Comparison: Japanese And American Plant Closing Laws, Allison Zousmer Jan 1989

Comparison: Japanese And American Plant Closing Laws, Allison Zousmer

Michigan Journal of International Law

This Note analyzes the American and Japanese approaches to plant closings and discusses to what extent the American government can apply the successful Japanese approach to its own labor relations system. The first part examines the specific provisions of the two nations' laws. Second, it illustrates how the divergent social rules and historical backgrounds influence the operation of the plant closing laws in both nations. Part three explores the impact and applicability of Japanese labor policies to American industrial practices. The Note concludes that although the Japanese provide a general model for a labor management system which combines cooperation and …

Equal Protection- The Social Dimension Of European Community Law, T. Koopmans Jan 1989

Equal Protection- The Social Dimension Of European Community Law, T. Koopmans

Michigan Journal of International Law

There are two reasons for drawing attention to the social dimension of European Community law. First, the EEC treaty comprises different provisions on social policy whose importance is consistently underestimated: the treaty is often considered as merely establishing a "common market" and as only concerning economic problems. This approach is prominent in the United States, where the business world is primarily interested in trade with, and within, the common market, and where much literature is devoted to this subject. Second, the social provisions of the EEC treaty have given rise to an interesting evolution in the case law of the …

Congress And Genocide: They're Not Going To Get Away With It, Jordan J. Paust Jan 1989

Congress And Genocide: They're Not Going To Get Away With It, Jordan J. Paust

Michigan Journal of International Law

Today at least, it is generally recognized that genocide is a crimen contra omnes, a crime under customary international law over which there is universal enforcement jurisdiction and responsibility. Indeed, it is commonly expected that the prohibition of genocide is a peremptory norm of customary international law, a jus cogens allowing no form of derogation under domestic or treaty-based law. It is also commonly understood that the definition of genocide contained in the Convention on the Prevention and Punishment of the Crime of Genocide defines that which is prohibited by customary jus cogens.

The United States, The United Nations, And Micronesia: Questions Of Procedure, Substance, And Faith, Harry G. Prince Jan 1989

The United States, The United Nations, And Micronesia: Questions Of Procedure, Substance, And Faith, Harry G. Prince

Michigan Journal of International Law

This study first considers the procedural requirements for proper termination and concludes that Security Council approval is required. Second, this writing identifies the major issues that should be considered if the proposed termination of the Trusteeship Agreement for Micronesia is subjected to Security Council review. Two basic concerns should be the propriety of the division of the Trust Territory into four separate entities and the legitimacy of the agreements between the new governments and the United States for continuing relations as either commonwealth or freely associated states. The history of and practice under the trusteeship system indicate that the particular …

The Beginning Of The Constitutional Era: A Bicentennial Comparative Study Of The American And French Constitutions, Rett R. Ludwikowski Jan 1989

The Beginning Of The Constitutional Era: A Bicentennial Comparative Study Of The American And French Constitutions, Rett R. Ludwikowski

Michigan Journal of International Law

This article is intended only to be introductory. The author is quite aware that the period surrounding the creation of the American Constitution has been profoundly studied; thorough analysis has been provided concerning both the origin and historical development of the American Constitution, as well as the intellectual background of the "founding generation." Characteristically, these studies have focused on the "American constitutional tradition," which means that they have been limited to little more than two centuries of colonial experience. This essay follows a different vein of inquiry. The author's purpose is not to add another article to the numerous works …

The Ec Hormone Ban Dispute And The Application Of The Dispute Settlement Provisions Of The Standards Code, Allen Dick Jan 1989

The Ec Hormone Ban Dispute And The Application Of The Dispute Settlement Provisions Of The Standards Code, Allen Dick

Michigan Journal of International Law

As the concept of a unified European market becomes more of a reality as we approach 1992, talk of a "Fortress Europe" has heightened sensitivity on trade issues among officials of the United States and the European Community ("EC"). The EC's plan to ban the sale of meat treated with growth hormones within the Member-States has presented a trade issue disconcerting to both sides. This brewing tempest has raised many interesting legal issues involving the dispute settlement provisions set out in the Agreement on Technical Barriers to Trade ("Standards Code"). This note examines why the process failed to resolve, and …

An Analysis Of The Progress Of Social Welfare Administration In The United States And An Examination Of Some Major Alternatives, Amy Marie Marshall

UNLV Retrospective Theses & Dissertations

This thesis considers the social welfare administration legislation that was passed during the presidential administration of Lyndon Johnson, and whether this legislation has successfully accomplished the eradication of poverty in the United States. Reasons for the persistence of poverty are considered and major private and public alternatives to present poverty relief programs are examined.

