Crow Indian Tribe V. United States, Hallee Kansman Dec 2018

Crow Indian Tribe V. United States, Hallee Kansman

Public Land & Resources Law Review

The protection status of the Greater Yellowstone grizzly bear continues to elicit debate and find its way into the courtroom. In Crow Indian Tribe v. United States, for the second time in the last decade, a court held the Service’s attempt to delist the Yellowstone Grizzly arbitrary and capricious. Specifically, the court found the Service’s evaluation of remnant populations, recalibration, and genetic health deficient. This case demonstrates the importance in and the resilient motivation behind preserving grizzly bear populations and genetics. As the practice of delisting a species under the Endangered Species Act continues, this case will provide important …

Geologic Map And Structural Development Of The Noerthernmost Sur-Nacimiento Fault Zone, Central California Coast, Scott M. Johnston, John S. Singleton, Alan D. Chapman, Gabriella Murray Dec 2018

Geologic Map And Structural Development Of The Noerthernmost Sur-Nacimiento Fault Zone, Central California Coast, Scott M. Johnston, John S. Singleton, Alan D. Chapman, Gabriella Murray

Physics

The Sur-Nacimiento fault exposed along the central California coast (United States) juxtaposes the Salinian block arc against the Nacimiento block accretionary complex, cuts out the majority of the forearc basin and western arc, and requires a minimum of 150 km of orogen-normal crustal excision within the Mesozoic California convergent margin. Despite this significant strain, the kinematic evolution of the Sur-Nacimiento fault remains poorly understood, with diverse hypotheses suggesting sinistral, dextral, thrust, or normal displacement along the fault. This Late Cretaceous–Paleogene strain history is complicated by the location of the fault within a belt of subparallel faults that have accommodated significant …

Dui Courts: The Need For Standardized Dui Court Evaluations, Howard Cameron Dec 2018

Dui Courts: The Need For Standardized Dui Court Evaluations, Howard Cameron

Justice

There have been numerous evaluations of driving under the influence (DUI) treatment courts. The evaluation process and tools vary widely. This research project reviewed seven individual courts' evaluations, including process evaluations and outcome evaluations to determine the strength of each court's evaluation. The research goal was to better understand how these courts are evaluated, the strength of those evaluation processes, and to determine what, if any, changes can and should be made to strengthen them. Presently, there are not any standardized evaluations tools for DUI treatment courts. This research concludes that evaluations should be standardized and such standardization will allow …

Precision Of Provider Licensure Data For Mapping Member Accessibility To Medicaid Managed Care Provider Networks, Nathaniel Bell, Ana Lòpez-Defede, Rebecca Wilkerson, Kathy Mayfield-Smith

Faculty Publications

BACKGROUND:

In July 2018, the Centers for Medicare and Medicaid Services (CMS) updated its Medicaid Managed Care (MMC) regulations that govern network and access standards for enrollees. There have been few published studies of whether there is accurate geographic information on primary care providers to monitor network adequacy.

METHODS:

We analyzed a sample of nurse practitioner (NP) and physician address data registered in the state labor, licensing, and regulation (LLR) boards and the National Provider Index (NPI) using employment location data contained in the patient-centered medical home (PCMH) data file. Our main outcome measures were address discordance (%) at the …

Ladies Of Liberty: The Women Who Shaped Our Nation, Cynthia Phillips

Children's Book and Media Review

Ladies of Liberty is a book about the women who helped to lay the groundwork for the United States. Included are stories about a number of women who were educators, writers, mothers, reformers, novelists, explorers, and more. These women opened orphanages, started women’s rights movements, supported presidents, raised children, and powerfully helped to form a young nation. Women such as Sacagawea, a Native American who helped lead Lewis and Clark through the Louisiana Territory, and Lucy Terrace Prince, a freed slave and brilliant poet and orator, offer stories about amazing women “of color” during a time where skin color was …

Addressing Gun Violence In The United States, Sarah House Dec 2018

Addressing Gun Violence In The United States, Sarah House

Gettysburg Social Sciences Review

When compared with other high-income countries, gun violence is clearly a problem in the United States. Although homicide appears to be a more serious issue compared with other countries, suicide causes many more deaths per year than homicide does and therefore deserves at least as much attention. Discussion of gun policy has also focused heavily on mental illness, and although this is a potential factor in gun violence, we must also recognize that most people with mental illness are not dangerous. Other factors that contribute to risk of gun fatalities include social environment and access to guns, which are important …

Refugee Resettlement And Perceptions Of Insecurity: A Comparative Study Of The United States And Canada, Erik Amundson Dec 2018

Refugee Resettlement And Perceptions Of Insecurity: A Comparative Study Of The United States And Canada, Erik Amundson

