After School Policy In The State Of Michigan, Erica Curry Jul 2006

After School Policy In The State Of Michigan, Erica Curry

SPNA Review

Young people spend just 20 percent of their waking hours in school. Nationwide, 28 million children between the ages of 6 and 17 have parents who work outside the home. These children need care and supervision before and after school, over the summer, and during school breaks. Often, the supply does not meet the demand, and many of the children are not able to get the care and supervision they need. In fact, lack of funding is causing many school-age programs to reduce services or to shut down completely. The lack of care is not without consequences. This paper examines …

A Budgetary Process Of Michigan State Parks, Kimberly Ann Langley Jul 2006

A Budgetary Process Of Michigan State Parks, Kimberly Ann Langley

SPNA Review

This analysis addresses issues of budgeting in Michigan State Parks. Understanding the budgetary process is key, especially with the current state of the economy. Today, the Michigan State Park system is 4.5 million dollars in debt, and there is no relief in sight. For the last past 3 years, increases in state park fees have been seen. However, these increases can no longer go on forever. Something other than fee increases must occur to save the Michigan State Park system. There is currently discussion about closing some Michigan State Parks because the state cannot afford to keep them open. Hundreds …

Evaluating Public School Funding In Michigan And The Impact Of Proposal A, Anne-Marie Bessette Jul 2006

Evaluating Public School Funding In Michigan And The Impact Of Proposal A, Anne-Marie Bessette

SPNA Review

“The scope of reductions under consideration by the Grand Rapids Public School Board should be a wake-up call for the entire community. We can no longer expect business as usual—what was once unimaginable now becomes reality.” - Grand Rapids Education Reform Initiative.

While it is a national trend that public schools are struggling financially, each state has a unique situation due to different funding practices. The budget problems are often blamed on poor money management: too many administrators, too high levels of salaries, extra cost in working with unions, excessive benefits. As for Grand Rapids Public Schools, there are four …

Rethinking Gender Opportunities: Nontraditional Sports Seasons And Local Preferences, Kristen Boike May 2006

Rethinking Gender Opportunities: Nontraditional Sports Seasons And Local Preferences, Kristen Boike

University of Michigan Journal of Law Reform

In Communities for Equity v. Michigan High School Athletic Association, the Court of Appeals for the Sixth Circuit affirmed a district court decision, holding that the scheduling of high school girls' sports in "nontraditional" seasons in Michigan violated the Equal Protection Clause. The Supreme Court of the United States, granting certiorari, vacated and remanded this case back to the Sixth Circuit. This Note suggests reasons why the Sixth Circuit and/or the United States Supreme Court should protect the Michigan High School Athletic Association's (MHSAA) current scheduling of sports seasons. Specifically, using the model provided by Romer v. Evans and …

A Study Of Islamic Leadership Theory And Practice In K-12 Islamic Schools In Michigan, Adnan Ibrahim Aabed Apr 2006

A Study Of Islamic Leadership Theory And Practice In K-12 Islamic Schools In Michigan, Adnan Ibrahim Aabed

Theses and Dissertations

Effective leadership in Islamic schools involves the incorporation of Islamic principles in the leadership behaviors and practices. With so much literature about the need of Islamic leadership in Islamic institutions in the United States, the problem addressed by the study was whether school principals in Islamic schools exhibited and led these schools according to the principles of Islamic leadership. The study described leadership approaches used by school principals in Islamic schools and how those leadership approaches were influenced by Islamic leadership principles, comparing the Islamic leadership principles derived from the literature with the leadership principles of principals of Islamic schools. …

An Analysis Of Internal Phosphorus Loading In White Lake, Alan Steinman, Mary Ogdahl Jan 2006

An Analysis Of Internal Phosphorus Loading In White Lake, Alan Steinman, Mary Ogdahl

Scientific Technical Reports

An analysis of internal phosphorus loading in White Lake, MI was conducted during the summer, 2006. Sediment cores were removed from 4 sites in White Lake and incubated in the laboratory under aerobic (with oxygen) and anaerobic (without oxygen) conditions. Phosphorus flux from the sediments into the overlaying water column was measured over a 27-day period and compared to rates measured from sediment cores collected previously from Mona and Spring Lakes.

Internal phosphorus loading in White Lake sediments ranged from 1.55 to 7.78 mg TP/m2/d in anaerobic conditions and from -0.18 to 0.14 mg/m2/d in aerobic conditions. The negative value …

The Michigan Civil Rights Initiative And The Civil Rights Act Of 1964, Carl Cohen Jan 2006

The Michigan Civil Rights Initiative And The Civil Rights Act Of 1964, Carl Cohen

Michigan Law Review First Impressions

The underlying principle of the Michigan Civil Rights Initiative (MCRI), adopted by state wide vote on 7 November 2006, is identical to that of the Civil Rights Act of 1964. Section 601 of the Civil Rights Act provides: “No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.” The recent passage of the MCRI results now in the inclusion [in Article 1, Section 26 of the Michigan constitution] of section …

Disparate Impact And The Use Of Racial Proxies In Post-Mcri Admissions, Matthew S. Owen, Danielle S. Barbour Jan 2006

