What I’Ve Learned Along The Way: A Public Historian’S Intellectual Odyssey, Robert Weyeneth Jan 2014

What I’Ve Learned Along The Way: A Public Historian’S Intellectual Odyssey, Robert Weyeneth

Faculty Publications

In this biographically reflective essay, the author identifies two themes that have informed his public history work in communities with historical secrets, in civil rights history, and on the architecture of racial segregation: the importance of acknowledging and remembering the “dark past” and of asking questions from the perspective of place. His projects have taught him to look for the pukas or gaps, to cast down his bucket and engage nearby history, to think ecologically by hitching case studies to broad patterns of meaning, and to accept that the impact of projects may be catalytic rather than conclusive. He argues …

Solitary Confinement, Public Safety, And Recdivism, Shira E. Gordon Jan 2014

Solitary Confinement, Public Safety, And Recdivism, Shira E. Gordon

University of Michigan Journal of Law Reform

As of 2005, about 80,000 prisoners were housed in solitary confinement in jails and in state and federal prisons in the United States. Prisoners in solitary confinement are generally housed in a cell for twenty-two to twenty-four hours a day with little human contact or interaction. The number of prisoners held in solitary confinement increased 40 percent between 1995 and 2000, in comparison to the growth in the total prison population of 28 percent. Concurrently, the duration of time that prisoners spend in solitary confinement also increased: nationally, most prisoners in solitary confinement spend more than five years there. The …

Constitutional Skepticism: A Recovery And Preliminary Evaluation, Louis Michael Seidman Jan 2014

Constitutional Skepticism: A Recovery And Preliminary Evaluation, Louis Michael Seidman

Georgetown Law Faculty Publications and Other Works

The aim of this article is to recover and reevaluate the American tradition of constitutional skepticism. Part I consists of a brief history of skepticism running from before the founding to the modern period. My aim here is not to provide anything like a complete description of the historical actors, texts, and events that I discuss. Instead, I link together familiar episodes and arguments that stretch across our history so as to demonstrate that they are part of a common narrative that has been crucial to our self-identity. Part II disentangles the various strands of skeptical argument. I argue that …

Hog Chains And Mark Twains: A Study Of Labor History, Archaeology, And Industrial Ethnography Of The Steamboat Era Of The Monongahela Valley 1811-1950, Marc Nicholas Henshaw Jan 2014

Hog Chains And Mark Twains: A Study Of Labor History, Archaeology, And Industrial Ethnography Of The Steamboat Era Of The Monongahela Valley 1811-1950, Marc Nicholas Henshaw

Dissertations, Master's Theses and Master's Reports - Open

This dissertation examines a unique working class in the United States, the men and women who worked on the steamboats from the Industrial Revolution until the demise of steam-powered boats in the mid-20th century. The steamboat was the beginning of a technological system that was developed in America and used in such great numbers that it made the rapid population of the Trans-Appalachian West possible. The steamboat was forever romanticized by images of the antebellum South or the quick wit of Samuel Clemens and his sentimental book, Life on the Mississippi. The imagination swirls with thoughts of boats, bleach …

Cutting Out Worry: Popularizing Psychosurgery In America, Antonietta Louise Iannaccone Jan 2014

Cutting Out Worry: Popularizing Psychosurgery In America, Antonietta Louise Iannaccone

Scripps Senior Theses

We think of the lobotomy as utterly primitive and brutal; we shudder at the idea of it. The archetypal image of creepiness, violence, and unnecessary brutality was expressed in the book and movie One Flew Over the Cuckoo’s Nest. This procedure weighs heavy on America’s conscience but in 1945 the procedure was characterized as being as gentle as ‘cutting through butter’ and the therapeutic effect was described as ‘cutting out worry’. How did the lobotomy gain such widespread acceptance? One part of the answer is that Walter Freeman advocated for it not just among his colleagues, but through the popular …

Healthcare For Undocumented Workers In France And The United States, Rehab Talat Jan 2014

Healthcare For Undocumented Workers In France And The United States, Rehab Talat

Browse all Theses and Dissertations

The purpose of this thesis is to explore healthcare for undocumented immigrants in France and the US in light of immigration policy, labor needs, and social values. While both countries have historically relied and continue to rely on undocumented labor, they treat irregular migrants differently when it comes to healthcare. While many hospitals in the US deport undocumented patients in a practice termed medical repatriation, the French government has legislated an illness clause that gives residency permits to severely sick sans-papiers who need medical care. To explore the reasoning behind these extremely contrasting treatments, the thesis studies the social values …

Wildlife Damage Management: Changes Over The Last 40 Years And A Look At The Future, Kathleen A. Fagerstone Jan 2014

