Cyborgs And The Americans With Disabilities Act, Lou Colasanti Aug 2022

Cyborgs And The Americans With Disabilities Act, Lou Colasanti

Student Scholarship

Medical technology is advancing at lightning speed with the potential to drastically benefit the disabled. These new technologies will result in humans who will use a wide array of assistive technologies and will likely be labelled as Cyborgs. Assistive technologies such as self-driving cars, robots, computer chip implants, insertable medical hardware, and exoskeletons are already well developed. The day is rapidly approaching when Cyborgs as a class will be large and influential. Critically, the Americans with Disabilities Act (ADA), the judges tasked with enforcing this legislation, and the legislature itself are all ill equipped to handle the speed of this …

Impactful Digital Technology: Connecting With Nature In Early Childhood, Kathleen A. White Aug 2022

Impactful Digital Technology: Connecting With Nature In Early Childhood, Kathleen A. White

Masters Projects

Young children are increasingly found to be spending their free time passively engaging with various types of digital technology. This has become one of the primary reasons why children’s time spent outdoors is diminishing. It has also led to an increase in negative health and developmental concerns. Children suffer from what has been deemed Nature Deficit Disorder, first coined by Richard Louv. Their lack of feeling connected with the natural world early on decreases the chances of them becoming a steward of that same world later in life. The studies have shown that although many believe young children should be …

The Effect Of Technology And Regulation On The Co-Evolution Of Product And Industry Architecture, Nicholas Burton, Peter Galvin

Research outputs 2022 to 2026

This paper explores the co-evolution of product and industry architecture by drawing on a longitudinal study of the UK personal pensions industry between 2005 and 2020. It provides qualitative evidence for the way in which institutional structures, particularly regulation, entwine with firm strategic choices to shape the contours of an industry value chain (IVC). We draw upon modularity theory and the literature on industry architecture to consider how strategic bottlenecks emerged and how value shifted between layers of the IVC. Furthermore, we examine the interplay between the agendas of the regulator and firm strategic responses to unpack how firms (product …

Neuroscience-Informed Technology: Implications For Professional Counselors And Counselor Education, Deborah L. Duenyas, Zach Budesa, Chad Luke, Lauren A. Fry

Journal of Technology in Counselor Education and Supervision

The ACA Code of Ethics (2014) state that counselors who use technology must also develop the knowledge and skills necessary to safely engage with clients. To date, no studies were found that identified prevalence or preferences among counselors' use of technology with clients. The purpose of this pilot study was to investigate licensed professional counselors’ self-assessment of competency to use Neuroscience-Informed Technology (NIT). A national sample of licensed professional counselors were surveyed (N = 69). Results indicate that licensed professional counselors feel competent to use NIT as an intervention in their clinical work (94%). Participants reported feeling most competent in …

Psychology: Faculty Publications and Other Works

Background: Rates of mental health problems among youth are high and rising, whereas treatment seeking in this population remains low. Technology-delivered interventions (TDIs) appear to be promising avenues for broadening the reach of evidence-based interventions for youth well-being. However, to date, meta-analytic reviews on youth samples have primarily been limited to computer and internet interventions, whereas meta-analytic evidence on mobile TDIs (mTDIs), largely comprising mobile apps for smartphones and tablets, have primarily focused on adult samples.

Objective: This study aimed to evaluate the effectiveness of mTDIs for a broad range of well-being outcomes in unselected, at-risk, and clinical samples of …

Responsible Imagineering: John Dewey's Pluralistic Ethics And Technological Innovation, John A. Machielsen Jul 2022

Responsible Imagineering: John Dewey's Pluralistic Ethics And Technological Innovation, John A. Machielsen

Education and Culture

I argue for taking John Dewey’s pluralistic ethics as a starting point, or embedded practice, from and in which technological innovations are conceptualized, critiqued, designed, tested, and eventually implemented. Dewey reconstructs human reason into operational intelligence where all behavior becomes gradually imaginative. I take Dewey’s view of moral deliberation as a basis for a responsible process-based methodology combining creative technological design with the training of imaginative prospection. I further use Dewey’s conception of technology that holds that implements, but also ideas and concepts are tools, forms of technology. I end by looking at the educational impact for the creative industries.

