Arbitration Overcorrection? Interpreting Arbitration Clauses After Morgan V. Sundance, Peter Constable Alter

In 2022’s Morgan v. Sundance, Inc., the Supreme Court ruled that the Federal Arbitration Act (FAA) does not allow courts to “devise novel rules to favor arbitration over litigation.” Applying that principle, the Court held that the Eighth Circuit erred by grafting an arbitration-specific prejudice requirement onto the generally applicable waiver standard when deciding whether a defendant waived its right to arbitrate by proceeding in court. The Supreme Court traced this error to a misunderstanding of the FAA’s core purpose. The purpose of this study was to identify the current state of artificial intelligence (AI) policies in U.S. education and propose actionable recommendations through large language model–based topic modeling and Delphi surveys. Out of 12 policy documents released between 2015 and 2025, only two documents (National Center for Learning Disabilities, 2024; W.A. v. Clarksville/Montgomery County School System, 2024) specifically addressed learning disabilities. Policy documents addressing topics such as AI-driven risk assessment, data protection, legal risk management, and ethical guidelines covering other disabilities and general AI in education policy were provided as baselines that could be discussed and validated through …

Teacher Agency: Finding Spaces To Transform Ela Classrooms, Kathryn Mitchell Pierce, Carol Gilles, Sarah D. Reid

Amid ongoing attacks on teachers and their professionalism, we studied three middle school ELA teachers who exercised their agency to transform their classrooms and curricula through social justice pedagogy (SJP). Using Pantić's (2017) model, we examined their sense of purpose, competence, autonomy, and reflexivity in confronting barriers. This multiple-case study drew on interviews, focus group transcripts, artifacts, and responses to our analysis of their reported beliefs regarding their agency about dialogic talk in literature discussions as part of SJP. We found that teachers' agency, dialogic talk, literature discussions, and SJP were deeply interwoven. Teachers valued dialogic talk in literature discussions …

Rural adolescents approach the transition out of high school with individual concerns about making an emotionally or financially expensive “mistake,” family concerns about young people leaving home, and national and local concerns about declining rural economies and out-migration. The literature concerning this topic considers factors that influence youth aspirations in rural areas, such as economic barriers, the way higher education is valued, and perceptions of rural places as lacking in opportunity. Nutrition epidemiological models involve many analytic decisions, such as defining exposures, selecting which covariates to include, or configuring variables in different ways. We explored the impact of analytical decisions on conclusions in nutrition epidemiology using self-reported beef intake and incident coronary heart disease as a case study. We used REasons for Geographic and Racial Differences in Stroke (REGARDS) data, and selected covariates and their configurations from published literature to recapitulate common models used to assess associations between meat intake and health outcomes. The essentiality of protein in the human diet is unequivocal. Yet researchers, clinicians, and lay people often believe numerous propositions about dietary protein despite insufficient supporting or refuting data in some instances. To address this disconnect, and to "pressure-test" current beliefs about dietary protein, the Indiana University School of Public Health-Bloomington convened a workshop in February 2025 titled "Human Dietary Protein Needs and Benefits: A Critical Assessment of Postulated Propositions." Background: The relationship between abdominal fat depots and cardiometabolic risk among youth is inconclusive due to the cross-sectional nature of existing studies and limitations in assessment methods. In this study, we examined cross-sectional and longitudinal associations of subcutaneous adipose tissue (SAT) and visceral adipose tissue (VAT) with cardiometabolic risk indicators among Mexican adolescents.

Methods: Participants (n = 169 at baseline and 134 at follow-up) were assessed for diastolic or systolic blood pressure (DBP or SBP), total cholesterol (TC), high-density lipoprotein cholesterol (HDL-C), low-density lipoprotein cholesterol (LDL-C), triglycerides, glucose, and insulin. Death By Discretion: Executive Power And The Arbitrary Machinery Of Federal Capital Punishment, Reem Haikal

