Haiti Is Black! Racial Essentialism And United States Involvement In The 2004 Removal Of President Aristide, Jordan E. Dollar
St. Thomas Law Review
Through this paper I seek to interrogate the United States' policy toward Haiti as one based on racial essentialism. This paper will track the historical evolution of racial essentialism towards Haiti by the United States and the culmination of this essentialism through the removal of populist president Jean-Bertrand Aristide. I will show the common theme in U.S. policy towards Haiti, beginning with the successful slave rebellion in 1804, and ending with the 2004 removal of Aristide; the suppression of popular movements in Haiti based on racial essentialism. Progress often comes slower than most want. No one knows this better than black Americans. After slavery, it took another century for blacks to finally receive equal treatment under the law with the Civil Rights Act of 1964 and the Voting Rights Act of 1965. But after the big hopes following the Civil Rights Movement, the lack of progress hurt all the more. Most blacks assumed that with the dismantling of Jim Crow, equality would surely follow. This, however, was not the case. By the 1980s, few blacks still reached the pinnacle of success. The black students at Harvard were …

Ethical Considerations For Attorneys Responding To A Data-Security Breach, Robert J. Scott, Julie Machal-Fulks
Northwestern Journal of Technology and Intellectual Property
Attorneys increasingly are confronting the significant ethical issues raised when a data-security breach occurs. Many traps exist for the unwary in this evolving area of the law, especially in light of concerns regarding e-discovery and a lack of judicial interpretation of applicable statutes. This article provides a legal framework in this area of the law and explores ethical considerations arising when an attorney represents a client who has suffered a data-security breach.

The First Amendment And State Regulation Of In-Person Solicitation Of Public Accounting Services, Damaris Rosich-Schwartz

This article will discuss the history of the commercial speech doctrine as part of the First Amendment, its past and present protection, and the current test applied to state regulation of commercial speech, concentrating on state regulation of in-person solicitations of professionals, like attorneys and CPAs. This article will further discuss the reasons why an attorney's in-person solicitations can and should be regulated by the states, and why the same reasons apply to CPAs. Additionally, this article will discuss the United States Supreme Court's 1993 decision, Edenfield v. Fane, where the Court held that states cannot regulate in-person solicitations of …

The Word and the Law is an extraordinary combination of law, personal statement, literary criticism, and theology. In a sense its central question is whether it is possible to have a life in the law that is good, and the answer is yes-yes, though not at all easy. My friend and teacher Milner Ball speaks of the law as "systemic injustice." I find that a bit harsh and tend instead toward a way of looking at injustice that comes from the equally melancholy reflections of Robert E. Rodes, Jr., also my friend—my colleague, too—and also my teacher (in two senses, including the I-once-paid-tuition sense). Bob Rodes has noticed injustice as much as Milner has, but Bob, who tends to be an Erastian, would say it is not the law that is the source of injustice; it is not even the "system"; it is lawyers who are the source …

Education Law Priorities And Need: A Comparitive Analysis, Michael Anson Magone

This descriptive study ascertained the perceptions of Montana public school principals and superintendents, and Montana education law attorneys, regarding school law education for Montana public school principals. The study surveyed 595 individuals: 239 superintendents, 347 principals, and 9 education law attorneys. The 268 responses obtained represented a 95.6% confidence level.
The study addressed the following questions: 1) Which areas of school law are essential for a public school principal to know?; 2) In which school law areas do public school principals have an immediate need for knowledge?; 3) Which school law areas are critical for inclusion in a graduate-level principal …

Constitutional Crisis In The Commonwealth: Resolving The Conflict Between Governors And Attorneys General, Michael Signer
University of Richmond Law Review
In this article, I argue the solution to agency conflict and the broader problem of establishing the proper scope of executive authority lies in establishing that Virginia has a "statutory" rather than a "common-law" model of the Attorney General's powers, and that the Office of the Attorney General is therefore circumscribed by statute. Contrary to popular understanding, I will argue that Wilder v. Attorney General of Virginia effectively establishes Virginia as a statutory state and resolves the conflict in favor of the Governor.
