In chapter 11 bankruptcy voting procedures, the issue of non-voting impaired classes can be a complicated issue, but the Southern District of Texas’s new “nonfactor” approach can be used as a lens through which different solutions to this issue may be understood. The United States Bankruptcy Code states that a bankruptcy plan may only be confirmed if every impaired class votes to accept the plan. But despite the statute’s apparent clarity, different jurisdictions’ solutions vary, some deeming non-voting impaired classes to plan. Adjudicating 35 U.S.C. § 112(A): The "Person Of Ordinary Skill In The Art" Conundrum And How To Address It, Matthew T. Simmons

A viable alternative for adjudicating issues under 35 U.S.C. § 112(a) of the Patent Act is needed due to the difficulties of trying these issues to a lay jury. Congress agreed when it enacted the America Invents Act (“AIA”), which created alternative proceedings for challenging patent validity post-grant, including post-grant review (“PGR”) and inter partes review (“IPR”). In theory, PGR proceedings permit the Patent Trial and Appeal Board of the United States Patent and Trademark Office to adjudicate whether one or more claims of a patent are valid on § 112 grounds. Background: Gingivitis is a common inflammatory disease of the periodontal tissues characterized by immune responses triggered by microbial biofilm. The inflammatory process involves the release of several cytokines and chemokines, including interleukin-1 beta (IL-1β ) and chemokine CXCL8, which play crucial roles in regulating leukocyte recruitment and inflammatory signaling within the gingival tissues. These biomarkers are considered important indicators of periodontal inflammation and may reflect the progression of periodontal diseases.

Human well-being has been a topic of interest to philosophers at least since the time of Aristotle, and well-being has also been a core concern of social scientists since the birth of the discipline in the late 18th century. Some theories of well-being include economic inequality as a factor, and multiple ways to measure this factor have been developed; as with well-being, there is no single best measure of economic inequality and the choice of which measure to use may be based on both theoretical and practical reasons. The Appellate Division affirmed the denial of tenants' motion, seeking a declaration of a rent overcharge scheme. The motion, improperly brought under CPLR 906(1) and thus treated as one for summary judgment, was denied because tenants failed to provide all necessary documentary evidence, such as leases and underlying records for claimed improvements, to meet their prima facie burden. The court noted that while an attorney affirmation is permissible for admissible documents, personal knowledge is required for unrefutable facts. Attacker-in-the-middle (AitM) phishing toolkits have emerged as a critical threat to enterprise and individual security by enabling adversaries to bypass multi-factor authentication (MFA) and compromise cloud-based accounts at scale. Traditional detection techniques--such as IP blocklists or content-based detection methods--are often ineffective against these increasingly sophisticated attacks. We propose a novel method that detects malicious proxies by identifying artifacts they introduce into HTTP request headers. To evaluate our approach, we systematically analyze traffic passed through several open-source AitM toolkits and proxies, identifying distinct modifications to header structures and content, then formalize these features as YARA rules for automated use. This qualitative study explored how native language influences emotional experience. Fourteen participants from diverse countries were recruited to capture a range of linguistic perspectives and experiences. Data were analyzed using thematic analysis, resulting in four key themes: (1) shared experience as central in creating emotional meaning, (2) the power of words in shaping emotional experience, (3) stronger emotional resonance in native or frequently used languages, and (4) the importance of regional differences in emotional experience. Findings suggest that while emotions may be largely universal, linguistic and cultural differences play a significant role in an individual's emotional identity. The study highlights …

This report provides a comprehensive analysis of South Carolina’s public school teacher workforce in 2024–25. Aligned with SC TEACHER’s mission, it offers data to support decision-making at both state and district levels. Using teacher-level information for 55,634 educators, this report describes key workforce characteristics and trends of classroom teachers (PK–12), special education teachers, and retired educators who have returned to the classroom.

