Addressing Space Tourism’S Environmental Effects: Marine Environment Regulations As A Basis For Regulating Orbital Space Debris, Elena Mak
Journal of Air Law and Commerce
With the success of private suborbital space flight, the space industry is now facing unprecedented growth as billionaires strive to accomplish the task of sending astrotourists into space. However, given the novelty of this objective, the current domestic and international legal regimes governing outer space and space travel are both confusing and outdated, and thus, they have not adequately accounted for space tourism activities. Given the projected growth of this industry, detrimental and dangerous environmental effects—such as an increase in orbital space debris—have become a pressing concern. These effects will not only affect the global climate on Earth but will …
Curiousity Killed The (Fat) Cat: Promoting Safety Over Profit In The Space Tourism Industry, Ryan Puente
Curiousity Killed The (Fat) Cat: Promoting Safety Over Profit In The Space Tourism Industry, Ryan Puente
Journal of Air Law and Commerce
Humans have never been more capable than they are now of dominating the extreme environments of the universe. This newfound capacity to enter the depths of the oceans and exit the familiar grasp of the atmosphere has led to an unprecedented ability to explore the corners of the universe. This ability brings excitement and opportunity but also presents many potentially fatal risks associated with the unknowns of the extreme environments being explored. The space tourism industry, like other extreme tourism industries, faces the challenge of navigating the forefront of human exploration in a sustainable way that preserves the lives and …
A Hard Pill To Swallow: Privacy Implications Of Direct-To-Consumer Prescription Drug Services, Varsha Challapally
A Hard Pill To Swallow: Privacy Implications Of Direct-To-Consumer Prescription Drug Services, Varsha Challapally
SMU Science and Technology Law Review
This case note discusses the emergence and popularity of direct-to-consumer prescription drug services and evaluates their privacy implications on consumers. Minimal regulation exists regarding direct-to-consumer prescription drug services, and patient privacy and data protection laws are also limited. Proponents of these services claim that they allow certain prescription drugs to be available to consumers without the hassle and logistics of health insurance and making and attending medical appointments, effectively empowering individuals to take control of their own health. Alternatively, critics claim that direct-to-consumer prescription drug services are operated by private companies that are not always required to be compliant with …
Proposed Methodologies To Cure The No-Fly List’S Current Violations Of The Due Process Clause For Affected U.S. Citizens, Sierra Stone
Proposed Methodologies To Cure The No-Fly List’S Current Violations Of The Due Process Clause For Affected U.S. Citizens, Sierra Stone
Journal of Air Law and Commerce
Often, the No-Fly List is a helpful tool that increases the safety of commercial aviation for U.S. citizens flying domestically and internationally. The TSA and various intergovernmental agencies utilize a nomination process and those who meet the requisite criteria are added to a database and can be entered into the No-Fly List. Once being placed on the “List,” an individual is no longer allowed to board a flight flying anywhere within or over U.S. airspace. However, for a small number of people, this deprivation of the ability to fly came unjustifiably and without realistic opportunities to be removed from the …
Examining Systemic And Dispositional Factors Impacting Historically Disenfranchised Schools Across North Carolina, Raketa Ouedraogo-Thomas
Examining Systemic And Dispositional Factors Impacting Historically Disenfranchised Schools Across North Carolina, Raketa Ouedraogo-Thomas
Dissertations
This mixed method sequential explanatory study provided analysis of North Carolina (NC) school leaders’ dispositions in eliminating opportunity gaps, outlined in NC’s strategic plan. The study’s quantitative phase used descriptive and correlation analysis of eight Likert subscales around four tenets of transformative leadership (Shields, 2011) and aspects of critical race theory (Bell, 1992; Ladson-Billings, 1998; Ladson-Billings & Tate, 2006) to understand systemic inequities and leadership attitudes.
The qualitative phase comprised three analyses of education leadership dispositions and systemic factors in NC schools. The first analysis of State Board of Education meeting minutes from 2018–2023 quantified and analyzed utterances of racism …
“A Real Man . . .”: Deconstructing Machismo Heteronormative Standards With K–12 Latino Male Educators Through Dialogic Spaces, Mario Echeverria
“A Real Man . . .”: Deconstructing Machismo Heteronormative Standards With K–12 Latino Male Educators Through Dialogic Spaces, Mario Echeverria
Dissertations
In a K–12 educational landscape where 75% of educators are white women, recruitment of Latino male educators is crucial for diversification, yet these educators represent just 2% of the teaching workforce in the United States (NCES, 2020). These educators grapple with a layered sense of identity as they navigate expectations of hegemonic masculinity and machismo norms that dictate their roles as disciplinarians and saviors, especially for young boys of color (Brockenbrough, 2018; Lara & Fránquiz, 2015; Martino & Kehler, 2006; Mills et al., 2004; Singh, 2021). Unfortunately, Latino male educators leave the profession at twice the rate of their Latina …
Individual Dignity As The Foundation Of An Inclusive Society, Cory R. Liu, Anthony Pericolo
Individual Dignity As The Foundation Of An Inclusive Society, Cory R. Liu, Anthony Pericolo
SMU Law Review
In Students for Fair Admissions, Inc. v. President & Fellows of Harvard College, the Supreme Court considered voluminous evidence that Harvard discriminated against Asian Americans to keep the racial composition of its student body similar year after year. The Court held that Harvard engaged in unlawful discrimination, providing clarity to an area of the law that was filled with ambiguities and self-contradictions. The Court’s decision made clear that discrimination in favor of some racial groups necessarily inflicts discriminatory, race-based harms on others.
This Article explores how Fair Admissions sheds light on the failure of identity politics to create a genuinely …
Growing Tensions: Consumer Privacy And Corporate Disclosures, Megan Wischmeier Shaner
Growing Tensions: Consumer Privacy And Corporate Disclosures, Megan Wischmeier Shaner
SMU Law Review
Data privacy and data security have become key issues for legislators, regulators, and individual citizens. Roughly two-thirds of Americans believe their data is being regularly tracked, monitored, and collected by companies and the government. A majority of U.S. adults also believe their data is less secure today than five years ago, expressing concerns that they have little control over how their personal information is being used and that the entities who control their data are not responsible stewards. In the absence of comprehensive federal regulation, a continuous stream of privacy statutes have been proposed at the state level. Beginning with …
75 Years Of Clinical Legal Education: Celebrating The Past While Looking To The Future, Mary Spector
75 Years Of Clinical Legal Education: Celebrating The Past While Looking To The Future, Mary Spector
SMU Law Review
In October 2023, the Clinical Program at SMU Dedman School of Law celebrated its 75th anniversary. The occasion provided an opportunity to celebrate seventy-five years of free legal services to thousands of clients over the years: real people with real problems without the means to hire a lawyer. Among the legal services provided were ones that ensured families had safe and affordable places to live, protected the rights of those in the criminal justice system, safeguarded seniors’ financial stability, assisted taxpayers in navigating disputes with the IRS, and ensured that employees obtain the benefits to which they are entitled.

