The Internet community—just like all other speech communities—ought to be afforded First Amendment protections. I don't see any reason why Internet speech should be treated any less favorably than other kinds of speech. But the vastly overblown claim that the communications medium somehow deserves to be put outside normal legal constraints--because it's so global, or because it's so different—is self-defeating. It substitutes generalities and sentiments for real thinking. The kind of analysis we've seen at this conference—the kind of debate we've had here—is very useful, because we're talking about the specifics of what legal constraints should be allowed. Foucault In Cyberspace: Surveillance, Sovereignty, And Hardwired Censors, James Boyle

This is an essay about law in cyberspace. I focus on three interdependent phenomena: a set of political and legal assumptions that I call the jurisprudence of digital libertarianism, a separate but related set of beliefs about the state's supposed inability to regulate the Internet, and a preference for technological solutions to hard legal issues on-line. I make the familiar criticism that digital libertarianism is inadequate because of its blindness towards the effects of private power, and the less familiar claim that digital libertarianism is also surprisingly blind to the state's own power in cyberspace. Instructional Environments For Technology Inservice Education, Karen Jane Grove

This study examines different instructional formats for providing inservice education on classroom technology applications to elementary teachers. An intensive weekend workshop format was compared with a traditionally paced format for inservice education. Results are discussed in terms of measurable changes in teacher growth in the use of the applications and growth in the use of the applications with students. A secondary purpose was to determine if there was a relationship between learning styles and success in these two environments. Teachers' learning styles were identified using the Myers-Briggs Type Indicator. The results of the study indicate that intensive models of inservice …

Technology Use By A College Of Education Faculty And Factors Influencing Integration Of Technology In An Undergraduate Teacher Preparation Program, Christy J Falba

This study describes current levels of technology use by a College of Education (COE) faculty and use of technology in teaching classes. In addition, the formation of a systematic plan for integrating technology throughout the teacher preparation programs was explored. Both quantitative and qualitative methods were used in this two-phase study; Phase I survey results suggested that although 93% of faculty believed technology in teacher education was very important or somewhat important, use of technology in teaching was limited. Consistent with previous findings on university faculty use of technology, COE faculty rated themselves as having high levels of knowledge and …

The Supreme Court will bring the highest degree of clarity to the Internet freedom of speech debate if, in ACLU v. Reno, it sets forth the operative metaphor for freedom of speech and applies the metaphor in conjunction with an appropriate analogy for the technology.Part I of this Article discusses judicial decision-making tools with an emphasis on the use of analogy and the importance of applying legal precedents in a manner which is consistent and logical. Pornography Drives Technology: Why Not To Censor The Internet, Peter Johnson

Federal Communications Law Journal

Historically, the development of new media has been advanced by the creators of pornography. This was evident as communications media evolved from vernacular speech to movable type, to photography, to paperback books, to videotape, to cable and pay-TV, to 900 phone lines, to the French Minitel, and to the Internet. In short, pornography, far from being an evil that the First Amendment must endure, is a positive good that encourages experimentation with new technology. Accordingly, society should not view cyberpornographers as pariahs, rather they should be viewed as explorers who pave the roads for civilization to follow.

Digital Demons And Lost Lawyers: A Review Of Law In A Digital World By M. Ethan Katsh, Bruce A. Markell

The increase in technology gives rise to an interesting discussion on whether the way lawyers approach the law will change. This question is analyzed with Professor Katsh's premise that the increase in the use of computers and networks will ultimately change the manner in which lawyers accumulate and use information. The Reviewer defends the role of lawyers as being more than just "information providers;" lawyers are guardians of a distinguished service as well. The article depicts the visual and conceptual significance of the film “12 Monkeys”, directed by Terry Gilliam and starring Bruce Willis and Brad Pitt. In this film, movie genres and tropes are called into question. Terry Gilliam presents a visions of the future, but relies on the conventions of the American Western Formula. Gilliam tales a distinct approach to typical characters, allowing his proragonists to become onlookers to the foreboding issue at play. What Gilliam achieves in his 12 Monkeys is making the viewers “entertain” that the future depicted in the movie may be seen as a warning.

A Double-Barrelled Assault: How Technology And Judicial Interpretations Threaten Public Access To Law Enforcement Records, Jamison S. Prime

Recently, an explosion of media coverage has revealed gross misconduct on the part of many police officers in the United States. From Rodney King to Mark Furman, the events have raised grave questions about whether existing checks against police misconduct are effective. Yet, at this crucial period, technological advances and judicial interpretations undermine the ability of the public to access police records. The Author argues that most Freedom of Information (FOI) statutes provide inadequate access to police records in light of technological advances and narrow judicial interpretations of FOI statutes.

The continual "cultural wars" between "Generation X" ("baby busters" whose birth years begin with 1961, aged 11-35), and New Right "baby boomers" (whose birth years range. From 1946 to 1960), around the issue of violence as represented in the popular cultural forms of film and television provide critically concerned art educators with an opportune moment to examine how conservative rhetoric has made "moral panic" an object of current discourses. Art Education And Technology: These Are The Days Of Miracles And Wonder, Paul Duncum

Journal of Social Theory in Art Education

This paper examines the impact on human consciousness of the exponential proliferation of electronic images, and offers suggestions concerning how educators should respond. A postmodern critique includes the ideas of an inverted Kantian aesthetics which embraces the everyday, a dramatic compression of space and time, and personal disorientation. A further critique grounds these views of consciousness in new economic arrangements and the rapaciousness of capitalism. I argue that the only viable educational response to this new consciousness is a critical examination of mass media imagery. Basic components of media education in schools are signposts of an appropriate response.

As a result of ignorance and misconceptions about the nature of computer artwork, the computer artist is misunderstood by practitioners in fine art, art education, science, and industry. This paper enters the world of the computer artist to look at some of the factors which contribute to misperceptions. It examines social issues ranging from the design and use of hardware and software to access issues, and problems with concrete and electronic exhibition venues. Broadband Integrated Services Digital Network (R-ISDN) provides a range of narrowband and broad-band services for voice, video, and multimedia. Asynchronous Transfer Mode (ATM) has been selected by the standards bodies as the transfer mode for implementing B-ISDN; The ability to digitize images has lead to the prospect of reducing the physical space requirements, material costs, and manual labor of traditional film handling tasks in hospitals. The system which handles the acquisition, storage, and transmission of medical images is called a Picture Archiving and Communication System (PACS).
