Artificial Intelligence: An Impetus To Amend The Aba Model Code Of Judicial Conduct, Davis G. Yee Apr 2025

Artificial Intelligence: An Impetus To Amend The Aba Model Code Of Judicial Conduct, Davis G. Yee

St. Mary's Journal on Legal Malpractice & Ethics

Notwithstanding the increasing prevalence of artificial intelligence or AI in the legal field, Chief Justice Roberts recently predicted that “human judges will be around for a while.” The reason is that at this time, AI cannot perform judicial mental functions as well as human judges can in deciding cases. Yet, instead of having AI replace human judges, some have explored whether AI can be used to assist human judges with their adjudicative and administrative responsibilities.

This Article focuses on a judge’s ethical obligations when encountering AI on both sides of the bench. That is, what do judicial ethics call for …

The Effects Of Geometric Shape And Power-Law Index On The Thermal Activity And Dynamic Behavior Of A Complex Fluid, Houssem Laidoudi Apr 2025

The Effects Of Geometric Shape And Power-Law Index On The Thermal Activity And Dynamic Behavior Of A Complex Fluid, Houssem Laidoudi

Emirates Journal for Engineering Research

The paper presents numerical results for non-Newtonian fluid confined horizontally between two rings. The outer ring has a circular shape, low temperature and rotates at a constant and uniform speed, while the inner ring has different shapes (circular, square and triangular), is constant and has a high temperature. This study aims to determine the method and the amount of heat transfer between the rings and under the influence of these factors: the rheological coefficient of the fluid, known as the power-law index, thermal buoyancy intensity, the rotation speed of the outer ring and the geometric shape of the inner ring. …

Higher education institutions face challenges in integrating predictive analytics due to data silos and resistance to adoption, limiting their ability to improve student outcomes and operational efficiency. This issue concerns institutional leaders, as ineffective data use can lead to declining retention rates, financial strain, and missed opportunities for growth. Grounded in the composite conceptual framework of the technology acceptance model and the diffusion of innovations theory, the purpose of this qualitative pragmatic inquiry study was to explore effective strategies to implement predictive analytics tools to reduce costs and improve student outcomes. The study included three higher education leaders in Ontario …

Fighting The Hypothetical: Why Law Firms Should Rethink The Billable Hour In The Generative Ai Era, Nancy B. Rapoport, Joseph R. Tiano, Jr. Apr 2025

Fighting The Hypothetical: Why Law Firms Should Rethink The Billable Hour In The Generative Ai Era, Nancy B. Rapoport, Joseph R. Tiano, Jr.

Washington Journal of Law, Technology & Arts

“Fighting the Hypothetical: Why Law Firms Should Rethink the Billable Hour in the Generative AI Era” analyzes how the emergence and adoption of generative artificial intelligence (GenAI) will fundamentally disrupt the traditional billable hour model that has dominated the industry since the 1960s. Professor Rapoport and Mr. Tiano contend that GenAI’s ability to perform routine legal tasks quickly and accurately will force law firms to shift away from billing structures based primarily on time spent (or inputs) and toward models that better reflect client value (or outputs).

The authors interviewed law firm leaders to gain an “in the trenches” view …

Gendering The New International Convention On Cybercrimes And New Norms On Artificial Intelligence And Emerging Technologies, Rangita De Silva De Alwis

Washington Journal of Law, Technology & Arts

The trifecta of the Digital Global Compact (2024), the UN General Assembly Resolution on AI for Sustainable Development (2024) and the new Cyber Crime Convention (2025) come at a time of what seems to be an inexorable march of new technology. It is also at a time of transborder disruption caused by data breaches and cyber threats, that binding international norms can respond to global challenge. However, it must be emphasized that digital violence, developer bias, and data bias are not new phenomena, they have existed since the origins of the internet. Data that is used to train machine-learning algorithms …

Pacific Faculty Work

Background: Mobile gaming applications are increasingly marketed as cognitive training tools for older adults, yet their scientific validity and accessibility remain uncertain. This scoping review evaluates their effectiveness and inclusivity. Methods: A systematic search of the Apple App Store and Google Play Store identified 227 applications, with 14 meeting inclusion criteria. Apps were assessed for scientific validity, theoretical foundation, accessibility, cognitive targeting, user engagement, and monetization models. Results: While all 14 apps claimed cognitive benefits, only one cited empirical research. None included baseline cognitive assessments or progress tracking. Accessibility was limited—eight apps had visual accommodations, but none provided auditory support. …

Core Climate & Health Competencies For Physicians Across The Continuum In An Ever Warming World, Deborah Simpson, Anne Getzin, Aaron Levy, Syndey Warner, Marie Cabiya, Kjersti Knox, Climate And Health Medical Education Task Force Of The Advocate Health Environmental Action Council

Aurora GME

Background: Climate change impacts on patients’ health and sustainability is a topic emerging in medical education. >50% medical schools have some climate related curriculum but inclusion in GME-CPD programs is limited. Several groups (eg, Global Consortium on Climate and Health Education) have published core competencies on climate and health across professions to guide action but are often extensive and without “where to start” guidance. For example, GCCHE’s document contains 4 competency domains, 25 concepts and 2-8 learning objectives for each concept!

