Contractual Depth, Cathy Hwang, Matthew Jennejohn Feb 2022

Contractual Depth, Cathy Hwang, Matthew Jennejohn

Minnesota Law Review Vols. 106:2 onward (2021-present)

Who is the intended audience of a contract? A court, who may be called upon to resolve a dispute, is one audience. Another is commercial communities, who punish breach with reputational sanctions, per the longstanding literature on informal enforcement. This Article shows how modern contracts have more intended audiences than courts and communities: instead, they are drafted with many third parties in mind, including regulators. When contracts speak to many audiences, they gain multiple layers of meaning, giving them “contractual depth.” This Article draws upon a series of novel interviews with dealmakers—law firm partners, general counsel, and executives—in a wide …

Preemption & Gender & Racial (In)Equity: Why State Tort Law Is Needed In The Cosmetic Context, Marie C. Boyd Feb 2022

Preemption & Gender & Racial (In)Equity: Why State Tort Law Is Needed In The Cosmetic Context, Marie C. Boyd

Faculty Publications

Much of the legal scholarship on the preemption of state tort law in the food and drug context and beyond has focused on issues of federalism. While the literature has considered the relationship between state tort law and the regulatory system, it has not generally explored the impact the federal preemption of state tort law may have on women and people of color. Similarly, while the literature has grappled with gender and racial justice issues in the tort system, including in the context of tort reform, it has largely not examined the gender and racial equity issues raised by federal …

A Novel Treatment Of Postpartum Depression And Review Of Literature., Jennifer Yoon, Jason Gu Md, Katherine B. Martin Md

Department of Psychiatry

Early-onset postpartum depression has been shown to have a unique neurobiological basis compared to major depressive disorder, implying a need for targeted treatments such as the recent Food and Drug Administration (FDA)-approved brexanolone. In this case report, a woman with a past medical history of major depressive disorder was diagnosed with postpartum depression due to worsening mood with suicidal and homicidal ideations. She was treated with vilazodone and aripiprazole with good effect after consideration of her past medication trials. Her regimen is unique in clinical practice and not reported in current literature for the treatment of postpartum depression. It may …

Assessment Of Protection Offered By The Nrf2 Pathway Against Hyperoxia-Induced Acute Lung Injury In Nrf2 Knockout Rats, Said H. Audi, Elizabeth R. Jacobs, Taheri Pardis, Swetha Ganesh, Anne V. Clough Feb 2022

Assessment Of Protection Offered By The Nrf2 Pathway Against Hyperoxia-Induced Acute Lung Injury In Nrf2 Knockout Rats, Said H. Audi, Elizabeth R. Jacobs, Taheri Pardis, Swetha Ganesh, Anne V. Clough

Biomedical Engineering Faculty Research and Publications

Nuclear factor erythroid 2-related factor (Nrf2) is a redox-sensitive transcription factor that responds to oxidative stress by activating expressions of key antioxidant and cytoprotective enzymes via the Nrf2-antioxidant response element (ARE) signaling pathway. Our objective was to characterize hyperoxia-induced acute lung injury (HALI) in Nrf2 knock-out (KO) rats to elucidate the role of this pathway in HALI. Adult Nrf2 wildtype (WT), and KO rats were exposed to room air (normoxia) or >95% O2 (hyperoxia) for 48 h, after which selected injury and functional endpoints were measured in vivo and ex vivo. Results demonstrate that the Nrf2-ARE signaling pathway …

Comparative Analysis Between Saudi Arabia And Norway In Moving Beyond Fossil Fuels Towards A Sustainable Economy: A Special Emphasis On The Renewable Energy Sector, Saad Nasser Alqahtani Feb 2022

Comparative Analysis Between Saudi Arabia And Norway In Moving Beyond Fossil Fuels Towards A Sustainable Economy: A Special Emphasis On The Renewable Energy Sector, Saad Nasser Alqahtani

