This volume, the first in Ernst Rabel's monumental comparative treatise on the conflict of laws, was initially published in 1945. Since then three additional volumes have been added, completing the survey of the systems of conflicts law as originally contemplated. Meanwhile, the first edition of the first two volumes has been exhausted for some time, and the literature of conflicts law has substantially increased, reflecting the new developments that have taken place since 1945. Factors Influencing The Decisions Of Latter-Day Saint Youth Concerning The Selection Of A Temple Or Non-Temple Type Of Marriage Ceremony, Boyd C. Rollins

It is the writer's opinion that deviation from temple marriage in the Mormon culture brings to bear a direct and indirect social pressure so strong that it effects deviation in other areas of the culture. This contention is partly borne out by a tested hypothesis that "Members within the Latter-day Saint Church who were married in the temple would have characteristic patterns of behavior which would differ from patterns of behavior of those members who were married by a Church official or by a civil authority". This hypothesis was tested mainly with respect to behavior after marriage.

John and Maltie Preston moved onto a parcel of land in 1910 where they lived until 1950 when John died intestate. Maltie died intestate in 1954. Title to the land had been perfected by twenty years adverse possession. Evidence showed that the adverse possession was intended to inure to their joint benefit. Complainants, collateral heirs of John, sued in ejectment claiming that John took the whole title by exclusive adverse possession. Defendants, collateral heirs of Maltie, claimed a tenancy by the entirety had been created, with the survivor, Maltie, becoming the sole owner. The court of appeals ruled that the …

Divorce law, theoretically, is the embodiment of policies governing the dissolution of marriage. It is the legal expression of the values attached to marriage and implicitly states the law's understanding of the marital relationship, at least that part of it that reflects conflict and disturbance.
The analytic discourse which follows briefly assesses the roles and meanings of marriage, the sources and consequences of marital disharmony and the complications of marriage dissolution. I remember Katherine O'Donovan vividly. She was a young law lecturer at Queen's University Belfast when I was a first-year student there seventeen years ago. Law, on the whole, does not provide a large number of women to stimulate one's aspirations, but Katherine O'Donovan would have been outstanding in any context. Just as the law requires, for ordinary contracts, that a party thereto must have reached an age sufficient to give him reasonable discretion, so, in connection with the contract of marriage, the law has required that the parties be not too immature. It must first be recognized that three different types of problems are raised in this field by what purport to be marriages: problems concerning the creation of the relationship of man and wife; those concerning the method whereby the parties signify their consents to the assumption of the relationship; and those concerning the legal protection accorded to claims arising therefrom. Testator devised and bequeathed his property to his children, but with a proviso that the gift to any child who should marry a person not born in the Hebrew faith should lapse. Subsequent to the testator's death, the defendant married a woman who had been born a Roman Catholic. The other beneficiaries brought a proceeding to declare that the defendant had lost his rights under the will by reason of his marriage. "Successive" polygamy-remarriage after the death of one's spouse-is licit for all Christians, but simultaneous polygamy is not.
Both polyandry and polygyny are wrong, but the former is even less defensible.
In the Old Testament, God bore with the polygamy of the patriarchs. While their polygamous unions contradicted the monogamous ideal of the divine institution, the patriarchs were not adulterers, and their wives were not whores. They must have had a revelation, or at least a consciousness, that God had dispensed them from the requirement of monogamy. The prophets do not condemn polygamy. Not fleshly lust, but the ardent desire for …

Each year the State of Nebraska compiles and publishes a considerable amount of data on marriage and divorce. An analysis of these data-such as a study of the extent, increase, and rate of divorce-offers a factual basis for determining how the family is faring in certain important aspects. Some indication of the probabilities of divorce may also be gained. The areas in a state where family breakdown is least and most pronounced may be located, and by comparing these areas, factors associated with high rates of divorce may be determined. The location of the areas may point out where research …

This thesis grew out of a paper presented to the Northern Alberta Pastors’ Conference or the Alberta-British Columbia District of the Lutheran Church - Missouri Synod. The discussion showed that many of the pastors were poorly informed on the matter, and not a few based their views mainly upon tradition rather than on the clear Word of God.
