Therapeutic Jurisprudence In The Appellate Arena, David B. Wexler

In this Introduction, I will briefly summarize Des Rosiers' Court Review article, entitled From Telling to Listening: A Therapeutic Analysis of the Role of Courts in Minority-Majority Conflicts, placing it in a framework that transcends minority-majority conflicts and encourages discussion regarding the use of therapeutic jurisprudence by appellate tribunals. My brief summary is followed by a series of comments that have the potential of launching a refreshing line of inquiry into the appellate process, opinion writing, and the formulation of legal doctrine.

This Article explores the establishment of mental health courts as a partial solution to the perplexing societal problem that relegates mentally ill offenders to a "revolving door" existence in and out of prisons and jails.This inescapable situation results from a paucity ofeffective humanitarian policies, laws, and procedures for treating such medically disordered defendants. The establishment of mental health specialty courts is investigated as a potential means of addressing the complex legal issues and psycho-sociological problems faced by the judicial system in dealing with mentally ill offenders.

Dementia is a growing social problem in Australia because as the population ages, the incidence of dementia increases. While the prevalence rates are only about I% at age 65, they double every five years until by 85 years of age the rate is over 24%. It is expected that by the year 2030, the number of elderly people with dementia will increase by 200%. Dementia is easily recognized in its advanced stages but can be overlooked in the early phase. The purpose of this study was to demonstrate a reduction in depressive symptoms in nursing home residents by using a pet therapy intervention to increase levels of social support and social interaction within the nursing home facility.;The target population in this study consisted of two nursing home facilities in West Virginia. Approximately 21 subjects participated in the study. An intervention using pet therapy was conducted in the intervention facility in which certified therapy animals "visited" the residents once a week for four weeks. The control group received a delayed intervention of gospel singing once a week for four weeks after …

This study examines the relationship between a history of milk A/I in infancy and intelligence in later childhood. Participants included 74 male and female children ages 3 years to 12 years, referred for psychological evaluation. Background information gathered from the primary caregiver included history of milk A/I in infancy. The Wechsler Scales of Intelligence provided information on the participants level of cognitive functioning. Findings were significant for both ANOVA and chi square analysis, with children in Group One (milk A/I) demonstrating lower IQ scores than children in Group Two (no milk A/I). Because of this, children and adolescents are being affected, whether directly or indirectly, by the violence in their communities. The purpose of this study was to determine if principal leadership styles and school-site conditions were associated with elementary teachers' stress levels. The study focused on the relationship between the independent variables of principal leadership styles and school-site conditions and the dependent variables of teacher stress levels. A survey composed of the Leader Behavior Description Questionnaire (LBDQ), Teacher Stress Inventory (TSI) and a demographic information sheet was administered to 585 teachers from 28 elementary schools. The purpose of this study was to ascertain which, if any, variables would effect how a minister felt about counseling and psychology, and what impact this may have on the possibility that he or she would refer to secular counselors for those in their congregations who are having difficulties beyond the pastor's expertise. People have long perceived a connection between mental and even physical illness and spiritual anguish. Yet, modem culture tends to view both types of illness from an increasingly medical perspective, seeking a genetic or environmental explanation. In most cases, this "medical model" is probably the best approach, even if it is imperfect. First, the purely medical explanation may be accurate. Second, even if it is not accurate, treating the symptoms of a disease with a spiritual source is probably far easier than treating the source itself. The idea that there is a connection between the way individuals treat animals and human beings has a long history in Western popular culture, but a shorter history as the subject of scientific research. Recently, a growing body of evidence has confirmed an association between repeated, intentional abuse of animals and a variety of violent antisocial behaviors including child abuse, domestic violence, and violent criminal activities. The student writes, Rather than viewing eating disorders simplistically and only investigating the most common forms, which are anorexia and bulimia, current researchers are now embracing the idea of continuum. Mental health services for children and adolescents in Ireland exist in a state of ambiguity. Services operate within a context of resource constraints and increasing demand. The result is that practitioners have to prioritise the client groups according to policy dictates. In Ireland the policy priority is children at risk of physical and sexual abuse. Utilising current literature in the field, this paper discusses the potential consequences of such a focus for clients, practitioners and policy through a comparative analysis with the United Kingdom. The purposes of this study were to determine if posttraumatic stress (PTS), depression, and anxiety occurred in a community sample of Vietnamese and Hmong mothers and to describe relationships between PTS, depression, anxiety, acculturation and maternal sensitivity. Transition theory (Bridges, 1980), and a conceptual model of parenting in immigrant populations building on Belsky's (1984) work, provided the theoretical framework (Foss, 1996). The sample was divided evenly between Vietnamese and Hmong participants. Ages ranged from 17–43 years, time lived in the United States ranged from 3–21 years, and education ranged from no formal education to completion of college. Maternal sensitivity was …

