Warren/Burger Courts Exalted “Free” Expression Over Other American Values, Louis W. Hensler Iii
Warren/Burger Courts Exalted “Free” Expression Over Other American Values, Louis W. Hensler Iii
Marquette Law Review
Anglo-American defamation law started with a simple condemnation of the sin of evil speaking. Eventually, this value condemning harmful speech was accommodated to the value of speaking the truth, even hurtful truth. A third value of fostering responsible self-government was injected into American defamation law at and around the time of the American Revolution. This value makes it especially important for citizens to freely speak even hurtful truth about their government.

2022-2023 Christmas Bird Counts, Don Paseka
Nebraska Bird Review
Sixteen counts were run in the 2022-2023 CBC season. Because of weather and rescheduling issues, the Crawford, Harrison, and Harlan County counts were cancelled. Eight of the counts were completed during the first week of the count period and the other eight were scattered throughout the remainder of the count period. An early December cold snap seemed to drive many of the birds south, but the weather on actual count days was fairly benign: mostly dry with an average high of 34˚F and an average low of 19˚F and with three circles reporting light snow. The total number of species …

Nebraska Bird Review
Since this is a Winter Seasonal Report, it seems appropriate to lead off with notable reports of occurrences that might be considered unexpected for midwinter, of which there were several. A range of species was involved, suggesting an encompassing cause such as climate change. Of interest were northerly wintering groups of waterfowl including Gadwall, Green-winged Teal, Canvasback, Ringnecked Duck, and Hooded Merganser. Reports of wintering Tundra Swans, Whitewinged Doves, and Lesser Goldfinches continue to increase, and numerous Redwinged Blackbirds in the northeast in midwinter were unexpected. Also quite unexpected were two Sandhill Cranes wintering in the east, the state’s first …
An Analysis Of The Episodic Writing Process, Megan Kanger
An Analysis Of The Episodic Writing Process, Megan Kanger
Honors Program: Senior Projects (Public)
Writing for an episodic series vastly differs from writing for a short film. This essay explores the major differences between writing a short film in contrast to writing an episodic series and how these differences impact the writing process. The essay examines the topic by breaking down my own experience writing an episodic series and the key findings I uncovered throughout that process. I describe my series, Scythe, and the central themes and characters that encompass the series. With a central theme of death, I describe how I worked to establish an emotional tonal balance between drama and humor within …

The mammalian superior colliculus and its non-mammalian homolog, the optic tectum (OT), are midbrain structures that integrate multimodal sensory inputs and guide non-voluntary movements in response to prevalent stimuli. Recent studies have implicated this structure as a possible site affected in Autism Spectrum Disorder (ASD). Interestingly, fetal exposure to valproic acid (VPA) has also been associated with an increased risk of ASD in humans and animal models. Therefore, we took the approach of determining the effects of VPA treatment on zebrafish OT development as a first step in identifying the mechanisms that allow its formation. We describe the normal OT …

Comparative Civilizations Review
Most of this brief review will be academic history, but one of the truisms of the martial arts is that it is never strictly “academic.” Words on paper cannot express some things at the heart of the art. Many of the most thoughtful masters of various schools have worried about how to cultivate students with the discipline and philosophical background to be “safe” for polite society. This is a similar problem for police departments and even armies. The best wish to train professionals in ways of being deadly, without empowering undisciplined people to harm innocents. Therefore, part of this paper …

Autism is a lifelong, genetic disorder that creates communication challenges, including social-emotional reciprocity, nonverbal communicative behavior deficits, and relationship struggles; restricted or repetitive behavior patterns and interests; and sensitivity to sensory inputs.1 This disorder presents a range of conditions, known as the autism spectrum, which spans from “low-functioning” individuals, who have significant speech challenges, to “high-functioning” individuals, who can communicate but have other social and behavioral challenges; high-functioning autism has traditionally been called Asperger’s syndrome. This disorder has become more of a mainstream topic, with television shows and movies, such as The Good Doctor and Rainman, depicting characters on …

Abstract Introduction Soils worldwide are degrading, raising concerns about our ability to feed the growing global population. Soil amendments that can alleviate degradation are gaining attention. The application of sediments dredged from waterways to agricultural fields has increasing promise as a means for improving degraded soils. However, herbaceous plant species may have difficulty establishing on dredged material because of low nutrient availability, inhibitory levels of toxins, unsuitable moisture conditions and lack of microorganisms capable of ameliorating these characteristics. To counteract these issues, we sought to understand if the use of a cover crop would increase the abundance, diversity and function …

Dairy Science and Food Science Faculty Publications: 2022 to Present
The objective of this retrospective observational study was to determine whether preweaning calf behaviors and milk replacer (MR) intake from an automatic calf feeder were associated with age at first calving and first-lactation performance. Calves were housed in groups with access to an automatic calf feeder for 7 wk with a maximum milk allowance of 1,800 g/d of MR (12 L/d). Outcomes of interest included age at first calving (n = 137), first-lactation mature-equivalent 305-d (ME305) milk yield (n = 132), and first-lactation ME305 energy-corrected milk (ECM) yield (n = 132). Linear models included the fixed effects of the daily …