Dissertations & Theses

Saudi Arabia is the largest economy in the Middle East and the 18th largest in the world. The country has the world's second-largest proven petroleum reserves and is the largest exporter of petroleum. In 2016, Saudi Arabia had the third highest estimated value of natural resources at $34.4 trillion (US). However, because of the 2014 oil crash, climate change, and the development of renewable energy technology, the government has decided to transition from its complete reliance on oil revenues and to start investing heavily in other non-oil sectors, such as the renewable energy sector. The Saudi government plans to generate …

RNAi is an evolutionarily fluid mechanism with dramatically different activities across animal phyla. One major group where there has been little investigation is annelid worms. Here, the small RNAs of the polychaete developmental model Capitella teleta are profiled across development. As is seen with nearly all animals, nearly 200 microRNAs were found with 58 high-confidence novel species. Greater miRNA diversity was associated with later stages consistent with differentiation of tissues. Outside miRNA, a distinct composition of other small RNA pathways was found. Unlike many invertebrates, an endogenous siRNA pathway was not observed, indicating pathway loss relative to basal planarians. No …

The objective of the study was to evaluate the effect of a low-cost solar collector to pre-heat ventilation air in commercial broiler buildings on supplemental heating demand and air quality during the cold season. Six black fabric-based solar collectors of 36 m(2) each were installed on the south-facing rooftop of a broiler house. The solar collectors provided fresh warm air into the house during the ON cycle of minimum ventilation and during the OFF cycle of minimum ventilation when the temperature under the collectors met certain criteria. The daily cumulative duration of solar collectors in operation averaged 125 and 133 …

Alfred Russel Wallace Notes 19: Social Evolution's Useful Idiots, Charles H. Smith Feb 2022

Alfred Russel Wallace Notes 19: Social Evolution's Useful Idiots, Charles H. Smith

Faculty/Staff Personal Papers

In today’s world liberals look at conservatives as the villains, and vice versa. How did this come to pass? In this essay a model of the biological roots of liberalism and conservatism is advanced; this is followed by a discussion of why cognitive dissonance may represent the key process in our social evolution. Alfred Russel Wallace’s experience with cognitive dissonance is then detailed, including how he dealt with it.

Sex‐related differences in mortality are widespread in the animal kingdom. Although studies have shown that sex determination systems might drive lifespan evolution, sex chromosome influence on aging rates have not been investigated so far, likely due to an apparent lack of demographic data from clades including both XY (with heterogametic males) and ZW (heterogametic females) systems. Taking advantage of a unique collection of capture–recapture datasets in amphibians, a vertebrate group where XY and ZW systems have repeatedly evolved over the past 200 million years, we examined whether sex heterogamy can predict sex differences in aging rates and lifespans. We showed …

Raising Corporate Consciousness Of Employer Liability For Video Zoom While Driving, Nanci K. Carr Feb 2022

Raising Corporate Consciousness Of Employer Liability For Video Zoom While Driving, Nanci K. Carr

William & Mary Business Law Review

Imagine that you have logged onto a video Zoom meeting, and you notice that one of the participants is driving. He fumbles with the phone, trying to align the camera with his face, looking from the phone to the road ahead. Other participants on the call either say nothing or thank him for being willing to participate from his car. That is distracted driving, and if he collides with a car or pedestrian due to that distraction, each of those meeting participants could be held liable for distracting the driver. In addition, they would be witnesses to his distracted driving …

Emergency Bylaws: An Underutilized Tool For Corporate Operation During An Emergency, Grace Myers Feb 2022

Emergency Bylaws: An Underutilized Tool For Corporate Operation During An Emergency, Grace Myers

William & Mary Business Law Review

Emergency bylaws are an underutilized tool for corporate governance whose importance has been highlighted by COVID-19. Emergency bylaws can be included within corporations’ bylaws and only operate during an “emergency” as defined by state statutes. These provisions usually give boards more agency to act during an emergency through mechanisms such as looser quorum and notice requirements. These provisions will be increasingly important during future pandemics, wars, and global warming. However, few corporations have these bylaws, and the current hodgepodge of state statutes hinders their adoption. The current state of emergency bylaws regulation and implementation raises some questions about shareholder rights …

