The Jawboning Cases End With A Bang Disguised By A Whimper, Derek E. Bambauer Jan 2024

The Jawboning Cases End With A Bang Disguised By A Whimper, Derek E. Bambauer

UF Law Faculty Publications

Jawboning is government enforcement through informal channels, where the underlying authority is in doubt. Government actors at all levels have increasingly deployed this tactic to pressure Internet platforms to suppress disfavored speech. Internet jawboning debuted at the Supreme Court in two cases (National Rifle Association of America v. Vullo and Murthy v. Missouri) in 2023. Although the Court disposed of both cases on procedural and standing grounds, rather than offering a new methodology for evaluating jawboning, the opinions offer examples of what a successful jawboning claim looks like and what an unsuccessful claim lacks. Thus, jawboning as a …

Using Social Media As A Tool To Inform Person-Centred Justice, Matthew Dylag

Articles, Book Chapters, & Popular Press

Many leading access to justice organizations recognize the importance of including the public’s perspective within programming and policy development. One key question underlying this approach is, how can organizations learn about the public’s experience with legal problems and the law? Noting that conversations about legal problems provide evidence of such experiences, this paper presents a study that examines conversations posted to the social media platform Reddit. It argues that social media can be leveraged to better understand the public’s experience with legal problems and the law and, in doing so, help to inform a person-centred perspective of justice.

Machine Manipulation: Why An Ai Editor Does Not Serve First Amendment Values, Alec Peters

University of Colorado Law Review

The past few years have seen increasing calls for regulation of large social media platforms, and several states have recently enacted laws regulating their content moderation, promotion, and recommendation practices. But if those platforms are exercising editorial discretion when carrying out these tasks, many of the regulations will run into constitutional concerns: the First Amendment protects the “exercise of editorial control and judgment” by publishers over their choice of content and how it is presented. However, the editorial operation of social media platforms differs significantly from traditional media, most importantly in the use of artificial intelligence (AI) for editorial decision-making. …

Adolescent girls face increased pressure to conform to societal standards. As social beings, adolescent girls gravitate to social media as an outlet for peer interaction, community, and validation. Research has found that at the critical age of adolescence, 12-18, girls experience appearance comparison on social media, which can lead to internalizing unrealistic beauty standards and negative self-appraisal. Digital storytelling emerges as a source of encouragement, providing a platform for empowerment, self-expression, community engagement, and a safe space for adolescent girls to share their body image and self-esteem experiences. This Systematic Review sought to synthesize findings of qualitative and mixed-methods studies …

Coattailing For Regime Continuity?: Unraveling Duterte's Legacy In Marcos Jr.'S 2022 Electoral Victory, Gabrielle Ann S. Mendoza, Imelda B. Deinla, Cristine Lian C. Domingo, Jurel K. Yap

Ateneo School of Government Publications

The electoral victory of President Ferdinand Marcos Jr. has been attributed to a range of factors such as misinformation, patronage, and populism. We argue that Marcos’ electoral victory should not be treated as an isolated instantaneous event, but rather a result of a shift in the country's political narrative due to the legacy of his predecessor. The shift to illiberal populism is tied to the public's continued support for Duterte's flagship policies as well as in the proliferation of populist rhetoric on social media. Using a non-probability survey of 1500 Filipinos, we find that support for President Duterte and his …

The Original Instagram: Whose Property Is It?, Sue Altmeyer

Akron Law Faculty Publications

This article examines why the “Original Creation and Transfer” test is a better approach than implied transfer when determining ownership of a social media account. The Original Creation and Transfer test promotes judicial economy, clarity, and predictability. It also has the advantages of a property rule, namely encouraging investment, reducing litigation, and allowing employee mobility. This test achieves the proper balance between worker and employer rights and yields fair results in test cases. Additionally, a uniform law should be created based on the Original Creation and Transfer test to help promote uniformity across jurisdictions.

Protecting Free Speech In Social Media: A Pathway To Self-Determination In International Law, Sydney Marie Harley Jan 2024

Protecting Free Speech In Social Media: A Pathway To Self-Determination In International Law, Sydney Marie Harley

Emory International Law Review Recent Developments

With the growth of Internet and social media usage, state regulatory action to surveil and censor citizens is running rampant. As the principle of self-determination stands, minority populations are typically bearing the brunt of these attacks, receiving little protection under domestic and international law. Self-determination within international law must be restructured into a definitive pathway that includes protecting the freedom of speech to encourage discourse and tolerance between the State and its minority populations. This article proposes a solution that could fill the gap in international law formed by insufficient domestic rule in States that neglect to protect these populations …

Transition-Aged Youth Perspectives On Social Media Use Behaviors And Mental Health: A Qualitative Study, Lauren L. Niles

Dissertations

Rates of mental health difficulties have risen drastically in recent years. Transition-aged youth (TAY) ages 18-24 years old represent a vulnerable population at risk for poor mental health outcomes, with depression and anxiety diagnoses increasing faster than any other age group. While the cause for this upsurge is multifaceted, these trends have occurred concurrently with the increasing popularity of social media (SM) platforms. Current evidence presents contradictory findings as to the impact of SM platforms on mental health, revealing a critical gap in knowledge. This study addresses this gap by exploring how TAY perceive their use of SM platforms and …

The problem arises when this data, particularly personal data, is misused. This dilemma of choosing which information to share is incredibly important as social media and the internet evolve. Taking control of one’s privacy may assist in determining which information to share and may reduce stress …

Does Attention Control Mediate The Negative Effects Online Usage Exerts On College Students' Gpa, Carolina Rodriguez

Honors Undergraduate Theses

Online media, especially social media, is a continuously growing area of research which has raised questions about its impacts on academic outcomes. Many previous studies have established a negative relation between social media use and academic performance; however, the mechanism behind this finding is still unknown. The present study investigated whether level of attention control mediates the relation between an individual’s propensity for online usage and grade point average (GPA). Undergraduate students at the University of Central Florida (N=226) were recruited for this study, and their levels of online vigilance and attention control were measured. College GPA was self-reported by …

Into The Activism: An Exploration Of Gen Z'S Political Participation, Nia J. Davis Jan 2024

Into The Activism: An Exploration Of Gen Z'S Political Participation, Nia J. Davis

Honors Undergraduate Theses

Gen Z is a considerably politically active generation. However, Gen Z differs from previous generations in their methodology, campaigning for change through both in person and digital activism. While both forms of activism are effective in their own way, digital poses a unique challenge. When people can be activists from the comfort of their phone, they become “slacktivists”. People whose activism does not contribute to any significant action outside of the internet (Serup Christensen).

Through interviews and focus groups, my documentary explores how Gen Z participates in activism, and what that means for the future of activism. After these discussions, …

The Impact Of Social Media On Charitable Giving For Nonprofit Organization, Namchul Shin

Journal of International Technology and Information Management

Research has extensively studied nonprofit organizations’ use of social media for communications and interactions with supporters. However, there has been limited research examining the impact of social media on charitable giving. This research attempts to address the gap by empirically examining the relationship between the use of social media and charitable giving for nonprofit organizations. We employ a data set of the Nonprofit Times’ top 100 nonprofits ranked by total revenue for the empirical analysis. As measures for social media traction, i.e., how extensively nonprofits draw supporters on their social media sites, we use Facebook Likes, Twitter Followers, and Instagram …