Social Media And Social Reform: Why States Should Consider Protecting The Rising Kidfluencers, Rina Wong
Social Media And Social Reform: Why States Should Consider Protecting The Rising Kidfluencers, Rina Wong
SMU Law Review
The rise of social media in the twenty-first century has led to multi-million-dollar careers for influencers, adults, and children alike. Similarly, the rise of child influencers, often colloquially coined as “kidfluencers,” have raised legal issues because kidfluencers are currently unprotected by child labor laws. The Coogan Law, enacted in 1939 to protect child performers in California and similar laws across the United States do not currently apply to kidfluencers. This places kidfluencers at a severe risk of having their financial earnings squandered by their parents or guardians managing their funds.
Fortunately for kidfluencers, legislators both domestically and internationally have started …
At Least Make It Adequate: The Constitution Should Better Protect Public Education, Cristina J. Mauldin
At Least Make It Adequate: The Constitution Should Better Protect Public Education, Cristina J. Mauldin
SMU Law Review
Public education lacks adequate constitutional protection. The COVID-19 pandemic highlighted pre-existing issues in the public education system, such as poor literacy rates, chronic absenteeism, and disparities in students’ post-secondary college and career readiness. Additionally, recent changes in educational policies have often been part of legislative schemes passed by lawmakers who, on average, are at least two generations removed from American students—these policy changes have not been driven by data in response to students’ needs. As a result, there is a serious lack of consistency in the quality of an American education that has contributed to disparities in students’ learning and …
A Critique Of The Current Epidemic In Our Criminal Justice System: “Guilty Until Proven Innocent”, Jaclyn Marsh
A Critique Of The Current Epidemic In Our Criminal Justice System: “Guilty Until Proven Innocent”, Jaclyn Marsh
SMU Law Review
It has been a long-held notion of American jurisprudence that a citizen of this country shall not be deprived of their fundamental rights until required so by law. It is an offshoot of this notion that an American should not be deprived of these fundamental rights through being confined to jail or prison until twelve of their own fellow peers have laid down a finding of guilty. However, this phenomenon is exactly what is happening today, and the issue has been steadily increasing in occurrence since the passing of a federal statute in 1984.
Because of judicial interpretation and government …

