A Thousand Views Of The Cathedral: The Law, Politics, And Statistics Of Pandemic Dashboards, Jeff Lingwall, Tj Bliss

Health Matrix: The Journal of Law-Medicine

This Article explores the law, politics, and statistics of communicating data through the thousands of state, county, school district, and higher-education dashboards created in response to the COVID-19 global pandemic. Using a nationally distributed questionnaire and series of interviews with dashboard managers and stakeholders, we offer a wide-ranging view of data visualization practice in response to COVID-19. We pair this evidence with a survey of almost 3,000 entities responsible for public health communication, which resulted in collection of over 1,100 COVID-19 dashboards from a spectrum of government actors and private parties. We evaluate how legal issues were perceived and acted …

Limits On Biomedical Research: Whether, Why, And How, Christine Grady May 2023

Limits On Biomedical Research: Whether, Why, And How, Christine Grady

Health Matrix: The Journal of Law-Medicine

This article examines the limitations of laws and regulations in regulating biomedical research. While laws and regulations can serve as guardrails to limit certain research studies, they are often blunt instruments that struggle to keep up with the rapid pace of scientific progress. Moreover, laws in one jurisdiction may not be binding on others, making it difficult to regulate the global scientific community. The article argues that regulatory parsimony should be exercised, imposing regulations only where they work and not where they are unhelpful. The article also explores the ethical considerations surrounding biomedical research and its impact on society, including …

Eula, Or Eulogy? Reckoning End User License Agreements And Near-Future Cyborgs, Owen Carpenter May 2023

Eula, Or Eulogy? Reckoning End User License Agreements And Near-Future Cyborgs, Owen Carpenter

Health Matrix: The Journal of Law-Medicine

Integrated biotechnology is a quickly-approaching future legal issue that will blur the line between technology and person. The technology will likely run through some kind of software, and users of the technology will likely need to agree to some type of licensing agreement to use the software. End User License Agreements (“EULAs”) as they exist today have terms and clauses that will be problematic when applied to an implanted artificial heart, a replacement for the human eye that enhances vision, or other types of integrated technology. Current FDA regulation and EULAs are insufficient to deal with the problems that technology …

Splitting Deceased Donor Livers To Double The Transplant Benefits: Addressing The Legal, Ethical, And Practical Challenges, Evelyn M. Tenenbaum, Jed Adam Gross May 2023

Splitting Deceased Donor Livers To Double The Transplant Benefits: Addressing The Legal, Ethical, And Practical Challenges, Evelyn M. Tenenbaum, Jed Adam Gross

Health Matrix: The Journal of Law-Medicine

Liver transplantation is different from transplanting other solid organs because some recipients can achieve good long-term outcomes with only half of a donor’s liver (or less). This means that some deceased donor livers can be split, saving two lives instead of one. However, although more than 10 percent of cadaveric livers meet the criteria for splitting, only about 1.5 percent are actually split in the United States. This article identifies a set of ethical, legal, and logistical challenges to a more extensive use of split liver transplantation (SLT) within existing legal frameworks. We then discuss how each of these challenges …

Opioid Lawsuits: Is There Any End In Sight?, Richard C. Ausness May 2023

Opioid Lawsuits: Is There Any End In Sight?, Richard C. Ausness

Health Matrix: The Journal of Law-Medicine

The opioid epidemic has led to a surge in litigation against opioid manufacturers, distributors, and retail pharmacy chains. This article provides a comprehensive overview of the legal landscape surrounding opioid lawsuits. It discusses the chemical nature of opioids, marketing practices of Purdue Pharma and others, and the largely unsuccessful personal injury cases brought against Purdue by private individuals prior to 2014. The article also examines the public nuisance doctrine—the most popular liability theory invoked by government plaintiffs—and analyzes three of the most important litigation pathways: (1) suits by individual government entities, usually states; (2) multidistrict litigation (MDL); and (3) bankruptcy …

Evidence For Community Face Masking To Limit The Spread Of Sars-Cov-2: A Critical Review, Ian T. Liu, Vinay Prasad, Jonathan D. Darrow May 2023

Evidence For Community Face Masking To Limit The Spread Of Sars-Cov-2: A Critical Review, Ian T. Liu, Vinay Prasad, Jonathan D. Darrow

Health Matrix: The Journal of Law-Medicine

The use of facemasks in community settings has become an accepted public policy response to decrease disease transmission during the COVID-19 pandemic. Yet evidence of facemask efficacy is based primarily on observational studies that are subject to confounding and on mechanistic studies that rely on surrogate endpoints (such as droplet dispersion) as proxies for disease transmission. The available clinical evidence of facemask efficacy is of low quality and the best available clinical evidence has mostly failed to show efficacy, with fourteen of sixteen identified randomized controlled trials comparing face masks to no mask controls failing to find statistically significant benefit …

Exploration Of The Relationships Between Principal Preparation Program Admission Requirements And Program Performance, Summer Pannell May 2023

Exploration Of The Relationships Between Principal Preparation Program Admission Requirements And Program Performance, Summer Pannell

School Leadership Review

Admission criteria for principal preparation programs vary from state to state and even amongst universities within the same state. Despite the recommendation nearly two decades ago to connect admission criteria to leadership standards, little research has been done to help develop such criteria. This study examined principal preparation program admissions requirements at one southern university to determine if a relationship existed between admission criteria, academic program performance, and performance on educational leadership licensure assessments. The Pearson product-moment correlation found a statistically significant correlation between, both, the GRE and GRE Writing assessments and the School Leadership Licensure Assessment for educational administrator …