Old Macdonald Had A Trust: How Market Consolidation In The Agricultural Industry, Spurred On By A Lack Of Antitrust Law Enforcement, Is Destroying Small Agricultural Producers, Cody Mccracken

William & Mary Business Law Review

The U.S. agricultural industry is controlled by a handful of large corporations. Unprecedented levels of market consolidation has created a power disparity, where controlling corporations alone shape markets, often to the disadvantage of small agricultural producers. A primary, and often overlooked, cause of this consolidationdriven bargaining disadvantage, and its resulting harm, can be found in the lacking enforcement of the nation’s antitrust laws. Faulty metrics and lax legal interpretations employed by regulatory agencies have permitted large corporations to grab control of nearly every sector of the industry. From the seeds farmers plant to the markets they sell their goods into; …

The Shimmering Cathedral: Extraordinary Spiritual Experiences And The Meaning We Make Of Them, Seth Daniel Jones Feb 2022

The Shimmering Cathedral: Extraordinary Spiritual Experiences And The Meaning We Make Of Them, Seth Daniel Jones

Doctor of Ministry

This project portfolio presents the formational work for a book about Extraordinary Spiritual Experiences (ESEs). The project seeks to create a spiritual cartography which helps guide clergy, professionals, interested persons, and experiencers as they navigate ESEs and the subsequent process of making meaning from such experiences, particularly in the context of Christian faith, but by no means limited to it. By way of a novel exploration of the structure of an ESE event and stories from scripture, it is hoped that pathways for creating a safe space to share ESEs in group settings will blossom. In the context of the …

The World Health Organization has identified antibiotic resistance as one of the largest threats to human health and food security. In this study, we compared antibiotic resistance patterns between ESBL-producing Escherichia coli from human clinical diseases and cefotaxime-resistant environmental strains, as well as their potential to be pathogenic. Antibiotic susceptibility was tested amongst clinical isolates (n = 11), hospital wastewater (n = 22), and urban wastewater (n = 36, both influent and treated effluents). Multi-drug resistance predominated (>70%) among hospitalwastewater and urban wastewater influent isolates. Interestingly, isolates from clinical and urban treated effluents showed similar multi-drug …

Glomerular Biomechanical Stress And Lipid Mediators During Cellular Changes Leading To Chronic Kidney Disease, Mukut Sharma, Vikas Singh, Ram Sharma, Arnav Koul, Ellen T. Mccarthy, Virginia J. Savin, Trupti Joshi, Tarak Srivastava

Biomedical Sciences

Hyperfiltration is an important underlying cause of glomerular dysfunction associated with several systemic and intrinsic glomerular conditions leading to chronic kidney disease (CKD). These include obesity, diabetes, hypertension, focal segmental glomerulosclerosis (FSGS), congenital abnormalities and reduced renal mass (low nephron number). Hyperfiltration-associated biomechanical forces directly impact the cell membrane, generating tensile and fluid flow shear stresses in multiple segments of the nephron. Ongoing research suggests these biomechanical forces as the initial mediators of hyperfiltration-induced deterioration of podocyte structure and function leading to their detachment and irreplaceable loss from the glomerular filtration barrier. Membrane lipid-derived polyunsaturated fatty acids (PUFA) and their …

Association Of Endothelin-I And A Symmetric Dimethylarginine Levels With Insulin Resistance In Type-2 Diabetes Mellitus Patients, Sara Muhammed Khidhir, Almas. Mr Mahmud, Ismail M. Maulood

