Aesthetics In The Ecotheology Of Sallie Mcfague: A Critique And A Proposal For A Theological Aesthetics Of Nature, Mary-Paula Cancienne Jan 2009

Aesthetics In The Ecotheology Of Sallie Mcfague: A Critique And A Proposal For A Theological Aesthetics Of Nature, Mary-Paula Cancienne

Electronic Theses and Dissertations

This dissertation focuses on the ecological theology of Sallie McFague, who, as part of her work, employs the use of aesthetics. This study recognizes her contribution and then seeks to build upon it.
In aim of this goal, a limited history of aesthetics in the Western tradition is surveyed and attention is given to three significant contemporary scholars in the field of aesthetics and nature/environment (Emily Brady, Allen Carlson, and Arnold Berleant). While this work intended to propose the rudiments of a Theological Aesthetics of Nature, we find that nature and culture are so intertwined that what is initially called …

Differences In Romanian Men's Online Personals By Sexualities, Sebastian E. Bartoş, Voonchin Phua, Erin N. Avery Jan 2009

Differences In Romanian Men's Online Personals By Sexualities, Sebastian E. Bartoş, Voonchin Phua, Erin N. Avery

Sociology Faculty Publications

As Internet usage increases, its ability to provide almost instant connections and to pre-screen potential partners has made it a popular source for meeting people. To contribute to current literature, we examine differences in content between 187 men seeking men and 193 men seeking women in a sample of Romanian (Bucharest) personals in 2007. Results show that men seeking women provide more information about themselves than men seeking men. While the results also show that some Romanian men are more open about expressing their sexualities than others, there are still many obstacles affecting how men choose to share and express …

Gossip At Work: Unsanctioned Evaluative Talk In Formal School Meetings, Tim Hallett, Brent D. Harger, Donna Eder Jan 2009

Gossip At Work: Unsanctioned Evaluative Talk In Formal School Meetings, Tim Hallett, Brent D. Harger, Donna Eder

Sociology Faculty Publications

This article uses a form of linguistic ethnography to analyze videotaped recordings of gossip that took place during formal school meetings. By comparing this gossip data against existing models of gossip based on data collected in informal settings, we identify eleven new response classes, including four forms of indirectness that operate to cloak gossip under ambiguity, and seven forms of avoidance that change the trajectory of gossip. In doing so, this article makes three larger contributions. First, it opens a new front in research on organizational politics by providing an empirically grounded, conceptually rich vocabulary for analyzing gossip in formal …

Ethics Across The Curriculum, Or, On Being Bilingual, Lois Eveleth

Faculty and Staff - Articles & Papers

Both philosophical ethical systems and religious ethics are eminently desirable in higher education today. And, like two languages, and despite the differences, they can and should complement each other. In an increasingly secular milieu, our graduates will have to be "bilingual."

No Cracks In The Wall: The Standing Barrier And The Need For Restructuring Animal Protection Laws, Kristen Stuber Snyder Jan 2009

No Cracks In The Wall: The Standing Barrier And The Need For Restructuring Animal Protection Laws, Kristen Stuber Snyder

Cleveland State Law Review

American society's perception of animals has come a long way since the country was founded over 200 years ago. However, the court system has been slow to evolve along with these views, and the standing requirement maintains a barrier for those wishing to enforce protection through litigation. While protective legislation currently exists, it does not provide the necessary means of enforcement to accomplish its objectives. Thus, the enactment of new legislation is necessary to ensure animals in this country exist under decent and humane conditions.

Disestablishing Environmentalism, Andrew P. Morriss, Benjamin D. Cramer Jan 2009

Disestablishing Environmentalism, Andrew P. Morriss, Benjamin D. Cramer

Faculty Scholarship

The debate over environmental policy is increasingly conducted in language with strong religious overtones. Both proponents and opponents of various environmental policies appeal to religious doctrine to support their positions: Those who question human-caused global warming are labeled "heretics, " while appeals for environmental "stewardship" echo Biblical texts. Religious groups play an important role in defining environmental policy issues, and both supporters and critics of specific environmental policy views have labeled particular sets of beliefs about the environment a "religion." In this Article we engage in a thought experiment, arguing that there are valuable lessons to be learned from treating …