Decoding Variance And Predictive Ability In Selection Systems: An Application Of Gauthier’S Framework Of Rater Cognitions, Peyton Anderson
Decoding Variance And Predictive Ability In Selection Systems: An Application Of Gauthier’S Framework Of Rater Cognitions, Peyton Anderson
Faculty Publications – Psychology
Foster et al. (2024) offer compelling insights into the advancement of selection measurement assessments, emphasizing high construct validity and accurate predictive capabilities for evaluating candidates’ work performance. Previous arguments surrounding the validity of selection assessments and the predictive performance abilities they encompass have been centered on viewing the measurement system as the culprit of error or have placed a heavy emphasis on understanding the noncognitive influences of raters, such as social contexts (Spence & Keeping, 2011). Foster et al. (2024) provide six recommendations of ways in which the field may benefit from shifting focus away from the measurement tool but …
The Literary Landscape For Twentieth-Century Spanish-Speaking Lds Poets, Gabriel González Núñez
The Literary Landscape For Twentieth-Century Spanish-Speaking Lds Poets, Gabriel González Núñez
Writing and Language Studies Faculty Publications
Spanish is the second-most spoken language among Latter-day Saints, but relatively little is known about Mormon literature in this language, either its current status or its history. This absence is evident in the key surveys on Mormon literature that have been carried out. For example, when Eugene England considered the prospects of Mormon literature in his landmark essay on its history and future, he looked ahead at a mostly US-centric and fully English-language literary horizon.1 This makes sense in the context in which he was writing. In the English language, and in the United States in particular, Mormon literature …

Barriers And Bridges To Well-Being For Latinx Immigrant Youth In A New Latinx Destination: A Digital Narrative Inquiry, Jenn M. Lilly
Social Service Faculty Publications
An increasing number of Latinx young people in the United States are facing unique challenges to attaining and maintaining well-being as residents of new Latinx destinations. This study analyzes the testimonios of 12 Latinx immigrant youth (aged 18–21) who participated in a digital narrative research project in New Orleans – a new Latinx destination in the US South. Findings are interpreted and discussed through the lens of the Phenomenological Variant of Ecological Systems Theory (PVEST), revealing Latinx young people’s perspectives on the barriers to experiencing well-being, the “bridges” that helped them to experience well-being despite those barriers, and the ways …

“I Learned To Bottle Up My Feelings From A Young Age”: A Narrative Analysis Of Latina Young People’S Family Mental Health Socialization, Jenn M. Lilly
Social Service Faculty Publications
Latina young people report high levels of mental health problems and low levels of help-seeking compared with their white peers, but little research has examined factors influencing their mental health views. Inductive analysis of 25 participants’ narratives revealed that Latina young people described three stages in the development of their mental health-related beliefs, attitudes, and behaviors: undergoing a process of family mental health socialization, suffering in silence, and attaining a new perspective. Within each of these phases, participants shared stories that attest to their agency and resilience. This research uncovers a novel theoretical construct, “family mental health socialization,” which elucidates …
Considering A Unified Model Of Artificial Intelligence Enhanced Social Work: A Systematic Review, Michael Garkish, Lauri Goldkind
Considering A Unified Model Of Artificial Intelligence Enhanced Social Work: A Systematic Review, Michael Garkish, Lauri Goldkind
Social Service Faculty Publications
Social work, as a human rights–based profession, is globally recognized as a profession committed to enhancing human well-being and helping meet the basic needs of all people, with a particular focus on those who are marginalized vulner- able, oppressed, or living in poverty. Artificial intelligence (AI), a sub-discipline of computer science, focuses on develop- ing computers with decision-making capacity. The impacts of these two disciplines on each other and the ecosystems that social work is most concerned with have considerable unrealized potential. This systematic review aims to map the research landscape of social work AI scholarship. The authors analyzed the …

