Masters Theses

My name is Rigoberto Flores and I was born in Guerrero, Mexico. The work I make involves politics, immigration, cartel violence and religious themes. I’m interested in presenting these challenging and difficult concepts, to have them remain in the public consciousness. The work I produce involve charcoal drawings, textiles, print, and painting. Weisner V. Google Llc: An Effort To Provide Clarity Regarding Patent Subject Matter Eligibility, Poirot, Nicole

Santa Clara High Technology Law Journal

The United States Court of Appeals for the Federal Circuit (“Federal Circuit”) recently issued a precedential two-to-one decision regarding patent subject matter eligibility under section 101 of the Patent Act.1 In Weisner v. Google LLC, the Federal Circuit held that U.S. Patent Nos. 10,380,202 and 10,642,910 are directed to abstract ideas of creating digital travel logs which are patent ineligible.2 Additionally, the Court held that U.S. Patent Nos. 10,394,905 and 10,642,911 are directed to both creating and using travel logs to improve computerized search results and are potentially patenteligible.3 The majority’s decision is an attempt to clarify the historically gray …

Algorithmic Auditing: Chasing Ai Accountability, Goodman, Ellen P., Trehu, Julia

Santa Clara High Technology Law Journal

Calls for audits to expose and mitigate harms related to algorithmic decision systems are proliferating,3 and audit provisions are coming into force—notably in the E.U. Digital Services Act.4 In response to these growing concerns, research organizations working on technology accountability have called for ethics and/or human rights auditing of algorithms and an Artificial Intelligence (AI) audit industry is rapidly developing, signified by the consulting giants KPMG and Deloitte marketing their services.5 Algorithmic audits are a way to increase accountability for social media companies and to improve the governance of AI systems more generally. They can be elements of industry codes, …

Continuous Estimation Of Smoking Lapse Risk From Noisy Wrist Sensor Data Using Sparse And Positive-Only Labels, Md Azim Ullah

Electronic Theses and Dissertations Archive

Estimating the imminent risk of adverse health behaviors provides opportunities for developing effective behavioral intervention mechanisms to prevent the occurrence of the target behavior. One of the key goals is to find opportune moments for intervention by passively detecting the rising risk of an imminent adverse behavior. Significant progress in mobile health research and the ability to continuously sense internal and external states of individual health and behavior has paved the way for detecting diverse risk factors from mobile sensor data. The next frontier in this research is to account for the combined effects of these risk factors to produce …

Policy Monitoring And Governance: The Cost-Effectiveness Of Community-Based Sanitation Programs In Indonesia, Devi Yulianti, Intan Fitri Meutia

Hatfield Graduate Journal of Public Affairs

Community-based sanitation (CBS) is a sanitation service option with technical and institutional assistance for poor urban communities to develop sanitation infrastructure in urban areas and treat domestic wastewater in small-scale sanitation systems. The Indonesian government has implemented critical policy interventions and investments to upgrade sanitation access nationwide since the early 2000s. This research will answer how policy monitoring and governance affect community-based sanitation program delivery through cost-effectiveness analysis. Building upon a qualitative paradigm, this paper contributes insights into community-based sanitation program effectiveness in local government. We adopted a descriptive case study-based research project in several urban villages in Bandar Lampung, …

Renal medullary carcinoma (RMC) is an aggressive tumour driven by bi-allelic loss of SMARCB1 and tightly associated with sickle cell trait. However, the cell-of-origin and oncogenic mechanism remain poorly understood. Using single-cell sequencing of human RMC, we defined transformation of thick ascending limb (TAL) cells into an epithelial-mesenchymal gradient of RMC cells associated with loss of renal epithelial transcription factors TFCP2L1, HOXB9 and MITF and gain of MYC and NFE2L2-associated oncogenic and ferroptosis resistance programs. We describe the molecular basis for this transcriptional switch that is reversed by SMARCB1 re-expression repressing the oncogenic and ferroptosis resistance programs leading to ferroptotic …

The Plausibility Transition Model For Sensemaking, Gary Klein, Mohammadreza Jalaeian, Robert R. Hoffman, Shane T. Mueller May 2023