A Survey Of Civil Procedure: Technology To Covid-19 Within State Courts, Joshua H. Hernandez Jul 2022

A Survey Of Civil Procedure: Technology To Covid-19 Within State Courts, Joshua H. Hernandez

Marquette Law Review

The COVID-19 pandemic catalyzed the implementation of technological innovation within the legal field. Specifically, state courts used technology to adjust their civil procedures while maintaining accurate results, limiting costs, and providing meaningful participation to varying degrees of success. In addition, given the piecemeal nature of these adjustments, there is a lack of knowledge regarding what actions were taken in the early months of the pandemic. Thus, this Comment conducts a survey focusing on how the states adjusted their judicial civil procedures to respond to COVID-19’s impact. This Comment then argues that the most liberal implementation of technological adjustments may not …

The Patent Medium: Toward A Network Paradigm Of The Patent System, Or Cohen Sasson Jul 2022

The Patent Medium: Toward A Network Paradigm Of The Patent System, Or Cohen Sasson

Articles

The modern patent system is conceived of as an information platform; it is evident in the common description of the patent system as a quid-pro-quo bargain: Society grants exclusive rights in exchange for information published by a patentee. But is there more to the patent system than merely informing others? Does the patent system also serve as a communication (and not only information) platform, namely, as a medium? Based on an interdisciplinary analysis of the patent system's structure and features through the lenses of communication studies, this Article suggests that it does. It demonstrates how the patent system as a …

This essay attempts to highlight the significance of freedom from speech in order to clarify the importance of the First Amendment right against compelled speech; provide an explanation for when the right of free speech yields to other rights; and offer a …

Using Video Games To Teach Social Studies, Model Careers, And Develop Environmental Identities Within Our Classrooms, Luke Stahlmann

School of Education and Leadership Student Capstone Projects

Decades of research point towards great, but unfortunately untapped, potential video games provide classrooms for meaningful learning and enrichment. Despite a lot of academic thought being poured into the subject of video games’ educational value, we do not see them being used commonly within classrooms or even cohesively studied as different games are focused on and successes are measured in non uniform ways. The content created for this project focuses on taking much of the academic foundation or merit of learning through video games and advocates them to a general audience alongside modern games that exemplify learning principles covered. The …

Road user distraction is a major safety concern. The issue is not only for drivers, but also for vulnerable road users such as pedestrians. Every year people are involved in potential and real crashes due to being distracted while walking/crossing streets. Although there are several ways by which pedestrians are distracted, phone use while crossing streets is among the riskier and growing behaviors. Crossing an intersection, especially those with heavy traffic, requires full attention from the individual. Inattentiveness to traffic while on a phone call, texting, web-surfing, listening to music before crossing a street can lead to a fatal crash. …

All Aboard The Abortion Pill Train: Activism, Medicine, And Reproductive Technologies In The Republic Of Ireland, Brenna Mccaffrey

Dissertations, Theses, and Capstone Projects

The successful legalization of abortion in the Republic of Ireland in 2018 is one of many recent political changes amidst ongoing global debates about the role of reproductive freedom in modern societies. This dissertation follows these changes through both clandestine and highly public social movement activism, deliberative and legislative political processes, and dynamic shifts in medical service provision over a three-year period from 2017 to 2020. I center the abortion pill as a medical and pharmaceutical technology that has been under-examined by scholars as an agent of change in the story of Ireland’s abortion debates. The emergence of non- profit …

The intersection between criminal justice and technology is fairly understudied, despite increasing technological advancements in the world and within the criminal justice system. A rather recent addition to the technological landscape of prison is the adoption of tablets used by imprisoned people for communication and connection with loved ones and other activities, which is particularly important given the context of COVID-19, a virus which caused a global pandemic from 2020-2022. While the use of tablets by imprisoned people appears to be a new trend, the use of tablets in prison both prior to and during the pandemic has remained an …

Can Social Media Corporations Be Held Liable Under International Law For Human Rights Atrocities?, Juliana Palmieri

Pace International Law Review

This article examines the relevant international law associated with genocide and hate speech and examines whether there are any legal grounds to hold a corporation liable for how people chose to use its product or service in relation to human rights violations. The analysis begins with a brief overview of international criminal and human rights law, relevant treaties, jurisdictional issues, and the legal theories of corporate criminal liability and complicity. Marketing Research And Children’S Consumer Privacy Rights: A Battle In The Digital Age, Hadley Johnson May 2022

Marketing Research And Children’S Consumer Privacy Rights: A Battle In The Digital Age, Hadley Johnson

Child and Family Law Journal

Advancements in technology and social media have led to a decreased level of personal data privacy. Companies are now provided with limitless ways to extract information about their customers, even without their knowledge. This is especially concerning when it is the personal information of a child that is being collected, as in the United States, few regulations exist to protect them on social media. Even fewer regulations exist to protect children between the ages of thirteen and seventeen. The purpose of this Note is to discuss the importance between market research practices and children’s consumer privacy rights in the digital …

A New Antitrust Framework To Protect Mom And Pop From Big Tech, Cara Macdonald

Journal of the National Association of Administrative Law Judiciary

While the economy declined during the COVID-19 pandemic, big technology companies like Amazon and Oracle experienced unprecedented growth and influence. Critics argue big technology companies are finding this level of success in-part due to anticompetitive practices. The crux of the debate rests on whether current, traditional antitrust laws are sufficient to cope with big technology companies. Some theorists argue that current laws are adequate, while others assert that antitrust laws are insufficient to regulate big technology companies because they are so different from the types of companies antitrust laws were designed to regulate. This article concludes that big tech companies …