From Judging Culture To Taxing 'Indians': Tracing The Legal Discourse Of The 'Indian Mode Of Life', Constance Macintosh Jan 2009

From Judging Culture To Taxing 'Indians': Tracing The Legal Discourse Of The 'Indian Mode Of Life', Constance Macintosh

Articles, Book Chapters, & Popular Press

In this article I consider how judicial decision making characterizes Indigenous peoples’ culture outside the context of determinations under section 35(1) of the Constitution Act, 1982. I am concerned with how contemporary jurisprudence sometimes subjects Indigenous people to stereotyped tests of Aboriginality when they seek to exercise legislated rights. These common law tests of Aboriginality tend to turn on troubling oppositional logics, such as whether or not the Indigenous person engages in waged labour or commercial activities. These tests arose in historic legislation and policy that were premised on social evolutionary theory and were directed at determining whether an Indigenous …

Proportionality Balancing And Global Constitutionalism, Jud Mathews, Alec Stone Sweet Jan 2009

Proportionality Balancing And Global Constitutionalism, Jud Mathews, Alec Stone Sweet

Faculty Scholarship

Over the past fifty years, proportionality balancing – an analytical procedure akin to strict scrutiny in the United States – has become a dominant technique of rights adjudication in the world. From German origins, proportionality analysis spread across Europe, into Commonwealth systems (Canada, New Zealand, South Africa), and Israel; it has also migrated to treaty-based regimes, including the European Union, the European Convention on Human Rights, and the World Trade Organization. Part II proposes a theory of why judges are attracted to the procedure, an account that blends strategic and normative elements. Parts III and IV provide a genealogy of …

Ethnoracial Land Restitution: Finding Indians And Fugitive Slave Descendants In The Brazilian Northeast, Jan Hoffman French Jan 2009

Ethnoracial Land Restitution: Finding Indians And Fugitive Slave Descendants In The Brazilian Northeast, Jan Hoffman French

Sociology and Anthropology Faculty Publications

This chapter considers how a desire for land and development can lead to a refashioning of ethnoracial identities and identifications. Debates in development studies have centered on culture as an impediment to development. I turn that debate on its head and argue that new assertions of cultural particularity have in certain settings advanced the equity goals of development. The chapter explores the contrasting responses of two neighbouring communities of related African descended, mixed race rural workers who over a 25-year period (1975- 2000), under new laws, were recognized and given land by the Brazilian government. One was identified as an …

Evolutionary Theory And The Origin Of Property Rights, James E. Krier Jan 2009

Evolutionary Theory And The Origin Of Property Rights, James E. Krier

Articles

For legal scholars, the evolution of property rights has been a topic in search of a theory. My aim here is to draw together various accounts (some of them largely neglected in the legal literature), from dated to modern, and suggest a way they can be melded into a plausible explanation of property's genesis and early development. What results hardly amounts to a theory, but it does suggest an outline for one. Moreover, it provides a primer on the subject, a reasonably solid foundation for thinking and talking about the evolution of property rights.

Reconceptualizing Law And Politics In The Transnational: Constitutional And Legal Pluralist Approaches, Ruth Buchanan Jan 2009

Reconceptualizing Law And Politics In The Transnational: Constitutional And Legal Pluralist Approaches, Ruth Buchanan

Articles & Book Chapters

Despite the apparent fluidity that characterizes this historical moment as well as this moment in legal scholarship, this paper argues that there is also an enduring rigidity that is found in the persistence of a modernist conception of law. It is revealed in debates surrounding transnational constitutionalism, which even as they purport to transcend the nation-state, cannot escape some forms of reinscription of the relation between law and a centralized sovereign authority.

