What’S In A Name? How Nations Define Terrorism Ten Years After 9/11, Sudha Setty Jan 2011

What’S In A Name? How Nations Define Terrorism Ten Years After 9/11, Sudha Setty

Faculty Scholarship

Ten years after the attacks of September 11, 2001, it almost goes without saying that the acts of grotesque violence committed on that day have had enormous effects on national security law and policy worldwide. To be labeled a terrorist, or to be accused of involvement in an act of terrorism, carries far more severe repercussions now than it did ten years ago. This is true under international law and under domestic law in nations that have dealt with serious national security concerns for many years.

Given the U.N.’s global mandate to combat terrorism and that being defined as a …

Selling "Dream Insurance" : The Standardized Test-Preparation Industry's Search For Legitimacy, 1946-1989, Keegan Shepherd

Electronic Theses and Dissertations

This thesis analyzes the origins, growth, and legitimization of the standardized test preparation ("test-prep") industry from the late 1940s to the end of the 1980s. In particular, this thesis focuses on the development of Stanley H. Kaplan Education Centers, Ltd. ("Kaplan") and The Princeton Review ("TPR"), and how these companies were most conducive in making the test-prep industry and standardized test-preparation itself socially acceptable. The standardized test most frequently discussed in this thesis is the Scholastic Aptitude Test ("SAT"), especially after its development came under the control of Educational Testing Service ("ETS"), but due attention is also given to the …

Alliance Management Of Post-Cold War Us-Israeli Relations, Wun Liong Chau Jan 2011

Alliance Management Of Post-Cold War Us-Israeli Relations, Wun Liong Chau

Lingnan Theses

There is always a controversial debate on why the US-Israeli relationship can enjoy lengthy endurance (even after the end of the Cold War). Scholars have traditionally offered explanations through either the strategic role of Israel to the US, or domestic factors including the Jewish lobbies in the US, or the cultural affinities between the two states. However, they tend to emphasize the significance of only one particular dimension, marginalizing possible insights from competitive dimensions.

This research aims to offer a different approach to study US-Israeli relations through alliance management theories. Although there are no formal military treaties between the US …

American Muslim Minorities: The New Human Rights Struggle, Ashley Moore Jan 2011

American Muslim Minorities: The New Human Rights Struggle, Ashley Moore

Human Rights & Human Welfare

The ramifications of the attacks of September 11, 2001 are felt throughout the United States. However, no minority community is as deeply affected as the American-Muslim minority. Since the attacks on the World Trade Center, Muslims residing in the United States have experienced violations of economic and political liberties, as well as ongoing social discrimination. Media stereotypes and government legislation continually exacerbate these human rights abuses and entrench institutional, social, and economic discrimination deeper in American society. At the heart of this discrimination are clear misunderstandings about Islam and those who practice the faith. In an effort to combat these …

Estimation Of Short-Term Tag-Induced Mortality In Horseshoe Crabs Limulus Polyphemus, Jennifer Mattei, Mark Beekey, H. R. Potter, C. S. Bond, Alyssa Woronik, J. A. Roberts, K. A. Smith

Biology Faculty Publications

Horseshoe crabs Limulus Polyphemus range along the East Coast of the United States and over 150,000 of them have been marked with U.S. Fish and Wildlife Service disk tags. It has been assumed that the tags do not harm the animals and are similar to common epibionts often found on the shells of the horseshoe crabs. We investigated whether newlv tagged adult female horseshoe crabs would exhibit higher short-term mortality rates than untagged adult females. All crabs were collected from a beach in Connecticut and then were transported to a laboratory for the experiment. Tagging involved drilling a small hole …

An increasing number of serodiscordant couples are utilizing advanced reproductive technologies to address their reproductive needs. Recent literature has demonstrated that it is not only technically possible but also safe to utilize sperm-washing techniques to allow for the creation of embryos, thereby preventing both horizontal and vertical transmission of HIV. This article addresses the strengths and weakness of various reproductive techniques and discusses our experience at Columbia University (NY, USA), the location of the largest HIV-focused fertility program in the USA.

The United States And The International Criminal Court Post-Bush: A Beautiful Courtship But An Unlikely Marriage, Megan A. Fairlie Jan 2011

The United States And The International Criminal Court Post-Bush: A Beautiful Courtship But An Unlikely Marriage, Megan A. Fairlie

Faculty Publications

The article focuses on the relationship status between the U.S. and the International Criminal Court (ICC) from being dormant due to being renewed. The renewal was evident from the U.S. representation at the 2009 ICC's Assembly of States Parties annual meeting and the 2010 ICC Review Conference. Using the Rome Statute, the ICC has been granted subject matter jurisdiction over war crimes, crimes against humanity and genocide.

