Scholars analyzing the intersection of federalism and disaster law and policy have primarily focused on the difficulties federalism poses for interjurisdictional coordination of disaster response. Though scholars have highlighted that rising disaster risks and costs are associated with “land-use planning that exacerbates, rather than mitigates, disaster risk,” a more holistic analysis of land-use-related disaster law and policy is needed. This Article provides a more comprehensive framework within which to analyze prospective mitigation or prevention of disaster risk and costs through a rebalancing - or reconstituting - of the respective roles of the federal and state governments in land-use planning. Commerce In The Commons: A Unified Theory Of Natural Capital Regulation Under The Commerce Clause, Blake Hudson

Scholars continue to debate the scope of Congress’s Commerce Clause authority and whether fluctuations in the U.S. Supreme Court’s Commerce Clause jurisprudence place federal environmental regulatory authority at risk. Yet when one analyzes major Commerce Clause cases involving resource regulation since the beginning of the modern regulatory state, a consistent theme emerges: both the Supreme Court and Circuit Courts of Appeal have consistently upheld federal authority to regulate depletable natural resources, the appropriation of which is non-excludable - key characteristics of a commons. Title VII of the Civil Rights Act of 1964 represents a watershed moment in American history. With Title VII's passage, Congress acknowledged the need to “back” the civil rights movement with “federal legislative power.” Title VII was meant to eliminate practices that inhibit employment opportunity equality. Beyond eliminating those practices, Title VII was also designed to assure equality of employment opportunities and to eliminate conduct that “fostered racially stratified job environments to the disadvantage of minority citizens.” This Title renders unlawful the refusal or failure to hire or “otherwise to discriminate against any individual with respect to his compensation, terms, …

Heat waves are expected to become more frequent and severe as climate changes, with unknown consequences for biodiversity. We sought to identify ecologically-relevant broad-scale indicators of heat waves based on MODIS land surface temperature (LST) and interpolated air temperature data and assess their associations with avian community structure. Specifically, we asked which data source, time periods, and heat wave indices best predicted changes in avian abundance and species richness. Ixodes affinis Neumann is a hard-bodied (ixodid) tick known to be a competent vector for Borrelia burgdorferi, the agent of Lyme disease, and agents of other human diseases (Keirans et al. 1999). Ixodes affinis has been reported in Florida, Georgia, and South Carolina and throughout coastal North Carolina (Clark et al. 1998, Harrison et al. 2010). Harrison et al. (2010) indicated that I. affinis was established throughout the coastal plain of North Carolina up to the Virginia border and suggested that I. affinis might occur in Virginia.

Foreword: Rulemaking, Democracy, And Torrents Of E-Mail, Nina A. Mendelson

This Foreword is meant as an initial foray into the question of what agencies should do with mass public comments, particularly on broad questions of policy. Part I discusses the extent to which congressional control, presidential control, and agency procedures themselves can ensure that agency decisions are democratically responsive. In view of shortcomings in both congressional and presidential control, I underscore the need to focus closely on rulemaking procedures as a source of democratic responsiveness. The possibility that agencies may be systematically discounting certain public submissions raises difficulties, and I present some examples. Part II makes a preliminary case that …

An increasing number of serodiscordant couples are utilizing advanced reproductive technologies to address their reproductive needs. Recent literature has demonstrated that it is not only technically possible but also safe to utilize sperm-washing techniques to allow for the creation of embryos, thereby preventing both horizontal and vertical transmission of HIV. This article addresses the strengths and weakness of various reproductive techniques and discusses our experience at Columbia University (NY, USA), the location of the largest HIV-focused fertility program in the USA.

This article explores the relationship between the Americans with Disabilities Act (“ADA”) and the relative labor market outcomes for people with disabilities. Using individual-level longitudinal data from 1981 to 1996 derived from the previously unexploited Panel Study of Income Dynamics (“PSID”), we examine the possible effect of the ADA on (1) annual weeks worked; (2) annual earnings; and (3) hourly wages for a sample of 7120 unique male household heads between the ages of 21 and 65 as well as a subset of 1437 individuals appearing every year from 1981 to 1996. Four Constitutional Limits That The Minimum Coverage Provision Respects, Neil S. Siegel

Opponents of the minimum coverage provision in the Affordable Care Act charge that if Congress can require most people to obtain health insurance or pay a certain amount of money, then Congress can impose whatever mandates it wishes—or, at least, whatever purchase mandates it wishes. This Essay refutes that claim by identifying four limits on the Commerce Clause that the minimum coverage provision honors. Congress may not use its commerce power: (1) to regulate noneconomic subject matter; (2) to impose a regulation that violates constitutional rights, including the right to bodily integrity; (3) to regulate at all, including by imposing …

Since its adoption in 1993 at the insistence of U.S. President Bill Clinton's administration, the labor side accords to the North American Free Trade Agreement (NAFTA) have been extensively examined, occasionally ridiculed, and often dismissed as irrelevant. Most analysis tends to focus on the disappointing results of the North American Agreement on Labor Cooperation (NAALC) in affecting meaningful changes in the conditions of workers in Mexico. In this article, I aim to take a different approach. Mainstream Alaskan history has largely ignored women's role in the development of the state during the early 20th century. Although mainly a male endeavor, the multiple Alaskan gold stampedes from 1899 to 1914 brought a migration of women, and they played a role in the development of the territory. The current literature of women in the north focuses primarily on the Canadian Klondike stampede of 1897-98 which saw women traveling to the gold fields for a variety of reasons, such as to support their husbands in their ventures, seek their own business opportunities, or just seek adventure. During the period 8-9 December 2010, the United States Naval War College (NWC) in Newport, Rhode Island hosted the Global Shipping Game (GSG). The GSG was developed and executed at the direction of the Chief of Naval Operations (CNO). The purpose of the GSG was to explore strategic-level implications as a result of future changes in global shipping patterns. Organic And Sustainable: The Emergence, Formalization And Performance Of A September 11th Disaster Relief Organization, David A. Campbell

The terrorist attacks of September 11, 2001, spawned 252 new nonprofit organizations. We know little about these organizations, including how they emerged, formalized, met constituents' expectations for immediate performance, and ultimately survived. This article explores these issues through a case study of one successful organization, the Windows of Hope Family Relief Fund. Using concepts from disaster, organizational ecology, and entrepreneurship research, the analysis identifies six propositions that link these literatures, notably the role of resource acquisition in formalization and the role of legitimacy in both fund development and organizational endurance. The study contributes new knowledge about the role of collaboration …
