Legislative Discouragement Of Maine's Marine Industrial Growth, John H. Pursel May 2025

Legislative Discouragement Of Maine's Marine Industrial Growth, John H. Pursel

Maine Law Review

At common law the public rights to navigation and fishing could not be alienated by the King. Dry land and the land beneath the sea could be alienated but only so long as the public rights to navigation and fishing were preserved. This common law doctrine was rejected in 1842 by the United States Supreme Court as binding precedent for limiting the alienation of the public domain by the legislatures of the various states. In Martin v. Wadell the Court reasoned that this common law principle was not applicable because the people of the United States through their act of …

Conservation, Policy And The Role Of Counsel, David J. Halperin May 2025

Conservation, Policy And The Role Of Counsel, David J. Halperin

Maine Law Review

The conservation interests in the State of Maine have been roused to a furor by the decision of Maine's highest court in State v. Johnson. The case, in substance, holds that Maine's Wetlands Act is unconstitutional when applied to prohibit the filling of a specific segment of salt water marsh. While both the decision and the underlying statute are of considerable substantive interest, the case deserves particular study for the light it sheds on the role of counsel in helping the legal process accommodate new policy concerns. A note of caution must, of course, be sounded before seeking to generalize …

De Novo Juries, Misdemeanor Counsel, And Other Problems: Changes Ahead For The Maine District Courts?, Pierce B. Hasler

Maine Law Review

The Maine judicial system has two levels of criminal courts, the superior court having exclusive trial jurisdiction over felony prosecutions and the district court operating with concurrent trial jurisdiction for misdemeanors. The district court also processes the preliminary phases of felony cases; included in this function are bail hearings, initial appearances (arraignments), and preliminary hearings. To provide jury trials in misdemeanor prosecutions state law permits all district court convictions to be appealed to the superior court for trial de novo to a jury. The accepted reason for unlimited de novo trials is that the state constitution requires a jury in …

Mesoderm-Specific Transcript Has A Role In The Systemic Regulation Of Obesity, Maria J. Orellana Rosales May 2025

Mesoderm-Specific Transcript Has A Role In The Systemic Regulation Of Obesity, Maria J. Orellana Rosales

Thinking Matters Symposium

Mesoderm specific transcript (Mest) expression in white adipose tissue (WAT) is variable in genetically identical mice. Previous studies have shown a connection between Mest high expression and propensity for fat mass expansion. WAT and liver crosstalk has been well documented with hormone-like peptides signaling and regulating important metabolic pathways. The aim of this study is to investigate the correlation between these circulating factors and Mest expression in mice after exposure to a high fat diet (HFD). A group of 120 C57B6/J mice, males and females, were exposed to a HFD (Western Diet, 40 kcal% fat) for 4 weeks (8-12 weeks …

Doctor of Education Program Dissertations

All people, including individuals with disabilities, who participate in hands-on visual art can experience various benefits. However, visual studio art teachers, especially museum-based teachers, have various backgrounds that do not always include education or training in serving individuals with disabilities. The purpose of this qualitative phenomenological study was to explore how museum-based visual studio art teachers perceived that their training and preparation informed their awareness of ableism and ability to serve students with disabilities in art museums in the New England region of the United States. Twelve museum-based, visual studio art teachers participated in this study through semi-structured interviews. Through …

Maximum Entropy Production And Constructal Law: Variable Conductance And Branched Flow, Phillip Johnson May 2025

Maximum Entropy Production And Constructal Law: Variable Conductance And Branched Flow, Phillip Johnson

Seatific Journal

Within the scope of modern thermodynamics, several new principles have been advanced. Yet a coherent picture has not yet fully emerged beyond classical thermodynamics, in part because of the disparate nature of these principles. This work analyzes two such principles, that of maximum entropy production and also the constructal law. These ideas are compared in two examples scenarios, atmospheric convection and riverbed generation. It is shown that both ideas utilized a flow network with variable conductivity, particularly that of a branched system. Comparison is made to show underlying shared principles.