Wildlife Damage Management: Changes Over The Last 40 Years And A Look At The Future, Kathleen A. Fagerstone

United States Department of Agriculture Wildlife Services: Staff Publications

Since becoming a wildlife biologist 40 years ago, I have seen many changes. Yet some things have remained the same, like the economic impact of wildlife damage, which was high in 1974 and even higher now. In 2014, the worldwide cost of damage by vertebrate pests to agriculture will exceed $1 billion. The world’s human population has increased at an unprecedented rate, while some wildlife populations have also burgeoned over the past 40 years due to land-use changes and effective management programs. These simultaneous human and wildlife population increases have led to increasing conflicts between humans and wildlife. Nor has …

Corporate Taxation And Corporate Social Responsibility, Reuven S. Avi-Yonah Jan 2014

Corporate Taxation And Corporate Social Responsibility, Reuven S. Avi-Yonah

Articles

This Article will address the question of whether publicly traded U.S. corporations owe a duty to their shareholders to minimize their corporate tax burden through any legal means, or if instead, strategic behaviors like aggressive tax-motivated transactions are inconsistent with corporate social responsibility (“CSR”). I believe the latter holds true, regardless of one’s view of the corporation. Under the “artificial entity” view, such behavior undermines the constitutive relationship between the corporation and the state. Under the “real view,” such behavior runs contrary to the normal obligation of citizens to comply with the law (even absent effective enforcement). And under the …

Psi Sigma Siren

This semester’s edition of the Psi Sigma Siren reflects the hard work and dedication that several UNLV undergraduates put toward historical scholarship over the past year. Jonathan Barrett, Shanella Gardner, and Kaitlin Peck have produced work that most certainly lives up to the mission statement of Phi Alpha Theta. All three papers illustrate how each student exceeded the necessary rigor of collegiate life, and they have contributed to our educational community through these efforts.

The Unrelenting Libertarian Challenge To Public Accommodations Law, Samuel R. Bagenstos Jan 2014

The Unrelenting Libertarian Challenge To Public Accommodations Law, Samuel R. Bagenstos

Articles

There seems to be a broad consensus that Title II of the Civil Rights Act of 1964, which prohibits race discrimination in “place[s] of public accommodation,” was a remarkable success. But the consensus is illusory. Laws prohibiting discrimination by public accommodations currently exist under a significant legal threat. And this threat is merely the latest iteration in the controversy over public accommodations laws that began as early as Reconstruction. This Article begins by discussing the controversy in the Reconstruction and Civil Rights Eras over the penetration of antidiscrimination principles into the realm of private businesses’ choice of customers. Although the …

Hist 340: American Legal History: A Peer Review Of Teaching Project Benchmark Portfolio, Katrina Jagodinsky Jan 2014

Hist 340: American Legal History: A Peer Review Of Teaching Project Benchmark Portfolio, Katrina Jagodinsky

UNL Faculty Course Portfolios

Because I am teaching HIST 340: U.S. Legal History for the first time and plan to make it a signature course of mine, I am using the course portfolio and peer review teaching workshop to carefully chart effective teaching strategies for this course. My goals are threefold: 1) to more deeply consider the constituency and position of this course as an important component of the Pre-Law Program and imagine ways to strengthen the History Department’s presence in that area; 2) to ensure the efficacy of teaching strategies and assessments in giving students the opportunities they need to meet course objectives; …

Five Rules Of Marketing Insights From The Superior Engine Story, Bruce C. Sherony, Irvin A. Zaenglein, Michael F. Strahan Jan 2014

Five Rules Of Marketing Insights From The Superior Engine Story, Bruce C. Sherony, Irvin A. Zaenglein, Michael F. Strahan

Journal Articles

In the late 1890s, an exceptional product line of marine engines was developed in Marquette, Michigan. The authors trace the roots of these innovations and posit abstract marketing lessons from their insights. Five rules about marketing insights are suggested to play an important role in new product development. It is suggested that marketing people who practice these rules could improve their product and service innovativeness.

Gideon V. Wainwright A Half Century Later, Yale Kamisar Jan 2014

Gideon V. Wainwright A Half Century Later, Yale Kamisar

Reviews

When he was nearing the end of his distinguished career, one of my former law professors observed that a dramatic story of a specific case "has the same advantages that a play or a novel has over a general discussion of ethics or political theory." Ms. Houppert illustrates this point in her very first chapter.