Breast Tissue Tumor Detection Using Microstrip Patch Antenna With Defected Ground Structure, Nihal F. F. Areed, Hamdi Ahmed El Mikati, Laila T. Rakha

Mansoura Engineering Journal

This work proposes a slotted microstrip patch antenna with an inset feed and defective ground structure (DGS). The proposed antenna is built with Roger-RT/5880 (Ԑr=2.2) as the substrate material for X-band application with a resonant frequency of 10 GHz. The proposed design has been simulated using Finite Element Method (FEM) and the results of bandwidth and gain read about 700MHz and 8dB; respectively. The suggested design is compared with previously published equivalent designs in light of the most recent research. The comparison reveal that that the suggested design with tuned dimensions offers higher gain and wider bandwidth than what has …

Amplifying Tutor Voices: A Qualitative Analysis For Improving Writing Center Tutoring Practices And Pedagogy, Leah Washko May 2023

Amplifying Tutor Voices: A Qualitative Analysis For Improving Writing Center Tutoring Practices And Pedagogy, Leah Washko

English Department Masters Theses

Within the walls of university writing centers, tutors and tutees collaborate. They discuss writing, but even more than that, they communicate about ideas and theories bigger than themselves, all while discovering their identities. Exploration of how tutors define their authority and agency, while also highlighting the importance of tutors’ voices, is necessary for the continuation of writing center studies. Writing center tutors’ roles may be understood by some, but the mental hurdles, the questioning natures, and the care-giver roles they are emersed into need to be further investigated. Through a study conducted at Kutztown University’s Writing Center, tutors were surveyed …

Aging And Learning: Community Engagemente And Self-Efficacy In L2 Teaching To Elderly Learners, Leticia Rinaldi Souza May 2023

Aging And Learning: Community Engagemente And Self-Efficacy In L2 Teaching To Elderly Learners, Leticia Rinaldi Souza

Spanish and Portuguese ETDs

The elderly population (60 years or older) has been increasing during the past decades around the world and is expected to reach two billion by 2050 (Scult, Haime, et al 2015). However, the misconception that elderly people are uncapable, or incompetent is still part of the imaginary constructed around such populations (Minichiello and Coulson, 2005). Older adults present powerful functional capacities and social activities lead to better performance and slower decreases in their memory and executive function (Scott, Masser, & Pachana, 2020). Thus, second language learning plays an effective role in enabling active and regular engagement in social and psychological …

The Bias Of New Mexico Nurses In A Residency Program Toward People Experiencing Homelessness, Tolulope Kabir Fijabi May 2023

The Bias Of New Mexico Nurses In A Residency Program Toward People Experiencing Homelessness, Tolulope Kabir Fijabi

Doctor of Nursing Practice Scholarly Projects

ABSTRACT

There is growing evidence that healthcare workers do not provide equivalent levels of care to patients of different social groups. This group includes the population of people experiencing homelessness and the number continues to grow simultaneously across U.S. Studies have also shown that the poor and the marginalized experiences disappointment in the healthcare industry due to negative attitudes such as stereotyping, bias, and prejudice from healthcare providers limiting them from accessing care when necessary. With growing research on the influence of the experience of trauma among people experiencing homelessness, there is a lack of trauma-informed services as it relates …

Civility Intervention In A Private Ambulatory Clinic, Steve D. Fusselman May 2023

Civility Intervention In A Private Ambulatory Clinic, Steve D. Fusselman

Doctor of Nursing Practice Scholarly Projects

Healthcare workers commonly face incivility in the workplace. This quality improvement project aimed to employ evidence-based practices to help improve self-perception about workplace civility using Dr. Cynthia Clark’s Workplace Civility Index (WCI)© 20-item Likert questionnaire and an educational intervention on civility. The impact of incivility in the workplace is undeniable, contributing to lower morale, absenteeism, decreased productivity, impaired communication, job burnout, and resignations. An exploratory factor analysis confirmed the reliability of WCI© as a beneficial instrument for measuring a company's capacity for civility. Finally, this project revealed that incorporating the WCI© with an educational intervention had a significant impact and …

2023 Private Capital Markets Report, Craig R. Everett

Pepperdine Private Capital Markets Report

The Pepperdine private cost of capital survey was originally launched in 2007 and is the first comprehensive and simultaneous investigation of the major private capital market segments. This year’s survey specifically examined the behavior of senior lenders, asset‐based lenders, mezzanine funds, private equity groups, venture capital firms, angel investors, privately‐held businesses, investment bankers, business brokers, limited partners, and business appraisers. The Pepperdine survey investigated, for each private capital market segment, the important benchmarks that must be met in order to qualify for capital, how much capital is typically accessible, what the required returns are for extending capital in today’s economic …

Learning To Teach Prospective Elementary Teachers: A Narrative Inquiry Of A Newer Mathematics Content Instructor, Kelsey Quaisley May 2023

Learning To Teach Prospective Elementary Teachers: A Narrative Inquiry Of A Newer Mathematics Content Instructor, Kelsey Quaisley

Department of Teaching, Learning, and Teacher Education: Theses and Other Student Research

Learning to teach mathematics content courses designed for prospective elementary teachers (PTs) is challenging. Mathematics content instructors must be prepared to not only teach mathematics content, but engage PTs in understanding children’s mathematical thinking strategies, learning trajectories, and misconceptions (Carpenter et al., 1996; Carpenter & Moser, 1982; I et al., 2020). When considering how instructors might best be prepared and supported, however, one must recognize that there is significant variation in the backgrounds and expertise of mathematics content instructors (Masingila et al., 2012; Yow et al., 2016) and little is known about the preparation, knowledge, and experiences of mathematics content …
