'Civil unions' represent a fragile political armistice, not lasting peace. My interest in 'civil unions' is not, however, political. It is philosophical. I argue in this paper that 'civil unions' are wrong - and should be abandoned in law - because they are incoherent. This article is about what's in the name, marriage. My thesis is that the reason why same-sex couples may not marry defeats the case for 'civil unions' defined (even in part) as a sexual relationship. To reasonably deny these couples access to marriage is to deny them access to 'civil unions'. Conversely, to create 'civil …

The family has changed over time, as has the law concerning families and relationships. Thank goodness. Until recent decades, the law punished nonmarital sex, delineated separate spheres for men and women, and restricted the grounds for ending marriage. The sexual revolution, feminism, and the demand for divorce were the social phenomena that facilitated these changes. Today we take for granted that marriage is not the right dividing line for the rights and obligations of parents. We now must revise our laws to protect the economic security and emotional peace of mind of the full variety of today's families and relationships.

Positive Coping Among Wives Of Male Christian Clergy, Mark R. Mcminn, Sarah P. Kerrick, Susan Duma, Emma R. Campbell, Jane B. Jung

Clergy spouses experience various life stressors, yet many cope and function effectively in the midst of their daily challenges. Mental health professionals were asked to identify wives of male clergy who exemplify emotional and spiritual health. Nominees were contacted and interviews conducted with 25 women. Each interviewee was asked about coping with normal life stressors, stressors associated with being married to a minister, and catastrophic life events. All interviews were transcribed and coded, using grounded theory. Participants emphasized the importance of spirituality, social support, limit-setting, and healthy lifestyle choices. Implications are discussed.

On December 4, 1867, the ninth day of the convention to write a new post-Civil War constitution for the state of Louisiana, delegate Edouard Tinchant rose to propose that the convention should provide “for the legal protection in this State of all women” in their civil rights, “without distinction of race or color, or without reference to their previous condition.” Tinchant’s proposal plunged the convention into additional debates ranging from voting rights and equal protection to recognition of conjugal relationships not formalized by marriage.

Background Having close social relationships and being married specifically have been reliably associated with health benefits including lower morbidity and mortality. Purpose The purpose of this study was to examine the influence of marital status, relationship quality, and network support on measures of psychological and cardiovascular health. Method We examined ambulatory blood pressure (ABP) among 204 married and 99 single males and females (N=303). Results We found that both marital status and marital quality were important. Married individuals had greater satisfaction with life (SWL) and blood pressure dipping than single individuals. High marital quality was associated with lower ABP, lower …

What is the role of courts in circumstances of "values polarization"? The framing of this question brings to mind, but differs from, some familiar inquiries about the judicial role in circumstances of conscientious moral disagreement or value pluralism and debates about liberty, morality, and community. Using the conflict over whether civil marriage should extend to same-sex couples as an example, I contrast two recent analyses of values polarization and its implications for finding agreement, Ronald Dworkin’s book, Is Democracy Possible Here?, and June Carbone and Naomi Cahn's project, Red Families v. This essay explores the past and present social meanings of what occurred during a 1920s New York trial court case, Rhinelander v. Rhinelander. Rhinelander involved a claim by Leonard Kip Rhinelander, a white socialite, who filed for annulment of his marriage to Alice Beatrice Jones, a woman of racially ambiguous heritage. Leonard claimed that Alice committed fraud that went to the essence of their marriage by failing to inform him that she was of "colored" blood. According to legend, Leonard and Alice were madly in love, and Leonard filed the lawsuit only because of his father, who refused to accept …

Online sexual activities, including pornography use, have drastically increased in recent years. Many studies have examined the impact that pornography use can have on marriages and families. One of the key findings has been that pornography use can negatively impact trust in relationships. This study focused on understanding the mechanisms involved when a husband's pornography use negatively impacts his marital relationship and his wife's emotional well-being. Through qualitative analysis of interviews of 14 wives who received therapy because of their husband's pornography use, the analytic team found (1) a breakdown of expectations and assumptions central to the marriage, (2) a …

