Manipulating Public Debate: Using The Patriot Act To Keep Out Foreign Scholars, Hasan Z. Mansori

St. Thomas Law Review

This paper will argue that the new exclusion provision violates the First Amendment right to receive information and ideas by "blacklisting" foreigners who express disfavored political views. The Bush Administration has routinely utilized its powers to stifle dissent and to manipulate the public debate over political issues. This signifies a reemergence of the system of ideological exclusion prevalent during the Cold War. By preventing foreign scholars, poets, artists, musicians, and others with unique talents and perspectives from entering our borders, the government restricts public access to such views and information in contravention of the First Amendment. Law, Food, And Culture: Mexican Corn's National Identity Cooked In "Tortilla Discourses" Post-Tlc/Nafta, Ernesto Hernandez-Lopez

St. Thomas Law Review

With this essay, I will briefly introduce an inquiry concerning food and national cultural identity as expressed in the law. I will examine current changes in the Mexican state's public legal obligations, i.e., the law, and the production and consumption of corn, i.e., maize or maiz. These changes suggest that law, food, and culture are mutually influential in their production and consumption. The specific law examined is Mexico's corn tariff regime altered by the Tratado de Libre Comercio de America de Norte/North American Free Trade Agreement ("TLC/NAFTA"), which in the year 2008 eliminates all tariffs for corn imports from the …

The International Child Poverty Gap: Does Demography Matter?, Patrick Heuveline, Matthew Weinshenker

According to the Luxembourg Income Study data, the United States child poverty rate is the second highest among 15 high-income nations. The present work reveals that 55% of all American children living in a household headed by a single female with no other adult live in poverty —the highest rate for any of the five living arrangements in the 15 countries examined by this Study. While previous analyses have focused on market forces and governmental redistribution across households, we question the contribution of demographic factors that place children in family structures with different poverty risks relative to other factors such …

“Diesmal Fehlt Die Biologie!” Max Horkheimer, Richard Thurnwald, And The Biological Prehistory Of German Sozialforschung, Kevin S. Amidon Ph.D.

Modern Languages Faculty Publications

In his early writings Max Horkheimer explored the issues surrounding biological explanation in Kantian and neo-Kantian philosophy. After he became director of the Institut für Sozialforschung in 1930, he continued to explore the relationships between biology, materialism, philosophy, and social theory. This interest was reflected both in his editorial policy for the Zeitschrift für Sozialforschung and in his own scholarly development that led to the development of critical theory in the later 1930s and the anti-Semitism research of the 1940s. Horkheimer's interests and ambitions also generated resistance from other social scientists. The Berlin ethnologist Richard Thurnwald, along with his student …

Because social power is interpersonal, it is exercised in physical space. Edward Hall distinguishes between public, social, personal, and intimate space by the distance that individuals maintain from each other in that space. Soja describes the concept of space as either a geophysical reality, a mental-symbolic reality, or a social reality. Power is a physically perceived, socially-negotiated construct based on mental perceptions of authority and value in a group. The first critical study of Kathak dance within the discourses of the modern and the global, tracing the arc of two centuries of Kathak: the colonial nautch dance, classical Kathak under nationalism and postcolonialism and 'innovation' and 'new directions' under transnationalism and globalization. It blends various approaches from anthropology, ethnomusicology, and performance, media and gender studies to map the journey of Kathak from baijis and tawaifs to the global stage. The book uses dance as a lens to explore the interaction between the actors and forces of cultural change from power and patronage to television and film.

This biotic inventory will document the species-level diversity of dynastine scarabs, their spatial and temporal distributions, ecological preferences, and biology. The long term, multi-country research project explores a biotically megadiverse region that is seriously at risk from deforestation, environmental homogenization, invasive species, and urban sprawl. As the Emerging Church is one of the most significant developments in current popular Western ecclesiology, it is important that it be engaged theologically. As part of this engagement, this paper brings the Emerging Church into a constructive dialogue with John Wesley, a theologian who shared similar passions and faced comparable challenges. It maintains that Wesley would applaud the spirit and creativity of the Emerging Church, especially its mission to reach contemporary seekers and its desire to recapture an ancient-future faith. Christianity is fundamentally a peculiar way of life. Christian initiation is the process a person goes through within a Christian community of being formed and transformed into a new being, modeled after the likeness of Christ.
