5. Social Inquiry: Instructional Manual To Accompany 'Mark', Matthew Lipman, Ann Margaret Sharp
5. Social Inquiry: Instructional Manual To Accompany 'Mark', Matthew Lipman, Ann Margaret Sharp
Secondary School Curriculum
The task of social studies as a discipline is to focus students’ already developed thinking skills upon the conceptual foundation of the social sciences. Students will think about these underlying concepts if they can talk about them, and they will talk about what they perceive as controversial or problematic. This, then, is what Mark and Social Inquiry aim to do: to identify selected root issues in the social sciences and expose to students the conflicting concepts at the heart of each issue.

4. Mark (Novel), Matthew Lipman
4. Mark (Novel), Matthew Lipman
Secondary School Curriculum
The high school has been vandalized, and Mark is arrested at the scene of the crime. He claims he is a “victim of society.” But what is society? What forces hold it together or work to pull it apart? These are questions to which Mark and his classmates address themselves. What they seek are ways of evaluating social institutions, rules and values, so as to determine how well society is able to live up to the ideals which, at one time or another, have been set for it. They pay particular attention to the nature of law and crime, tradition, …

Comparison Of The Eeocc Four-Fifths Rule And A One, Two Or Three Binomial Criterion, Marion Gross Sobol, Paul Ellard
Historical Working Papers
The amount of error is examined in using the four-fifths rule or the standard deviation to decide court cases which deal with discrimination. Since one, two or three standard deviations may be used as a criterion, it becomes apparent that it is possible for players in a court case to "game" the scenarios and use statistics to support their case. It is suggested that courts adopt a statistical standard in addition to the four-fifths rule in order to minimize the game playing.

A Model For The Analysis Of The Language Of Lawyers, Robert Alex Chaim
A Model For The Analysis Of The Language Of Lawyers, Robert Alex Chaim
University of the Pacific Theses and Dissertations
Lawyers have recently become a favorite target for criticism from both within and without their profession; nowhere are they more vulnerable than in their use of the English language. Whether they imitate cuttlefish by obscuring their paths with ink or simply reflect the complexity of twentieth century civilization with their language presents a question not soon to be resolved. Yet since law must serve society and since language must serve law, the questions concerning lawyers' uses and abuses of language will continue to press. Though common in casual debate, most generalizations about the language of lawyers are difficult--if not impossible-- …

Hypnosis And The Law, Emmanuel Levin
Hypnosis And The Law, Emmanuel Levin
University of Baltimore Law Forum
An aura of the occult surrounds the mention of hypnosis. As a result, hypnotism is rarely used in court. Although tainted by its sideshow reputation, hypnosis, when applied properly, can substantially aid both the investigation and litigation stages of law enforcement.

Current Studies In Japanese Law, Whitmore Gray, Kazuo Sugeno, Walter L. Ames, Ronald G. Brown, Richard O. Briggs
Books
Over the past fifteen years there has been a remarkable growth in the study of Japanese law in the United States. The foundation was laid during the late 1950's when the Harvard-Michigan-Stanford program brought together Japanese legal specialists and their American counterparts for study and research. At the end of this program a major conference was held, and the resulting publication, Law in Japan, continues to serve as a point of departure in descriptive studies of Japanese law.
During the 1960's interest in Japan continued to develop among law faculty members, but an even more important development was the increase …

State Medical Malpractice Screening Panels In Federal Diversity Actions, Vincent C. Alexander
State Medical Malpractice Screening Panels In Federal Diversity Actions, Vincent C. Alexander
Faculty Publications
During the early 1970's, a medical malpractice crisis was perceived in the United States. An increasing number of costly and time-consuming lawsuits alleging medical malpractice against doctors, hospitals, and other health care providers caused malpractice insurers to raise premiums substantially, which in turn threatened to curtail the availability of adequate health care at reasonable cost. State legislatures responded to the crisis with a variety of substantive and procedural measures intended to reduce the number of litigated claims and the size of jury awards. One of the principal steps taken in a majority of states was the creation of extrajudicial panels …

Reports
This pamphlet contains the Commentary on the Alaska Revised Criminal Code, which was passed by the Alaska State Legislature in June 1978 with an effective date of January 1, 1980. The revision followed four years of work by the Alaska Criminal Code Commission and Subcommission from 1975 to 1978. The Revised Criminal Code represents the first comprehensive revision of Alaska's criminal laws, which from 1899 to 1979 were primarily based on Oregon criminal statutes as they existed at the close of the nineteenth century. Earlier drafts of the commentary on the Revised Criminal Code may be found in the six-part …
