Religious Freedom, Democracy, And International Human Rights, John Witte Jr., M. Christian Green Jan 2009

Religious Freedom, Democracy, And International Human Rights, John Witte Jr., M. Christian Green

Faculty Articles

Clearly, religion and freedom do not yet coincide in many countries, however rosy their new constitutional claims are as to religious rights and freedoms for all. Apostasy, Blasphemy, Conversion, Defamation, and Evangelization-these are the new alphabet of religious rights violation in a number of regions around the world. Occurring at the intersection of religion and international human rights, these violations are also challenges to the universality of human rights and the democratic institutions that generate and affirm them.

New Homes! (For The "Right" Family): Exclusionary Messages In Subdivision Advertising, Jennifer J. Heneghan Jan 2009

New Homes! (For The "Right" Family): Exclusionary Messages In Subdivision Advertising, Jennifer J. Heneghan

UNF Graduate Theses and Dissertations

Segregation is a large and incompletely understood problem in modern American society. By recognizing some of the ways segregation is perpetuated through print media we can gain more of an understanding into why the problem persists. This study of advertising for new subdivisions appearing in Jacksonville, Florida's major daily newspaper from 1960 through 2000 examines the use of potentially exclusionary messages such as use of the Equal Housing Opportunity logo or tagline, the race/ethnicity of human figures, and messages and images associated with particular socioeconomic statuses. Using both quantitative and qualitative data analysis this paper finds that exclusionary messages persist, …

A Theory Of Cultural Glocality, Sarah Elizabeth Fernandez Jan 2009

A Theory Of Cultural Glocality, Sarah Elizabeth Fernandez

UNF Graduate Theses and Dissertations

A Theory of Cultural Glocality shows how globalization can be salvaged from the negativity that often surrounds it. Globalization has been the target of criticism that claims globalization is pushed on cultures and in the process is destroying local cultures. The purpose of this thesis is to explore the limitations of globalization critics and show that it is not a negative force, that there is a healthy form of globalization. Therefore, globalization does not have to be considered disastrous for local cultures. Glocalizing provides cultures with a way to balance the local and the global in a healthy way where …

The Relationship Between Parental Influence And Christian Spiritual Practices Among Adventist Youth In Puerto Rico, Obed Jiménez

Dissertations

Problem. Typically, parents do not realize how influential they are in fostering spiritual growth in their children and are not aware of key influential factors that can motivate their children in practicing spiritual disciplines such as prayer, Bible reading, meditation, and church attendance.

Method. This study used data from the Avance PR study conducted during the months of March and October 1995. The population for this study was high-school students enrolled in Seventh-day Adventist academies and youth who attended Seventh-day Adventist churches in Puerto Rico. The youth sample (ages 13-25) consisted of 1,377 single, never-married subjects: 586 males and 775 …

A Critical Evaluation Of John Hick's Religious Pluralism In Light Of His Eschatological Model, Haejong Je Jan 2009

A Critical Evaluation Of John Hick's Religious Pluralism In Light Of His Eschatological Model, Haejong Je

Dissertations

Introduction to the Problem

The philosophy of John Hick, who is famous for his religious pluralism, has received vigorous study in terms of its epistemology, authority, the concept of God, and Christology. However, less attention has been given to his pareschatology. As explained below, initial investigation shows that there is a need for in-depth study of Hick’s religious philosophy in this area.

The Problem

Based upon preliminary research, Hick’s religious pluralism seems to reveal a critical problem with external correspondency, as follows. His pareschatology, which is an attempt to accept all eschatologies of major world religions as valid, may as …

Geografía Social De Zonas Críticas En México Su Contexto Económico Político: 1982-2005, Jose Antonio Roldan Amaro, Gabriel Saucedo Arteaga, Marsela Alvarez Izazaga, Richard Meindl, Cynthia Thompson, Tremaine Gregory

Peer Reviewed Articles

The Divide Of The Coca Leaf: National Culture And The Drug Policies Of Bolivia And The United States, Megan Koops Jan 2009

The Divide Of The Coca Leaf: National Culture And The Drug Policies Of Bolivia And The United States, Megan Koops

SPNA Review

While the United States and Bolivian cultures have different values, attitudes and norms, these differences have not been a major factor in determining the aid Bolivia receives from the United States (US). Now, President Morales, a former union leader for coca leaf growers, has refused to comply with US foreign policy to eradicate the coca leaf, creating political and cultural tension. This paper examines the US and Bolivian relationship as a case study through Schein’s organizational cultural theory and Adler’s culture theory to determine how Bolivia’s battle to save the coca leaf may affect the aid it receives from the …

