Reforming The Law Of Gratuitous Transfers: The New Uniform Probate Code, John H. Langbein, Lawrence W. Waggoner

In the mid-1980s the Uniform Law Commission undertook a landmark revision of the American law of gratuitous transfers. These reforms culminated in a drastically revised Uniform Probate Code ("UPC"). The revisions inspired the Albany Law Review to organize this symposium issue for the purpose of examining the 1990 UPC. In this introductory paper, we point to the main themes of the reform movement, discuss some of the traits and constraints of the uniform law process, and comment on some of the suggestions and insights that appear in the symposium articles.

The subject of "marital property rights" is very timely because those rights are in a state of transition. The term "marital property rights" covers a vast multitude of rights or interests conferred by law on persons who occupy the status of spouse. This lecture is divided into four discrete, yet related segments. The first segment addresses how the law allocates original ownership between spouses in a marriage. The second segment turns to the intestate share of the surviving spouse. A Multivariate Study Of Marital Quality, David W. Bradley

Marital quality has been defined as the subjective feelings of happiness and satisfaction that a spouse experiences when considering all current aspects of his/her marriage. This study examined five dependent variables regressed on ten independent variables. The sample for this study came from the National Survey of Families and Households. Five hypotheses were found to be supported , with at least three of the five dependent variables showing statistical significance. Age at the time of marriage, education, health and well-being, and couples ' satisfaction in the parenting role were positively related to marital quality. The length of the marriage was …

Maggie Scarf presents a paper on the research for her book Intimate Partners, a book about marrriage. The statistics show that one in two first marriages end in divorce; the prospect for remarriage is even worse. She discusses the technique of writing a genogram, a history of each partner's emotional relationships, all the way back to childhood, to see the origins of how marriage partners currently interact and evolve. Initially, this Comment will examine traditional theories of marital support and their relation to post-cohabitant support. Next, this Comment will review express contract, implied-in-fact contract, and quasi-contract theories of support and how these different theories have been effectively applied by various state courts. A brief discussion follows concerning federal courts and the confusion surrounding the federal jurisdiction of cohabitation actions. Finally, the contract theories of relief will be contrasted against proposed legal status solutions.Ultimately, this Comment concludes that post-cohabitation support issues are best resolved through contract theories. The riddle of alimony is why one former spouse should have to support the other when no-fault divorce seems to establish the principle that marriage need not be for life and when governmental regulation of intimate relationships is conventionally condemned.
