Underground Fieldwork – A Cultural And Social History Of Cave Cartography And Surveying Instruments In The 19th And At The Beginning Of The 20th Century, Johannes Mattes Jul 2015

Underground Fieldwork – A Cultural And Social History Of Cave Cartography And Surveying Instruments In The 19th And At The Beginning Of The 20th Century, Johannes Mattes

International Journal of Speleology

At the turn of the 20th century, the practical examination of caves went through a radical change. Governmental organizations and private clubs were founded in an attempt to establish speleology as an independent academic subject. In contrast to earlier cave visitors, travelers began entering underground areas and attributing the names of “explorers” or “researchers” to themselves. Fieldwork—especially cave surveying and cartography—became common practice in speleology and such work provided important clues on speleogenesis, which was a controversial issue in the first half of the 20th century. Due to the fact that speleologists began separating themselves from ordinary …

The Future As A Concept In National Security Law, Mary L. Dudziak Jul 2015

The Future As A Concept In National Security Law, Mary L. Dudziak

Pepperdine Law Review

With their focus on the future of national security law, the essays in this issue share a common premise: that the future matters to legal policy, and that law must take the future into account. But what is this future? And what conception of the future do national security lawyers have in mind? The future is, in an absolute sense, unknowable. Absent a time machine, we cannot directly experience it. Yet human action is premised on ideas about the future, political scientist Harold Lasswell wrote in his classic work The Garrison State. The ideas about the future that guide social …

Originalism As Thin Description: An Interdisciplinary Critique, Saul Cornell Jul 2015

Originalism As Thin Description: An Interdisciplinary Critique, Saul Cornell

Res Gestae

My essay was intended as a critique of originalism from the perspective of intellectual history. I pointed out that originalism lacked a rigorous empirical method for analyzing what texts meant in the past. I suppose in some sense it is flattering that Solum has devoted much of his recent article to an attack on my earlier essay. Of course, flattery aside, it would have been more useful if Solum had stated my thesis correctly. For purposes of clarity, I have juxtaposed Solum’s description of my argument with what my essay actually said. Readers will be able to judge for themselves …

Which Medicine? Medicine-Taking And Changing Sherpa Lives, Susan Heydon

HIMALAYA, the Journal of the Association for Nepal and Himalayan Studies

An increasing quantity of medicines, including medicines of different healing systems, have become available since the nineteen fifties to the mainly Sherpa inhabitants of the Mt. Everest region of Nepal. Considerable change and economic development has occurred in which this mountainous and remote area has become one of Nepal’s principal tourist destinations and people have gained access to education, health services, and modern means of communication. The Nlrb, The Courts, The Administrative Procedures Act, And Chevron: Now And Then, Theodore J. St. Antoine Jul 2015

The Nlrb, The Courts, The Administrative Procedures Act, And Chevron: Now And Then, Theodore J. St. Antoine

Articles

Decisions of the National Labor Relations Board (NLRB), like those of other administrative agencies, are subject to review by the federal judiciary. Standards of review have evolved over time. The Administrative Procedure Act of 1946 provides that administrative decisions must be in accord with law and required procedure, not arbitrary or capricious, not contrary to constitutional rights, within an agency's statutory jurisdiction, and supported by substantial evidence. In practice, more attention is paid to two Supreme Court decisions, Skidmore (1944) and Chevron (1984). For many years Chevron seemed the definitive test. A court must follow a clear intent of Congress, …

Strategic Planning And Collaborative Effort To Preserve The University’S History, Xiaohua (Cindy) Li Jul 2015

Strategic Planning And Collaborative Effort To Preserve The University’S History, Xiaohua (Cindy) Li

Librarian Publications

Since established in 1963, Sacred Heart University has accumulated tens of thousands of photographs that have recorded the significant moments or important occasions in the university’s history. Over the years, more and more photos have been taken but the effort to preserve the valuable information has not been up to the pace of the photo accumulation. Realizing some photos started to deteriorate due to the physical space in which these images were stored and the university was about to lose the visual data, the Office of University Advancement (OUA) began to seek a long-term solution that would help them manage …
