What Climate Change Means For Latin America, Paul Isbell Jan 2011

What Climate Change Means For Latin America, Paul Isbell

Latin American Energy Dialogue, White Papers and Reports

This article discusses how even though Latin America contributes to only 10% of the world's annual greenhouse gas emissions, the region is vulnerable to the environmental and geopolitical consequences of climate change. The energy matrix in Latin America and the region's carbon emissions are explored.

On Equality: The Anti-Interference Principle, Donald J. Kochan Jan 2011

On Equality: The Anti-Interference Principle, Donald J. Kochan

University of Richmond Law Review

This essay seeks to summarize the general equality concept and proposes that equality requires that the government engage in anti-interference with individual choices and activities, so long as these things create no negative externalities for others. If we are serious about respecting equality, such interference actions should be avoided. Adopting an "anti-interference principle" is a necessary foundation for achieving the goal of true equality. The primary point is that equality matters. The purpose of this essay is not to survey the vast political, jurisprudential, and academic debate on equality, but instead, to take a broad look at the philosophical concept …

The Loophole That Would Not Die: A Case Study In The Difficulty Of Greening The Internal Revenue Code, Lawrence A. Zelenak Jan 2011

The Loophole That Would Not Die: A Case Study In The Difficulty Of Greening The Internal Revenue Code, Lawrence A. Zelenak

Faculty Scholarship

Congress and the Treasury have commissioned the National Academy of Sciences (NAS) “to undertake a comprehensive review of the Internal Revenue Code of 1986 to identify the types of and specific tax provisions that have the largest effects on carbon and other greenhouse gas emissions and to estimate the magnitude of those effects.” The hope of the proponents of the NAS carbon audit is that Congress, once informed of the results of the audit, will respond by “greening” the Internal Revenue Code. This Essay cautions that a more environmentally friendly Code will not necessarily follow from the legislative consciousness-raising of …

Hermenêutica Americana Feia / Ugly American Hermeneutics, Francis J. Mootz Iii Jan 2011

Hermenêutica Americana Feia / Ugly American Hermeneutics, Francis J. Mootz Iii

McGeorge School of Law Scholarly Articles

This article is part of a Symposium that provides a forum for comparing legal herme-neutics as articulated by four scholars from the United States and four scholars from Brazil. The article embraces this cross-cultural event by asking whether American legal hermeneutics is “ugly” and is practiced by “ugly Americans.” The pejorative cast of this terminology is obvious and intentional, but it is also ambiguous and multi-layered. The Essay unfolds various dimensions of ugly American hermeneutics and suggests that - ugly though they may be -American scholars still can make some important contribu-tions to the worldwide conversation regarding legal hermeneutics. It …

The Macondo Well Blowout: Taking The Outer Continental Shelf Lands Act Seriously, John J. Costonis Jan 2011

The Macondo Well Blowout: Taking The Outer Continental Shelf Lands Act Seriously, John J. Costonis

Journal Articles

Choice of law issues in marine pollution events engage federal admiralty/general maritime law, federal environmental legislation and the reserved powers of the states to protect their natural resources and economic welfare. Admiralty and general maritime law enjoyed center stage throughout the first two thirds of the last century. Federal marine pollution statutes were few and weak, and state initiatives were typically deemed preempted in all but the so-called “marine but local” cases. The equilibrium began to shift in favor of state police powers and federal environmental values in the mid-1960’s in consequence of the Supreme Court’s solicitude for the former, …

Reconstituting Land Use Federalism To Address Transitory And Perpetual Disasters: The Bimodal Federalism Framework, Blake Hudson Jan 2011

Reconstituting Land Use Federalism To Address Transitory And Perpetual Disasters: The Bimodal Federalism Framework, Blake Hudson

Journal Articles

Scholars analyzing the intersection of federalism and disaster law and policy have primarily focused on the difficulties federalism poses for interjurisdictional coordination of disaster response. Though scholars have highlighted that rising disaster risks and costs are associated with “land-use planning that exacerbates, rather than mitigates, disaster risk,” a more holistic analysis of land-use-related disaster law and policy is needed. This Article provides a more comprehensive framework within which to analyze prospective mitigation or prevention of disaster risk and costs through a rebalancing - or reconstituting - of the respective roles of the federal and state governments in land-use planning. The …

Commerce In The Commons: A Unified Theory Of Natural Capital Regulation Under The Commerce Clause, Blake Hudson Jan 2011

Commerce In The Commons: A Unified Theory Of Natural Capital Regulation Under The Commerce Clause, Blake Hudson

Journal Articles

Scholars continue to debate the scope of Congress’s Commerce Clause authority and whether fluctuations in the U.S. Supreme Court’s Commerce Clause jurisprudence place federal environmental regulatory authority at risk. Yet when one analyzes major Commerce Clause cases involving resource regulation since the beginning of the modern regulatory state, a consistent theme emerges: both the Supreme Court and Circuit Courts of Appeal have consistently upheld federal authority to regulate depletable natural resources, the appropriation of which is non-excludable - key characteristics of a commons. Commerce Clause jurisprudence can be interpreted as treating appropriation of this natural capital, here described as “privatized …

The Improper Dismissal Of Title Vii Claims On "Jurisdictional" Exhaustion Grounds: How Federal Courts Require That Allegations Be Presented To An Agency Without The Resources To Consider Them, Katherine Macfarlane Jan 2011