Objective: To identify minimum competencies for all physicians across the continuum of medical education who provide direct care to …

Incremental Rehearsal As An Instructional Technique For Young Children With Autism Spectrum Disorder, Robert A. Cordova Apr 2025

Incremental Rehearsal As An Instructional Technique For Young Children With Autism Spectrum Disorder, Robert A. Cordova

Electronic Theses & Dissertations

Repetition is said to be the most important factor in learning (Symonds & Chase, 1992). A common instructional technique that also incorporates repetition is incremental rehearsal (IR), which is often implemented due to its potential efficiency and effectiveness. Previous research has indicated a positive effect on reading fluency, math intervention, and sight word acquisitions using IR teaching procedures; however, there is a stark lack of application of IR to individuals with autism spectrum disorder (ASD). Therefore, the purpose of the study was to evaluate IR as an instructional technique for skill acquisition, specifically within an early intervention setting with young …

Californians’ Perceptions Of The Causes Of Homelessness And Potential Policy Solutions, Sophie G. Srivastava, Benjamin D. Rosenberg, Vincent Berardi

Psychology Faculty Articles and Research

Introduction

This study examines whether residents’ perceptions of the causes of homelessness and preferred policy solutions are associated with homeless-related behaviors and opinions, and whether such perceptions are attributed to internal or external factors.

Methods

California residents (N = 371) completed a survey and an exploratory factor analysis was conducted, which identified subscales of the perceived causes, preferred policy solutions, opinions, and behaviors. We used MANCOVA to examine which sociodemographic characteristics were associated with each subscale, and multiple regressions to assess relationships among subscales.

Results

As predicted by attribution theory, internal causes (e.g. lack of ambition) were positively associated …

Students For Sustainable Fashion & The Impact Of Fast Fashion, Anne M. York Apr 2025

Students For Sustainable Fashion & The Impact Of Fast Fashion, Anne M. York

Honors Theses

This thesis report took a project-based approach, making a change on campus through Students for Sustainable Fashion (SFSF), a club I founded here at the University of Mississippi. My thesis intends to document the establishment process and record the growth of SFSF throughout its last three semesters. SFSF emerged due to a significant challenge identified through casual class conversations, observational thinking, and campus engagement. However, university students are provided with abundant information about fast fashion's detrimental effects, and many feel unable to act due to social pressures, financial constraints, and the influence of fast-paced consumer culture. While students often desire …

Don’T Byte Off More Than You Can Chew: Ethical Considerations For The Estate Planner In The World Of Generative Artificial Intelligence, Gerry W. Beyer

St. Mary's Journal on Legal Malpractice & Ethics

Artificial intelligence (AI) is rapidly being incorporated into estate planning practices. AI products can increase the speed by which you prepare, review, and summarize estate planning related documents, tax returns, and client communications. Likewise, the speed by which you can conduct legal and financial research is faster than ever. This presentation is designed to explain how AI operates, the potential use of AI in your practice, warnings about the use of AI, techniques you may adapt to enhance your AI competency, and how to address the ethical issues that arise when using AI.

When Can A Lawyer Lawfully Use Threats When Negotiating?, James M. Fischer Apr 2025

When Can A Lawyer Lawfully Use Threats When Negotiating?, James M. Fischer

St. Mary's Journal on Legal Malpractice & Ethics

This Article focuses upon a basic negotiation device—a threat, used in a particular context—threats contained in settlement demand letters. In some, but not all, cases, however, the threat may be deemed a crime (extortion), in which case, the lawyer may be subject to sanction (criminal or civil liability, professional discipline) for making the threat. This consequence has, however, been largely ignored in academic literature. That is unfortunate, for it appears that many lawyers are unaware of the risks negotiation threats present because the risk is not well defined in the professional codes lawyers would normally look to for guidance.

This …

Sighting The Scope Of A Lawyer’S Representation, Douglas R. Richmond Apr 2025

Sighting The Scope Of A Lawyer’S Representation, Douglas R. Richmond

St. Mary's Journal on Legal Malpractice & Ethics

Clients engage lawyers for many reasons. Regardless of the circumstances, however, the lawyer and the client need to agree on the scope of the lawyer’s representation, meaning the legal services the lawyer will perform for the client. The client must agree to and understand the scope of the lawyer’s representation as aspects of establishing her objectives for the matter and thereafter evaluating whether the lawyer is achieving those objectives. The client must also understand the scope of the representation to be able to decide whether the matter’s potential expense justifies its pursuit and to gauge the reasonableness of the lawyer’s …

Executive Watch: The Breadth And Depth Of The Trump Administration's Threat To The First Amendment, Timothy Zick Apr 2025

Executive Watch: The Breadth And Depth Of The Trump Administration's Threat To The First Amendment, Timothy Zick

Popular Media

Given the Trump administration’s continued and varied assaults on the First Amendment, it is vital to monitor those attacks and then realize the gravity of the “sweeping and draconian sanctions ” imposed by unconstitutional executive fiat. Vigilance is especially important, as New York Times investigative reporter Michael S. Schmidt has noted, because “Mr. Trump has employed tactics including lawsuits, executive orders, regulations, dismissals from government jobs, withdrawal of security details and public intimidation to take on a wide range of individuals and institutions he views as having unfairly pursued him or sought to block his agenda.”

Mindful of such matters, …
