In the administration of justice in the Territory of Utah the United States marshal served an important role, especially because of the conflict between Mormons and non-Mormons. The marshal was an officer of the federal court, and as such he served warrants, obtained witnesses, helped select jurors, conducted executions upon order of the court, collected the census, served as warden of the territorial penitentiary, and in addition. performed many minute and tedious duties.

While the first United States marshal in Utah was Mormon, all others were non-Mormon and most were recruited from outside the territory. In general, they were capable …

The subway fare in New York City was recently raised to thirty cents. Incensed citizens immediately declared they would go to court and have the increase declared unconstitutional. "Unconstitutional" and "constitutional rights" have become the watchwords of political protestors and reformers. Moreover, their political forum is often a court of law. Who taught the nation this rhetoric, this mode of action, and this attitude toward law, law reform, and politics? The Supreme Court of the United States. The American public of late has shown increasing concern over the quality of the environment. Water pollution has long been recognized as a major threat to a better environment. Municipal, industrial, and agricultural operations all contribute to the pollution problem. Municipalities empty millions of gallons of inadequately-treated sewage into the nation's rivers and streams. Municipal wastes are almost exclusively organic in nature. Currently municipal wastes are estimated to average about ten million tons annually while industrial pollution averages approximately fifteen million tons. Treatment in general is technologically feasible; the primary impediment is financial inability on the part of municipalities to …

Procedural Due Process In Administrative Law: Some Thoughts From The French Experience, Richard L. Herrmann

As administrative law has grown so have the suggestions for change and reform. During the last thirty years a recurrent proposal has been that Congress create a federal administrative court. The first such bill was introduced in 1933 by Senator George Norris. In the same year the American Bar Association also championed the creation of such a court. Bills advocating an administrative court were again introduced in the Seventy-Fourth, Seventy-Fifth, and Seventy-Sixth Congress. The most recent proposal came in 1949. None were ever passed.

There has been a great of research conducted to find factors which can be used to predict academic success. A number of these factors have already been identified. For example, college board scores, high school rank, and high school grades are widely used a predictors of academic success. Most of the research that has been conducted has dealt with intellectual factor, but there has been some research done to find non-intellectual factors related to academic success. These non-intellectual factors include: study habits, personality, traits, and environmental factors.

A related article published in this journal, Kimball and Pfennigstorf, Legislative Control of the Terms of Insurance Contracts: A Comparative Study, 39 IND. L.J. 675 (1964), examined legislative and judicial control of the provisions of insurance policies. Ideally, it would have been better to publish all aspects of control of insurance policies in one article, but length as well as complexity necessitated division of the subject matter. The reader who wishes a more complete picture of public control of the terms of insurance contracts should consult the earlier article and other available literature.