The Improper Dismissal Of Title Vii Claims On "Jurisdictional" Exhaustion Grounds: How Federal Courts Require That Allegations Be Presented To An Agency Without The Resources To Consider Them, Katherine Macfarlane

Journal Articles

Title VII of the Civil Rights Act of 1964 represents a watershed moment in American history. With Title VII's passage, Congress acknowledged the need to “back” the civil rights movement with “federal legislative power.” Title VII was meant to eliminate practices that inhibit employment opportunity equality. Beyond eliminating those practices, Title VII was also designed to assure equality of employment opportunities and to eliminate conduct that “fostered racially stratified job environments to the disadvantage of minority citizens.” This Title renders unlawful the refusal or failure to hire or “otherwise to discriminate against any individual with respect to his compensation, terms, …

Heat Waves Measured With Modis Land Surface Temperature Data Predict Changes In Avian Community Structure, Thomas P. Albright, Anna M. Pidgeon, Chadwick D. Rittenhouse, Murray K. Clayton, Curtis H. Flather, Patrick D. Culbert, Volker C. Radeloff

United States Department of Agriculture, Forest Service / University of Nebraska-Lincoln: Faculty Publications

Heat waves are expected to become more frequent and severe as climate changes, with unknown consequences for biodiversity. We sought to identify ecologically-relevant broad-scale indicators of heat waves based on MODIS land surface temperature (LST) and interpolated air temperature data and assess their associations with avian community structure. Specifically, we asked which data source, time periods, and heat wave indices best predicted changes in avian abundance and species richness. Using mixed effects models, we analyzed associations between these indices and data from the North American Breeding Bird Survey in the central United States between 2000 and 2007 in four ecoregions …

Ixodes Affinis (Acari: Ixodidae) In Southeastern Virginia And Implications For The Spread Of Borrelia Burgdorferi, The Agent Of Lyme Disease, Robyn M. Nadolny, Chelsea L. Wright, Wayne L. Hynes, Daniel E. Sonenshine, Holly Gaff

Biological Sciences Faculty Publications

Ixodes affinis Neumann is a hard-bodied (ixodid) tick known to be a competent vector for Borrelia burgdorferi, the agent of Lyme disease, and agents of other human diseases (Keirans et al. 1999). Ixodes affinis has been reported in Florida, Georgia, and South Carolina and throughout coastal North Carolina (Clark et al. 1998, Harrison et al. 2010). Harrison et al. (2010) indicated that I. affinis was established throughout the coastal plain of North Carolina up to the Virginia border and suggested that I. affinis might occur in Virginia.

Foreword: Rulemaking, Democracy, And Torrents Of E-Mail, Nina A. Mendelson Jan 2011

Foreword: Rulemaking, Democracy, And Torrents Of E-Mail, Nina A. Mendelson

Articles

This Foreword is meant as an initial foray into the question of what agencies should do with mass public comments, particularly on broad questions of policy. Part I discusses the extent to which congressional control, presidential control, and agency procedures themselves can ensure that agency decisions are democratically responsive. In view of shortcomings in both congressional and presidential control, I underscore the need to focus closely on rulemaking procedures as a source of democratic responsiveness. The possibility that agencies may be systematically discounting certain public submissions raises difficulties, and I present some examples. Part II makes a preliminary case that …

Reemployment Under Userra Sections 4312 & 4313: At Will Employment Vs. Temporary Employment, Richard L. Pate Jan 2011

Reemployment Under Userra Sections 4312 & 4313: At Will Employment Vs. Temporary Employment, Richard L. Pate

WCBT Faculty Publications

As thousands of service members return to the U.S., severe economic conditions render acclimation to civilian life especially difficult. In 2010, as the combat mission in Iraq approached an end, the unemployment rate of Iraq and Afghanistan era veterans had reached 13.1 percent. The Uniform Services Employment and Reemployment Rights Act, 38 U.S.C. §§ 4301-4333 (1994) ("USERRA"), was enacted, in great part, to mitigate harms such as those caused by the aforementioned perfect storm. Among other things, USERRA protects service members by entitling them to reemployment after military service. More specifically, USERRA Sections 4312 & 4313 entitle returning service members …

The Effect Of Consumers And Mutualists Of Vaccinium Membranaceum At Mount St. Helens: Dependence On Successional Context, Suann Yang, Eelke Jongejans, Sylvia Yang, John G. Bishop Jan 2011

The Effect Of Consumers And Mutualists Of Vaccinium Membranaceum At Mount St. Helens: Dependence On Successional Context, Suann Yang, Eelke Jongejans, Sylvia Yang, John G. Bishop

Biology

In contrast to secondary succession, studies of terrestrial primary succession largely ignore the role of biotic interactions, other than plant facilitation and competition, despite the expectation that simplified interaction webs and propagule-dependent demographics may amplify the effects of consumers and mutualists. We investigated whether successional context determined the impact of consumers and mutualists by quantifying their effects on reproduction by the shrub Vaccinium membranaceum in primary and secondary successional sites at Mount St. Helens (Washington, USA), and used simulations to explore the effects of these interactions on colonization. Species interactions differed substantially between sites, and the combined effect of consumers …
