It’S Gone To The Dogs: The Need For Regulation In Professional Service Dog Training, Crystal J. Elsner Jan 2026

It’S Gone To The Dogs: The Need For Regulation In Professional Service Dog Training, Crystal J. Elsner

Dickinson Law Review (2017-Present)

Currently, no state requires professional service dog trainers to pass any test or obtain any occupational licensure to prove their competency. While the Americans with Disabilities Act and its implementing regulations do not require that dogs complete a professional training program to be considered service dogs, many individuals with disabilities choose to use such programs. The unregulated nature of the industry allows inexperienced individuals to market themselves as professionals, which can harm not only the dogs receiving training but also the humans that will eventually take them home. Further, the lack of industry oversight leaves room for bad actors to …

Advocating For Cause: The California Recall Process Needs A Purpose, Mary-Beth Moylan Jan 2026

Advocating For Cause: The California Recall Process Needs A Purpose, Mary-Beth Moylan

Dickinson Law Review (2017-Present)

Democratic systems and the tools that sustain them need to operate by the people and for the people with consideration to the realities of the era in which they exist. The use of direct democracy, and in particular the recall process, in recent decades suggests that what was once a progressive reform intended to ensure good government has now become a political tool for stoking partisan disruption. It is time for a close look at how and why some states continue to allow for recall and the circumstances under which a recall election should be called. During the COVID-19 pandemic, …

Administrative Self-Constitutionalism, Brian Lipshutz Jan 2026

Administrative Self-Constitutionalism, Brian Lipshutz

Public Law and Legal Theory Working Papers

Since the days of the Interstate Commerce Commission, federal agencies have generally refused to address the constitutionality of statutory provisions. They have offered little reasoning to justify that refusal, yet scholars have generally accepted it. This Article explains why agencies can—and should—address constitutional challenges to statutory provisions.

Agencies have the power to assess the constitutionality of statutory provisions. They already exercise a similar authority when they apply the canon of constitutional avoidance and consider the constitutionality of individual actions. There is no basis for stopping short of addressing challenges to statutes. And many scholars have recognized that, as a formal …

Characterization Of The Genetic Diversity Of Curlyleaf Pondweed (Potamogeton Crispus L.) In The Contiguous United States And Canada And Analysis Of Possible Hybrid Potamogeton Crispus Lineages, Mallory M. Kaiser

All Graduate Theses, Dissertations, and Other Capstone Projects

Curlyleaf Pondweed (Potamogeton crispus L.) is a prolific invasive species that has spread across the United States and into parts of Canada since its introduction to North America in the 1840s. It causes extensive economic and environmental damage across its invasive range, and its control and eradication are of utmost importance to agricultural, ecological, recreational, and transportational stakeholders. Developments in molecular ecology and invasive management have found that genetic diversity and hybridization of aquatic macrophytes may affect their susceptibility to herbicide treatments, and genotype or lineage identification are important control variables that must be considered in field and …

Evaluating Soil And Plant Health In A Wide-Row Maize (Zea Mays L.) Production System Integrated With Perennial Cover Crops And Turkey (Meleagris Gallopavo), Sovika Bhattarai

All Graduate Theses, Dissertations, and Other Capstone Projects

In regions dominated by intensive maize (Zea mays L.) production systems, such as the US Midwest, sustainable agricultural practices such as cover crops and livestock integration are gaining interest for their potential to improve soil, plant, and environmental health. Traditionally, annual cover cropping systems (ACCs) have been used to maintain soil quality and crop performance without compromising ecosystem services. However, the high establishment and management costs of ACCs highlight the need for alternative approaches, such as perennial cover crops (PCCs). Grown as companion crops with maize, PCCs provide extended soil cover and can improve soil biochemical properties (e.g., total C …

An Examination Of Potential Mechanisms Underlying Muscle Memory, Santiago González-Quintero Jan 2026

An Examination Of Potential Mechanisms Underlying Muscle Memory, Santiago González-Quintero