The Plausibility Transition Model For Sensemaking, Gary Klein, Mohammadreza Jalaeian, Robert R. Hoffman, Shane T. Mueller

Michigan Tech Publications, Part 1

When people make plausibility judgments about an assertion, an event, or a piece of evidence, they are gauging whether it makes sense that the event could transpire as it did. Therefore, we can treat plausibility judgments as a part of sensemaking. In this paper, we review the research literature, presenting the different ways that plausibility has been defined and measured. Then we describe the naturalistic research that allowed us to model how plausibility judgments are engaged during the sensemaking process. The model is based on an analysis of 23 cases in which people tried to make sense of complex situations. …

Canada’S Most Decisive Victory: An Analysis Of Canada’S Role In The Hundred Days Offensive, 8 August - 11 November 1918, Ryan Goldsworthy, J.L. Granatstein

Canadian Military History

Of Canada’s long military history, Vimy is the one battle that most Canadians will know. Some will be familiar with Passchendaele, D-Day or the disasters at Hong Kong and Dieppe. Canadians should know the Hundred Days because the battles that constitute that offensive were almost certainly the most important victories ever won by Canadian soldiers. This article analyses the various reasons for the stunning Canadian successes of that war-winning offensive: chiefly the Canadian experience and doctrine; the state of the enemy and the Allies; artillery and counter-battery fire (the most important tactical arm); and logistics and administration. Ultimately, as the …

Indigenous Veterans Of The First World War And Their Families In The Prairie West, William John Pratt May 2023

Indigenous Veterans Of The First World War And Their Families In The Prairie West, William John Pratt

Canadian Military History

This study of forty-five military pension files of Indigenous First World War veterans of the Treaty 4, 6 and 7 regions shows that the racist perspectives and structures of settler colonialism on the Prairies could prevent just administration of benefits. Pension files of Indigenous veterans expose the tragedy of their lives during and after the First World War. Many soldiers had lingering pains and ailments as a result of the war, as well as continuing problems shaking the gaze of settler colonialism, which seemed unable to view them as both Indigenous and veterans. Despite the numerous legal and cultural obstacles …

Je Ne Me Souviens Pas: Pensioned Veterans From French Canada’S 22nd Battalion, Serge Marc Durflinger May 2023

Je Ne Me Souviens Pas: Pensioned Veterans From French Canada’S 22nd Battalion, Serge Marc Durflinger

Canadian Military History

An examination of the pension files of men having served in the 22nd Battalion (canadien-français), the Canadian Corps’ only French-speaking line battalion, situates veterans into a specific ethno-linguistic and, more generally, socio-economic context. This article seeks to illuminate some of the many personal crises that could, and commonly did, afflict veterans, their families and their survivors. It demonstrates that beyond the devastation of serious physical or psychological wounding, many of Canada’s returned men, perhaps far more than we imagined, suffered persistent ill health, financial distress and family estrangement. Almost without exception, the sixty 22nd Battalion case files examined …

Gauging The Effect Of Buyer Vs. Seller Initiation Of Customer Value Creation On Buyer Loyalty In Large B2b Sales Relationships, George Talbert, Earl D. Honeycutt Jr., Subhashish Samaddar

Engaged Management ReView

This study addresses two central questions: Is it important to determine whether the salesperson or the buyer initiates value creation in large business-to-business (B2B) selling environments? Furthermore, does the mode of initiation – buyer or seller – later influence customer attitudes toward the sales interaction? Value creation is necessary for large B2B sales situations because customized solutions often are required to meet customer needs. This empirical study compares buyer and seller initiators of value creation in B2B dealings and analyzes which actor most positively affects customer perceptions. In a study of 142 senior-level managers at buyer organizations

who participated in …

Sharing Bank Deposit Information With Other Countries: Should Tax Compliance Or Privacy Claims Prevail?, Cynthia Blum May 2023

Sharing Bank Deposit Information With Other Countries: Should Tax Compliance Or Privacy Claims Prevail?, Cynthia Blum

Florida Tax Review

A proposed regulation issued as one of the final acts of the Clinton Administration would have required U.S. banks to routinely file with the IRS reports identifying nonresident alien individuals receiving payments of interest and the amount of such interest. U.S. bank deposit interest paid to nonresident aliens is exempt from U.S. tax, and previously only payments to Canadians were required to be reported to the IRS. Intense opposition to this regulation was expressed by bankers and other organizations, such as the Center for Freedom and Prosperity, as well as by Governor Jeb Bush of Florida (where bank deposits are …

Recent Developments In Federal Income Taxation: The Year 2003, Ira B. Shepard, Martin J. Mcmahon Jr.