International Law And The U.S. Common Law Of Foreign Official Immunity, Curtis A. Bradley, Laurence R. Helfer Jan 2011

International Law And The U.S. Common Law Of Foreign Official Immunity, Curtis A. Bradley, Laurence R. Helfer

Faculty Scholarship

In Samantar v. Yousuf, 130 S. Ct. 2278 (2010), the U.S. Supreme Court unanimously held that the Foreign Sovereign Immunities Act does not apply to lawsuits brought against foreign government officials for alleged human rights abuses. The Court did not necessarily clear the way for future human rights litigation against such officials, however, cautioning that such suits “may still be barred by foreign sovereign immunity under the common law.” At the same time, the Court provided only minimal guidance as to the content and scope of common law immunity. Especially striking was the Court’s omission of any mention of the …

Professional associations of clergy have invoked the ministerial exception to claim immunity from the antitrust laws. In claiming immunity, these clergy feel entitled to construct cartel-like arrangements that, absent such immunity, would violate section 1 of the Sherman Act, 15 U.S.C. § 1 (2006). The question presented in this case characterizes the ministerial exception as a bar to most “employment-related lawsuits brought against religious organizations by employees performing religious functions.” Such a characterization leaves open the possibility that “religious organizations” could include professional associations of clergy, in addition to churches, religious schools, or other employers of clergy, and “employment-related lawsuits” …

A Cooperative Conundrum? The Naalc And Mexican Migrant Workers In The United States, Robert Russo

All Faculty Publications

Since its adoption in 1993 at the insistence of U.S. President Bill Clinton's administration, the labor side accords to the North American Free Trade Agreement (NAFTA) have been extensively examined, occasionally ridiculed, and often dismissed as irrelevant. Most analysis tends to focus on the disappointing results of the North American Agreement on Labor Cooperation (NAALC) in affecting meaningful changes in the conditions of workers in Mexico. In this article, I aim to take a different approach. My analysis focuses instead primarily on the efficacy of the NAALC process when complaints are made about alleged labor law violations in the United …

Biodefense And Constitutional Constraints, Laura K. Donohue Jan 2011

Biodefense And Constitutional Constraints, Laura K. Donohue

Georgetown Law Faculty Publications and Other Works

The United States and United Kingdom have different approaches to quarantine law that reflect each country’s unique historical context and constitutional structure. Under the Tudors, England vested quarantine authority in the monarch, with its subsequent exercise conducted by the military. As the constitutional structure changed, the manner in which quarantine was given effect subtly shifted, leading to constitutional reforms. Authorities transferred first to the Privy Council and, subsequently, to Parliament, where commercial interests successfully lobbied them out of existence. By the end of the 19th Century, quarantine authorities had been pushed down to the local port authorities. In the United …

[Introduction To] America's War: Talking About The Civil War And Emancipation On Their 150th Anniversaries, Edward L. Ayers

Edited by Edward L. Ayers, America’s War is an anthology of Civil War writing originally published between 1852 and 2008. Co-published by the American Library Association and the National Endowment for the Humanities, America’s War was created in support of a national reading and discussion program for libraries called “Let’s Talk About It: Making Sense of the American Civil War.”

The selections in America’s War include works of historical fiction and interpretation, speeches, diaries, memoirs, biographies, and short stories. Together, these readings provide a glimpse of the vast sweep and profound breadth of Americans’ war among and against themselves, adding …

[Introduction To] In Uncertain Times: American Foreign Policy After The Berlin Wall And 9/11, Melvyn P. Leffler, Jeffrey W. Legro Jan 2011

[Introduction To] In Uncertain Times: American Foreign Policy After The Berlin Wall And 9/11, Melvyn P. Leffler, Jeffrey W. Legro

Bookshelf

In Uncertain Times considers how policymakers react to dramatic developments on the world stage. Few expected the Berlin Wall to come down in November 1989; no one anticipated the devastating attacks on the World Trade Center and the Pentagon in September 2001. American foreign policy had to adjust quickly to an international arena that was completely transformed.

Melvyn P. Leffler and Jeffrey W. Legro have assembled an illustrious roster of officials from the George H. W. Bush, Clinton, and George W. Bush administrations—Robert B. Zoellick, Paul Wolfowitz, Eric S. Edelman, Walter B. Slocombe, and Philip Zelikow. These policymakers describe how …

Economics Of U.S. Government Debt Accumulation, Carlos Ignacio Garcia Jimenez Jan 2011

Economics Of U.S. Government Debt Accumulation, Carlos Ignacio Garcia Jimenez

LSU Doctoral Dissertations

The United States of America is an indebted nation in the early years of the new millennium, changing from $469 billion in 1973 to $14 trillion in 2010, as spending is justified on the basis that it promotes GDP growth which in turn increases societal benefits. Despite the benefits of debt, its effectiveness and the transmission mechanisms of fiscal policy are still on debate. Consequently, the economic effects of U.S. government debt accumulation are studied in three empirical research articles.

The dissertation is composed of five chapters. The first chapter is an introduction wherein the problem statement, the purpose, objectives …