Theses & ETDs

"Muscle memory is generally understood as the mechanism that supports the execution of a motor task during retraining following an initial period of both training and detraining. It can be found in the central nervous system where commands are being sent to accomplish a motor task; however, evidence exists for another type of memory within the myofiber itself. Through the analysis of data from animal and human exercise studies, this thesis examines the notion of muscle memory at different locations proximal to and/or within muscle, including the evidence for and feasibility of myonuclear permanence as a mechanism underlying muscle memory. …

Eat My Love:Finding Truth In Fairytales Through Filmmaking, Calypso Camacho Jan 2026

Eat My Love:Finding Truth In Fairytales Through Filmmaking, Calypso Camacho

Theses & ETDs

This thesis is both a creative project and a critical investigation into the dissolving boundary between art shaping life and life shaping art in filmmaking. The creative project at its center is EAT MY LOVE, a short film adaptation of the Russian folk tale The Maiden Tsar (Царь-Девица). It is a fairytale set in the modern world that uses elements of surrealism and magical realism, and unexpectedly became a camouflaged documentary. Paralleling EAT MY LOVE’s storytelling rhythm, this thesis is divided into three segments: pre-production, production, and post-production. Each segment documents the corresponding step in the filmmaking process and explores …

Climate Change As A Security Interest: A Novel Defense In Fossil Fuel Investment Arbitration, Nabil Kapasi Jan 2026

Climate Change As A Security Interest: A Novel Defense In Fossil Fuel Investment Arbitration, Nabil Kapasi

Chicago Journal of International Law

Thousands of international investment and trade agreements contain provisions protecting investments made by parties from the signatory states. One such provision is Investor-State Dispute Settlement (ISDS), a mechanism allowing foreign investors to sue host states in arbitration for treaty violations. Fossil fuel investors are increasingly utilizing ISDS successfully to hold states liable for climate action; arbitral tribunals are awarding large compensations to these investors when states deny them permits for upstream activities or enact phase-out policies attempting to ban fossil fuel consumption. These awards impose heavy burdens on states while simultaneously deterring climate action by creating fears of liability. This …

Retention Time Of Microplastics In The Purple Sea Urchin (Arbacia Punctulata), Alexandra Shore Jan 2026

Retention Time Of Microplastics In The Purple Sea Urchin (Arbacia Punctulata), Alexandra Shore

Honors Theses and Capstones

Marine ecosystems around the world are facing the problem of plastic pollution. Large pieces of plastic eventually degrade into smaller microplastics that are suspended in the water column and sink to the seabed. Sea urchins are exposed to microplastics as they graze on the sea floor and can accidentally consume these pollutants. Sea urchins are ecologically important animals because they physically alter their ecosystem via grazing and are integral part of marine food webs. To better understand how sea urchins interact with microplastics, purple sea urchins were exposed to microfibers and microspheres in a laboratory setting, and the retention time …

From Sacred Practice To Social Identity: The Historical Evolution Of Vegetarianism Through Religion, Psychology, And Social Norms, Makenna Mae Seymour Jan 2026

From Sacred Practice To Social Identity: The Historical Evolution Of Vegetarianism Through Religion, Psychology, And Social Norms, Makenna Mae Seymour

Honors Theses – Charlotte Campus

This research paper aims to explore how the vegetarian diet has evolved throughout history through lenses of religion and social psychology. Using primary and secondary academic resources, over thirty resources were evaluated, including books and journal articles,  using key words, such as “vegetarian,” “attitudes,” and “social norms.” The beginnings of vegetarianism were established through religious practices, but social norms from families and friends, as well as personal gain reasons, are the driving factors that have maintained the vegetarian diet over time. Vegetarianism began from Pythagoras and his cult in the 600s BC, but it grew once Hinduism and Jainism adopted …

Memoir: The Brain, Neuroethics, And Bioethics, Leslie C. Griffin Jan 2026

Memoir: The Brain, Neuroethics, And Bioethics, Leslie C. Griffin

Scholarly Works

This Essay examines how developments in neuroscience (or brain science) affect our views of law, medicine, ethics, and religion. Part I shows how lack of clarity about brain death can lead to premature organ donation. Part II argues that health care too often provides inadequate brain care and incomplete rehabilitation. Part III explains why recovery may be possible for those braininjured patients who are told it is not. Part IV demonstrates how the fear of a brain-injured patient oddly affects my perspective on Tort and Criminal Law, which are being influenced by neuroscientific advances. Part V examines the new developments …

