College Students’ Online Speech: Searching For The Appropriate Standards Within First Amendment Case Principles, Jeffrey C. Sun, Neal H. Hutchens Jan 2014

College Students’ Online Speech: Searching For The Appropriate Standards Within First Amendment Case Principles, Jeffrey C. Sun, Neal H. Hutchens

Cardozo Law Review de•novo

College student free speech cases, particularly as applied to student online speech challenges, suffer from conflicting legal principles. This paper highlights empirically noted problems in resolving disputes between a college student’s free speech rights and a public college’s authority to maintain order and campus safety. In Part I of this paper, the authors present the established legal principles from two foundational cases addressing issues of student speech in the educational context. In Part II, the authors demonstrate how courts have used PK12 education cases and public employment cases as sources that address legal principles for college student speech cases—particularly to …

The Basic Logic Of Post-Tinker Jurisprudence, R. George Wright Jan 2014

The Basic Logic Of Post-Tinker Jurisprudence, R. George Wright

Cardozo Law Review de•novo

Tinker v. Des Moines Independent Community School District is rightly regarded as a landmark student speech case. At this point, however, it is fair and important to ask about the likely consequences of radically abandoning Tinker and the succeeding case law. What might it mean, at this historical point, to abandon Tinker along with its qualifying and limiting cases? The discussion briefly pursues this question and endorses a radical abandonment of Tinker and the succeeding cases as binding case law.

Autism Interventions In Educational Settings: Delivery Within A Response To Intervention Framework, Caitlin E. Gilmartin

PCOM Psychology Dissertations

Monitoring the progress of and delivering services to students with Autism present a unique challenge. Numerous interventions exist without a common, mandated progress monitoring system or service delivery system. The current study examined the principles of Response to Intervention (RTI) programs in the context of service delivery for students with Autism. An innovative service delivery system, the Autism Response to Systematic Intervention (ARTSI), was designed utilizing these principles. Outcomes of the study included a manual for the program, as well as forms and necessary materials to provide initial program implementation. Initial comment from stakeholders, future directives, and limitations are also …

Dark Sarcasm In The Classroom: The Failure Of The Courts To Recognize Students' Severe Emotional Harm As Unconstitutional, Emily Suski Jan 2014

Dark Sarcasm In The Classroom: The Failure Of The Courts To Recognize Students' Severe Emotional Harm As Unconstitutional, Emily Suski

Faculty Publications

Sometimes the very people who are supposed to teach, nurture, and protect students in public schools — the students’ teachers, principals, coaches, and other school officials — are instead the people who harm them. Public school officials have beaten students, causing significant physical harm. They have also left students suffering from depression, suicidal ideation, and Post-Traumatic Stress Disorder. When school officials cause such severe harm to students, all the federal courts of appeals to consider the issue have concluded that the Fourteenth Amendment at least in theory protects them, regardless of whether the form of the harm is emotional or …

Identification Of Threshold Concepts For Biochemistry, Jennifer Loertscher, David Green, Jennifer E. Lewis, Sara Lin, Vicky Minderhout

Chemistry Faculty Publications

Threshold concepts (TCs) are concepts that, when mastered, represent a transformed understanding of a discipline without which the learner cannot progress. We have undertaken a process involving more than 75 faculty members and 50 undergraduate students to identify a working list of TCs for biochemistry. The process of identifying TCs for biochemistry was modeled on extensive work related to TCs across a range of disciplines and included faculty workshops and student interviews. Using an iterative process, we prioritized five concepts on which to focus future development of instructional materials. Broadly defined, the concepts are steady state, biochemical pathway dynamics and …

The Case Of Dixon V. Alabama: From Civil Rights To Students' Rights And Back Again, Philip Lee

Journal Articles

On February 25, 1960, African American students from Alabama State College participated in a sit-in at a segregated lunch grill at the Montgomery County Courthouse. The lunch grill refused to serve the students and ordered them to leave. The students left and went to the courthouse corridor, where they remained for an hour before going back to campus.

