Off-Reservation Treaty Hunting Rights, The Restatement, And The Stevens Treaties, Ann E. Tweedy Oct 2022

Off-Reservation Treaty Hunting Rights, The Restatement, And The Stevens Treaties, Ann E. Tweedy

Washington Law Review

The underdevelopment of the law of off-reservation treaty hunting and gathering poses challenges for treatises like the groundbreaking Restatement of the Law of American Indians (“Restatement”). With particular attention to sections 83 and 6 of the Restatement, this Article explores those challenges and offers some solutions for dealing with them in subsequent editions of the Restatement. Specifically, this Article explores the potential usefulness of historical law in interpreting treaties, the need to tie treaty interpretation to the language of the treaty when an explicit right is at issue, the proper application of the reserved rights doctrine and the Indian canons, …

Looking For Good Work: From Matthew Crawford To Pope Francis Via Wittgenstein, Mark Ryan Oct 2022

Looking For Good Work: From Matthew Crawford To Pope Francis Via Wittgenstein, Mark Ryan

Theology and Religious Studies Faculty Publications

Each semester, I teach third-year business students a course in theological ethics. Since my students’ choices of majors (e.g., “accounting,” “marketing,” etc.) directly reference the jobs they hope to have after graduating, it has seemed fitting to make ‘work’ one of our topics of study. I am an Aristotelian, which means that my goal ought to be to teach about the manner in which my students’ work is part of their ongoing formation with the ultimate goal, one hopes, of becoming successful moral agents—or, in Aristotelian terms, achieving excellence in goodness. However, I have often been tempted to teach work’s …

Is It Useful? Orthophosphate Mapping Of An Excavated Cellar Of A Mid 1700’S Tavern In New London Va, Thomas M. Bender, Randy Lichtenberger

Faculty Publications and Presentations

The partially backfilled cellar of Mead’s Tavern (VDHR # 015-0120) a circa 1760’s building in New London Virginia, was studied by orthophosphate (PO43) mapping of the recently exposed, culturally sterile, subsoil floor. Prior studies of the cellar had exposed a hearth along with features that were speculated to be wall partitions for subdivision of the cellar. The full intended purpose for those exposed features is unknown. To further probe that exposed subsoil prior to a major engineering stabilization of the tavern’s foundation, a chemical mapping of surface PO43- levels in the cellar was done. The …

Integrating Medical Pluralism In Southern Africa: The Case Of The Zion Christian Church’S Healing Motif, Olaotse Obed Gabasiane

Journal of Adventist Mission Studies

The challenges that Western-trained medical missionaries and Christian doctors face is that their African patients, some of whom may be Christians, do consult all the healers in the parallel medical systems freely and almost simultaneously, the result of which may be complications, and possibly mental confusion, due to medications from different sources being taken at the same time without any liaison between doctors and healers.

Effect Of Lateral Outflow On Three-Dimensional Flow Structure In A River Delta, M. Kifayath Chowdhury, Kory M. Konsoer, Matthew Hiatt Oct 2022

Effect Of Lateral Outflow On Three-Dimensional Flow Structure In A River Delta, M. Kifayath Chowdhury, Kory M. Konsoer, Matthew Hiatt

Faculty Publications

Spatial and temporal patterns in three-dimensional flow structure are linked to channel processes and morphology in many environments. However, there is not yet an understanding of how the flow structure is influenced by channelized and gradually distributed lateral outflows that are often prevalent in river deltas. This study presents an analysis of three-dimensional flow structure data collected from Wax Lake Delta, a naturally developing river-dominated delta in the northern Gulf of Mexico. Three hydrographic surveys were conducted using a boat-mounted acoustic Doppler current profiler at two sites: a channelized outflow zone and a distributary channel experiencing unchannelized lateral outflow. The …

The Ascension Of Indigenous Cultural Property Law, Angela R. Riley Oct 2022

The Ascension Of Indigenous Cultural Property Law, Angela R. Riley

Michigan Law Review

Indigenous Peoples across the world are calling on nation-states to “decolonize” laws, structures, and institutions that negatively impact them. Though the claims are broad based, there is a growing global emphasis on issues pertaining to Indigenous Peoples’ cultural property and the harms of cultural appropriation, with calls for redress increasingly framed in the language of human rights. Over the last decade, Native people have actively fought to defend their cultural property. The Navajo Nation sued Urban Outfitters to stop the sale of “Navajo panties,” the Quileute Tribe sought to enjoin Nordstrom’s marketing of “Quileute Chokers,” and the descendants of Tasunke …

Household Salt Production By The Late Classic Maya: Underwater Excavations At Ta'ab Nuk Na, Heather Mckillop, E. Cory Sills

Geography Faculty Publications and Presentations

Salt is an essential commodity; archaeological remains around the world attest to the importance of its production, exchange and consumption. Often located in coastal locations, many production sites were submerged by rising seas, including the Paynes Creek Salt Works on the southern Belize coast. Survey and excavation of these sites has identified ‘kitchens’ for brine boiling, as well as Terminal Classic residential structures at Ek Way Nal. The authors report the discovery of an earlier residential building alongside salt kitchens at the nearby site of Ta'ab Nuk Na. This finding indicates that surplus household production began during the Late Classic, …

