U.S. politicians are actively “marketcrafting”: the passage of the Bipartisan Infrastructure Law, the CHIPS and Science Act, and the Inflation Reduction Act collectively mark a new moment of robust industrial policy. However, these policies are necessarily layered on top of decades of shareholder primacy in corporate governance, in which corporate and financial leaders have prioritized using corporate profits to increase the wealth of shareholders. The Administration and Congress have an opportunity to use industrial policy to encourage a broader reorientation of U.S. businesses away from extractive shareholder primacy and toward innovation and productivity. In A History of Securities Law in the Supreme Court, A.C. Pritchard and Robert B. Thompson write, “Securities law offers an illuminating window into the Supreme Court’s administrative law jurisprudence over the last century. Backchannel responses (Yngve, 1970) have always been an essential component of conversational interactions that facilitate speaker-listener engagement and mutual shaping of narratives (Bavelas et al., 2000). This study aims to investigate the cross-linguistic difference in backchannelling responses between Taiwan Mandarin and English (General American) second language (L2) learners, and how those differences might impact communication in a cross-cultural classroom. The current study examines 20 participants, ten each from Taiwan Mandarin speakers and American English speakers. A common belief during the early modern period held that humans bear ethical relations only to creatures with whom we share the right kinds of similarity. A tradition attributed to René Descartes holds speciesist and anthropocentric views according to which nonhuman animals are mere automata who lack rational minds. Even Baruch Spinoza, who was much more radical in his Ethics, suggests creaturely similarity is restricted to beings with rationality. As such, Descartes and Spinoza conclude that lower beings cannot be morally evaluated for their actions and humans cannot be morally evaluated for their treatment of lower creatures. In her sole …

The complex and beautiful relationship the people in Victorian England had to the bee is one that goes beyond ideas of politics and religion. This thesis will explore this relationship by utilizing print, ephemera, jewelry, and household items, to demonstrate how the representation and symbolism of the bee was recognized and cherished by Victorians. While bees did certainly have an intimate relationship to the areas of politics and religion, one that is acknowledged throughout this work, their connection to grander themes of introspection, industrialism, folklore, morality, and status helps us understand the Victorians on a deeper level.

Nutrient cycling in freshwater systems is primarily performed by microorganisms, however the interactions between microorganisms and other aquatic organisms such as macroinvertebrates is poorly understood. Interactions between macroinvertebrates and their associated microbial community, their microbiome, are important to understanding ecosystem functioning and guiding conservation efforts for imperiled macroinvertebrate species. In this study, I characterized the microbiomes of various freshwater macroinvertebrates and investigated the influence of sample storage methods and environmental parameters on these microbial communities. Following their defeat in the American Civil War, tens of thousands of American Southerners, many of them former Confederates, fled the United States to seek out new homelands in Latin America. Thousands would set their sights on Brazil, encouraged by the promise of arable land and the prospect of a new society in one of the hemisphere’s last slaveholding societies. Though many of these Confederados returned to the United States after Reconstruction, their influential presence in Brazil has remained a persistent factor. Extracellular vesicles (EVs) function as potent mediators of intercellular communication for many in vivo processes, contributing to both health and disease related conditions. Given their biological origins and diverse functionality from correspondingly unique "cargo" compositions, both endogenous and modified EVs are garnering attention as promising therapeutic modalities and vehicles for targeted therapeutic delivery applications. Their diversity in composition, however, has revealed a significant need for more comprehensive analytical-based characterization methods, and manufacturing processes that are consistent and scalable. Bill S-203, An Act to amend the Criminal Code and other Acts (ending the captivity of whales and dolphins) became Canadian law in 2019, banning the captivity of cetaceans. This Article critically examines Bill S-203, arguing that it is underpinned by anthropocentric and science-based justifications that will work as exclusionary forces against many animals in need of legal protection. Instead, the Article advocates for an empathetic and multi-jural approach that accounts for human-animal interconnectedness and the unique cultures of animals. This argument is theoretically rooted in vegan ecofeminism’s empathic and non-binaristic perspective. As such, this Article scrutinizes the reasoning behind …

Starting in the 1930s with the earliest version of the proxy rules, the Securities and Exchange Commission (SEC) has gradually increased the proportion of “instructed” votes on the shareholder’s proxy card until, for the first time in 2022, it required a fully instructed proxy card. This evolution effectively shifted the exercise of the shareholder’s vote from the shareholders’ meeting to the vote delegation that occurs when the share-holder fills out the proxy card. Today’s corporate governance debates are replete with discussion of how best to operationalize so-called stakeholder capitalism—that is, a version of capitalism that considers the interests of employees, communities, suppliers, and the environment alongside (if not before) a company’s shareholders. So much focus has been dedicated to the question of capitalism’s reform that few have questioned a key underlying premise of stakeholder capitalism: that is, that competitive capitalism does not serve these various constituencies and groups. The mounting focus on ESG has forced internal corporate decision-making into the spotlight. Investors are eager to support companies in innovative “green” technologies and scrutinize companies’ transition plans. Activists are targeting boards whose decisions appear too timid or insufficiently explained. Consumers and employees are incorporating companies sustainability credentials in their purchasing and employment decisions. These actors are asking companies for better information, higher quality reports, and granular data. In response, companies are producing lengthy sustainability reports, adopting ambitious purpose statements, and touting their sustainability credentials. Understandably, concerns about greenwashing and accountability abound, and policymakers are preparing for action.