Dissertations

In the United States and Canada, refugee resettlement has been the subject of extensive scrutiny and political debate, particularly since the November 2015 terrorist attacks carried out by the Islamic State of Iraq and Syria (ISIS) against targets in Paris. While public opinion polls have shown increasingly negative attitudes toward refugees, existing survey questionnaires only provide a limited understanding of what shapes these views. As such, this study focuses on two important factors that influence attitude formation toward refugees, pre-existing levels of knowledge and contact with minority groups. Using a comparative case study approach, this research examines how refugee resettlement …

From Riots To Sovereignty: United States Policy Makers Ideas, Perceptions, And Reactions To The Panamanian Struggle For Sovereignty, William Edward Humphrey Dec 2018

From Riots To Sovereignty: United States Policy Makers Ideas, Perceptions, And Reactions To The Panamanian Struggle For Sovereignty, William Edward Humphrey

Graduate Theses

After the Hay-Bunau-Varilla Treaty of 1903 the Panamanian people had to live in an occupied country. The U.S. took control of a ten-mile stretch of land surrounding a canal of immense importance to world trade. The U.S. policy makers ignored the pleas, complaints, and demonstrations of the Panamanian people as they struggled for sovereignty in their country. This thesis will show, through the use of primary sources from the U.S. government that U.S. policy makers refused to see the importance of sovereignty to the Panamanian people until the 1964 Panamanian Flag Riots. After that episode, U.S. policy makers dramatically shifted …

Which Activities Count? Using Experimental Data To Understand Conceptualizations Of Physical Activity, Rachel Cusatis, Dana Garbarski Dec 2018

Which Activities Count? Using Experimental Data To Understand Conceptualizations Of Physical Activity, Rachel Cusatis, Dana Garbarski

Sociology: Faculty Publications and Other Works

US health surveys consistently report that men and those with higher socioeconomic status (SES) engage in more physical activity than women and lower SES counterparts, using questions that ask about physical activity during leisure time. However, social characteristics such as gender and SES shape understandings of and access to leisure-based physical activity as well as other domains where healthy activity is available – namely house work, care work, and paid work. Thus, the physical activity of US adults may look different when what counts as physical activity expands beyond leisure activity.

The current study uses Amazon’s Mechanical Turk platform …

A Comparison Of Screening, Prevention, And Management For Hepatitis B Patients Between The Us And Chinese Healthcare Systems, Thomas Chen, James D. Plumb, Md Dec 2018

A Comparison Of Screening, Prevention, And Management For Hepatitis B Patients Between The Us And Chinese Healthcare Systems, Thomas Chen, James D. Plumb, Md

Phase 1

Introduction: Hepatitis B (HBV) is a complex disease entity with potentially serious outcomes, including developing hepatocellular carcinoma (HCC). HBV is estimated to be responsible for about 50-80% of HCC cases worldwide, and 75-95% of HCC cases in HBV endemic regions.1 HBV and HCC are great concerns especially in East Asian countries like China. In China, HCC ranks as the 2nd most common cancer and 2nd in cancer mortality, both behind only lung cancer.1 China is considered an endemic HBV region, with about 100-150 million people infected. In comparison, only an estimated 550,000-2 million people are chronically …

New Documents Shed Light: Why Did Peacekeepers Withdraw During Rwanda’S 1994 Genocide?, Emily A. Willard

Genocide Studies and Prevention: An International Journal

Why did the international community decide to withdraw United Nations peacekeeping troops from Rwanda during the 1994 genocide? Analysis of newly released documents and results from an international conference with former U.N. and government officials sheds further light on our understanding of what took place leading up to and during the Rwandan genocide. This article focuses on two key moments: 1) the United States’ reluctance to support the peacekeeping mission from before its mandate began and prior to the killing of U.S. troops in Somalia in autumn 1993; and the United States’ central role pushing the United Nations Security Council …

OBJECTIVES: To evaluate the Rochester and modified Philadelphia criteria for the risk stratification of febrile infants with invasive bacterial infection (IBI) who do not appear ill without routine cerebrospinal fluid (CSF) testing.

METHODS: We performed a case-control study of febrile infants ≤60 days old presenting to 1 of 9 emergency departments from 2011 to 2016. For each infant with IBI (defined as a blood [bacteremia] and/or CSF [bacterial meningitis] culture with growth of a pathogen), controls without IBI were matched by site and date of visit. Infants were excluded if they appeared ill or had a …

What Influences Whether Family Forest Owners Participate In Outreach Campaigns?, Brett J. Butler, Sarah M. Butler, Kelley Dennings, Tricia Gorby Knoot

Journal of Extension

We used an experimental design to analyze factors affecting participation rates for family forest owner outreach campaigns. Through logistic regression, we assessed the participation rates as a function of campaign and landowner attributes. Participation rates ranged from 3% to 14%. Owners offered a publication were on average 4.3 times more likely to participate than those offered a forester visit. Owners with a college degree were on average 1.5 times more likely to participate than those with lower levels of formal education. Extension and other outreach professionals can use knowledge of these factors to design more effective outreach campaigns.