The project incorporated elements of Scottish heritage and environmental significance through visual motifs and design. Featured flavors were inspired by major cities located along the River Tay, reinforcing the geographic and cultural connection. Plaid patterns, nature-inspired graphics, and imagery of an otter; an animal …

From Property To Personhood: Reimagining Nature's Place In The Legal Order, Lan Cao Jan 2026

From Property To Personhood: Reimagining Nature's Place In The Legal Order, Lan Cao

William & Mary Environmental Law and Policy Review

This Article explores the emerging rights of nature movement as a radical departure from traditional environmental approaches, grounded in a “new consciousness” that challenges the anthropocentric world-view. The Article sets the stage for a defense of the rights of nature by providing a comprehensive critique of the current model of economic development, primarily focused on GDP, which has proven detrimental to environmental health by neglecting broader values; the Article also highlights alternative measures adopted by entities like the UN and EU that incorporate factors like happiness. Rights of nature builds upon that foundation for a broader understanding of development and …

A Green Supply Chain Or A Greenwashed Ad Campaign? Supply Chains, Environmental Marketing, And The Energy Transition, Meredith A. Wegener

William & Mary Environmental Law and Policy Review

Building upon prior research and scholarship, this Article is a study into supply chain environmental marketing, the Federal Trade Commission, and the evaluation of potential changes to the Green Guides under the umbrella of the global energy transition. While prior legal scholarship has addressed details of environmental marketing such as fashion, recycling, or agricultural practices, this Article brings this work forward and addresses the collective challenge the global supply chain creates for all environmental claims across industries in truthful environmental marketing.

What is truth-in-advertising in environmental marketing, given the global path of consumer products? In Part I of this Article, …

The Wanton-Lyman-Hazard Collection: Reanalysis Of A Legacy Collection, Emily E. Henderson

ENG 490 Senior Seminar Capstone

Constructed in 1697, the Wanton-Lyman-Hazard House is one of the oldest remaining structures on Aquidneck Island. Archaeological excavation by Salve Regina University in the early 2000's uncovered 300+ years of material culture associated with the site, but these artifacts have since been subject to few and incomplete analyses. While discussing discrepancies in these earlier analyses of this site, ongoing research creates a collections management system for these artifacts and evaluates their potential to inform a variety of other research avenues in the future.

Creating A Modern American Piano: Antecedent, Launch, And Reinvention Of Mason & Hamlin's Piano Line Through 1905, Arian Sheets Jan 2026

Creating A Modern American Piano: Antecedent, Launch, And Reinvention Of Mason & Hamlin's Piano Line Through 1905, Arian Sheets

Dissertations and Theses

The American piano industry was in a significant period of technical innovation, increased production, and standardization during the second half of the nineteenth century. This resulted in the American form of the instrument dominating the design and sound ideals still expected of the modern piano. Mason & Hamlin, a major reed organ company, entered the piano market in the early 1880s, relatively late compared to the largest, and most market-dominant companies, such as Steinway and Chickering. This thesis examines the origin and early implementation of the designs and innovations that have become standard for the modern American piano, and how …

Eldad And Medad’S Effusive And Momentous Worlds: A Diachronic View, David J. Zucker Jan 2026

Eldad And Medad’S Effusive And Momentous Worlds: A Diachronic View, David J. Zucker

The Asbury Journal

In Numbers 11, Eldad and Medad, two of the seventy chosen elders of the people of Israel remain in camp, while their counterparts join Moses at the Tent of Meeting. At the Tent, God takes some of the divine spirit that is on Moses and puts it on the elders, who then speak in ecstasy (others: prophesy, have a vision). Suddenly and simultaneously Eldad and Medad also speak in ecstasy (others: prophesy, have a vision). This article addresses how the text has been received and interpreted in the postbiblical world, largely in rabbinic writings, but also in religiously based homilies …
