This issue of the Temple Journal of International and Comparative Law hosts a symposium about Randle DeFalco's cutting-edge book, Invisible Atrocities: The Aesthetic Biases of International Criminal Justice. In it, DeFalco glances at glimpses of the metastasis of mass atrocity. He sees these metastatic processes-these movements-as simultaneously fast and slow. By fast, he refers to obvious and instantly horrific acts of physical violence. These are massacres, attacks, pogroms, and wanton destruction. But DeFalco also discerns that mass violence implicates slower movements and less directly causal harms: these are famine, starvation, corruption, impoverishment, mental anguish, and aid interference.' The Establishment Clause, Civil Rights, And The Accomodationist Path Forward, Lisa Shaw Roy

The U.S. Supreme Court’s First Amendment Religion Clause doctrine is undergoing a transition between the Court’s older, strict separationist decisions and its current accommodationist approach. This shift can be seen in the Court’s most recent Establishment and Free Exercise Clause decisions, and in particular, in its unanimous Free Speech Clause decision in Shurtleff v. City of Boston, a case which found that the challenger, Harold Shurtleff, had a First Amendment right to raise a flag with a cross on a city flagpole. In many ways, Shurtleff exemplifies the Court’s incremental movement toward an accommodationist Establishment Clause doctrine, and this …

A Law & Macroeconomics Critique Of San Antonio Independent School District V. Rodriguez, Steven A. Ramirez

Fifty years ago, the Supreme Court decided, in San Antonio Independent School District v. Rodriguez, to permit states to provide dramatically disparate funding for childhood education from district to district, thereby concretizing and propagating racial and economic inequality indefinitely. This Article shows that this decision entails staggering macroeconomic costs, undermines human development in the United States, and has hindered the government from promoting general welfare, domestic tranquility, and common defense. The opinion pursued the political objectives of the Southern Strategy and does not rest upon a legitimate exercise of judicial power. Rodriguez furthers the replication of our nation’s racial …

Rapid Growth In Late Cretaceous Sea Turtles Reveals Life History Strategies Similar To Extant Leatherbacks, Laura E. Wilson

Modern sea turtle long bone osteohistology has been surprisingly well-studied, as it is used to understand sea turtle growth and the timing of life history events, thus informing conservation decisions. Previous histologic studies reveal two distinct bone growth patterns in extant sea turtle taxa, with Dermochelys (leatherbacks) growing faster than the cheloniids (all other living sea turtles). Dermochelys also has a unique life history compared to other sea turtles (large size, elevated metabolism, broad biogeographic distribution, etc.) that is likely linked to bone growth strategies. On The Ethics Of Selling Psychic Services, Jeffrey Moriarty

In many places, it is possible to buy psychic services, including tarot card, palm, and mediumship readings. Yet we have powerful evidence that psychic abilities do not exist. This paper asks whether psychic services should be for sale. I begin by considering whether psychics deceive or mislead buyers. Next, I consider a harm-based argument against the sale of psychic services. Finally, I consider an argument in favor of their sale that appeals to expressive considerations. I conclude with a tentative policy recommendation: the sale of psychic services should be permitted. This is so even though much of the money spent …

The COVID-19 pandemic has exposed the vulnerability of our ecosystem and demonstrated a crucial need to address sustainability across the fashion supply chain, including the end-use consumer. As consumers become more conscious and demand sustainable fashion, the question of whether the pandemic has shaped such behaviors for long-term transitions remains unanswered. This qualitative study aimed to understand whether the COVID-19 pandemic has created a societal shift in individual attitudes toward sustainable fashion, whether it can help to motivate long-term sustainable consumption practices, and whether positive psychology plays a role in this context. Among eighteenth-century Quaker writers, John Woolman was idiosyncratic, as illustrated by the fact that in his journal he recorded an ac-count of his own death. Needless to say, this was not usually done. Instead, it was conventional for posthumously published Quaker journals to include not only an autobiographical narrative of spiritual development but also additional material written by qualified Friends offering further testimony and giving details about how and when the author died. The first printing of Woolman’s journal in his posthumous Works (1774) is accompanied by such material about his 1772 death in York, England, but this was not …

Environmental Aesthetics And Environmental Justice In Jonathan Edwards’S Personal Narrative And John Woolman’S Journal, Jay David Miller

This essay examines the relationship between Christian theology, environmental aesthetics, and environmental justice in colonial America. As opposed to the work of secular writers from the early republic like J. Hector St. John de Crèvecoeur and Thomas Jefferson, the Christian environmental aesthetics of Jonathan Edwards and John Woolman have potential to address questions of environmental justice in American literary history, such as tenant exploitation, African enslavement, and Indigenous displacement. Edwards, however, worked in a pastoral literary tradition, which limited his ability to imagine environmental justice due to his commitment to the doctrine of election. Every day, consumers are bombarded with conflicting messages about what they should and should not eat. In an effort to make healthy food choices, consumers often flock to food products that boast “organic,” “all-natural,” or “non-GMO” labels. But are all of these foods really better? In this note, I discuss the confusion surrounding “natural” food and how it has hindered progress toward more productive and sustainable food systems. First, I examine the hazy definition of “natural” foods and explain why consumers continue to demand natural foods despite their environmental impacts.