Critique And Theory In The History Of The Modern Humanities, Paul Jay Jan 2014

Critique And Theory In The History Of The Modern Humanities, Paul Jay

English: Faculty Publications and Other Works

What role has poststructuralist literary, critical, and cultural theory played in the making of the humanities, particularly in the period between 1968 and the present, and what role should theory have going forward as we come to terms with the corporatization of higher education, with its stress on practical skills, vocational training, and on measuring concrete learning outcomes? Exploring these questions requires confronting - and linking - two key issues currently at the core of sometimes-fierce debates about the humanities in the West, and particularly in t he US. T he first issue has to do with whether or not …

Transatlantic Discourses Of Freedom And Slavery In The English Revolution, John Donoghue Jan 2014

Transatlantic Discourses Of Freedom And Slavery In The English Revolution, John Donoghue

History: Faculty Publications and Other Works

Three themes in the discursive history of freedom and slavery during the English Revolution are explored here: the liberty of conscience, the liberty of the body, and the liberty of commerce. In the contests waged to define these liberties, contending factions of revolutionaries refashioned their opponents’ concepts of freedom as forms of bondage. Although explored in discrete fashion by historians, these discourses of religious, bodily, and commercial liberty hardly operated independently from one another. Indeed, they became increasingly entangled as the Revolution reached its imperial turn (ca. 1649-1655), accompanied as it was by the rise of the slave trade in …

Rising From The Ashes: Hansen’S Disease, Carville, And Patient Identity In 20th Century America, Lauren Quimby Jan 2014

Rising From The Ashes: Hansen’S Disease, Carville, And Patient Identity In 20th Century America, Lauren Quimby

Senior Independent Study Theses

This paper investigates the reactions of patients in the national leprosarium at Carville, Louisiana to the loss of their old identities and the gain of a new one as a patient during the middle of the 20th century. The patient identity was formed by isolation, stigma, community, and domesticity within the hospital. Over the course of their time in the hospital, residents rejected, embraced and worked to change the patient identity. They typically reacted in a combination of these ways. This paper uses memoirs, oral histories, and patient published newspapers to investigate questions of patient identity at Carville. The …

The Battle Of The Rosebud, Albert Winkler Jan 2014

The Battle Of The Rosebud, Albert Winkler

Faculty Publications

The Battle of the Rosebud, which took place on 17 June 1876, was the largest single engagement between the United States cavalry and Indian forces in the entire history of the American West. It was a fierce encounter that lasted about six hours and involved all together several thousand cavalrymen and Indian warriors. The outcome of the contest was highly significant because it turned back a major invasion of Indian territories and freed many warriors to engage another invading force under the command of George Armstrong Custer. This led to the destruction of Custer's command at the Battle of the …

[Introduction To] Escrituras A Ras De Suelo: Crónica Latinoamericana Del Siglo Xx, Marcela Aguilar, Claudia Darrigrandi, Mariela Méndez, Antonia Viu

Bookshelf

History, Development, And A New Concept Of Phthalocyanines In Turkey, Özer Bekaroğlu Jan 2014

History, Development, And A New Concept Of Phthalocyanines In Turkey, Özer Bekaroğlu

Turkish Journal of Chemistry

This paper reviews the history of phthalocyanines in Turkey. Phthalocyanines are chemical compounds that were accidently discovered nearly a century ago. The relevant research and articles have grown dramatically in Turkey since our first paper on them containing four [15]crown[5] published in 1986. The ball-type phthalocyanines were produced and published as a new concept in phthalocyanine chemistry for the first time by our group in Turkey in 2006. Unfortunately, with the exception of our work on this subject, almost no papers have been published in Turkey or in other countries since then. We strongly urge scientists to consider working on …

A Historical Analysis Of The Relationship Of Faith And Science And Its Significance Within Education, John Gerard Yegge Jan 2014

A Historical Analysis Of The Relationship Of Faith And Science And Its Significance Within Education, John Gerard Yegge

Walden Dissertations and Doctoral Studies

Science curriculum and pedagogy are at the center of a centuries-long debate concerning the appropriate relationship of faith and science. The difficulties that science educators face seem to be based in misinformation about the historical roots of this conflict. To address that conflict, the goals of this research were to separate myth from reality and to provide a necessary context to the current tensions that are disrupting science pedagogy and curriculum content within American public schools. Working within a theoretical framework of historical literacy, this qualitative, historical analysis was a comprehensive examination of the relationship of faith and science from …

To Bend But Not Break: Adult Views On Resilience, Ann Korn Jan 2014

To Bend But Not Break: Adult Views On Resilience, Ann Korn

Antioch University Dissertations & Theses

A universal definition of resilience does not exist amongst researchers in the social sciences, making comparisons between studies nearly impossible. Added to this dilemma is that researchers hold divergent theories regarding the origin of resilience, whether it is a static trait across the span of a lifetime or more fluid phenomenon in response to life experience. Furthermore, the importance of resilience and the question of its commonality among individuals continue to be debated. A common thread, however, weaves through research: participants in the studies have not been asked for their views. A gap of understanding about the meaning and importance …