The Marijuana Insurgency: Federalism And Social Reframing In Policy Reform, Matthew P. Cavedon

After fifty years of federal prohibition, marijuana reform efforts have won political and legal success. These victories hold lessons for anyone seeking to resist federal law without being able to directly affect it.
Victory can come from reframing an issue. For marijuana reform, social reframing—not formal legal analysis or material factors—provides the best explanation for how advocates achieved change. Their unconventional political tactics, akin to those used by insurgents in wartime, undercut federal prohibition by winning hearts and minds.
This is an analysis of the sociology of legal change. It is also the story of how ordinary Americans retook personal …

Clematis L. is one of many plant genera that contributes prominently to the species richness and endemism of the southeastern United States. Here we examined phylogenetic relationships among species in Clematis sect. Viorna, commonly known as leatherflowers, which are distributed primarily in the southeastern United States. We used data from restriction site-associated ddRADseq to reconstruct a best estimate phylogeny of this group. Our analyses revealed that the North American members of sect. Viorna form a well-supported clade, and several of the traditionally recognized infrasectional taxa were resolved as monophyletic. Environmental enrichment standards are set in many animal welfare laws, but such protections are generally withheld from farmed animals. Instead, farmed animals are subject to substandard enclosures that are under-stimulating and inappropriate for their species-specific behavioral needs. Scientific studies have shown that the inclusion of environmental enrichment in an animal’s enclosure balances their production of stress hormones, which has beneficial implications for the overall health and wellbeing of the animal. Establishing enclosure standards for farmed animals that include provisions relating to environmental enrichment would improve farmed animal well-being and, subsequently, the health of the humans who consume products deriving from …

For decades, long-tailed macaques have served an instrumental role in advancing biomedical research. However, due to the recent primate shortage in U.S. laboratories, these macaques have become coveted targets for poachers. In 2022, the International Union for Conservation of Nature (IUCN) elevated the long-tailed macaque’s threat level from “Vulnerable” to “Endangered,” citing research-related capture as a critical factor contributing to their decline. Under this new status, long-tailed macaques are at risk of being categorized under Appendix I of CITES, a designation that will subject them to stricter trade regulations. This Article posits that changes in U.S. laws and policies regarding animal experimentation depend on the recognition of animal sentience. Sentience—distinct from cognition and self-awareness—is the ability of an animal to experience pain, pleasure, and other emotions. First, this Article reviews the reasons animals are still used in biomedical research and the relevant characteristics of U.S. law. This is followed by a discussion of sentience and the concepts of cognition and self-awareness, and a discourse on societal interests. Under modern Supreme Court jurisprudence, the First Amendment ordinarily imposes no heightened standard of review upon neutral laws of general applicability that coincidentally burden the free exercise of religion. To relieve or minimize this burden, however, lawmakers are generally free to promulgate exemptions from, or accommodations to, such laws for the benefit of religious adherents. Such accommodations are common.
When a law is not neutral with respect to religion, or when the law is not generally applicable, then it will be subject to the exacting test of strict scrutiny to the extent that it burdens the free exercise of religion. …

Under current federal law, undocumented immigrants remain unable to access one of the most fundamental rights contained within our Constitution: the Second Amendment right to keep and bear arms. Several undocumented immigrants have challenged the constitutionality of the federal prohibition (18 U.S.C. § 922(g)(5)(A)), resulting in a three-way circuit split on whether undocumented immigrants are protected by the Second Amendment. The Supreme Court, however, has remained silent on the issue, leaving undocumented immigrants unprotected.

We live in the algorithmic society, characterized by massive digital surveillance and data collection by private companies exploiting human information vulnerabilities for profit. The infrastructure of free expression translates into an infrastructure of digital surveillance. This model, dubbed “surveillance capitalism,” includes massive personalized algorithmic targeting that departs from human speakers, allowing a level of influence never witnessed before in scale, scope, or depth.

Agricultural mechanics is a prominent topic in Georgia Agricultural Education, as it is the agricultural subject matter area with the second-largest enrollment across all school systems in the state. Georgia Elementary Agricultural Education (EAE) was formally introduced through the 2018 Senate Bill 330 (SB33); a two-part bill passed with unanimous support in both the House & the Senate. The first part of the bill included the three-component model of school-based agricultural education for high schools and middle schools which includes classroom/laboratory instruction, supervised agricultural experience, and leadership development through the National FFA Organization. Agriculture education programs in Georgia are held to the same standards and evaluations regardless of their location, resource availability, and student clientele. For schools with agriculture mechanics programs specifically, students are expected to obtain proficient skills in welding, electrical wiring, woodworking, small engines, concrete, and machinery. Students' are expected to obtain skill sets in these various content areas, yet the equipment and resources available to the educator differs among schools. Traditional stream fish sampling methods, such as seining and electrofishing, are time consuming, expensive, and limited to short stretches of stream. However, the analysis of environmental DNA (eDNA) from water samples promises to be a quick, inexpensive method for detecting fish. The streams of the Land Between the Lakes Recreational Area (LBL) are unique, undisturbed streams which contain many interesting fish species for which little information exists. This dissertation explores the influence that Agriculture Education programs, at all levels, have on student choice of careers in production agriculture. The average age of a farmer in the United States is increasing, and the shortage of young people returning to family farming operations (or beginning operations of their own) becomes more apparent each year. This study utilizes focus groups of professionals to gather information about the factors that influence student choice in agriculture careers, and the ability of agriculture education programs to either enhance or mitigate those factors.