When Alabama State College learned of the students’ actions, it summarily expelled them without notice or hearing. In expelling the students, the college relied on Alabama State Board of Education regulations that allowed it to expel students for “conduct unbecoming a student …

Psychopathy And The Hexaco Personality Model, M. Todd Lobrano Jan 2014

Psychopathy And The Hexaco Personality Model, M. Todd Lobrano

Doctoral Dissertations

Within the recently published DSM-5, alternative diagnostic criteria for personality disorders have been offered (American Psychiatric Association [APA], 2013). These changes allow for a more dimensional diagnostic system than has been previously used while maintaining some aspects of a categorical system (Skodol et al., 2011). These changes also include a description of specific traits that characterize personality disorders and make it possible for measures of normal personality to have a more significant impact in their diagnosis. Relevant to the present study are the changes in the diagnosis of antisocial personality disorder and psychopathy, considered by many to be an extreme …

After the fall of the Soviet Union in 1991, Professor Marina Kaul of the Russian State University for the Humanities (RGGU), together with Professor Irwin Weil of Northwestern University, co-founded the American Studies Center at RGGU, the two-fold goals of which were 1) to expose post-Soviet Russian scholars and students to a reasonably objective view and appreciation of American history, culture, and politics; and 2) to help American scholars and students to see themselves as others saw them. Thus far, the Center has held annual conferences, facilitated professional and student exchanges, and published numerous conference proceedings. It has enjoyed the …

From Keyboard To Schoolhouse: Student Speech In An Age Of Pervasive Technology, Erin M. Leach Jan 2014

From Keyboard To Schoolhouse: Student Speech In An Age Of Pervasive Technology, Erin M. Leach

Missouri Law Review

To most Americans, the First Amendment's Free Speech Clause is among the most sacred provisions of the Constitution. At first reading, it seems a broad guarantee of the right of citizens to speak their mind without limitation. But the jurisprudence on the clause shows that the law governing free speech is far from uncomplicated. The analysis is made more complex in the context of student speech due to a different set of standards governing the rights of students while they are under the care of their schools. S.J.W ex rel. Wilson v. Lee's Summit R-7 School District, a recent Eighth …

Why Teach Pe? Factors That Affect Students' Decisions To Teach Physical Education Revisited, Patrick Mcgaha, David C. Barney

Faculty Publications

Many times a child will be asked, "What do you want to be when you grow up?" The answers are varied, yet their responses usually reflect what their parents' employment may be. For this study, factors were investigated that have an effect on college students' decisions to become physical educators. For this study it was found that former physical education and coaches were the most influential people affecting college students' decision to become physical education teachers, not parents. It was also found that many of these college students were actively involved in high school athletics, thus also affecting their decision …

The Constitutional Limit Of Zero Tolerance In Schools, Derek W. Black Jan 2014

The Constitutional Limit Of Zero Tolerance In Schools, Derek W. Black

Faculty Publications

With the introduction of modern zero tolerance policies, schools now punish much more behavior than they ever have before. But not all the behavior is bad. Schools have expelled the student who brings aspirin or fingernail clippers to campus, who does not know that a keychain knife in his backpack, or who reports having taken away a knife from another student in order to keep everyone safe. Despite challenges to these examples, courts have upheld the suspension and expulsion of this good-faith, innocuous behavior. With little explanation, courts have opined that the Constitution places no meaningful limit on the application …

Improving Enrollment In The Construction Management Graduate Program Through Students’ Perspectives, Mouloud Messaoudi

Master of Technology Management Plan II Graduate Projects

Low enrollment and the decrease in graduation and retention rates are challenges facing the growth of the Master’s in Technology Management – Construction Management (MTM-CM) program at BGSU. In addition, the competition between the universities to enroll and retain more in-state, out-of-state, and international students is aggressive. There is a need for a revaluation for the MTM-CM program in order to attract more students in the future. This study is a necessary step to know what the MTM-CM students think about the product delivered to them at BGSU. There was no prior study investigating the satisfaction level of the construction …

Intrusiveness Of Behavioral Treatments For Children With Autism And Developmental Disabilities: An Initial Investigation, Michael R. Mayton, Stacy L. Carter, Jie Zhang, John J. Wheeler

ETSU Faculty Works

The behaviors frequently displayed by students with autism can place them at risk for overly reactive behavior interventions with unwanted side effects. The current study examined the level of intrusiveness of behavioral treatments developed for 198 students with disabilities from 13 different states. Results demonstrated that students diagnosed with autism had proportionally more intrusive behavior interventions when compared to students in five other disability categories and indicated that many students with autism were unnecessarily subjected to highly intrusive behavior interventions. The implications of these findings are discussed, and recommendations for future research are provided.