Faster Algorithms For Stable Allocation Problems, Siddharth Munshi

We consider a high-multiplicity generalization of the classical stable matching problem known as the stable allocation problem, introduced by Baiou and Balinski in 2002. By leveraging new structural properties and sophisticated data structures, we show how to solve this problem in O(mlog n) time on an bipartite instance with n nodes and m edges, improving the best known running time of O(mn). Our approach simplifies the algorithmic landscape for this problem by providing a common generalization of two different approaches from the literature -- the classical Gale-Shapley algorithm, and a recent algorithm of Baiou and Balinski. In the Middle Ages, marriage represented a shift in the balance of power for both men and women. Struggling to define what constitutes the ideal marriage in medieval society, the marriage group of Geoffrey Chaucer's The Canterbury Tales attempts to reconcile the ongoing battle for sovereignty between husband and wife. Existing hierarchies restricted women; therefore, marriage fittingly presented more obstacles for women. Chaucer creates the dynamic personalities of the Wife of Bath, the Clerk and the Merchant to debate marriage intelligently while citing their experiences within marriage in their prologues. The purpose of this study was to examine how sexual satisfaction in older marriages (marriages with at least one spouse between the ages of 55 and 75) was affected by family-of-origin distress (recent measure of recollection of childhood experiences) and marital distress (measure of current marital relationship) for husbands and wives. The hypotheses of this study were that both family-of-origin distress and marital distress would have negative effects on sexual satisfaction for older couples, with marital distress having a direct, negative effect on sexual satisfaction and with family-of-origin distress having an indirect, negative effect on sexual satisfaction through its influence …

Studies show that formal dating has all but disappeared from college campuses and has been replaced almost exclusively by "hanging out" and "hooking up"—a euphemism for anything from kissing to having non-committal sexual encounters. The authors surveyed BYU students to discover if dating and courtship patterns mirror the national trends. They report that while BYU students hang out as much as their national peers, and a few even "hook up," BYU students are much different than students at other schools in their levels of abstinence before marriage, the frequency they go on formal dates in addition to hanging out, and …

The development of the Remarital Assessment Questionnaire for Divorced Persons (RAQ-D) is presented. Steps of development of the questionnaire are outlined: a review of remarital literature, interviews with remarried couples, the creation of a pool of items, review of the items by clinicians, and the development of a preliminary questionnaire. Data were collected through the internet. An Exploratory Factor Analysis of the data yielded scales relating to adjustment areas that are specific to remarital couples. The resulting scales exhibited acceptable level of internal consistency. Psychometric properties of the resulting scales are reported. In the world of Henry James's novels, characters are often placed in difficult situations where their happiness depends on their ability to make a free choice. Female characters are manipulated and diminished by a patriarchal system that not only seeks to subordinate their will, but also to objectify them, to place them on the shelf as a trophy. Fathers and husbands are typically the controlling agents, but James also presents women who appropriate the dominating role.

With varying degrees of success, each female character rejects the status of trophy. Instead, each attempts to make choices and determine her own future. …

The marriage process for the poor in nineteenth-century Bavaria involved a delicate interplay between cultural bias, economic constraint, the prejudice of social rank, and the will to power in the peasant community by those who controlled marriage. This study follows Leonhard Büttner and his fiancée, Margaretha Weiss. Leonhard was a day laborer who had few marriage options due to his poverty and low social status. The insanity of Margaretha's father restricted her marriage choices. Cultural, financial, and legal limits prevented the couple from marrying, and they chose to have children out of wedlock in 1812 and 1816.

In early Victorian England, married women were denied the legal right to own property, and social convention remanded them to ostracism if they chose to remain single. Likewise, jobs that were available to women failed to pay a living wage, so women were placed under tremendous economic and social pressure to marry. In Charles Dickens' novel, Nicholas Nickleby, he depicts how marriage becomes manipulated within the working and middle classes as a means to acquire wealth. The purpose of this feminist hermeneutic study was to discover the meaning of living in the community with a husband who has coronary heart disease (CHD). Ten women, aged 47-74 who were married from 4 to 55 years, participated in unstructured face to face interviews. The women were interviewed 6 to 18 months after their husbands were diagnosed with medically or surgically treated CHD. Audio recorded transcribed interview data were analyzed to identify the essential themes and sub-themes. Texts were interpreted guided by hermeneutic phenomenology (Gadamer 1960/1989; 1976) and van Manen's (1990) research activities. A feminist lens was applied to …