This Article argues that the federal death penalty is not merely at risk of being cruel; it is increasingly at risk of becoming arbitrary and lawless. Despite the procedural safeguards embedded in the Federal Death Penalty Act (FDPA), executive practices have reintroduced many of the same constitutional flaws that the Supreme Court identified in Furman v. Georgia. Through detailed analysis of the FDPA’s structure, this Article shows that the statute fails to meaningfully constrain the Attorney General’s charging discretion, allowing life-and-death decisions to hinge on opaque and often politicized processes. For many decades, titanium implants have achieved a remarkably high success rate. However, there are cases in which osseointegration does not occur as predicted or desired. In these cases, an analysis of the factors that led to the implant failure must be conducted. There are multiple, widely accepted potential causes of such implant failures. Tilapia is commonly integrated with vegetables in aquaponics systems, where complex microbial interactions may have important implications for food safety. This scoping review examines the current evidence on the microbiota diversity of tilapia reared in aquaponics systems, analyzes its potential influence on food safety, and highlight direction for future research. The agricultural landscape in Rivers State, Nigeria, is increasingly threatened by the dual challenges of escalating flooding events and return migration. Historically, flooding in the region has shifted from isolated incidents to a persistent and widespread hazard, significantly disrupting agricultural livelihoods and rural stability. This study assessed the effects of flooding-induced migration on the food security status of farming households in Nigeria. Modeling of intraday fluctuation in future climate parameters. This study uses ARIMA and LSTM models to evaluate and examine the prediction accuracy of four main meteorological parameters (solar irradiance, temperature, relative humidity, and wind speed) that have an impact on perovskite solar modules using Chad as an example. The findings show that the use of averaged climatic data considerably obscures the effects of intraday fluctuation, which significantly increases power output volatility and speeds up degradation. Increasing short-term temperature extremes may further jeopardize system reliability, according to projections under future climate scenarios. Cardiovascular-kidney-metabolic (CKM) syndrome integrates excess adiposity, metabolic dysfunction, kidney impairment, subclinical cardiovascular diseases, and clinical events along a staged continuum that invites unified prevention and treatment. Ultra-processed foods (UPFs) are a complex, high-prevalence exposure that may influence risk across CKM stages through nutrient profiles, additives, processing-induced compounds, and packaging-related contaminants. This review synthesizes epidemiologic, mechanistic, and translational evidence with attention to exposure definition and analytic rigor. We summarize NOVA-based UPF operationalization across dietary assessment tools, highlighting misclassification of mixed dishes, brand heterogeneity, and energy under-reporting, and we propose further examination of energy-adjusted models, calibration, and harmonized metrics. Micro- and nanoplastics (MNPs) are pervasive in food-contact environments and the human diet, positioning the gastrointestinal (GI) tract as the primary portal of entry and a plausible site of early biological effects. Human exposure is supported by detection of microplastics in stool and colon tissue, and emerging clinical studies report associations between fecal microplastic burden and GI disease states, including inflammatory bowel disease (IBD) and colorectal cancer (CRC). Preclinical studies provide mechanistic plausibility, reporting that ingested MNPs can modulate microbial ecology, alter mucus membrane integrity, increase intestinal permeability through changes in cellular tight junction biology, and induce inflammatory gene expression. …

Micro- and nanoplastics (MNPs) are pervasive environmental contaminants with growing recognition as potential contributors to human disease. Widespread human exposure occurs primarily through ingestion of contaminated food and water, and MNPs have been detected in multiple human tissues, including the gastrointestinal tract. Experimental evidence provides a plausible biological basis for disease associations, including impairment of intestinal barrier integrity, activation of mucosal immune pathways, and alteration of gut microbial communities caused by MNP exposure. Although human data remain limited, early studies demonstrate MNP detection in stool and suggest potential correlations with inflammatory biomarkers such as fecal calprotectin. Even as repeated crises have left ordinary savers wiped out, regulation has shown itself to be woefully absent as a means of mitigating risks ex ante or helping cover the cost of damage ex post. Disgorgement is the U.S. Securities and Exchange Commission’s (SEC) most powerful enforcement tool and among its most controversial. For decades, federal courts treated disgorgement in securities enforcement actions as an equitable remedy, a view that the U.S. Supreme Court confirmed in Liu v. SEC. Months after Liu, Congress passed the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021, which codified disgorgement in SEC enforcement actions. Background/purpose: Metastasis is the leading cause of treatment failure in oral squamous cell carcinoma (OSCC). This study investigated the role of C-X-C motif chemokine ligand 13 (CXCL13) in OSCC metastasis and the underlying signaling mechanism.

Materials and methods: Integrative transcriptomic analysis was performed using three independent OSCC datasets to identify metastasis-associated genes. Background/purpose: Substantial evidence demonstrates that diabetes is associated with periodontal disease. The purpose of this study was to analyze the scientometric characteristics and research trends of diabetes-associated periodontal disease (DAPD).

Materials and methods: All the papers on DAPD were comprehensively retrieved from the Scopus database. The years of publication were divided into before 2019 and after 2019 in the analysis of research trends.

As a fundamental physiological process, sleep is essential for maintaining systemic homeostasis. Although sleep restriction (SR) has been shown to trigger a systemic inflammatory response, its specific impact on local pulpal inflammation remains poorly understood. In this preliminary study, we investigated the effects of SR on the inflammatory response and reparative capacity of dental pulp in a rat model. Immunohistochemistry and western blotting revealed that, even in intact pulp tissue, SR upregulated the expression of interleukin-6, increased the infiltration of neutrophils, and activated the nuclear factor-kappa B signaling pathway.