Introducing Generative Artificial Intelligence Into The Msw Curriculum: A Proposal For The 2029 Educational Policy And Accreditation Standards, Maria Rodriguez, Lauri Goldkind, Bryan Victor, Barb Hilz, Brian Perron
Social Service Faculty Publications
The most recent Council on Social Work Education’s Educational Policy and Accreditation Standards (EPAS) demands that social workers develop competence in the ethical and professional deployment of technology. Arguably, artificial intelligence has become a critical element in the technological landscape, most recently with the advent of Generative Artificial Intelligence (GenAI). Beginning in late 2022, there has been an explosion of interest in GenAI, along with a massive and ongoing rollout of GenAI tools for personal and professional use, such as ChatGPT. While GenAI will undoubtedly affect social work practice, scholars and ethicists have raised crucial concerns about GenAI, its potential …
Engaging With Culturally Relevant Curriculum Development Practice In First-Year Writing Courses Through A Community Of Practice, Mitchell Dallas Herring
Engaging With Culturally Relevant Curriculum Development Practice In First-Year Writing Courses Through A Community Of Practice, Mitchell Dallas Herring
Theses and Dissertations
This qualitative action research study provides a case study of a community of practice (CoP) comprised of six faculty who teach first-year writing at Southern Technical College (pseudonym) as they engaged with culturally relevant teaching to review their curriculum development practices. The guiding question of this study was: How does engagement with culturally relevant pedagogy within a community of practice impact faculty who teach first-year writing's curriculum development practice, especially given their perceptions of students' needs and literacies? The study used a case study research design to document the faculty's experiences discussing and reflecting on their practice and perceptions of …

Systems Check: A Qualitative Case Study Of Educators And Parent-Educators Supporting Adolescent Readers From An Ecological Systems Perspective, Kristi Nicole Grooms
Theses and Dissertations
In spite of decades of research and an abundance of well-intentioned intervention efforts, supporting adolescent readers, particularly at the middle level, remains a significant area of concern for educators in the United States. The struggles are present for educators working to help underperforming readers reach grade-level and keep advanced readers motivated and engaged. At home, parents and guardians experience similar challenges. Data on adolescent comprehension performance continues to be frustrating in terms of producing consistent positive results. This qualitative action research study investigated the ongoing challenge of supporting adolescent readers, specifically within the context of 7th grade, through a systems …
The Inclusion Of Metacognition In Source Evaluation Instruction, Anthony Tardiff
The Inclusion Of Metacognition In Source Evaluation Instruction, Anthony Tardiff
Foley Library Scholarship
Though the ACRL Framework holds metacognition as crucial to exercising information literacy, its emphasis was reduced from prominence in early drafts to a single mention in the final document. At the same time, few of the frequently-taught sets of source evaluation criteria include a step for self-awareness. This raises the question: do librarians explicitly teach metacognitive concepts when they teach source evaluation? Online library guides about source evaluation from various colleges and universities in Washington state were analyzed, and librarians who taught source evaluation were surveyed to determine whether and to what extent metacognitive concepts were included as part of …

Exploring The Lived Experiences Of Title I Elementary School Principals And Youth Mental Health: An Interpretative Phenomenological Analysis, Marva Mckinney
UNF Graduate Theses and Dissertations
An interpretative phenomenological analysis (IPA) investigates how individuals make meaning of their social and personal environments. The primary questions that guide the exploration of the principals’ perspectives for this study include “How do Title 1 elementary school principals describe their leadership experiences in relation to student mental health challenges?”, “How do these experiences shape their perceptions of youth mental health within their schools?”, and “How do Title 1 elementary school principals understand the impact of external factors on their ability to address youth mental health challenges?”. According to Rousmaniere (2013, pp. 19–55), the principal has the most complex role in …

UNF Graduate Theses and Dissertations
Augmentative and Alternative Communication (AAC) systems play a crucial role in enhancing communication, language development, and learning for children with complex communication needs (CCN). Research suggests that AAC can significantly improve interaction with communication partners and mitigate risks in various developmental areas such as functional communication skills, speech, social engagement, and academic participation.
Early intervention is paramount for children with CCN to foster speech and language development, enabling them to express needs, interact socially, and lay the groundwork for future language skills. Introducing AAC systems early on and ensuring frequent exposure are essential for natural integration. Parents and caregivers must …

Rhetorical (Re)Inscription Practices Among Black Intercollegiate Football Participants In The Era Of Name, Image And Likeness, Mikayla Beaudrie
UNF Graduate Theses and Dissertations
When intercollegiate athletic participants were permitted the right to profit off of their name, image and likeness (NIL), the landscape of college sports was fundamentally changed. This qualitative explanatory case study investigated one consequence of that change: the discourse of amateurism. The National Collegiate Athletic Association (NCAA) has historically identified participants in the athletic programs it oversees with the word “student-athlete.” In the years since the word was first introduced, its meaning has generally been static. In short, the linguistic sign “student-athlete” has been signified in and by the discourse to reflect the amateur status of collegiate sport participants, emphasizing …
