The sector has also continuously received low rankings in categories concerning nonprofit financial health and was cited to have some of the slowest growing charities in the nation. The Tangled Web Of Plagiarism Litigation: Sorting Out The Legal Issues, Ralph D. Mawdsley

Law Faculty Articles and Essays

The purpose of this article is to explore the increasing complexity of plagiarism litigation in the United States. A determination as to when attribution is necessary in order to avoid a charge of plagiarism raises questions of intent and subject matter specific questions of general knowledge, as well as constitutional and contractual questions of fairness, tort questions of defamation, and questions of fair use under copyright law or misrepresentation under the Lanham Act. Most of the reported cases still involve students who contest discipline from their respective academic institutions--discipline that can range from a course penalty to expulsion from the …

Symposium: The Civil Rights Roots Of Tinker's Disruption Tests, Kristi L. Bowman Jan 2009

Symposium: The Civil Rights Roots Of Tinker's Disruption Tests, Kristi L. Bowman

American University Law Review

This past spring marked the fortieth anniversary of Tinker v. Des Moines Independent Community School District, the landmark student speech case in which the Supreme Court held that three students were protected by the First Amendment when they wore black armbands in their Des Moines, Iowa public schools to protest the Vietnam War. Looking at Supreme Court precedent alone, it would seem as though the Tinker tests were created out of whole cloth: the substantial or material disruption, reasonable anticipation of such disruption, and rights of others tests did not have much of a basis in earlier Supreme Court decisions. …

How Do You Know That? An Investigation Of Student Research Practices In The Digital Age, Randall Mcclure, Kellian Clink

Library Services Publications

This study investigates the types of sources that English composition students use in their research essays. Unlike previous studies, this project pairs an examination of source citations with deeper analysis of source use, and both are discussed in relation to responses gathered in focus groups with participating students and teachers. The researchers examine how students negotiate locating and using source material, particularly online sources, in terms of timeliness, authority, and bias. The researchers report on how teachers struggle to introduce these concepts and how students fail to perceive authority and bias in their sources.

Learning Our Lessons: A Proactive Approach To Bibliotherapy And Its Application To Children, Marleah Augustine Jan 2009

Learning Our Lessons: A Proactive Approach To Bibliotherapy And Its Application To Children, Marleah Augustine

Master's Theses or Doctor of Nursing Practice

The current study examined whether children can learn behaviors from fictional characters in books. Additionally, the researcher explored whether discussion of the topic at hand would improve the learning of those behaviors or if it would have no effect and reading alone can elicit change. Children in kindergarten and first-grade (n = 85) took both a pre-test and post-test about two separate topics, bullying and trying new things. They were assigned to four different groups: book only, discussion only, both book and discussion, and unrelated book. No significant differences were found between groups regarding the "trying new things" topic, whereas …

Examining Cultural Competence Among Osteopathic Medical Students , Sooni Lee Jan 2009

Examining Cultural Competence Among Osteopathic Medical Students , Sooni Lee

PCOM Psychology Dissertations

With the growing number of racial and ethnic minorities in the United States, there also has been a rise in health disparities. Ethnic minorities have been experiencing an overabundance of medical issues, particularly chronic diseases like cardiovascular disease, diabetes, and cancer. Although these chronic diseases are preventable, ethnic minorities are at greater risk for death from them. Possible contributing factors to the increase in health disparities include limited medical attention and follow-up appointments with physicians and the physician-patient relationship. The purpose of this study was twofold: to examine cultural competence among osteopathic medical students and to examine their attitudes toward …

School climate is created through the combined culture of the adults and students within a school – both the culture they share as an organization and the diverse cultures they bring from home. This study compared the school climate of two elementary schools, one urban and one suburban, by measuring 179 fourth and fifth grade students’ and 65 teachers’ perceptions of their schools’ ethical climates. The Elementary School Ethical Climate Index (ESECI) was utilized to factor perceptions into teacher to student, student to teacher/learning environment, and student to student interactions. For each of the ESECI subscales, two-way analyses of variance …

This study surveyed a stratified random sample of 2,000 teachers in Pennsylvania with 141 usable responses. The purpose of this study was to ascertain teacher understanding of components of RTI in districts using and not using RTI and to determine if district implementation procedures impacted perceived effectiveness. Biofeedback Assisted Relaxation Training Program To Decrease Test Anxiety In Nursing Students, Catherine Andrea Prato Jan 2009

Biofeedback Assisted Relaxation Training Program To Decrease Test Anxiety In Nursing Students, Catherine Andrea Prato

UNLV Theses, Dissertations, Professional Papers, and Capstones

Nursing programs have been cited as being among the most stressful undergraduate programs. Students' knowledge and skills are consistently tested and monitored, and students may fail a course or be dropped from their nursing program if scores are not above a certain standard. Anxiety reactions are common to situations perceived as threatening; however, excessive anxiety may paralyze an individual and interfere with effective learning, functioning, and testing. Numerous studies have found increased anxiety causes physiological changes including increased respirations and heart rate, and decreased peripheral skin temperature. The purpose of this study was two fold. First test anxiety was measured …

(Excerpt)

I have to give this disclaimer. I am high grader when it comes to contract drafting. So even though my presentation is on critiquing and grading, truthfully it’s more about critiquing for me. I will get into that in a minute. My name is Robin Boyle, and I teach at St. John’s University School of Law. First, my background. I was an evening student at Fordham and worked in law firms during the day in both litigation and corporate practices. By the time I graduated, I worked at a large law firm, which I had summered at and then …
