The Consequences Of Congress’S Choice Of Delegate: Judicial And Agency Interpretations Of Title Vii, Margaret H. Lemos
The Consequences Of Congress’S Choice Of Delegate: Judicial And Agency Interpretations Of Title Vii, Margaret H. Lemos
Faculty Scholarship
Although Congress delegates lawmaking authority to both courts and agencies, we know remarkably little about the determinants-and even less about the consequences-of the choice between judicial and administrative process. The few scholars who have sought to understand the choice of delegate have used formal modeling to illuminate various aspects of the decision from the perspective of the enacting Congress. That approach yields useful insight into the likely preferences of rational legislators, but tells us nothing about how (or whether) those preferences play out in the behavior of courts and agencies. Without such knowledge, we have no way of testing the …

The Private Antitrust Remedy: Lessons From The American Experience, Edward D. Cavanagh
The Private Antitrust Remedy: Lessons From The American Experience, Edward D. Cavanagh
Faculty Publications
(Excerpt)
The treble damage remedy has been a centerpiece of private antitrust enforcement since the enactment of the Sherman Act in 1890. Aware that government resources were limited, Congress created the private right of action as a complement to public enforcement to assure the detection and prosecution of antitrust offenders. The private right of action has proven to be a very potent weapon in the civil enforcement arsenal. It is the very potency of the private remedy, however, that has made the private right of action a target of criticism by defendants and, more recently, the courts. Indeed, in the …
The Political Assassination Of Edmund Randolph: George Washington's Presidential Affair Of Honor, John C. Kotruch
The Political Assassination Of Edmund Randolph: George Washington's Presidential Affair Of Honor, John C. Kotruch
Master's Theses and Capstones
On 19 August 1795 George Washington ambushed Secretary of State Edmund Randolph in an impromptu tribunal to face the allegation of treasonous corruption in the service of France with evidence covertly provided by Great Britain.
A synthesis of the biographies of Washington and Randolph, histories of Jay's Treaty, the Whiskey Rebellion, the Battle of Fallen Timbers, and the diplomatic correspondence between Great Britain and the United States during the early republic reveals the motivations behind a British plot to manipulate the composition of the United States' government by implicating Randolph. The study dispels the myth that the intercepted French diplomatic …
Western Maine Saints: The First Mormons Of Western Maine 1830--1890, Carole A. York
Western Maine Saints: The First Mormons Of Western Maine 1830--1890, Carole A. York
Master's Theses and Capstones
This thesis is about the forty-nine individuals and ten families who converted to the Church of Jesus Christ of Latter-day Saints (LDS) in Bethel and Newry, Maine and the missionaries who brought them into the church. The account includes a brief history of these small back country towns, providing the historical context for the early church in Maine, and continues with the experiences of these Saints as they fled from persecution in Ohio, Missouri, and Illinois. In February, 1846, the Mormons began the arduous trek to the Great Salt Lake Basin. This thesis shows that these converts, typical of other …
Understanding The Female Conceptualization Of Sexual Addiction And The Role Of Addiction Treatment, Megan Douglass
Understanding The Female Conceptualization Of Sexual Addiction And The Role Of Addiction Treatment, Megan Douglass
Electronic Theses and Dissertations
Beginning with the diagnosis of nymphomania in the 19th Century, there has been widespread and continued interest across the mental health and bio-medical realm of what constitutes normality of female sexual behavior, and of the boundary at which sexual desire is deemed to be excessive, and thus abnormal. However, research questions that specifically investigate the subjective female voice and perspective in considerations of so-called hypersexuality or sex addiction remain understudied. This research project proposes to examine the cultural pathways and systemic foundations which have historically in the West problematized female sexuality by investigating women's own perceptions of sexual addiction and …

Muslims In The Media:The New York Times From 2000 - 2008, Autumn Bishop
Electronic Theses and Dissertations
Although it is widely recognized that Muslims and Middle Easterners were negatively portrayed in the media after the terrorist attacks on September 11, 2001, few scholars examine the long term media presentations of Islam in the United States. The studies that have explored the relationship of the portrayal of Islam by the media have used short term, limited sampling techniques, which may not properly reflect the popular media as a whole. The current research uses data from the New York Times from 2000-2008 in order to determine whether the popular media was portraying Islam in a disparaging manner. The analysis …
Auditor Choice, Audit Fees And Internal Governance In Family Firms, Shaohua He
Auditor Choice, Audit Fees And Internal Governance In Family Firms, Shaohua He
Lingnan Theses
I study the role of auditing in mitigating agency concerns in family firms. Family firms face less severe agency problems due to the separation of ownership and control (Type 1) but more severe agency problems between controlling and noncontrolling shareholders (Type 2). As family firms make up a large part of most free enterprise economies it is important to examine these two agency problems with respect to auditor choice and audit effort. I find that family firms are more likely to choose a specialist auditor than nonfamily firms, consistent with the argument that family firms need to signal their non-expropriating …
Introductory Note To The United States Supreme Court: Graham V. Florida & The Federal Court Of Australia: Habib V. Australia, Chris Jenks
Faculty Journal Articles and Book Chapters
This introductory note considers two different and completely unrelated cases: Graham, a U.S. Supreme Court criminal case on the cruel and unusual punishment clause of the U.S. Constitution and Habib, an Australian civil case involving a former Guantanamo Bay detainee. This note focuses on one aspect of the disparate nature of the cases, starkly contrasting judicial attitudes towards the role of “foreign law” in domestic jurisprudence. Juxtaposed, the two cases offer an interesting view of not only the obvious differences between the U.S. inward and the Australian outward looking judicial philosophies, but perhaps a broader sense of how the two …
