The United States, more than most nation-states, has a history of confrontations between one culture and another, and of law as a means of ending cultural confrontations. Again and again in America, our dominant Anglo-Saxon Protestant culture has dealt with an alien culture and, as the story is usually told, overcome it. The dominant culture has used the law to bring the vulnerable culture into conformity to what we have referred to as "the American way."
We want to suggest that such a legal figure has two ways of using his legal power to deal between cultures—ways that are different …

The Daughters Of Charity In The Spanish-American War, Gertrude Fenner D.C.
Vincentian Studies
When the American government called for nurses during the Spanish-American War, 189 of the 282 sisters who responded were Daughters of Charity. Often under great hardship, they served the wounded in several hospitals within the United States and went to the battle lines in Cuba. They joined Spanish Daughters in Puerto Rico. They traveled on hospital ships and dealt with large numbers of typhoid and other fever cases at sea and on land. The Red Cross and other lay nurses often followed the Daughters’ techniques in nursing and ward management. The Daughters’ influence on Florence Nightingale and Clara Barton is …
In Celebration Of Constitutional Kindness: Soft Symbolism In A Hard Shell, James Audley Mclaughlin
In Celebration Of Constitutional Kindness: Soft Symbolism In A Hard Shell, James Audley Mclaughlin
West Virginia Law Review
The bicentennial of any constitution is surely an invitation to much sententious rhetoric. But the bicentennial of THE Constitution, The American Constitution of 1787, is an occasion for oratorical pyrotechnics of the first magnitude. So I shall make my brief tribute to note the importance of the Constitution as symbol - symbol of our national resolve to be a good society. Constitutions, in general, have two distinct functions: (1) As the outward sign and symbol of a society's fundamental commitment to social values and (2) perhaps more mundanely, as the framework for a political order. Our Constitution of 1787 (or …

Proceedings of the Sino-American Conference on Environmental Law (August 16)
On August 16 through 18, 1987 a delegation of 10 Americans met with a 14-member Chinese delegation to compare the systems of environmental law in the two countries. The meetings were held on and near the campus of the University of Peking in Beijing, People's Republic of China. This program was the fruition of nearly three years of discussion, planning, and organization involving Dean Betsy Levin and the Natural Resources Law Center.
The keynote speaker was Qu Geping, Director of the Chinese National Environmental Protection Bureau (comparable to the Administrator of the U.S. Environmental Protection Agency). He spoke of the …

Japanese-Style Worker Participation And United States Labor Law, William S. Rutchow
Japanese-Style Worker Participation And United States Labor Law, William S. Rutchow
Michigan Journal of International Law
This note will evaluate the current legal status of Japanese-style worker participation programs under the NLRA. First, it analyzes relevant sections of the NLRA and their interpretation by the Board and the courts. Second, the note describes various types of Japanese worker participation programs, and suggests how these programs can be legally implemented under current American labor law. Third, the note considers standards the Supreme Court may adopt to test the legality of worker participation programs in the future. Finally, this note recommends that the Supreme Court uphold those participation programs which are freely chosen by employees.

Honors Papers
The preceding section is the human evidence behind this paper: what did the Great Depression feel like? What was it like to live in a Hooverville? To travel across the country in a rundown Jalopy? To Jump freight trains and live in box cars? To go on relief? What impact did the depression have on the national and individual psyche? Many authors have dealt with these questions, so why do it again? First, this thesis represents a attempt to draw together all the information for myself. Second, it is also an endeavor to find what people considered then (and perhaps …