Rational Decisions: The Adaptive Nature Of Context-Dependent Choice, Alexandra G. Rosati, Jeffrey R. Stevens Jan 2009

Rational Decisions: The Adaptive Nature Of Context-Dependent Choice, Alexandra G. Rosati, Jeffrey R. Stevens

Department of Psychology: Faculty Publications

Although classical economic theory hinges on the assumption that rational actors should seek to maximize gains, psychologists and behavioral economists have recently collected a wealth of evidence challenging this premise. In violation of the principles of rational choice, context appears to dramatically influence human decision making. Like humans, numerous nonhuman animals, ranging from honeybees to primates, are sensitive to context, suggesting deep evolutionary roots for seemingly irrational decision-making. Many psychologists have suggested that such choices may stem from cognitive biases that result in errors. We contend, however, that labeling context-dependent choices as errors obscures the real issue. Natural selection does …

Social Interaction Effects On Reward And Cognitive Abilities In Monkeys, Jeffrey R. Stevens, Marc D. Hauser Jan 2009

Social Interaction Effects On Reward And Cognitive Abilities In Monkeys, Jeffrey R. Stevens, Marc D. Hauser

Department of Psychology: Faculty Publications

When given a choice between receiving $100 in 30 days and $110 in 31 days, most people wait for the larger, more delayed reward. However, when the choice is between $100 today and $110 tomorrow, many people shift their preferences to the smaller, immediate reward despite the same difference of $10 and one day. Reward properties—such as time to receipt—play a crucial role in our processing of rewards. However, reward processing does not only occur for individual decisions but also for social interactions; we must decide to either cooperate or compete with others for rewards. Humans stand out in the …

Information Literacy, “New” Literacies, And Literacy, John Buschman Jan 2009

Information Literacy, “New” Literacies, And Literacy, John Buschman

Library Publications

Literacy was once thought to be well-understood and well-defined. However, it has been argued that the digital world has disrupted any notions of literacy, supplanted with “new” forms of literacies in various new literacy studies and now, in the library and information science (LIS) scholarship as they apply to information literacy (IL). But, do the old forms of literacy in fact hold LIS back, and, do the critiques of conceptions of literacy fully represent that foundational scholarship? Are the “new” literacies really that different from traditional notions of literacy? A review of: concepts of literacy and IL that have been …

Cultural Culprits, Michelle Mckinley Jan 2009

Cultural Culprits, Michelle Mckinley

Studio for Law and Culture

This paper draws from a longer Article that examines questions of agency, victimization, and cultural essentialism in U.S. asylum adjudication and cultural defense cases specifically, and in international human rights law more broadly. I explore the adjudication of FGC asylum claims based on cultural persecution” that encode a racialized view of culture. I describe the historical trajectory of contemporary FGC claims through a detailed analysis of colonial anti-excision campaigns. I compare early 19th century anti-excision campaigns with contemporary maternal imperialism, as international law, UN agencies, and international financial institutions became more responsive to feminist concerns about eradicating FGC. Throughout the …

Blackboard Jungle: Delinquency, Psychiatry, And The Bio-Politics Of Brown, Anders Walker Jan 2009

Blackboard Jungle: Delinquency, Psychiatry, And The Bio-Politics Of Brown, Anders Walker

Studio for Law and Culture

In 1955, Metro-Goldwyn-Mayer released a controversial film about juvenile delinquency entitled Blackboard Jungle. Georgia Governor Ernest Vandiver subsequently used the film as a metaphor for what would happen to southern schools were Brown enforced, marking the beginnings of a much larger campaign to articulate southern resistance to integration in popular terms. Taking Blackboard Jungle as a starting point, this article recovers the intersection between discourses of delinquency and desegregation at mid-century, showing how civil rights groups and segregationists alike both drew from mass culture and social psychiatry to advance their constitutional agendas. It concludes by showing that even as …

Control-Force Inputs Obtained From Pilots And Nonpilots (Flight Attendants): Comparison With Established Handbook Distributions Of Performance, Dennis B. Beringer

International Symposium on Aviation Psychology - 2009

Earlier reports in this series (Beringer, 2006-2008) have reported the force that pilots and nonpilots could exert on flight controls. This paper presents a comparison of some well-known tables of human strength with the values from recent samples of women and men pilots and nonpilots in an attempt to determine how closely those distributions fit tabled distributions of human strength. Findings suggest that some other samples may be used to approximate the difficult-to-sample Part 121 female pilots if the data are treated properly. Specifically, yoke-activation tasks for the female pilots could be reasonably well approximated by fractional performance values of …
