This Population Council policy brief documents the magnitude of early marriage and early childbearing in India and sheds light on young people’s marriage-related planning and preparedness for married life, and the nature of married life. While child marriage is particularly evident among young women, it is notable that significant proportions of young men too have married below the legal minimum age at marriage for males. Findings call for multi-pronged efforts to eliminate the practice of early marriage among young men and women, and to support newlywed young women. This policy brief was produced in association with the International Institute for Population Sciences, Mumbai (IIPS). Data was drawn from the Youth in India: Situation and Needs study to examine key transitions, such as marriage and parenthood by young people in India. This brief is based on data obtained from the sample of married young men and women. Findings call for multipronged efforts to eliminate the practice of early marriage among young men and women, and support newly-wed young women.

Poverty, Marriage Timing, And Transitions To Adulthood In Nepal: A Longitudinal Analysis Using The Nepal Living Standards Survey, Ashish Bajracharya, Sajeda Amin

This working paper examines the influence of household poverty experienced during early childhood on early marriage and outcomes in schooling and workforce participation during adolescence for girls in Nepal. Much of the evidence concerning these relationships is drawn from cross-sectional data that cannot be used, and has not been able, to address causality. This Population Council study uses longitudinal data from the Nepal Living Standards Survey (NLSS), a two-wave panel in which the waves were conducted eight years apart to address these questions. Analyzing the data by household-wealth quintiles reveals surprisingly nonlinear results indicating that these associations are largest for …

In the spring of 2009, the legislatures of Connecticut, Maine, New Hampshire, and Vermont became the first in the U.S. to enact laws recognizing the legality of same-sex civil marriage. The legislation in all four states included provisions designed to protect the freedom of clergy and religious communities that do not want to recognize same-sex marriage. The legislation in several of the states also included provisions designed to insulate religious organizations from obligations that might arise from the legalization of same-sex marriage – for example, with respect to adoption or the provision of housing to married couples. In New York State at the beginning of 2010, same-sex couples cannot get married but can be married. The state’s highest court, the Court of Appeals, construed the state’s marriage law in 2006 to prohibit state officials from issuing marriage licenses to same-sex couples, but said nothing in that decision about whether same-sex couples married outside the state would be considered married when they were in the state. In February 2008, an intermediate appeals court in Rochester ruled that New York’s marriage recognition law supported extending comity to a same-sex marriage performed in Canada, and several other appellate courts have …

This short essay, written for a volume that celebrates and reflects on Lawrence M. Friedman’s work in legal history and legal culture, explores the modern controversy about same-sex marriage through a historical lens. The legalization of same-sex marriage by five states, and the express condemnation of it by more than forty others, has reintroduced the age-old problem of non-uniform marriage laws and the complicated interactions that follow. This modern story - a challenge to traditional marriage, a divisive moral debate, and the emergence of strong oppositional forces that are stuck, at least temporarily, but perhaps indefinitely, in a kind of …

This article considers the theology and canon law of marriage in light of 'Mulieris Dignitatem'. The article was a talk given at Catholic University of America on this twentieth anniversary of Pope John Paul II's Apostolic Letter. One of the document's central themes is the universal call to holiness lived out through sacramental marriage or virginity. In the first part of the article, I discuss Saint Augustine's teaching on the relation between marriage and virginity. Background Although there is substantial evidence that social relationships and marriage may influence both psychological and physical health, little is known about the influence of children. Purpose This study examined the competing predictions regarding the directional influence of parental status and its interaction with gender—given that mothers are typically disproportionately more responsible for everyday care of children—on cardiovascular functioning. Method We examined ambulatory blood pressure (ABP) over 24 hours among 198 married males and females. Results Couples without children had significantly higher ambulatory SBP and DBP than those with children. Moreover, we found a significant interaction between parental status and …

Most legal scholarship about polygamy has approached it in one of two ways. Some have framed it as a question of how far constitutional protection for religious freedom and privacy rights extends, including what we might think of as “intimacy liberty,” particularly in light of Lawrence v. Texas. Others have debated decriminalization, based on the contested effects of polygamy on matters ranging from women’s subordination to fraudulent behavior to democracy. Tax scholarship has long struggled with whether married taxpayers should be taxed differently from unmarried taxpayers. Currently, married taxpayers are subject to different tax rates than unmarried taxpayers, and may file a joint tax return. A married couple may pay a higher or lower amount of tax than an unmarried couple with the same total income, and a single person generally pays more tax on a given income than a married couple with a single earner with the same income. These outcomes are difficult to reconcile with a commitment to income tax progressivity, which in theory requires that higher incomes …

