Never Tell Me The Odds: How To Avoid Infringement When Alluding To Copyrighted Works In Branding, Paul M. Matenaer Feb 2023

Never Tell Me The Odds: How To Avoid Infringement When Alluding To Copyrighted Works In Branding, Paul M. Matenaer

Chicago-Kent Journal of Intellectual Property

Alluding to copyrighted works in branding is common, especially among small businesses that tend to fly under the radar of the large corporations which own those copyrights. The craft beer industry, for example, is fond of such allusions, incorporating references to movies, comic books, and video games in product names and beer labels. Whether to pay homage to the creative genius found in those copyrighted works or to cash in on popular enthusiasm for them, brand allusions to copyrighted works are common. However, such homages to copyrighted works can be as dangerous as flying into an asteroid field because they …

Investigating Evidence-Based Practices And Interventions Using Multifaceted Learning Theory For Students In A Special Education Self-Contained Classroom, Adam Maitland

Ed.D. Dissertations

Teachers working in a special education self-contained classroom were required to implement evidence-based practices and interventions, rarely researched in a school setting, with fidelity to meet the needs of students with intellectual disabilities. Evidence-based practices and interventions for students with intellectual disabilities were researched in clinical settings with one to three student participants and without a common evaluation tool. The purpose of this qualitative case study was to use the Tennessee Educator Acceleration Model General Educator Rubric to investigate how experienced teachers used multifaceted learning theory when implementing evidence-based practices and interventions in a diverse special education self-contained classroom to …

In Vivo Gene Delivery Into Mouse Mammary Epithelial Cells Through Mammary Intraductal Injection, Wen Bu, Yi Li Feb 2023

In Vivo Gene Delivery Into Mouse Mammary Epithelial Cells Through Mammary Intraductal Injection, Wen Bu, Yi Li

Faculty, Staff and Students Publications

Mouse mammary glands comprise ductal trees, which are lined by epithelial cells and have one opening at the tip of each nipple. The epithelial cells play a major role in mammary gland function and are the origin of most mammary tumors. Introducing genes of interest into mouse mammary epithelial cells is a critical step in evaluating gene function in epithelial cells and generating mouse mammary tumor models. This goal can be accomplished through the intraductal injection of a viral vector carrying the genes of interest into the mouse mammary ductal tree. The injected virus subsequently infects mammary epithelial cells, bringing …

Background: Among the important key modulators of the tumor microenvironment and hypoxia is a family of enzymes named carbonic anhydrases. Herein, 11 novel sulfonamide–pyridine hybrids (2–12) were designed, synthesized and biologically evaluated for their potential use in targeting breast cancer. Methods & results: The para chloro derivative 7 reported the highest cytotoxic activity against the three breast cancer cell lines used. In addition, compound 7 was found to induce cell cycle arrest and autophagy as well as delaying wound healing. The IC50 of compound 7 against carbonic anhydrase IX was 253 ± 12 nM using dorzolamide HCl as control. Conclusion: …

“In These Times Of Compassion When Conformity’S In Fashion”: How Therapeutic Jurisprudence Can Root Out Bias, Limit Polarization, And Support Vulnerable Persons In The Legal Process, Michael L. Perlin Feb 2023

“In These Times Of Compassion When Conformity’S In Fashion”: How Therapeutic Jurisprudence Can Root Out Bias, Limit Polarization, And Support Vulnerable Persons In The Legal Process, Michael L. Perlin

Texas A&M Law Review

This Article considers the extent to which caselaw has—either explicitly or implicitly—incorporated the precepts of therapeutic jurisprudence (“TJ”), a school of legal thought that focuses on the law’s influence on emotional life and psychological well-being, and that asks us to assess the actual impact of the law on people’s lives. Two of the core tenets of TJ in practice are commitments to dignity and to compassion. I conclude ultimately that with these principles as touchstones, TJ can be an effective tool—perhaps the most effective tool—in rooting out bias, limiting polarization, and supporting vulnerable persons in the legal process. But this …

Extinction Or Bust: Improving Species Recovery Under The Endangered Species Act By Amending The Funding Allocation And Recovery Planning Processes, Max Hayashi Feb 2023

Extinction Or Bust: Improving Species Recovery Under The Endangered Species Act By Amending The Funding Allocation And Recovery Planning Processes, Max Hayashi

Texas A&M Law Review

The Endangered Species Act of 1973 (“ESA”) is among the most powerful environmental statutes passed in U.S. history and serves as a blueprint for government-sanctioned conservation efforts globally. At its core, the ESA seeks to protect listed plant and animal species by prohibiting actions that harm their chances of survival. While the ESA has generally succeeded in pursuing this goal as implemented, it has also led to a host of problems that undermine its effectiveness and generated widespread discontent among conflicting, disparate stakeholders, including environmentalists, industry groups, government agencies, and private landowners. Criticisms of the ESA generally focus on several …