Freedom And Evolution In Science, Adrian Bejan

Seatific Journal

This article is about evolutionary design and freedom and is based on my new book, Freedom and Evolution: Hierarchy in Nature, Society and Science [1]. There is a lot to say about this broad subject, therefore I’ve reduced it to the topics of thermodynamics, freedom and evolution, diversity and hierarchy, and science and freedom. First, I will present the terminology, which will be followed by the applications of the evolution of cooling technology for high-density heat-generating components in a packet. Finally, I will show why this book is important for you, the reader, as well as for the practitioner.

The Dynamics Of Human Society Evolution: An Energetics Approach, Ram Chandra Poudel, Jon G. Mcgowan May 2025

The Dynamics Of Human Society Evolution: An Energetics Approach, Ram Chandra Poudel, Jon G. Mcgowan

Seatific Journal

Human society is an open system that evolves by coupling with various known and unknown (energy) fluxes. How do these dynamics unfold precisely? Energetics may provide further insights. We expand on Navier-Stokes’ approach to study non-equilibrium dynamics in a field that evolves over time. Based on social fi eld th eory, an induction of th e cl assical fie ld theories, we define social force, social energy, and the Hamiltonian of an individual in society. The equations for the evolution of an individual and society are sketched out based on the time-dependent Hamiltonian that includes power dynamics. We demonstrate in …

Demography Of Alligator Snapping Turtles (Macrochelys Temminckii) Along A Fishing Pressure Gradient, Luke T. Micek

Electronic Theses and Dissertations

Passive fishing gear is a threat to the alligator snapping turtle (Macrochelys temminckii). The spatio-temporal persistence of this threat and its impacts on M. temminckii populations has not been quantified. I quantified the density of passive fishing gear and the demographic parameters of M. temminckii along a fishing pressure gradient in East Texas streams. Most gear was abandoned and illegally deployed, with densities varying seasonally. Detectability of passive fishing gear declined with increasing gear age, water depth, and volume, but increased with increasing precipitation. Macrochelys temminckii catch per unit effort, abundance, and survival was lower at sites with …

Thresholds, Dagon Blank May 2025

Thresholds, Dagon Blank

Electronic Theses and Dissertations

Thresholds focuses on liminal spaces, moments of change, and those who cross these boundaries. For instance, transitions from the old to the new, unconscious to conscious, the known to the unknown, or where man meets nature. Sometimes, I think of them as a threshold where both sides are trying to cross simultaneously, but the door is only big enough for one to fit. The scenes in these paintings focus on the figure set in the contemporary world, referencing symbols of classical paintings, mythology, and philosophy.

The scenes are dynamic and driven by the expressiveness of the human figure and the …

Faculty Research 2025

Fragile X Syndrome (FXS) is a common cause of autism spectrum symptoms. The genetic mutation results in multiple molecular alterations that are hypothesized to negatively impact neural circuit development although the nature of any functional neural dynamic consequences remain unclear. Therefore, the characteristics of hippocampal-prefrontal (H-PFC) network dysfunction were investigated in a rat model of FXS. FMR-KO and control rats underwent behavioral tests assessing sociability, memory, and anxiety to validate and replicate previously recognized deficits. Single-unit electrophysiology in the H-PFC circuit during exploration was used to measure patterns of action potential firing that were then compared between groups using generalized …

A Subset Of Senescent Myofibroblasts Orchestrates Immunosuppression In Pancreatic Cancer., Jad Belle May 2025

A Subset Of Senescent Myofibroblasts Orchestrates Immunosuppression In Pancreatic Cancer., Jad Belle

Arts & Sciences Graduate Student Theses and Dissertations

Pancreatic Ductal Adenocarcinoma (PDAC) is the most lethal solid malignancy with a 12% 5-year survival rate. Most tumors are detected at metastatic stages that are extremely resistant to therapy. PDAC recalcitrance is driven by a unique tumor microenvironment (TME) comprising dense collagenous fibrosis embedded with an abundance of cancer associated fibroblasts (CAFs) and infiltrating leukocytes. Preclinical studies have indicated that PDAC CAFs can have both pro- and anti-tumorigenic effects. This is likely owed to CAF phenotypic heterogeneity which was recently uncovered by single cell transcriptomics. Three major CAF subpopulations have been identified in mouse and human PDAC thus far: myofibroblastic …

An Intervention To Empower People To Confront Sexism, Rebecca Grace Drake May 2025

