Technology’S Impact On Student – Faculty Interaction: Issues For Collective Bargaining, Mark Piwinsky, Mary Beth Leidman, Mathew Mckeague
Technology’S Impact On Student – Faculty Interaction: Issues For Collective Bargaining, Mark Piwinsky, Mary Beth Leidman, Mathew Mckeague
Journal of Collective Bargaining in the Academy
Today’s faculty confront challenges that are reshaping their workload and creating new demands and expectations. A decline in the proportion of tenured faculty and an increased reliance on temporary faculty is problematic in a time of strong enrollment growth. The American Association of University Professors (Trends in Faculty Status, 2007) reports the proportion of full-time tenured and tenure-track faculty has declined from 56.8% in fall 1975 to 31.2% in fall 2007. Data from the National Center for Education Statistics (2005, 2008) show enrollments increased from 17.92 million in fall 2005 to 19.57 million in fall 2008. Schaffhauser (2010) reports that …

The Future Of Free Expression In A Digital Age, Jack M. Balkin
The Future Of Free Expression In A Digital Age, Jack M. Balkin
Pepperdine Law Review
In the twenty-first century, at the very moment that our economic and social lives are increasingly dominated by information technology and information flows, the judge-made doctrines of the First Amendment seem increasingly irrelevant to the key free speech battles of the future. The most important decisions affecting the future of freedom of speech will not occur in constitutional law; they will be decisions about technological design, legislative and administrative regulations, the formation of new business models, and the collective activities of end-users. Moreover, the values of freedom of expression will become subsumed within a larger set of concerns that I …
Of Frightened Horses And Autonomous Vehicles: Tort Law And Its Assimilation Of Innovations, Kyle Graham
Of Frightened Horses And Autonomous Vehicles: Tort Law And Its Assimilation Of Innovations, Kyle Graham
Faculty Publications
This symposium contribution considers five recurring themes in the application of tort law to new technologies. First, the initial batch of cases presented to courts may be atypical of later lawsuits that implicate the innovation, yet relate rules with surprising persistence. Second, these cases may be identified, and resolved, by reference to analogies that rely on similarities in form, and which do not wear well over time. Third, it may be difficult to isolate the unreasonable risks generated by an innovation from the benefits it is perceived to offer. Fourth, potential claims by early adopters of the technology may be …

Bio+Terror: Science, Security, Simulation, Melanie Armstrong
American Studies ETDs
The United States government has spent more than $125 billion since 2001 to prepare the nation for bioterrorism. This dissertation examines the emergence of bioterrorism as a credible threat in the contemporary moment, considering how the preparedness practices of the security state constitute new biopolitical formations. To explore how changing ways of knowing disease and risk are reshaping communities, this multi-sited study investigates the material outcomes of biosecurity in people's lives. It shows how complex histories of disease and terror are remade in the modern age to bring about new spaces and forms of biological citizenship.Through interview, observation and detailed …

Exerting Leadership With Students In The Utilization Of Social Networking Sites, Carole A. Mckenzie, Cheryl K. Kent
Exerting Leadership With Students In The Utilization Of Social Networking Sites, Carole A. Mckenzie, Cheryl K. Kent
Biennial Convention (CONV)
As social networking sites and new communications technology become more enmeshed in the fabric of everyday life, the professional, ethical and legal implications of this sociological phenomenon are just beginning to emerge in the literature. As professional programs begin to struggle with the consequences, both educationally and in the professional practice setting, educators need assistance with how to manage these issues. In nursing, the legal ramifications may also include the possibility of Health Insurance Portability and Accountability Act (HIPAA) violations. For all educators, the Family Educational Rights and Privacy Act (FEERPA) comes into play in terms of how information is …

