The work of Kenneth Burke provides a method of rhetorical analysis that is useful in terms of bringing features of texts to the surface that are not readily apparent, such as how they produce identification in their audiences, and in revealing rhetorical factors related to but outside the text, for example the authors' motives. Burke's work is wide-ranging and open to many interpretations, so it can be difficult to apply. We live in a time of radically changing conceptions of family and of the relationships possible between children and parents. Though undergoing "a sea-change," family law remains tethered to culturally embedded stories and symbols. While so bound, family law will fail to serve individual families and a society whose family structures diverge sharply by education, race, class, and income.

After laying out a conventional account of the formalism vs. realism debates, this Article argues that formalism and realism are at once impossible and entrenched. To say they are impossible is to say that they are not as represented--that they cannot deliver their promised goods. To say that they are entrenched is to say that these forms of thought are sedimented as thought and practice throughout law's empire. We live thus amidst the ruins of formalism and realism. This dissertation is a rhetorical analysis of hip hop music and culture. Chapter 1 focuses on adding hip hop rhetoric to the discussion and terrain of rhetoric and writing studies and to the rhetorical tradition. Chapter 2 uses the rhetorical notion of kairos to discuss the ethos of hip hop culture and discourse. Chapter 3 uses hip hop rhetoric to discuss the tensuous-solidarity between Latinos and African Americans. Chapter 4 focuses on Latino/Borderland Hip Hop and discusses the multi-consciousness of Latino identity. Chapter 5 focuses on Christiian religious imagery in gangsta rap music. There is also a short conclusion.

In the last two decades, scholars in Rhetoric and Writing Studies have been calling for a greater representation of voices of those from other cultures who participated in rhetorical practices. As Jacqueline Jones Royster contends, rhetoric has been framed as mostly white, male, and elite, and that these positions distort the democratic perspective of our discipline. This study is an examination of a corpus of computer mediated Korean discourse (i.e., e-mail), based on a folk-cultural category, nunch’i. Nunch’i is actively involved in linguistic feature use in terms of [+age] and [+distance] of human relationships. Many Koreans think that the world has an inherent hierarchy according to age. This idea has been reflected through nunch’i, a culture-specific system for maintaining harmonious social relationships especially between [+age] and [–age] people. Audio-visual Rhetoric is a knowledge domain for designers in theory and practice that is valid for all communicative actions through media that aim for persuasion. Within this domain, we introduce a framework for media analysis. We developed an Audio-Visual Pattern (AVP) language for film that is visualized within a notation system. This system shows auditory and visual parameters in order to reveal film's rhetorical structure. We discuss related theories from pattern language and rhetoric and apply the AVP method to analyze 10 commercials.

This article proceeds from a way of thinking about legal-rights reasoning that is grounded in the rhetorical tradition. In light of questions of political legitimacy and personal ethics, a central premise of the article is that the rhetorical enterprise must situate itself within a paradigm of dialogic communication in which mutual persuasion is the orientation to argument and the quest for intersubjective validation of claimed premises, lines of argument, and conclusions is the purposive mode. Legal education fails students by not appreciating the rhetorical basis of legal reasoning and argumentation. I draw from Vico's "On the Study Methods of Our Time" and Llewellyn's legal realism; both argued that law and legal reasoning are exemplary sites of rhetoric. I suggest that contemporary cognitive studies of the metaphorical structure of human understanding and the initiatives of the "new legal realism" carry forward the insights of Vico and Llewellyn. This re-orientation corrects the shallow and instrumentalist outlook of most lawyers.

This research analyzes changes in the rhetoric of a sustaining myth in order to better assess what happens when a myth is threatened. By examining American sport and its current struggle to withstand the widespread use of steroids, the author investigates how public discourse about the scandal turns athletes from mythical heroes to cheaters. The author begins by explicating the rhetorical construction of the athlete as a moral hero in America and how this myth is perpetuated today. We conducted an experiment to assess the effect of presidential rhetoric in a time of crisis. Our study was based in part on terror management theory, which posits that subtle reminders of death (mortality salience) lead to increased support of leaders an authority figures. Subjects were randomly placed in either a mortality salient condition or control condition. We also composed two speeches - one charismatic and one non-charismatic - and subjects were randomly assigned to hear one of the two. The main objective of the research described in this dissertation was to explore how English second language (ESL) writers used their first language (L1) when composing in their second language (L2). This task was undertaken by identifying participants according to their L2 (English) proficiency level, Latino ethnic subgroup, and generational status. Documentation Style As Rhetorical Device: A Comparative Analysis Of Two Bibliographic Systems, Gregory A. Smith

The documentation styles developed by the Modern Language Association and the American Psychological Association reflect divergent assumptions regarding the apprehension and communication of knowledge. Each system expresses its rhetorical character through the aims it articulates, the sources it values, and the formats it prescribes for in-text citations and bibliographic references. Like other scholarly writing conventions, documentation styles are not arbitrary, but both shape and are shaped by the discourse communities that they serve. Emerging scholars need to be acculturated purposively to the conventions of their respective communities, while authors should consciously select bibliographic systems that support their rhetorical aims.

Traditionally, the Boydell Shakespeare Gallery is considered an important moment in England’s art history narrative. In this essay, I argue that the Boydell collection also reflects a new preference for reading Shakespeare’s plays in the eighteenth century via its editorial illustration of parts of the plays that would not normally be emphasized in theatrical productions.

In this essay, I explore the possibilities of rhetoric as gift. I begin with the Homeric gift economy and the rhetorical resources of this economy. My use of "economy" here is not reducible to a monetary exchange system, but rather a more general system of practices orchestrating cultural identity and relations. This study explores the ways cookbooks and their rhetorical dimensions have been re-imagined using hypertext and Web technology. Using the tenets of postmodern feminist rhetoric and Web design theory, the study considers how commercial cooking hypertexts construct users' identities. Although hypertext is a potentially empowering technology, democratizing rhetoric and knowledge making practices, commercial hypertext often circumscribes agency formation and prohibits participation. Participatory, constructive hypertexts are difficult to design and costly to maintain. Of the three sites studied, Epicurious.com, BettyCrocker.com, and FoodNetwork.com, only Epicurious.com encourages meaningful communication between users and between users and designers. This Article corrects widespread misconception about whether complex regulatory systems can be fairly described as either "rules-based" or "principles-based" (also called "standards-based"). Promiscuous use of these labels has proliferated in the years since the implosion of Enron Corp. While the concepts of rules and principles (or standards) are useful to classify individual provisions, they are not scalable to the level of complex regulatory systems. This dissertation connects classical theories regarding the enthymeme and thumos (a Greek word commonly translated as "heart," "mind," or one's "capacity for emotion") to modern theories of images and emotion in order to reconsider the central role of visual discourse in persuasion, ideology, and subject formation. Since "enthymeme" comes from en and thymos, meaning "in heart," etymologically the enthymeme is an argument that is realized in an individual's thumos.

Despite decades of efforts to reform American rape law, prosecution and conviction rates remain low compared to similar crimes. While activists led legislatures to adopt important statutory changes for rape and sexual assault, only modest effects in the levels of sexual violence have been observed. Nonetheless, reform-minded scholars continue to focus on statutory and rule tinkering as a means to quell sexual violence.

This article argues against the commonly-held belief that the crucial factors in determining the outcome of rape trials are substantive and procedural in nature. Rather, the issues of performance, representation, and language often pre-determine the outcomes of …