An Intervention To Empower People To Confront Sexism, Rebecca Grace Drake

Arts & Sciences Graduate Student Theses and Dissertations

Even though sexist comments and behavior occur frequently in everyday life, people do not often confront the individuals who are responsible. However, interpersonal bias confrontations can be powerful tools for reducing expressions of bias and norm setting. The current studies tested an intervention designed to increase confrontations by harnessing theory and research on what holds people back from confronting. We designed a half-hour intervention consisting of engaging and evidence-based videos on confronting bias and self-reflection exercises to increase personal relevance. The module aimed to boost confronting by intervening at multiple points of the decision-making process by increasing recognition of sexism, …

Circuit-Specific Vulnerability In A Mouse Model Of Alzheimer's Disease, Samuel Brunwasser May 2025

Circuit-Specific Vulnerability In A Mouse Model Of Alzheimer's Disease, Samuel Brunwasser

Arts & Sciences Graduate Student Theses and Dissertations

The relationship between brainwide functional decline and accumulation of pathological protein aggregates in Alzheimer’s disease (AD) is complex and not well understood. A set of highly interconnected cortical regions known as the Default Mode Network (DMN) exhibits selective vulnerability to both functional decline and amyloid beta (Aβ) plaques in early AD. One possibility is that early Aβ accumulation in the DMN drives vulnerability. However, it is unknown whether there is something intrinsic to neuronal projections within the DMN that biases these circuits towards dysfunction. In this dissertation, I describe the development of a multisite in vivo electrophysiology pipeline for chronic …

Depalmitoylation Regulates Metabolism And Mitochondrial Function, Sarah Lilly Speck May 2025

Depalmitoylation Regulates Metabolism And Mitochondrial Function, Sarah Lilly Speck

Arts & Sciences Graduate Student Theses and Dissertations

Tens of millions of Americans suffer from metabolic disorders, predisposing patients to cardiovascular disease, kidney disease, liver disease, infertility, and cancer. Unfortunately, the etiology of many of these diseases remains a mystery, limiting our ability to identify targets for pharmacologic therapies. Due to the relationship between altered lipid dynamics and metabolic dysfunction, we decided to study the effect of the posttranslational lipid modification, S-palmitoylation, on metabolism. S-palmitoylation is the only known reversible lipid modification for proteins, and this depalmitoylation process is catalyzed by acyl-protein thioesterases including APT1 and APT2. We hypothesized that APT deficiency in various tissues would predispose mammals …

Parapinopsin: A Photoswitchable Inhibitory Gpcr For Two-Photon Optogenetics, Bobbie J. Brown May 2025

Parapinopsin: A Photoswitchable Inhibitory Gpcr For Two-Photon Optogenetics, Bobbie J. Brown

Arts & Sciences Graduate Student Theses and Dissertations

The development of optogenetic tools has greatly advanced the capability of researchers to understand the connection between neuronal activity and behavior. Optogenetics makes use of opsins, which are light activated ion-channels, ion pumps, or G-Protein coupled receptor (GPCR-based) proteins used to regulate cellular activity. Coupled with technological advances in genetics and optical physics/microscopy, optogenetics can be used to control specific populations of cells in a time-locked, spatially specific manner. The experiments possible with optogenetics depend largely on the capabilities and limitations of the opsin used; thus, there have been continuous efforts to design and employ new opsins with a variety …

Parental Guidance Suggested: Genetic, Epigenetic, And Environmental Factors Shape Allele-Specific Gene Regulation In Metabolic Traits, Celine Louise St. Pierre May 2025

Parental Guidance Suggested: Genetic, Epigenetic, And Environmental Factors Shape Allele-Specific Gene Regulation In Metabolic Traits, Celine Louise St. Pierre

Arts & Sciences Graduate Student Theses and Dissertations

Deciphering the “genotype to phenotype” map is a crucial goal of biology. We will not improve our ability to predict phenotypes from DNA sequences until we better incorporate epigenetic and environmental variation into our models of human health and disease. Genes are typically presumed to express both parental alleles equally, but genetic and epigenetic factors can cause one allele to function differently than the other (e.g. expressed or silenced more). These allele-specific imbalances can alter the final composition of a gene’s transcriptional product and ultimately shape phenotypes. Allele-specific effects have widespread impacts on complex traits, but how environmental signals contribute …