Disparate Impact And The Use Of Racial Proxies In Post-Mcri Admissions, Matthew S. Owen, Danielle S. Barbour

Michigan Law Review First Impressions

The Michigan Civil Rights Initiative (“MCRI”) amended the Michigan Constitution to provide that public universities, colleges, and school districts may not “discriminate against, or grant preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin in the operation of . . . public education.” We argue that, in addition to prohibiting the overt use of racial preferences in admissions, the MCRI also prohibits using racial proxies such as socioeconomic status or a “Ten Percent Plan” that aim to prefer minorities in admissions. Though the MCRI does not expressly say so, we stipulate …

A Sheep In Wolf's Clothing: The Michigan Civil Rights Initiative As The Savior Of Affirmative Action, Ryan C. Hess Jan 2006

A Sheep In Wolf's Clothing: The Michigan Civil Rights Initiative As The Savior Of Affirmative Action, Ryan C. Hess

Michigan Law Review First Impressions

The University of Michigan has long been a place of important discussions about civil and human rights. On the steps of the Michigan Student Union, only a few paces from the Law School, lies an inconspicuous marker where then-President John F. Kennedy, Jr. dedicated the United States Peace Core. During the Vietnam War, the University played host to significant protests that changed how we think about war and its consequences. Most recently, the University litigated a series of Supreme Court cases that have helped define the role of educational institutions in the quest for equality. This role promises to continue …

What The Mcri Can Teach White Litigants About White Dominance, Adam Gitlin Jan 2006

What The Mcri Can Teach White Litigants About White Dominance, Adam Gitlin

Michigan Law Review First Impressions

The ballots have barely been counted, but litigation to enjoin implementation of the now-codified Michigan Civil Rights Initiative (“MCRI”) or at least limit its effect on admissions practices in Michigan’s universities is already underway. One of the primary arguments against the MCRI—and the basis upon which some plaintiff professors assert standing—is that students will suffer an impaired education if current admissions practices are discarded. Assuming that the MCRI survives these legal challenges, educators should be consoled somewhat to know the MCRI may still offer some pedagogy as compensation: litigation will likely be brought to enforce its provisions, and that litigation …

"Framing Affirmative Action", Kimberlé W. Crenshaw Jan 2006

"Framing Affirmative Action", Kimberlé W. Crenshaw

Michigan Law Review First Impressions

With the passage of the Michigan Civil Rights Initiative (“MCRI”), Michigan joins California and Washington to constitute the new postaffirmative action frontier. For proponents such as Ward Connerly, affirmative action is on the edge of extinction. Connerly plans to carry his campaign against what he calls “racial preferences” to eight states in 2008, scoring a decisive Super-Tuesday repudiation of a social policy that he portrays as the contemporary face of racial discrimination. On the other side of the issue, proponents of affirmative action are struggling to regroup, fearful that the confluence of lukewarm support among Democratic allies, messy presidential politics …

Addressing Putative Fathers In Child Protection Proceedings: Is 'John Doe' Still Alive?, Frank E. Vandervort, W. Lansat Jan 2006

Addressing Putative Fathers In Child Protection Proceedings: Is 'John Doe' Still Alive?, Frank E. Vandervort, W. Lansat

Articles

In practice, it seems, KH is not widely understood. Child protection petitions for temporary custody continue to name multiple men as the "father" of a child when there is a legal father. Some courts insist on terminating the parental rights of "John Doe" when no man has established paternity. After KH, are such actions necessary? Are they permissible?

Which Local Governments Cooperate On Public Safety?: Lessons From Michigan, Jered B. Carr, Kelly Leroux Oct 2005

Which Local Governments Cooperate On Public Safety?: Lessons From Michigan, Jered B. Carr, Kelly Leroux

Working Group on Interlocal Services Cooperation

Despite the increased interest in voluntary services cooperation, little is known about the factors that encourage local governments to enter into collaborative services arrangements with each other. This paper addresses this question through an analysis of interlocal contracting arrangements for police and fire services reported by 464 local governments in Michigan. While the contracting of public services is increasing common in local governments across the country, collaborations on police and fire services have proved far more difficult to achieve. Public safety contracting presents a dilemma for public managers. On one hand, local governments devote a substantial part of their budgets …

A Prudential Exercise: Abstention And The Probate Exception To Federal Diversity Jurisdiction, Christian J. Grostic Oct 2005

A Prudential Exercise: Abstention And The Probate Exception To Federal Diversity Jurisdiction, Christian J. Grostic

Michigan Law Review

Ann-Marie Brege's parents established an irrevocable trust in 1985, with Ann-Marie as sole beneficiary. When Merrill Lynch Trust Co. took over as trustee years later, however, the trust's principal dropped sharply, losing over half its value in just a few years. Ann-Marie sued in Michigan probate court, alleging that Merrill Lynch had violated its legal duties in administering the trust. Since Ann-Marie was from New York and Merrill Lynch had its headquarters in New Jersey, Merrill Lynch had an apparently easy argument for diversity jurisdiction. In an unremarkable turn of events, Merrill Lynch filed a notice of removal to federal …