Gone Fishing: Casting A Wide Net Using Geofence Warrants, Ryan Tursi
Washington Law Review
Technology companies across the country receive requests from law enforcement agencies for cell phone location information near the scenes of crimes. These requests rely on the traditional warrant process and are known as geofence warrants, or reverse location search warrants. By obtaining location information, law enforcement can identify potential suspects or persons of interest who were near the scene of a crime when they have no leads. But the use of this investigative technique is controversial, as it threatens to intrude upon the privacy of innocent bystanders who had the misfortune of being nearby when the crime took place. Innocent …

Angiotensin-converting enzyme (ACE) hydrolyzes N-acetyl-seryl-aspartyl-lysyl-proline (Ac-SDKP) into inactive fragments through its N-terminal site (ACE-N). We previously showed that Ac-SDKP mediates ACE inhibitors' cardiac effects. Whether increased bioavailability of endogenous Ac-SDKP caused by knocking out ACE-N also improves cardiac function in myocardial infarction (MI)-induced heart failure (HF) is unknown. Wild-type (WT) and ACE-N knockout (ACE-NKO) mice were subjected to MI by ligating the left anterior descending artery and treated with vehicle or Ac-SDKP (1.6 mg/kg/day, s.c.) for 5 weeks, after which echocardiography was performed and left ventricles (LV) were harvested for histology and molecular biology studies. ACE-NKO mice showed increased plasma …

Good water quality safeguards public health and provides economic benefits through recreational opportunities for people in urban and suburban environments. However, expanding impervious areas and poorly managed sanitary infrastructures result in elevated concentrations of fecal indicator bacteria and waterborne pathogens in adjacent waterways and increased waterborne illness risk. Watershed characteristics, such as urban land, are often associated with impaired microbial water quality. Within the proximity of the New York–New Jersey–Pennsylvania metropolitan area, the Musconetcong River has been listed in the Clean Water Act’s 303 (d) List of Water Quality-Limited Waters due to high concentrations of fecal indicator bacteria (FIB). The changes that have characterized advancements in anatomical sciences and medical education have significantly influenced pedagogies and the mode of delivery of teaching and training in the context of medical education. Another reality is the impact of educational technology (EdTech) penetration and integration into medical sciences and education. These events have undoubtedly influenced certain traditional practices and pedagogies including dissection. For example, EdTech and innovations have introduced virtual human images and three-dimensional (3D) human body representations for the purposes of teaching and dissection. Another instance includes the fact that the old dissection guides for gross anatomy, which follow the traditional …

Abstract: Edible insects are recognized as a potential alternative and sustainable source of high-quality protein for the human diet. Entomophagy is highly related to negative emotions that may cause reluctance to adopt insects as food in Western countries. During human interaction, a person's facial emotional expression (FEE) may influence other people's emotional responses. A person's emotional state may affect his/her food preference and food choice. Understanding how other people's FEE would affect consumers’ emotional profiles, liking, and subsequent willingness to try (WTT) and purchase intent (PI) toward insect-containing food products may help increase the acceptance of entomophagy. This study identified …

With increasing global demand for seafood, seafood byproducts (SB) utilization can contribute to a more sustainable food supply chain through waste-to-value food product development. However, consumer perceptions of SB (e.g., fish skin and bones) are underexplored. Therefore, this study aims to evaluate some factors influencing consumers’ willingness-to-try seafood byproducts. An online survey was conducted in the USA regarding intervention of SB informational cues with N = 904 adult seafood consumers internationally. The proportion of consumers willing to try SB increased significantly (McNemar’s test, α = 0.05) from 47% to 68% after SB safety and health claims had been presented in …

Coastal wetlands are rapidly disappearing worldwide due to a variety of processes, including climate change and flood control. The rate of loss in the Mississippi River Delta is among the highest in the world and billions of dollars have been allocated to build and restore coastal wetlands. A key question guiding assessment is whether created coastal salt marshes have similar biodiversity to preexisting, reference marshes. However, the numerous biodiversity metrics used to make these determinations are typically scale dependent and often conflicting. Here, we applied ecological theory to compare the diversity of different assemblages (surface and below-surface soil microbes, plants, …

North American sunfishes (Family Centrarchidae) are among the most popular sportfish throughout the United States and Canada. Despite the popularity of sunfishes, their ecological importance, and their extensive stocking and aquacultural history, few molecular studies have examined the evolutionary relationships and species boundaries among members of this group, many of which are known to hybridize. Here, we describe a chromosome-scale genome assembly representing Bluegill (Lepomis macrochirus), one of the most widespread centrarchid species. By combining long-read, Oxford Nanopore sequencing data with short-insert, whole-genome and HiC sequence reads, we produced an assembly (Lm_LA_1.1) having a total length of 889 Mb including …

Unhealthy Herds And The Predator–Spreader: Understanding When Predation Increases Disease Incidence And Prevalence, Robert L. Richards, Bret D. Elderd, Meghan A. Duffy

Disease ecologists now recognize the limitation behind examining host–parasite interactions in isolation: community members—especially predators—dramatically affect host–parasite dynamics. Although the initial paradigm was that predation should reduce disease in prey populations (“healthy herds hypothesis”), researchers have realized that predators sometimes increase disease in their prey. These “predator–spreaders” are now recognized as critical to disease dynamics, but empirical research on the topic remains fragmented. In a narrow sense, a “predator–spreader” would be defined as a predator that mechanically spreads parasites via feeding.