This study analyzes the spatiotemporal evolution and near-future trajectory of land surface temperature (LST) in Bizerte, a rapidly urbanizing Tunisian coastal governorate. Using multi-temporal Landsat imagery (2009–2024) processed in Google Earth Engine, we quantify bi-seasonal warming and project thermal conditions to 2029. Over 2009–2024, mean summer LST rose by 2.8 °C (to 41.7 °C) and winter LST by 2.5 °C (to 18.9 °C), with urban and bare-soil areas warming most intensely (+5.3 °C). This doctoral capstone experience (DCE) was completed at Corewell Health Grand Rapids Hospitals Hand Therapy Clinic and focused on two ACOTE concentration areas including advanced clinical practice skills and education. The experience combined hands-on clinical practice in a specialized outpatient hand therapy setting with the development of high-quality client education materials and home exercise programs (HEPs). Infestation of potato by the potato tuber moth (Phthorimaea operculella) varies markedly among cultivars, yet the chemical and molecular mechanisms underlying this variation remain poorly understood. Here, we combine field surveys, chemical ecology, functional genomics, and structural modeling to reveal how cultivar-specific volatile profiles shape moth oviposition behavior and pest outcomes. Field and laboratory assays identified marked differences in adult attraction, oviposition, and larval damage among potato cultivars, which correlated with distinct blends of emitted volatile organic compounds (VOCs). Behavioral analyses revealed that among other VOCs, trans-nerolidol and β-ionone act as attractants, whereas 3-carene and benzyl tiglate function as oviposition …

In recent years, many new vehicles equipped with autonomous driving capabilities have been deployed around the world, but they still have a number of failure cases. One proposed solution to improve performance in these scenarios is cooperative perception, a paradigm in which vehicles communicate with other vehicles and nearby sensors to collect additional perception information about the environment. Forest fire and climate change are reshaping the snow hydrology of the Pacific Northwest of the United States, yet the combined effects of these disturbances on snow accumulation, storage, and melt timing remain poorly quantified in these Mediterranean mountain watersheds. Background: Oscillatory shear stress (OSS), resulting from disturbed blood flow, is implicated in atherosclerotic plaque formation by incompletely understood mechanisms. This study aims to elucidate the involvement of death-associated protein kinase (DAPK) 2 in OSS-induced endothelial cell (EC) activation and atherosclerosis.
Methods: Publicly available resources, including genome-wide microarray, RNA sequencing, and single-cell RNA sequencing, were utilized to identify key OSS-sensitive regulatory factors. Techniques such as mass spectrometry, immunoprecipitation, proximity ligation assay, and RNA sequencing were employed to identify pyruvate kinase M2 (PKM2) as the binding protein of DAPK2 and determine the specific site of PKM2 phosphorylation by DAPK2. This thesis examines how United States Army Special Forces veterans of the Global War on Terror narrate the identity of the "Quiet Professional" across training, deployment, and post-service life. Drawing on oral history interviews with four retired Green Berets, as well as archival and material culture analysis, the study approaches Special Forces as a distinctive military institution shaped by narrative, institutional formation, and war. It argues that Special Forces ethos is not a fixed warrior identity, but a lived and contested achievement produced through rites of passage, embodied hardship, informal legitimacy, and collective memory. Background: Group O blood donors are considered universal red-cell donors due to the absence of A and B antigens on erythrocytes. However, their plasma contains naturally occurring anti-A and anti-B isoagglutinins, which may exhibit complement-mediated haemolytic activity. Transfusion of plasma-containing components from such donors to non-O recipients-especially platelets or large plasma volumes—can result in passive haemolytic transfusion reactions. Ready-to-use therapeutic and supplementary foods (RUTF/RUSF) are a primary treatment for childhood malnutrition in Community Management of Acute Malnutrition (CMAM) programs. However, measuring intervention compliance is labor intensive and unreliable. We applied FoodSeq, a fecal genomic dietary assessment biomarker, in malnourished infants (3-15 months) from Matiari, Pakistan. FoodSeq identified a significant increase in the abundance of DNA from chickpea, a primary RUSF ingredient, during RUSF administration and captured region-specific complementary feeding practices, including age-inappropriate feeding practices such as wide-spread tea consumption. This present research tended to analyze the teacher talk performed by the English teachers in a Senior High School in Palu, Central Sulawesi through the use of Self-Evaluation of Teacher Talk (SETT). This research employed a case study research design, in the nature of qualitative research. Random sampling technique was used in determining the research’s participants. From the results of the research, it was found that the English teachers implemented all of the fourteen interactional strate- gies of SETT. Besides, the teachers and students’ perceptions were also investigated.

Teachers’ Beliefs About Communicative Language Teaching (Clt) And The Implementation In Classroom Practices, Trifita Setyaningrum

This study aims at investigating the match between beliefs and classroom practices about communicative language teaching (CLT). Survey design through questionnaire for professional teachers of English and guided interviews is employed in this study. The 25 questionnaire items revealed the teachers’ belief about CLT and the classroom practices based on its characteristics, i.e.: overall goals, relationship of form and function, fluency-accuracy, focus on real-world contexts, autonomy and stra- tegic involvement, teacher roles, and student roles. The data were gathered, reduced, grouped, and verified. The results showed that the highest discrepancy is on the aspect of fluency-accuracy.