The constitutional right to privacy has been a conservative bugaboo ever since Justice Douglas introduced it into the United States Reports in Griswold v. Connecticut. Reference to the "so-called" right to privacy has become code for the view that the right is doctrinally recognized but not in fact constitutionally enshrined. This Article argues that the constitutional right to privacy is no more. The two rights most associated historically with the right to privacy are abortion and intimate sexual conduct, yet Gonzales v. Carhart and Lawrence v. Texas made clear that neither of these rights is presently justified by its …

Part one of this review chapter provides a brief historical overview of the fathering role. Following this overview, some cultural contradictions and challenges facing fathers, particularly married fathers, are outlined and discussed. Key issues of focus in this section include married fathers balancing economic provision, household work, and involvement in child rearing. Part two of the chapter will overview cultural challenges and contradictions facing mothers, particularly married mothers. The contradictory challenges often inherent in marriage-based mothering include the pressures too simultaneously provide "intensive mothering" and to be extensively involved in a career. Research on Native American families is limited and emphasizes the deficits of families and overlooks those Native American families that are thriving. This study seeks to illuminate the strengths of highly religious, Christian, Native American, married couples. The study employs a strengths-based perspective to examine how and why religious coping is meaningful and influential for these Native American couples’ enduring marriages and in their efforts to be responsive parents. This research applied a two-step triangulation approach to the study of mother-daughter communication in arranged marriages among the religious Sunnis of Beirut, Lebanon. Combining the theory of structuration and relational dialectics in one theoretical framework, the study investigated the role of mother-daughter interactions in the socialization of the daughter into the marital experience. The study investigated the process of marital socialization by first surveying 199 mother-daughter dyads, representing 398 individuals. In the second step, in-depth interviews were conducted with 12 families (three interviews per dyad), randomly selected out of the 199 surveyed pairs. The dyadic data analysis of the surveys …

Many scholars have noted the pervasiveness of individualism in American culture, particularly in the marriage culture. Unfortunately, assuming individualism in the marriage culture poses very specific threats to marriage as an institution. Some claim that these individualistic assumptions have also infiltrated the marital sciences, undermining the efforts of researchers who hope to defend marriage. This dissertation explores that claim by analyzing seven of the most popular marital outcome instruments used by marital researchers today for individualistic assumptions. On May 15, 2008, the California Supreme Court issued its historic decision regarding marriage rights for same-sex couples. In the course of its opinion, the court found that classifications based upon sexual orientation are subject to the protections of “strict scrutiny” for purposes of the state’s equal protection clause. The court also found that marriage is a fundamental right that extends to same-sex couples. On November 4, 2008, 52% of California voters voted for Proposition 8, which purported to “amend” the state constitution by adding fourteen words in a new clause following the equal protection clause: “only marriage between a …

Has The Marital Time Cost Of Parenting Changed Over Time?, Jeffrey P. Dew

Qualitative and quantitative research has suggested that married couples handle the increasing demands of intensive parenting norms and work expectations by reducing spousal time (e.g., the time that spouses spend alone with each other). Using nationally representative time-diary data, this study examined whether married individuals with children at home lost more spousal time in the years 1975–2003 than individuals without children at home. The analyses showed that on average married individuals have reduced their spousal time by 50 minutes a day. Contrary to expectations, however, individuals with minor children at home had lower time declines than individuals without children. The …

Questions about what makes a marriage work are treated widely in the popular press. This study seeks to discover how we learn about marriage through self-help books. According to Cameron (2007), these texts can become a part of our construction of everyday life. Therefore this study focuses on how marital self-help books frame the institution, and whether relational dialectics were present in each book. Two books— Laura Schlessinger’s The Proper Care and Feeding of Marriage and John Gottman’s Seven Principles of Making Marriage Work—were selected through an exhaustive process. There has been little marital research that focuses on contributing factors to successful long-term marriage and even less focus on the role that love plays in long-term marriage. As a means of furthering this research, the purpose of the current study was to examine levels of satisfaction in couples in long-term marriages and to identify contributing factors to an enduring marriage. From the fifteenth- to eighteenth-centuries, artists across Europe and England painted a scene depicting the negotiation of a marriage contract. In nearly every painting, a notary sits or stands at a table, quill in hand, memorializing the details of the dowry transfer. Some artists celebrated the accord, while others condemned arranged marriages made for purposes of status and money. Interestingly, at the same time the artists painted, massive changes occurred in the law and political philosophy aimed at changing some of the inherent problems in marriage law, such as the rights of women, the influence of parents, and divorce.
