists and even fewer scholars study their writings. But reading and evaluating Anti-Federalist writing is an important part of studying the Founding era and Constitutional debates. The Anti-Federalists, as much as their …

For They Shall Inherit The Earth: Humility And The Constructed Etruscan And Carolingian Origins Of The Medici, William M. Deloach Apr 2026

For They Shall Inherit The Earth: Humility And The Constructed Etruscan And Carolingian Origins Of The Medici, William M. Deloach

Tenor of Our Times

The Italian Renaissance and the cultural legacy of the Classical World are inextricably linked. The links between the non-classical sources and the Renaissance, however, have frequently been neglected. This article examines the non-classical origin claims made by the Medici family in Renaissance Florence. Specifically, it evaluates the purpose behind the Medici's attempts to link themselves to the Etruscans and to Charlemagne. Ultimately, it concludes that these efforts represent an attempt to conceal the significant authority the Medici had, both at the time that these sources were written and in Florentine history through the fifteenth century.

Obscuring Vivian Maier, Caroline Yuratich

Richard T. Schellhase Essay Prize in Ethics

Vivian Maier, despite being unknown during her lifetime, has undoubtedly become one of the most impactful photographers of the twentieth century. Her vast oeuvre has been shown worldwide, her bold and unconventional photographs rapidly capturing the attention of millions. Maier primarily photographed the streets of Chicago in the 1950s to 70s, snapping people and storefronts on her iconic Rolleiflex camera. Her most well-known works are perhaps her self-portraits, and her foreboding upward-shot street portraits have also taken the stage as some of her best work. However, people who knew her during her lifetime state that they knew almost nothing about …
