Revision And Codification Of Penal Law In The United States, Herbert Wechsler Apr 1983

Revision And Codification Of Penal Law In The United States, Herbert Wechsler

Dalhousie Law Journal

I am honored by the invitation to address you and happy to join in. your tribute to the memory of Horace Read. Dean Read was a pioneer in the perception that this is d legislative age, one of the greatest legislative eras of all time. He was concerned that lawyers be equipped to deal effectively with the ever growing corpus of the statutory law and he made valuable contributions to that end. Whether the larger legislative role in the development of law that he depicted and foresaw was a phenomenon that he regarded with approval or regret, I must confess …

The Rhetorical Factors Applied To The Reorientation Of American Public Opinion Toward The Soviet Union Immediately After June 22, 1941, Stanley Paul Berry

History Theses & Dissertations

This thesis asks the question: what rhetorical factors were applied to the reorientation of American public opinion toward the Soviet Union immediately after June 22, 1941. A brief review of American diplomatic trends leading to June 22, 1941 is provided. The term rhetoric is operationally defined and the limits establishing causation between persuasion and opinion are delineated. The national communication process is explained and a national opinion profile, as it existed in the spring of 1941, is described. Initial persuasive responses to the Russo-German war are addressed and analyzed. The primary persuasive goals are identified as improving the public's image …

Historical Trends In American Animal Use And Perception, Stephen R. Kellert, Miriam O. Westervelt Jan 1983

Historical Trends In American Animal Use And Perception, Stephen R. Kellert, Miriam O. Westervelt

Attitudes Towards Animals Collection

Changes in American attitudes and behaviors toward animals from 1900-1976 will be examined. The data are derived from an empirical analysis of 4,873 animalrelated newspaper articles. Four newspapers were used in this analysis- the Los Angeles Times; Hartford Courant; Buffalo, Wyoming Bulletin; and the Dawson, Georgia News. A content analysis procedure was employed to record animal-related information in the articles, and these data were subjected to a variety of statistical analyses. A comparison of the results with a 1978 national survey of American attitudes and behaviors is briefly attempted. Finally, some policy implications of the data are considered.

An Overview Of The Japanese Legal System, Elliott J. Hahn Jan 1983

An Overview Of The Japanese Legal System, Elliott J. Hahn

Northwestern Journal of International Law & Business

Trade between the United States and Japan is growing at such a rapid pace that it is incumbent on those involved in private international law to be well-versed in the Japanese legal system. This Article is inteded to be of service to one weeking an overview of that system. The basic lesson for the reader is that the legal system is that the legal system of Japan differs significantly from that of the United States. This difference arises from disparate views of Americans and Japanese as to the fundamental purpose of a legal system. Upon reflection, it is perhaps not …

The United States And Naval Limitation: From The Washington Conference To Pearl Harbor, David Jonas Murphy Jan 1983

The United States And Naval Limitation: From The Washington Conference To Pearl Harbor, David Jonas Murphy

Honors Papers

In conducting their foreign affairs, nations rarely act for purely altruistic reasons. Often, when their stated objectives are noble ones- such as world peace- one can find others which stem from the perceived needs of the individual nation or nations. The United States has not been an exception to this rule. Between World War I and World War II the foreign policy of the United States had as one of its major goals world peace or, failing world peace, peace for the United States. Naturally, this was not a totally altruistic ideal. It was believed that the United States would …

Belle S. Spafford: Leader Of Women, Gayle Morby Chandler Jan 1983

Belle S. Spafford: Leader Of Women, Gayle Morby Chandler

Theses and Dissertations

This historical/descriptive study analyzes the speaking career of Belle S. Spafford and attempts to document the relationship between her speaking and her influence with her peers. For over fifty years, the dedicated woman served as a spokesman for the Church of Jesus Christ of Latter-day Saints and the National Council of Women, briding the gap between the secular and religious world of women. A rhetorical analysis of four speeches indicates the following findings: Mrs. Spafford appealed to her audiences through a focus on shared values; she had credibility because of her positions of authority and used it wisely; she effectively …

A Comparative Study Of British Barristers And American Legal Practice And Education, Marilyn J. Berger Jan 1983

A Comparative Study Of British Barristers And American Legal Practice And Education, Marilyn J. Berger

Northwestern Journal of International Law & Business

The conduct of a trial in England is undeniably an impressive undertaking. Costume alone transports the viewer to Elizabethan times. Counsel and judges, bewigged and gowned, appear in a cloistered, regal setting, strewn with leather-bound books. Brightly colored ribbons of red, green, yellow and white, rather than metal clips and staples fasten the legal papers. After comparison with the volatile atmosphere and often unruly conduct of a trial in a United States courtroom it is natural to assume that the British model of courtroom advocacy provides an instructive model for its American counterpart.

Acquisition Of The Mitsui Collection By The East Asiatic Library, University Of California, Berkeley, Roger Sherman

Journal of East Asian Libraries

Not long after World War II came to a close, there was a burgeoning of interest in area studies, which prompted many academic libraries in the United States to embark on extensive acquisitions programs to obtain foreign books for their universities. At the Berkeley campus of the University of California, it was recognized that there was a need on the West Coast for a strong collection of East Asian research materials. This led to the establishment of the East Asiatic Library (EAL) in 1947 as a separate branch on campus. The first few years at the Library were a period …

The Problems In Research Within Juvenile Corrections, Laura Egerton Jan 1982

The Problems In Research Within Juvenile Corrections, Laura Egerton

Honors Theses

The research included in this evaluation had to meet two criteria. First, it had to be indexed in the 1980 or 1981 Sociological Abstracts of Social Source Citation Index. The research must also have been conducted in a correctional institution or in a diversion program. A diversion program is a community-based therapy program dealing primarily with status and first offenders. The goals of the program vary, but focus primarily on prevention of delinquency through early intervention. Of the over one hundred articles reviewed, only thirty met the criteria. The studies not included focused primarily upon either delinquents on probation or …

Criminal Cases At The Essex County, Massachusetts, Court Of General Sessions, 1700 - 1785, Paul Donald Marsella Jan 1982

Criminal Cases At The Essex County, Massachusetts, Court Of General Sessions, 1700 - 1785, Paul Donald Marsella

Doctoral Dissertations

This study provides detailed description of criminal cases at the Essex County, Massachusetts Court of General Sessions of the Peace from 1700 to 1785 and analyzes the relationship between crime and social tension in Massachusetts during this period. The Court of General Sessions was the county administrative and criminal court in eighteenth century Massachusetts and its records are extensive. Essex County, moreover, was a socially and economically diverse community, and it is an appropriate representative sample of eighteenth century Massachusetts society.

Sessions Court records yield a tremendous amount of detailed information about criminal activity in eighteenth century Essex County. The …

Order And Disorder In Early Connecticut: New Haven, 1639-1701, Robert West Roetger Jan 1982

Order And Disorder In Early Connecticut: New Haven, 1639-1701, Robert West Roetger

Doctoral Dissertations

This dissertation assesses order and disorder in New Haven, Connecticut from its founding in 1639 to the introduction of Justices of the Peace in 1701. It juxtaposes concepts of the well-ordered society as expressed in puritan rhetoric with the reality of behavior as reflected in legal documents to illustrate the pre-eminent role assumed by law in ordering society. What emerges is a picture of society not rigidly caught up in the policies of perfection, but one characterized by responsive lawmaking, equally flexible enforcement, and reliance upon formal legal institutions to resolve private controversies.

The study begins with a portrait of …