OBJECTIVE: Performance and utility assessment of ExoDx Prostate (IntelliScore) (EPI) urine exosome gene expression assay versus standard clinical parameters for discriminating Grade Group (GG) ≥2 PCa from GG1 PCa and benign disease on initial biopsy.

DESIGN, SETTING, AND PARTICIPANTS: A two-phase adaptive clinical utility study (NCT03031418) comparing EPI results with biopsy outcomes in men, with age ≥50 yr and prostate-specific antigen (PSA) 2-10ng/ml, scheduled for initial prostate biopsy. After EPI …

Ethical Cannabis Lawyering In California, Francis J. Mootz Iii Dec 2018

Ethical Cannabis Lawyering In California, Francis J. Mootz Iii

St. Mary's Journal on Legal Malpractice & Ethics

Cannabis has a long history in the United States. Originally, doctors and pharmacists used cannabis for a variety of purposes. After the Mexican Revolution led to widespread migration from Mexico to the United States, many Americans responded by associating this influx of foreigners with the use of cannabis, and thereby racializing and stigmatizing the drug. After the collapse of prohibition, the federal government repurposed its enormous enforcement bureaucracy to address the perceived problem of cannabis, despite the opposition of the American Medical Association to this new prohibition. Ultimately, both the states and the federal government classified cannabis as a dangerous …

Military Working Dogs In The United States Armed Forces From World War I To Vietnam, Tristan J. Kelly Dec 2018

Military Working Dogs In The United States Armed Forces From World War I To Vietnam, Tristan J. Kelly

Boise State University Theses and Dissertations

At the beginning of World War I, the only military working dogs the United States owned were sled dogs. In comparison, European nations in World War I used canines as sentries, messengers, ambulance, and draft dogs. In 1942, members of the American public, created Dogs for Defense Inc. to help recruit dogs for military use. By the end of the Vietnam War, dogs no longer were donated by the American public for use, rather the American military owned the dogs they deployed.

This thesis examines the use of dogs by the American military from World War I to the Vietnam …

Diego Rivera For A "Greater America": The United States Murals, Fascha Denray Decrescenzo Nov 2018

Diego Rivera For A "Greater America": The United States Murals, Fascha Denray Decrescenzo

Electronic Theses and Dissertations Archive

This thesis focuses on several works of art created by Diego Rivera for United States patrons in the early twentieth century. Although these U.S. art patrons and Rivera supported the idea of hemispheric unity, the artist’s viewpoint did not always concur with that of the state-side capitalists. Rivera wished to use Pan-American iconography to idealize the indigenous cultures of Latin America, specifically Mexico. The United States capitalists wanted to use art patronage of Latin American artists to instigate a new brand of imperialism – American Imperialism. Nevertheless, through his murals and other projects, Rivera challenged the ideological foundations of the …

Using Virtual Exchange To Advance Media Literacy Competencies Through Analysis Of Contemporary Propaganda, Renee Hobbs, Christian Seyferth-Zapf, Silke Grafe Nov 2018

Using Virtual Exchange To Advance Media Literacy Competencies Through Analysis Of Contemporary Propaganda, Renee Hobbs, Christian Seyferth-Zapf, Silke Grafe

Journal of Media Literacy Education

With the rise of so-called fake news as a global phenomenon, interest in propaganda analysis has advanced along with the recognition of the fundamentally social process of interpretation. In this essay, we explore the use of cross-national dialogue among German and American undergraduate students who are seeking to better understand how media messages are interpreted and how they inform and guide the civic actions of citizens. We describe and analyze five lessons that used a virtual exchange using a variety of digital media platforms, texts and technologies to support the cross-national study of contemporary propaganda. We observed that cross-national dialogue …

NYMC Student Publications

BACKGROUND: Smoking is the leading preventable cause of death in the United States, but evidence-based smoking cessation therapy is underutilized. Financial incentive strategies represent an innovative approach for increasing the use of counseling and pharmacotherapy. If effective, they could supplement or supplant resource-intensive policy options, particularly in populations for whom smoking has substantial societal costs. FIESTA (Financial IncEntives for Smoking TreAtment) will randomize hospitalized smokers to receive usual smoking cessation care alone or usual smoking care augmented with financial incentives. We aim to compare the impact of these two strategies on 1) smoking abstinence, 2) use of counseling and nicotine …