Of Life Beyond Domination: Capability Determination, Surfacing, Norm Play, Jeremy Bendik-Keymer

Faculty Scholarship

“Surfacing” is the process of rediscovering one’s sense of self-determination from within a context of enduring domination, including systems of enduring domination, such as racism, capitalism, and patriarchy. “Enduring domination” is the afterlife of domination that carries on into the conditions and mentality of anyone affected by domination, even indirectly. This article riggs together a concept from the Capability Approach to human development, a process from intersectional, epistemic justice work, and some broad possibilities within social practice art around norm play and subversion to fill out a practice of wondering that helps its participants surface. It serves as a contribution …

Hard To Be Won: A Theatrical Interpretation Of Elizabeth Keckly’S “Behind The Scenes, Or Thirty Years A Slave And Four Years In The White House”, Selah Degering Feb 2023

Hard To Be Won: A Theatrical Interpretation Of Elizabeth Keckly’S “Behind The Scenes, Or Thirty Years A Slave And Four Years In The White House”, Selah Degering

Undergraduate Honors Theses

Hard to Be Won is a musical adaptation of a memoir by Elizabeth Keckly, a black woman of considerable success who earned the confidence of Abraham Lincoln and his wife, Mary, in war-torn 1860s America. My adaptation of this story showcases a new perspective: that of Elizabeth herself. Despite her memoir narrating these events in her own voice, Elizabeth as an individual has been largely ignored or misrepresented in modern, idealistic, and racially ignorant retellings and criticism. Elizabeth as a token black person in the narrative of the Lincoln household cannot stand as representation of this woman’s legacy when she …

Dual-Specificity Phosphatases 22-Deficient T Cells Contribute To The Pathogenesis Of Ankylosing Spondylitis, Ming-Han Chen, Huai-Chia Chuang, Yi-Chen Yeh, Chung-Tei Chou, Tse-Hua Tan

Children’s Nutrition Research Center Staff Publications

Background: Dual-specificity phosphatases (DUSPs) can dephosphorylate both tyrosine and serine/threonine residues of their substrates and regulate T cell-mediated immunity and autoimmunity. The aim of this study was to investigate the potential roles of DUSPs in ankylosing spondylitis (AS).

Methods: Sixty AS patients and 45 healthy controls were enrolled in this study. Associations of gene expression of 23 DUSPs in peripheral T cells with inflammatory cytokine gene expression and disease activity of AS were analyzed. Finally, we investigated whether the characteristics of AS are developed in DUSP-knockout mice.

Results: The mRNA levels of DUSP4, DUSP5, DUSP6, DUSP7, and DUSP14 in peripheral …

Micrornas And Gene Regulatory Networks Related To Cleft Lip And Palate, Chihiro Iwaya, Akiko Suzuki, Junichi Iwata

Faculty, Staff and Student Publications

Cleft lip and palate is one of the most common congenital birth defects and has a complex etiology. Either genetic or environmental factors, or both, are involved at various degrees, and the type and severity of clefts vary. One of the longstanding questions is how environmental factors lead to craniofacial developmental anomalies. Recent studies highlight non-coding RNAs as potential epigenetic regulators in cleft lip and palate. In this review, we will discuss microRNAs, a type of small non-coding RNAs that can simultaneously regulate expression of many downstream target genes, as a causative mechanism of cleft lip and palate in humans …

The Process Theology Of John Elof Boodin, Michael A. Flannery Feb 2023

The Process Theology Of John Elof Boodin, Michael A. Flannery

Libraries Professional Work

Despite his impeccable academic pedigree, a protégé of Josiah Royce and a friend and student of William James, John Elof Boodin is nearly forgotten today among American philosophers; hence, an essential aspect of his thought lost to history is his contribution to process theology. The leading features of process thought demonstrate Boodin’s connections to this unique theology and show it to have been established early on, as early as 1900 and 1904. This places Boodin’s writing on process philosophy/theology well before Alfred North Whitehead, the putative pioneer in modern process metaphysics, by more than twenty years, and co-extensive with Henri …

Improving Phosphorus Acquisition Efficiency Through Modification Of Root Growth Responses To Phosphate Starvation In Legumes, Zhijian Chen, Linjie Wang, Juan Andres Cardoso, Shengnan Zhu, Guodao Liu, Idupulapati M. Rao, Yan Lin