The present study was an attempt to investigate the effects of a specific type of enriched environment on the stereotypic movements of individuals with severe and profound mental retardation. A multisensory room which contained visual, auditory, and tactile stimulation was used. Effects of brief exposure to the multisensory room was compared to effects of exposure to a placebo probe involving attention and access to tangibles and to no treatment controls. Comparisons were made during a 10-minute post-test session immediately following. Researchers have subsequently begun investigating relationships between psychopathology and social skills in individuals with mental retardation. This study was conducted to investigate contemporary orthodox and unorthodox methods of treatment as well as the factors affecting one's decision to seek treatment. During the colonial era the mentally ill, then referred to as lunatics, were segregated and incarcerated with common criminals. It wasn't until 1888 that the colonial government passed a legislative ordinance to provide for the custody of "lunatics" in an asylum in the former High Court in Victoriaborg, Accra. Prior to the appearance of Western orthodox medicine, traditional healers, most often spiritualists and herbalists, before coming to the hospital, treated all ailments, including mental illness, locally. …

The sexual victimization of children in an increasing crime problem in this country and is now also recognized as a serious mental health issue. It has been estimated that the risk of victimization could be as high as one in ten for boys (Finkelhor, 1979) and one in three for girls (Anderson, Martin, Mullen, Romans, & Herbison, 1993). Girls are eight times as likely as boys to suffer rape (Finkelhor & Dziuba-Leatherman, 1994). Prevalence rates estimate between 15% and 38% of women (Finkelhor, 1984; Herman, 1981) and 6% of men (Finkelhor, 1984) have experienced childhood sexual abuse (CSA).

Attorneys leave law school with limited knowledge and skills
concerning the issues that arise in mental disability law. Yet
psychiatrists and psychologists are appearing with increasing
frequency as witnesses in the nation's courts, and more attorneys
and judges can therefore expect to have to deal with testimony from
mental health professionals. To our knowledge, this article is the
first published assessment of practicing attorneys' and judges'
needs for continuing legal education (CLE) on mental disability
issues.
The 267 Dayton-area attorneys and 41 southwestern Ohio judges
who responded to our mailed survey said that one-seventh of their

Placement in a mental health facility may be made through either a voluntary or involuntary commitment. Involuntary commitment usually requires a number of protective safeguards, including a court hearing, the appointment of counsel, and the meeting of a statutory criterion such as danger to self or others. Voluntary commitment is much more informal, with a written application and clinical assessment being all that is normally required. Most voluntary commitments are made upon application.of a patient who has the ability to give informed consent. This Note argues that the use of any questions based upon an applicant's psychological history in the state bar application process violates the Americans with Disabilities Act. Part I demonstrates that Title II of the ADA applies to state boards of bar examiners, and that the ADA definition of a person with a disability includes a person who has sought or received psychological counseling. Part II applies the ADA and accompanying regulations to the psychological history inquiries currently used by state bar examiners and argues that such inquiries violate the ADA because they inquire specifically about disabled status. Between 1980 and 1990 nearly 9 million foreign-born individuals migrated to the United States. In 1993, the Immigration and Naturalization Service recorded the entry of over 900,000 immigrants and refugees. This figure is believed to be higher given the estimated 1.5 to 2.5 million people who enter this country illegally each year. Currently, ethnic minority groups make up one-fourth of the United States population. It is estimated that by the year 2000, one-third of the U.S. population will be comprised of ethnic minorities.