Global Legal Pluralism, Ralf Michaels Jan 2009

Global Legal Pluralism, Ralf Michaels

Faculty Scholarship

Some challenges of legal globalization closely resemble those formulated earlier for legal pluralism: the irreducible plurality of legal orders, the coexistence of domestic state law with other legal orders, the absence of a hierarchically superior position transcending the differences. This review discusses how legal pluralism engages with legal globalization and how legal globalization utilizes legal pluralism. It demonstrates how several international legal disciplines---comparative law, conflict of laws, public international law, and European Union law---have slowly begun to adopt some ideas of legal pluralism. It shows how traditional themes and questions of legal pluralism---the definition of law, the role of the …

After The Revolution – Decline And Return Of U.S. Conflicts Of Laws, Ralf Michaels Jan 2009

After The Revolution – Decline And Return Of U.S. Conflicts Of Laws, Ralf Michaels

Faculty Scholarship

Scholars in the US have become uninterested in conflict of laws, at least in the core issues that spurred the conflict of laws revolution, especially questions of method and areas of tort and contract law. Proposals for a new (third) Restatement have not yet led very far. By contrast, new interest comes from the fringes: special political questions and interdisciplinarity. As to the first, I use the example of same‑sex marriages to discuss the extent to which discussions about politics are inseparably linked with discussions over conflict of laws. Conflict of laws is here not a mere additional field in …

Feeding The Fledgling Repository: Starting An Institutional Repository At An Academic Health Sciences Library., Ann E. Koopman, Am, Daniel G. Kipnis, Msi

Academic Commons and Scott Memorial Library Staff Papers and Presentations

In 2005, the Scott Memorial Library at Thomas Jefferson University started an institutional repository (IR), the Jefferson Digital Commons (JDC) . Originally intended as a showcase for faculty scholarship, it has evolved to serve also as a university press for original journals and newsletters, and as an institutional archive. Many lessons have been learned about marketing techniques, common IR issues, and advantages of an IR for a library. IR recruitment has come to be viewed as yet another form of collection development and has been integrated into all forms of the Library's outreach. Jefferson's academic health sciences environment has proven …

Unhitching The Horse From The Carriage: Love And Marriage Among The Mosuo, Judith Stacey Jan 2009

Unhitching The Horse From The Carriage: Love And Marriage Among The Mosuo, Judith Stacey

Utah Law Review

In the end, however, the fate of Mosuo kinship will not depend on this sort of cost-benefit analysis of its upsides and downsides. Somewhat poignantly, the very factor that dooms durable relationships between the Mosuo and outsiders now threatens the survival of the Mosuo kinship system itself. To reconcile the pure relationship and family stability, tisese depends upon a high degree of geographic immobility, and perhaps on social and economic stability as well. Cultural conformity also is crucial to sustain intergenerational, extended families. Inherent Mosuo family conflicts over whether or when to divide households due to size and discord seem …

Military Lawyers On The Battlefield: An Empirical Account Of International Law Compliance, Laura T. Dickinson Jan 2009

Military Lawyers On The Battlefield: An Empirical Account Of International Law Compliance, Laura T. Dickinson

GW Law Faculty Publications & Other Works

This empirical study, based on personal interviews, draws on insights from organizational theory to consider how military lawyers embedded with troops can help produce battlefield decisions that comply with international legal norms. These lawyers appear to be most likely to function effectively and encourage legal compliance if certain organizational features are present. Accordingly, focusing on the links between organizational structure, institutional culture, and legal compliance through more nuanced qualitative analysis should contribute to a better understanding of international law compliance.

The New Legal Pluralism, Paul Schiff Berman Jan 2009

The New Legal Pluralism, Paul Schiff Berman

GW Law Faculty Publications & Other Works

Scholars studying interactions among multiple communities have often used the term legal pluralism to describe the inevitable intermingling of normative systems that results from these interactions. In recent years, a new application of pluralist insights has emerged in the international and transnational realm. This review aims to survey and help define this emerging field of global legal pluralism. I begin by briefly describing sites for pluralism research, both old and new. Then I discuss how pluralism has come to be seen as an attractive analytical framework for those interested in studying law on the world stage. Finally, I identify advantages …