All Peer-Reviewed Publications

Phosphorus (P) is one of the essential macronutrients for plant growth and development, and it is an integral part of the major organic components, including nucleic acids, proteins and phospholipids. Although total P is abundant in most soils, a large amount of P is not easily absorbed by plants. Inorganic phosphate (Pi) is the plant-available P, which is generally immobile and of low availability in soils. Hence, Pi starvation is a major constraint limiting plant growth and productivity. Enhancing plant P efficiency can be achieved by improving P acquisition efficiency (PAE) through modification of morpho-physiological and biochemical alteration in root …

Although tissue-resident memory T (TRM) cells specific for previously encountered pathogens have been characterized, the induction and recruitment of brain TRM cells following immune therapy has not been observed in the context of glioblastoma. Here, we show that T cells expressing fibrinogen-like 2 (FGL2)–specific single-chain variable fragments (T-αFGL2) can induce tumor-specific CD8+ TRM cells that prevent glioblastoma recurrence. These CD8+ TRM cells display a highly expanded T cell receptor repertoire distinct from that found in peripheral tissue. When adoptively transferred to the brains of either immunocompetent or T cell-deficient naïve mice, these CD8+ TRM cells reject glioma cells. Mechanistically, T-αFGL2 …

Modern Approaches To Addressing The Mass Incarceration Of America's Mentally Ill Population, Cameron A. Bice, April N. Terry

Academic Leadership Journal in Student Research

Correctional facilities negatively affect individuals with pre-existing mental and behavioral health concerns while also creating an environment that manifests future mental illness. Issues include facility overcrowding, restrictive housing practices, lack of accessible services, and ill-informed practices and procedures when working with individuals with mental illness. Incarcerated individuals with mental illness also face disparities through (1) sentence length, (2) race/ethnicity and gender, and (3) increased risk in victimization. This paper draws attention to a long-standing, yet current critical issue in the American criminal justice system—the use of jails and prisons as modern-day psychiatric hospitals. This literature yields many options for disrupting …

Shop Until You Drop: The Unexpected Effects Of Anticonsumerism And Environmentalism, Giovanni Maccarrone, Marco A. Marini, Ornella Tarola

Fondazione Eni Enrico Mattei Working Papers

In an economy where consumers are heterogeneous in their preferences over the hedonic and environmental attributes of goods on sale, we explore the effects of anti-consumerism and environmentalism. We show that when the environmental attributes of products come at the expense of the hedonic attributes, a higher supply of anti-consumerism and environmentalism yields the expected positive effect on the environment. In contrast, when hedonic and environmental attributes are jointly met by a good, higher levels of anti-consumerism and environmentalism negatively affect the society’s environmental footprint. Moreover, the impact of anti-consumerism and environmentalism on social welfare is far from being obvious, …

Drought Stress Prediction And Propagation Using Time Series Modeling On Multimodal Plant Image Sequences, Sruti Das Choudhury, Sinjoy Saha, Ashok Samal, Anastasios Mazis, Tala Awada

School of Natural Resources: Faculty Publications

The paper introduces two novel algorithms for predicting and propagating drought stress in plants using image sequences captured by cameras in two modalities, i.e., visible light and hyperspectral. The first algorithm, VisStressPredict, computes a time series of holistic phenotypes, e.g., height, biomass, and size, by analyzing image sequences captured by a visible light camera at discrete time intervals and then adapts dynamic time warping (DTW), a technique for measuring similarity between temporal sequences for dynamic phenotypic analysis, to predict the onset of drought stress. The second algorithm, HyperStressPropagateNet, leverages a deep neural network for temporal stress propagation using hyperspectral imagery. …

Massive Loss Of Proprioceptive Ia Synapses In Rat Spinal Motoneurons After Nerve Crush Injuries In The Postnatal Period, Ariadna Arbat-Plana, Sara Bolívar, Xavier Navarro, Esther Udina, Francisco J. Alvarez Feb 2023

Massive Loss Of Proprioceptive Ia Synapses In Rat Spinal Motoneurons After Nerve Crush Injuries In The Postnatal Period, Ariadna Arbat-Plana, Sara Bolívar, Xavier Navarro, Esther Udina, Francisco J. Alvarez

Neuroscience, Cell Biology & Physiology Faculty Publications

Peripheral nerve injuries (PNIs) induce the retraction from the ventral horn of the synaptic collaterals of Ia afferents injured in the nerve, effectively removing Ia synapses from α-motoneurons. The loss of Ia input impairs functional recovery and could explain, in part, better recovery after PNIs with better Ia synaptic preservation. Synaptic losses correlate with injury severity, speed, and efficiency of muscle reinnervation and requires ventral microglia activation. It is unknown whether this plasticity is age dependent. In neonates, axotomized motoneurons and sensory neurons undergo apoptosis, but after postnatal day 10 most survive. The goal of this study was to analyze …