Process Evaluations Of Positive Youth Development Programmes For Disadvantaged Young People: A Systematic Review, Grace Tidmarsh, Janice Thompson, Mary Quinton, Jennifer Cumming

Journal of Youth Development

This systematic review identified 10 process evaluation studies of positive youth development (PYD) programmes for disadvantaged young people, and aimed to assess the quality of reporting, methods used, and barriers and enablers to delivering programmes as intended. Four databases were searched: Web of Science, Psych INFO, Scopus, and Embase. Results indicated the methods used and quality of the process evaluations were highly varied. Numerous barriers (sessions feeling too much like school, lack of behaviour management skills, lack of funding, and logistical challenges) and enablers (collaboration with the local community, meeting young people’s needs, and communication) to delivering programmes as intended …

The Putrefaction Of Digital Scholarship: How Link Rot Impacts The Integrity Of Scholarly Publishing, Marshal A, Miller Oct 2022

The Putrefaction Of Digital Scholarship: How Link Rot Impacts The Integrity Of Scholarly Publishing, Marshal A, Miller

Doctor of Education (Ed.D)

Research sits at the core of scholarship. The integrity of that research allows fields of study to grow and build upon one another to form the foundation for and extension of human knowledge. In the last 10 years, a new phenomenon has occurred as digital scholarship has become more prolific. This phenomenon is called link rot. Link rot occurs when over time, digital resources become inaccessible because their originally cited location has been relocated or become permanently unavailable. This study examined the extent to which link rot has affected scholarly research and how it might affect the future of digital …

Although there is ample research on technology acceptance model from both out of tourism (Marangunić & Granić, 2015) and tourism literature (Pourfakhimi et al., 2019). There is no paper explicating how the TAM have been addressed in tourism and hospitality literature to guide researchers in accelerating theoretical advancement and help tourism professionals in designing creative solutions. Thus, it is the aim of this study to unfold progress of TAM in tourism and hospitality literature through overviewing it. To fulfil this aim, 145 quantitative papers based their theoretical framework on TAM, published at journals involved within SSCI, ESCI or Scopus indexes …

From Mud: Lessons Of Mindfulness Found In Clay Work, Casey Williams

Mindfulness Studies Theses

A significant part of the earth's history, clay represents the interconnectedness of all life. While clay has long been used in the field of art therapy, the use of the material in mindfulness has been unfolding. This creative thesis explores the significance of clay to humankind. It reviews Buddhist literature and text to identify the elements and parallels of clay work that make it a compelling contemplative material. Neuroscientific research that connects the mind and body interaction further make the case for clay work as an effective mindfulness-based practice. The creative component of this thesis is a clay retreat that …

Defending The Less Dead: Using The Decriminalization Of Sex Work To Combat The High Incidence Of Serial Homicide Of Street-Based Sex Workers, Lauren E. Fernandez Oct 2022

Defending The Less Dead: Using The Decriminalization Of Sex Work To Combat The High Incidence Of Serial Homicide Of Street-Based Sex Workers, Lauren E. Fernandez

William & Mary Journal of Race, Gender, and Social Justice

Sex workers have historically represented a disproportionate percentage of all victims of serial murder. Several serial murderers in the past thirty years have evaded detection for years, taking the lives of dozens of victims, by targeting sex workers, playing off the biases of society and law enforcement, and counting on the halfhearted investigation techniques that often followed missing person reports for less valued members of society, or the “less dead.” This Note argues that the decriminalization of all aspects of sex work is the surest way to improve the safety of street-based sex workers and reduce high victimization of this …

Not Just The Sinner’S Prayer: People’S Experiences With “Stranger-Evangelism”, Kenneth Nehrbass Oct 2022

Not Just The Sinner’S Prayer: People’S Experiences With “Stranger-Evangelism”, Kenneth Nehrbass

Great Commission Research Journal

While churches and Christian concerts are typical loci for evangelism, some Christians also broach the subject of faith with strangers they encounter at their health club, at the beach, or while visiting door-to-door. This study draws from 34 stories of “stranger-evangelism” offered by 11 ministers and laypeople who participated in semi-structured interviews. The central finding of this study is that stranger-evangelism contains a rich variety of experiences that are typical of any ministry: sometimes planned (by proclaiming, inviting, programming, befriending, and serving), and sometimes spontaneously. Participants described the fruit of their efforts along a continuum from rejection to interest, and …

It will first conduct a series of case studies of natural resources for which there is transnational or international demand, but unsustainable management. While CITES-listed resources will be considered with particular attention, unlisted and more conventional resources will also be considered. In its second part, this Note will consider mechanisms currently available in international trade to accommodate environmental progress, then will set forth various new measures the WTO could adopt to incentivize sustainable management of the Part I resources. Part III will …
