Agenda: Water Quality Control: Integrating Beneficial Use And Environmental Protection, University Of Colorado Boulder. Natural Resources Law Center

Water Quality Control: Integrating Beneficial Use and Environmental Protection (Summer Conference, June 1-3)

Conference organizers and/or faculty included University of Colorado School of Law professors David H. Getches, Lawrence J. MacDonnell and Charles F. Wilkinson.

Protecting water quality is essential to preserve the many beneficial uses of western water resources. This conference addresses the dominant federal requirements in the Clean Water Act, including the important major revisions enacted by Congress in 1987, with special attention to western problems regarding nonpoint source pollution. Developments in groundwater quality regulation are considered, as are selected issues concerning the implications of state and federal water quality regulation for the traditional exercise of water rights.

Risk Communication Law And Implementation Issues In The United States And European Community, Michael S. Baram Apr 1988

Risk Communication Law And Implementation Issues In The United States And European Community, Michael S. Baram

Faculty Scholarship

Risk communication has become an important element of public policy in the United States and the European Community (E.C.) for reducing technological risks to workers, product users and community residents. The risk communication process involves disclosure by an industrial firm (or other party) of information about the hazardous attributes of its activity or product to a regulatory agency or to persons who may be at risk, thereby facilitating a shared understanding of the risk and enabling interpretation of various risk prevention and response measures.

There are two general patterns of risk communication. One involves industrial disclosure to a government agency, …

An America's Cup For Tort Reform? Australia And America Compared, Jeffrey O'Connell, David Partlett Apr 1988

An America's Cup For Tort Reform? Australia And America Compared, Jeffrey O'Connell, David Partlett

University of Michigan Journal of Law Reform

The issue of tort reform has descended from Ivory Towers to populist politics. A few years ago no one could have predicted that "tort reform" would become political argot and a stirring election slogan. Some in the United States see the tort crisis and the stimulus for reform as somehow uniquely American. This Article shows instead that many advanced, industrialized societies are discussing tort reform initiatives actively. The precise nature of the problems, the reasons for reform, and the shape of solutions will be fashioned by indigenous culture, tradition, and the uncertainties of politics. In the common-law world, however, a …

Danish Perceptions And West Indian Realities: Slavery In The Danish West Indies, Karen Fog Olwig Jan 1988

Danish Perceptions And West Indian Realities: Slavery In The Danish West Indies, Karen Fog Olwig

The Bridge

The year 1987 marked the 70th anniversary of the sale of the Danish West Indies to the United States of America. With the sale of the three small islands of St. Thomas, St. Croix and St. John, Denmark had disposed of all her tropical colonies, which at one time had included possessions on the Gold Coast in Africa, the present Ghana, and in southeastern India, most importantly Trankebar.

Human Rights: Two Hundred Years Of Constitutional Experience In The United States, Robert S. Barker Jan 1988

Human Rights: Two Hundred Years Of Constitutional Experience In The United States, Robert S. Barker

Barker Papers

The study of the United States Constitution is not the exclusive province of any one discipline or profession. But, the history of the United States has demonstrated that the Constitution, particularly in its human rights aspects, is preeminently a legal document. As Tocqueville said a century and a half ago, "There is hardly a political question in the United States which does not sooner or later turn into a judicial one." This paper explains both the historical format and its jurisprudential emphasis.

Prurient Interest And Human Dignity: Pornography Regulation In West Germany And The United States, Mathias Reimann

University of Michigan Journal of Law Reform

This Article examines the regulation of pornography in West Germany and compares it to regulation in the United States. Part I provides an overview of the legal framework- constitutional and statutory-of pornography regulation in West Germany. Part II then traces the evolution of the concept of human dignity as a standard for defining pornography in West Germany, and Part III illustrates the practical impact of the idea in two widely debated recent cases. Part IV argues that West Germany's human dignity approach to pornography regulation raises important questions about how to view pornography, but that cultural and constitutional differences between …

Lawyers As Assimilators And Preservers, Thomas L. Shaffer, Mary M. Shaffer Jan 1988

Lawyers As Assimilators And Preservers, Thomas L. Shaffer, Mary M. Shaffer

Journal Articles

The United States, more than most nation-states, has a history of confrontations between one culture and another, and of law as a means of ending cultural confrontations. Again and again in America, our dominant Anglo-Saxon Protestant culture has dealt with an alien culture and, as the story is usually told, overcome it. The dominant culture has used the law to bring the vulnerable culture into conformity to what we have referred to as "the American way."

We want to suggest that such a legal figure has two ways of using his legal power to deal between cultures—ways that are different …