Dispute Over The United States’ Denial Of A Visa To Yasir Arafat, Sadiq Reza Jan 1989

Dispute Over The United States’ Denial Of A Visa To Yasir Arafat, Sadiq Reza

Faculty Scholarship

On November 26, 1988, the United States denied a visa to Yasir Arafat, Chairman of the Executive Committee of the Palestine Liberation Organization (PLO), when he sought to enter the United States to attend the forty-third session of the United Nations (UN) in New York. The denial rekindled a forty-year-old dispute between the United States and the UN over the extent to which the United States may, under the terms of the Agreement Between the United Nations and the United States of America Regarding the Headquarters of the United Nations (Headquarters Agreement), restrict entry to persons seeking to enter the …

International Commercial Arbitration In The United States: Considering Whether To Adopt Uncitral's Model Law, Patrick John Potter Jan 1989

International Commercial Arbitration In The United States: Considering Whether To Adopt Uncitral's Model Law, Patrick John Potter

Michigan Journal of International Law

This Note will explore some of the areas overlooked by the Committee, including the benefits and burdens which adopting the Model Law would involve. Part One briefly describes the Model Law's background and provides a summary of its articles. Part Two discusses some factors that should be considered when Congress decides whether or not to adopt the Model Law. Part Three summarizes the present status of international commercial arbitration law in the United States, and recommends en bloc adoption of the Model Law. Enacting a separate international arbitration law that is familiar to foreigners will facilitate arbitration with U.S. parties. …

A Comparison Of U.S. And Japanese Attitudes About The Relevance Of Current Consolidation Accounting Procedures, James A. Schweikart, Walter F. O'Connor Jan 1989

A Comparison Of U.S. And Japanese Attitudes About The Relevance Of Current Consolidation Accounting Procedures, James A. Schweikart, Walter F. O'Connor

Robins School of Business White Paper Series, 1980-2022

Consolidation accounting has not materially changed since APB Opinions 16 and 18. Only minor changes have been made such as the new rules requiring financial subsidiaries to be consolidated (FAS 94, 1989). The recent trend of mergers and acquisitions, however, represents a significant change in business environment from that which existed when consolidation accounting as we know it was formalized. Accordingly, there is concern that current consolidation practices may be less appropriate or relevant than before.

The Changing Process Of International Law And The Role Of The World Court, J. Patrick Kelly Jan 1989

The Changing Process Of International Law And The Role Of The World Court, J. Patrick Kelly

Michigan Journal of International Law

Two approaches have emerged in recent American literature as to the appropriate United States attitude toward the World Court: (1) the re-acceptance of compulsory jurisdiction with various reservations to preserve vital American interests; and (2) the preservation of the status quo premised on a perception that the World Court is biased or misguided, while promoting the United States government's perspective on international law. This article argues that neither approach comes to terms with the wide disagreements about content and process in the international community. Both fail to promote the goals of an enhanced World Court or a better international legal …

The Role Of The Tobacco Trade In Turkish-American Relations, 1923-29., Robert Carey Goodman Dec 1988

The Role Of The Tobacco Trade In Turkish-American Relations, 1923-29., Robert Carey Goodman

Master's Theses

This study of the tobacco trade between Turkey and the United States provides new perspectives on two major themes in Turkish-American relations between 1923 and 1929: the effect of Turkish nationalism on American interests in Ataturk's Turkey, and the effort to restore Turkish- American diplomatic ties broken during World War I. The marked rise in American cigarette consumption after World War I made the tobacco trade a crucial link between Turkey and America because it required the importation of aromatic tobacco. During the Turkish Republic' s first decades, the value of American tobacco imports from Turkey exceeded the value of …

Dynamics Of Minority Education: An Index To The Status Of Race And Ethnic Relations In The United States, James E. Blackwell Sep 1988

Dynamics Of Minority Education: An Index To The Status Of Race And Ethnic Relations In The United States, James E. Blackwell

Trotter Review

Throughout this century scholars and legal experts have devoted special attention to the issue of race and ethnicity as a determinant of life chances in the United States. Some of the more influential treatises in the social and behavioral sciences, many of which have become classics, addressed fundamental, derivative (and often more compelling) extensions of race and ethnicity. They focused on such topics as race-based group dominance, ethnic stratification, structural inequality based upon racial or ethnic identification, beliefs in inherent racial superiority and status privilege, class exploitation, the nature of prejudice, and the maintenance of power over groups defined as …

Reform And Democracy: British And American Reactions To The French Revolution, 1789-1801, Martha Lingua Wheless

History Theses & Dissertations

The outbreak of the French Revolution in 1789 had a profound effect on the countries of the western world. In Great Britain and America initial reaction to the Revolution was overwhelmingly positive, but as the events in France became increasingly violent opinions began to diverge. This thesis examines the diverse popular reactions to the French Revolution in both Great Britain and America. The role played by the governments of these nations in shaping public opinion is considered, as are the effects of the populaces' reactions on the government's policies, which culminated in the suppression of the parliamentary reform movement in …