The Igeneration: Technology Guidelines For Parents And Teachers, Karen A. Waldron
The Igeneration: Technology Guidelines For Parents And Teachers, Karen A. Waldron
Education Faculty Research
Ah, children and technology! At times, it can be overwhelming for families and educators to sort out the usefulness and danger of technological innovations in the hands of our youth. Often naïve of the outcomes of sending out personal information and photos, they worry us with their lack of understanding of consequences of “viral” messages and videos or about how much information they can safely share when others are willing to exploit their innocence. Yet when all else fails, we ask a 10-yearold for help in solving a computer problem and are usually astonished at the confidence and competence demonstrated …
Principals And Technology: A Case Study Of The Use And Perceived Effectiveness Of Technology To Communicate With Constituents, Bonnie Ann Allman
Principals And Technology: A Case Study Of The Use And Perceived Effectiveness Of Technology To Communicate With Constituents, Bonnie Ann Allman
Theses, Dissertations and Capstones
Among the many qualities or attributes that serve as the framework for school leadership development programs, communication is repeatedly noted as being an important facet of the administrative leader’s repertoire (Finch, Gregson & Faulkner, 1992; Gougeon, 1991). It is not enough for a leader to be concerned only about communicating with constituents; it is essential that the leader also considers the effectiveness of this communication (Gougeon, 1991). The consolidation of schools in West Virginia over the past forty years has placed more importance on the ability of a principal to communicate with staff, other administrators, students, parents and communities. Each …

Technology's Role In Constructing Meaningful Knowledge, Joseph Mayo
Pedagogy and the Human Sciences
This paper discusses technology’s role in meaningful knowledge construction, which hinges on ways computer tools can be used to improve pedagogy through actively engaging learners. At the center of this discussion is the difference between stand-alone technological literacy that serves as an end in itself, and educationally defensible information literacy that represents a technology-assisted means to the end of metacognitive reflection as a salient component of an undergraduate liberal education. Drawing on learning principles embodied in the theoretical frameworks of Seymour Papert’s constructionism and Gordon Pask’s conversation theory, personalized computer applications of concept maps, mind maps, and repertory grids are …

Law Faculty Blogs And Disruptive Innovation, J. Robert Brown Jr.
Law Faculty Blogs And Disruptive Innovation, J. Robert Brown Jr.
Sturm College of Law: Faculty Scholarship
The role of blogging in legal academia has been much debated. Some view the discipline as the antithesis of scholarship, a medium that allows faculty to broadcast ignorant or confused opinions. Others have viewed blogging by law faculty more favorably, focusing on the approach as a means of promoting traditional scholarship. While the debate has been ongoing, the matter has largely been resolved by actual practice. In the realm of legal scholarship, faculty law blogs are a disruptive innovation. Disruptive innovation usually connotes the introduction of a new technology that eventually destabilizes an existing market. Often, the technology, when introduced, …
Energy Subsidies, Market Distortion, And A Free Market Alternative, Hans Biebl
Energy Subsidies, Market Distortion, And A Free Market Alternative, Hans Biebl
University of Michigan Journal of Law Reform Caveat
Gas and coal are cheap. They are cheap because the U.S. government subsidizes their production. The result is that the marketplace does not recognize the true cost of fossil fuels. Without the subsidies, Americans—for the first time in nearly a hundred years—would experience the cost of unsubsidized fossil fuels. In a newly competitive marketplace, renewable sources of energy would be in a better position to compete. Without gas and coal subsidies, clean energy producers, who have not been able to compete with the low price of fossil fuels, might be more willing to invest in “clean, renewable, and more energy …

Creating An Interactive Past Digital Technologies For Public Representation Of Archaeological Sites And Artifacts, Alexis Santos
Creating An Interactive Past Digital Technologies For Public Representation Of Archaeological Sites And Artifacts, Alexis Santos
Theses & ETDs
Archaeological sites are met with a wide array of constraints ranging from limiting budgets to a lack of standing structures that pose unique challenges when creating representations of the sites and artifacts for the public. This thesis notes that archaeologists have not widely embraced digital technologies for the representation of archaeological sites and artifacts, posits that digital technologies enable archaeologists to excel within financial and material constraints, and argues for an expanded use of digital technologies in archaeological representations. Specifically, this thesis focuses on how three digital technologies augmented reality, video mapping and online repositories can enable the …