Baghdad Science Journal

Endothelin-I (ET-I) is one of the potent vasoconstrictors secreted from endothelial cells when needed. Many studies revealed the elevation of serum ET-I with human diabetes and microangiopathies. Since insulin resistance is a case of mixed diabetic and pre-diabetic cases, many risk factors beyond obesity and inflammation are proposed. The current study aims to demonstrate the association between serum ET-I and asymmetric dimethylarginine (ADMA) and insulin resistance in type 2 diabetes mellitus (T2DM). Sera of 73 subjects were enrolled currently (control= 35 subjects, and 38 with T2DM for more than 7 years), aged (40-60) years old, with distinct body mass index …

During their journey, these two men forge an unexpected bond as they grapple with the brutal past and strive for a hopeful future. An inventive and engrossing tale of American identity, immigration, and the ties that bind.

Novel Strategies For Glutamate Clearance In The Glia-Deprived Synaptic Hub Of C. Elegans, Joyce Chan Feb 2022

Novel Strategies For Glutamate Clearance In The Glia-Deprived Synaptic Hub Of C. Elegans, Joyce Chan

Dissertations, Theses, and Capstone Projects

As the major excitatory neurotransmitter in the mammalian brain, Glutamate (Glu) is critical for normal neuronal physiology. Disruption in Glu clearance results in hyper-stimulation of glutamatergic circuits, potentially leading to excitotoxic neurodegeneration. The canonical model of brain connectivity describes glutamatergic synapses as well insulated and enveloped by glia. These glia express Glu Transporters (GluTs) which work to clear Glu following synaptic activity. However, critical areas of the brain such as the mammalian hippocampus display poor synaptic isolation, which may result in Glu spillover between adjacent synapses and subsequent loss of circuit specificity. How accurate signal transmission is achieved in these …

Molecular Mechanisms Of Microrna-1205 In Aggressive Prostate Cancer, Michelle K. Naidoo Feb 2022

Molecular Mechanisms Of Microrna-1205 In Aggressive Prostate Cancer, Michelle K. Naidoo

Dissertations, Theses, and Capstone Projects

Prostate cancer (PCa) is one of the most commonly diagnosed cancers among men in the United States. High mortality rates of PCa are associated with metastatic castration-resistant prostate cancer (mCRPC) due to the maintenance of androgen receptor (AR) signaling despite androgen deprivation therapies (ADTs). Resistance to second generation ADTs leads to the progression of AR-independent treatment related-neuroendocrine PCa (t-NEPC), which is observed in nearly 1 in 5 men with mCRPC and is associated with very poor outcomes. The 8q24 chromosomal locus is a region of very high PCa susceptibility that carries genetic variants associated with PCa aggressiveness. Located at this …

This dissertation consists of three chapters that cover topics on development macroeconomics.

Chapter 1 - Misallocation of Resources and Total Factor Productivity: Evidence from Mexico. This paper aims to measure the gross output loss due to misallocation of resources in the manufacturing and service sectors in Mexico during 2008-2018 and identify the inputs of production related to it. To do so, I use Mexican Economic Censuses and an extension of Hsieh and Klenow (2009). I also include resource misallocation computations using data processed with a Bayesian model for editing and imputing data to correct for measurement error (MEC data), which …

Belowground Mechanism Reveals Climate Change Impacts On Invasive Clonal Plant Establishment, Surendra Bam, Jacqueline P. Ott, Jack L. Butler, Lan Xu

Natural Resource Management Faculty Publications

Climate change and disturbance can alter invasion success of clonal plants by differentially affecting the clonal traits influencing their establishment as young plants. Clonal traits related to the vegetative reproduction of native Pascopyrum smithii and non-native Bromus inermis grass seedlings were evaluated under altered precipitation frequencies and a single grazing event. Pascopyrum smithii maintained similar vegetative reproduction under three simulated precipitation frequencies whereas B. inermis vegetative reproduction declined as precipitation became more intermittent. Vegetative reproduction of the non-native B. inermis was greater than the native P. smithii under all simulated precipitation frequencies except the most intermittent scenario. A single grazing …
