A Great Invisible Crashing: The Rise And Fall Of Patent Eligibility Through Mayo V. Prometheus, Scott Pierce
A Great Invisible Crashing: The Rise And Fall Of Patent Eligibility Through Mayo V. Prometheus, Scott Pierce
Fordham Intellectual Property, Media and Entertainment Law Journal
Title 35 of the United States Code at Section 101 states that “[w]hoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.” Despite the apparent simplicity of the statute and its predecessors, the boundaries of patent eligibility dictated by the term “process” and the term “art” that it replaced, along with the terms “machine,” “manufacture” and “composition of matter,” have become increasingly uncertain over the course of the last two-hundred years. Recently, the lack …

Kennesaw State University: The First Fifty Years, 1963-2013, Thomas A. Scott
KSU Press Legacy Project
In fifty short years, Kennesaw had far exceeded the expectations of its founders. Decade after decade, the dreams of campus visionaries reached fruition and became the foundation stones for the plans of new generations of builders. The first eight yellow-brick structures still stood in 2012, but not one retained its original name or function.
Kennesaw was blessed throughout its history with visionary leadership, an excellent faculty and staff, and a foundation of extraordinarily talented individuals who donated their time, creativity, and financial resources to the betterment of the university. Kennesaw was always blessed with outstanding students and alumni. Like many …
Following The Roots Of Oregon Wine, Rachael Cristine Woody, Rich Schmidt
Following The Roots Of Oregon Wine, Rachael Cristine Woody, Rich Schmidt
Faculty & Staff Publications
Terroir is a French term widely used in wine circles to mean “the taste of the place.” The terroir of Oregon wine combines environmental and human elements to produce distinguishing flavors and reveals the histories of grape growers and winemakers in the state. A new archive at Linfield College, the Oregon Wine History Archive (OWHA), collects that history and makes it available to researchers and the public. Library professionals Rachael Cristine Woody and Rich Schmidt tell the story of OWHA’s origins and mission, which is to document all aspects of the wine industry by collecting and preserving historical materials such …

Oracles, Advisers, And Poets Constructing Authority In The Histories Of Herodotus, William Kingdon
Oracles, Advisers, And Poets Constructing Authority In The Histories Of Herodotus, William Kingdon
Theses & ETDs
Herodotus was a fifth-century writer who produced The Histories. He is considered the "Father of History", and his work is likewise considered the first text of the genre "history". This new genre had to borrow conventions from earlier texts, and also establish new ones. This thesis will make several arguments about those conventions, especially the convention of Herodotus's persistent first-person voice. In the first chapter, close-reading of the text will show that Herodotus uses the authority and knowledge of the Oracle at Delphi as a model for his own authoritative voice. It is argued that Herodotus also models his "wise-advisers" …

Ours Is The Harder Lot: Student Patriotism At The University Of Michigan During The Civil War, Julie Mujic
Ours Is The Harder Lot: Student Patriotism At The University Of Michigan During The Civil War, Julie Mujic
History Faculty Publications
Historians have considered some aspects of the impact of the war on higher education, but their work usually focuses on student experiences as soldiers or includes brief analyses of the war period in a larger institutional analysis. Their research does reinforce the unique nature, however, of circumstances at the University of Michigan, where the war period saw increases in enrollment and the expansion of curriculum.