No Cause Of Action: Video Surveillance In New York City, Olivia J. Greer
No Cause Of Action: Video Surveillance In New York City, Olivia J. Greer
Michigan Telecommunications & Technology Law Review
In 2010, New York City Police Commissioner Raymond Kelly announced a new network of video surveillance in the City. The new network would be able to prevent future terrorist attacks by identifying suspicious behavior before catastrophic events could take place. Kelly told reporters, "If we're looking for a person in a red jacket, we can call up all the red jackets filmed in the last 30 days," and "[w]e're beginning to use software that can identify suspicious objects or behaviors." Gothamist later made a witticism of Kelly's statement, remarking, "Note to terrorists: red jackets are not a good look for …

The Missed Opportunity Of United States V. Jones: Commercial Erosion Of Fourth Amendment Protection In A Post Google Earth World, Mary Graw Leary
Scholarly Articles
The Fourth Amendment protects people from unreasonable searches and seizures by the government. These protections, therefore, are only triggered when the government engages is a “search” or “seizure.” For decades, the Court defined “search” as a government examination of an area where one has a “reasonable expectation of privacy.” Such an expectation requires both that the individual demonstrate a subjective expectation of privacy and that the expectation is one society finds reasonable. In 1974, Anthony Amsterdam prophesized the unworkability of this test, warning of a day that the government would circumvent it my merely announcing 24 hour surveillance. Similarly, the …

Is A Substantive, Non-Positivist United States Environmental Law Possible?, Dan Tarlock
Is A Substantive, Non-Positivist United States Environmental Law Possible?, Dan Tarlock
Michigan Journal of Environmental & Administrative Law
U.S. environmental law is almost exclusively positive and procedural. The foundation is the pollution control and biodiversity conservation statutes enacted primarily between 1969–1980 and judicial decisions interpreting them. This law has created detailed processes for making decisions but has produced few substantive constraints on private and public decisions which impair the environment. Several substantive candidates have been proposed, such as the common law, a constitutional right to a healthy environment, the public trust, and the extension of rights to fauna and flora. However, these candidates have not produced the hoped for substantive law. Many argue that a substantive U.S. environmental …
Enhancing Public Access To Online Rulemaking Information, Cary Coglianese
Enhancing Public Access To Online Rulemaking Information, Cary Coglianese
Michigan Journal of Environmental & Administrative Law
One of the most significant powers exercised by federal agencies is their power to make rules. Given the importance of agency rulemaking, the process by which agencies develop rules has long been subject to procedural requirements aiming to advance democratic values of openness and public participation. With the advent of the digital age, government agencies have engaged in increasing efforts to make rulemaking information available online as well as to elicit public participation via electronic means of communication. How successful are these efforts? How might they be improved? In this article, I investigate agencies’ efforts to make rulemaking information available …
Voting Technology And The Quest For Trustworthy Elections, Candice Hoke
Voting Technology And The Quest For Trustworthy Elections, Candice Hoke
Law Faculty Contributions to Books
This chapter reviews four dimensions of the still-unresolved voting technology quandary. It begins by briefly reviewing the Florida Bush v. Gore background that, combined with the tradition of state governmental control over election administration, spawned the contours and limitations of new federal regulatory apparatus. It also surveys some illustrative voting system malfunctions and their consequences surfacing predominantly from 2009–12.
The second part of this chapter, Federal Compulsion to Adopt Software-Based Voting Technologies, explains the misconceptions about software and digital equipment that led to both the flawed federal mandates and the ineffectual regulatory structure.
The third part of this chapter, Litigation …

(De)Fencing The Cultural Commons Through A (De)Constructive Media Art Curriculum, Steven Ciampaglia
Journal of Social Theory in Art Education
Rampant consolidation in the media industry has led to an ever-increasing push to extend the breadth and scope of copyright law. A deliberate and systematic effort to restrict access to cultural texts that were previously accessible has led to a creative climate that is increasingly intimidating to young artists. The personal computer provides students the ability to re-open these texts and reclaim their right to fairly use the cultural artifacts of their surroundings as building blocks of expression. The personal computer can deconstruct closed media texts into malleable parts of visual language that students can reconstruct into new texts. These …