Florida Tax Review

This recent developments outline discusses, and provides context to understand the significance of, the most important judicial decisions and administrative rulings and regulations promulgated by the Internal Revenue Service and Treasury Department during the most recent twelve months—and sometimes a little farther back in time if we find the item particularly humorous or outrageous. Most Treasury Regulations, however, are so complex that they cannot be discussed in detail and, anyway, only a devout masochist would read them all the way through; just the basic topic and fundamental principles are highlighted. Amendments to the Internal Revenue Code generally are not discussed …

The Ethics Of Tax Cloning, Anthony C. Infanti May 2023

The Ethics Of Tax Cloning, Anthony C. Infanti

Florida Tax Review

In the United States, the limits on a fiduciary’s activities are usually developed by analogy, using existing fiduciary relationships as a guide. Many of the American neutral experts advising transition countries are attorneys, and as such are fiduciaries whose activities are confined within prescribed ethical boundaries. In addition, the subject of the neutral experts’ advice—whether they, as individuals, happen to be attorneys or not—is law reform. By rendering advice concerning the proper structure and content of a country’s tax laws, these experts are rendering what is arguably legal advice—broadly construed. In view of the nature of the advice being given …

Leaving Money On The Table(S): An Examination Of Federal Income Tax Policy Towards Indian Tribes, Mark J. Cowan May 2023

Leaving Money On The Table(S): An Examination Of Federal Income Tax Policy Towards Indian Tribes, Mark J. Cowan

Florida Tax Review

This Article addresses whether Indian tribes should be subject to federal income taxation from both a tax policy and Indian policy perspective. Underlying the debate over whether the tribes should be taxed is the tribe’s unique relationship to the federal government. Congress’s power over the Indian tribes is plenary and there is no provision in the Constitution reserving certain powers to the tribes.

Because there are no constitutional constraints to prevent Congress from taxing Indian tribes, the decision of whether to tax the tribes primarily involves fundamental concerns of fairness and equity. A tribe simultaneously acts as a sovereign government …

Charities And The Constitution: Evaluating The Role Of Constitutional Principles In Determining The Scope Of Tax Law's Public Policy Limitation For Charities, David A. Brennen

Florida Tax Review

The judicial assault on constitutionally permissible social justice efforts including affirmative action for minorities and ending discrimination against homosexuals continues. Through the rubric of “neutrality,” “equality” and “free expression,” courts today are using constitutional law principles to arrest efforts by state and federal governments either to (1) remedy present effects of historical discrimination or (2) end current discrimination. Accordingly, various federal circuit courts have interpreted Equal Protection Clause strict scrutiny as prohibiting government from considering race as a factor when making university admissions decisions or granting scholarships. Thus, it is not inconceivable that the Supreme Court might soon rule that …

Watchdogs That Failed To Bark: Standards Of Tax Review After Enron, Harold S. Peckron May 2023

Watchdogs That Failed To Bark: Standards Of Tax Review After Enron, Harold S. Peckron

Florida Tax Review

Enron Corporation, which was the seventh-largest U.S. corporation prior to its collapse, will long be a case study on various corporate governance and ethical failures. But the most frightening aspect of Enron is that it was never designed or intended to be a massive fraudulent scheme from its inception, unlike many substantial financial frauds.

It began by simply trading energy futures and eventually expanded to trading futures in commodities well beyond the company’s expertise. To continue its positive financial performance, the company required its advisors to develop “blowback” strategies ensuring continued stock price appreciation.

These so-called “strategies” were largely concerned …
